Subissue: Their investigation did not fix an error on your report
Consumer Complaint: I have reached out to the involved companies through the credit bureaus, and it has been 90 days without any response. This lack of communication is concerning and disappointing, as I am only trying to resolve the issue with these accounts. The unresponsiveness from the company may be perceived as an admittance of incorrect or inaccurate information. I demand that this unverifiable information be removed from my credit report immediately. The 90-day delay in addressing this matter is unacceptable and impacts my financial standing. I expect prompt action to resolve this issue and ensure that my credit report accurately reflects my financial history. CAPITAL ONE is in violation of 15 U.S.C. 1666 ( b ), which govern the timing of payments and grace periods. Under the law, a creditor may not treat a payment on a credit card account under an open end consumer credit plan as late for any purpose, unless the creditor has adopted reasonable procedures designed to ensure that each periodic statement including the information required by section 1637 ( b ) of this title is mailed or delivered to the consumer not later than 21 days before the payment due date.

Consumer Complaint: I purchased a vehicle through capital one navigator with their preferred dealer World Wide XXXX. The dealer engaged in fraud during the transaction. I was sold an extended warranty. The extended warranty was started while my original factory warranty was running. I contacted Capital One Auto Finance on several occasions without resolution. Capital One dealer risk team is stating that they can not verify when that the extended warranty ran concurrent with the extended warranty but I offered capital one proof but they refused to look at it. They also have proof in their position. I would like a refund for the warranty plus any interest accrued for that amount. This dealer has committed these acts in the past. I was told that I had to sign for the product when I purchased the vehicle and that it was an extended warranty that would start when my factory warranty expired. If they look at the contract and look at the vehicle mileage and year they would be able to determine when the factory warranty was in effect. Capital One refused to provide this information in writing even though I sent in a written complaint to XXXX in the presidents office.

Consumer Complaint: I've been back and forth with capital one in regards to two accounts XXXX, and XXXX. These accounts was charged off XX/XX/2022 and XX/XX/2022 per XXXX credit report. However, I've yet to recieve the canceled portion of a 1099c. Per IRS Publication 4681, Charge offs, when sold to a third party it is an certificate of indebtness with 1099c and is now INCOME, furthermore income can not be on a consumer report. Furthermore, Capital One is in violation as there privacy policy states that I as a consumer have a right to opt-out of third party sharing and that they only can do so with my written consent, which I never gave.I 'm also fully aware of Capital One trading and selling on my name unauthorized. Pursuant to the 10k sec filings ( indenture agreement ) Capital One failed to disclose My right as issuer to transfer my securities for discharge and recieve payment for doing so, which without disclose of this it's obviously securities fraud, because they're still selling and trading on my name unauthorized.

Issue: Managing an account
Subissue: Banking errors
Consumer Complaint: On XX/XX/XXXX I received a solicitation from Capital One Bank advertising their 360 Performance Saving account. Capital One Bank offered a {$500.00} bonus for opening a new account provided the new money deposited from an external bank during the Initial Funding Period was between $ XXXX {$99000.00}, and I maintained that Deposit Amount for 90 days. I opened an account on XX/XX/XXXX and made a {$50000.00} deposit on XX/XX/XXXX. I maintained this deposit for 98 days, withdrawing my money on XX/XX/XXXX. I have not received my {$500.00} bonus. I called on XX/XX/XXXX to track down my {$500.00} bonus and was told that I don't qualify. Here is the exact wording from their offer : '' How to earn it : Open a Capital One 360 Performance Savings account using XXXX XXXX XXXX to earn one of these bonuses : {$100.00} bonus The new money deposited from an external bank during the Initial Funding Period was between $ XXXX {$49000.00}, and you maintained that Deposit Amount for 90 days. {$500.00} bonus The new money deposited from an external bank during the Initial Funding Period was between $ XXXX {$99000.00}, and you maintained that Deposit Amount for 90 days. {$1000.00} bonus The new money deposited from an external bank during the Initial Funding Period was more than {$100000.00}, and you maintained that Deposit Amount for 90 days. You must deposit the required amount from externally sourced funds ( transfers between Capital One accounts will not qualify ) within the first 15 days of account opening ( Initial Funding Period ). '' Funding Period ). Their position is that the 90 days does not start until the end of the funding period, but their written offer states during the funding period and maintained for 90 days. It is misleading to state " during the funding period '' if your intention is really the end of the funding period.
