Consumer Complaint: On XX/XX/XXXX via certified registered mail, I tendered ( following no response from CAPITAL ONE ), another negotiable instrument ( U.C.C. 3-603 ) for satisfaction regarding account number ending in XXXX given the Remittance Coupon Presentment in the amount of [ {$3200.00}. XXXX/XXXX ] they sent by USPS. Included in my correspondence was Notice of Acceptance and Authorization to Set-off and " Instructions to Tender Payment '' to set-off account number ending in XXXX for the amount [ {$3200.00}. XXXX/XXXX ]. I informed CAPITAL ONE my negotiable instrument is presented under the authority of The Constitution Article 1 section 10. clause 1, The Constitution Seven Money Clause # 6, The Constitution Monetary Rule # 5, House Joint Resolution 192, Public Law 73-10, UCC 3-104 ( c ), Title 31 USC 5118, and the U.C.C. '' ( Uniform Commercial Code ) - The Federal Tax Lien Act of 1966. I requested if for any reason, CAPITAL ONE was unable to apply the credit and adjust the accounting thus completing the set-off, because I have accepted their presentment for assessed value, to please send a notice of dishonour from a qualified third party as well as, if applicable, send any law, code, policy or provision that purports that their company has a right to require payment in a particular kind of currency and/or that I am not in honour nor continue to operate in good faith nor with clean hands to satisfy this obligation for both parties. There was a directive to send the documents to the address I provided within ten ( 10 ) business days from the date the Notice of Acceptance and Authorization to Set-off was post marked. CAPITAL ONE did not respond AT ALL, nor with a third-party notice, nor did they set off of the account ending in XXXX ; therefore ( CAPITAL ONE ) fell into default due to non-response. As of date, XX/XX/XXXX, I have yet to receive any written correspondence/action fulfilling my specific request to discharge/setoff account ending in XXXX, nor have I been made aware as to why lawfully CAPITAL ONE is choosing to not sef-off the account though tender was made. CAPITAL ONE was informed of California 's Commercial Code 3603/UCC 3-603 `` If tender of payment of an obligation to pay an instrument is made to a person entitled to enforce the instrument and the tender is refused, there is discharge to the extent of the amount of the tender ''. Due to CAPITAL ONE not responding to any of my correspondence, they acquiesce to my terms therefore, I am seeking complete discharge/ set-off of the full amount of {$3200.00}. XXXX/XXXX Pursuant to 1-102 and 3-603 of the Uniform Commercial Code. With CAPITAL ONEs failure to respond and set off of the account, per contract is now in debt of {$7500.00} to the Principle of said account and no longer have the capacity to pursue collection.

I'm truly a victim of identity theft as well as true name fraud. I do have the perpetrator that established this account using my information without my knowledge nor my consent. In accordance with the Fair Credit Reporting act. The List of accounts below has violated my federally protected consumer rights to privacy and confidentiality under 15 USC 1681. Specifically, I availed myself of Capital One 's XXXX offer described at this link XXXX XXXX XXXX XXXX For a XXXX card, the terms state that between XX/XX/XXXX and XX/XX/XXXX, statement credits will be applied for up to six consecutive months in which XXXX XXXX membership has been charged to the card. I used my XXXX card to cover my XXXX membership from XX/XX/XXXX to XX/XX/XXXX ( six months ). I was charged {$9.00} six times, starting XX/XX/XXXX, and ending XX/XX/XXXX. However, I have only received five statement credits ( XXXX through XX/XX/XXXX ). I am therefore missing a statement credit. Even after calling Capital One, the agent acknowledges that I have been stiffed by the system, but the bank has continued to not correctly apply the final statement credit. I require immediate resolution of this issue, by applying an additional statement credit to my card in the amount of {$9.00}.
