Issue: Fees or interest
Subissue: Problem with fees
Consumer Complaint: So I have been trying to catch my Capital One Credit Card up and it seems nearly impossible to do so because everytime I make a payment. I get charged interest or late payment. Last month I paid more than the minimum and I still get charged fees. These fees are getting down right ridiculus. I have addressed this issue before with Capital One but they seem to not care. I am simply asking for help

Consumer Complaint: Capital One requested why payments were returned. I already explained in the first letter for the following reasons : XX/XX/2023 RE : Requested wave from Late payment 30 days from Capital One account. If you explain the XXXX -day Late Payment issue, I found that a company that I didn't know in the private account of the bank had automatically XXXX {$34.00} for XXXX months. I immediately contacted the bank and stopped the Debit Card. But there was passing without knowing that Capital Payment was paid. I continued to receive a message that I couldn't pay for it in Capital One, but I thought it was the wrong message. Later, I found out that Debit Card had a capital one payment on a card that was stopped, but I knew that it was already reported to the credit-related company. I admit that I made my mistake, but I am disappointed that my credit score has gone down over XXXX points. I want to make a good credit and I will ask you to exclude the credit company.

Issue: Managing an account
Subissue: Banking errors
Consumer Complaint: I have a 360 Savings account with Capital One ( used to be ING Direct before 2012 ). Please do me a favor and XXXX the interest rate on this account. If you did it, you will likely conclude that the rate is roughly 4.15 %, which is what I have been thinking for months. But we would be wrong. The 4.15 % is for an account that Capital One calls " 360 Performance Savings '' vs my account that it calls " 360 Savings ''. The rate on my " high yield savings '' account is 0.30 %. Again it's 0.30 %!!!!!! It is a 385bps difference which is massive and would be {$10000.00} per annum for a {$250000.00} balance! I called Capital One and wrote to them to complain about this and ask for credit for the interest rate difference for previous years but they have refused to do so. I looked up online and there are many other customers with the same complaint, but they do not know how they can " fight back ''. From what I can see there is no substantive difference between these two accounts. They are straightforward high yield savings accounts. The sole purpose for two such identical accounts with confusing similar names but massively different interest rates is to sucker legacy account holders ( who trust the Capital One institution ) out of millions of dollars in interest. If they want to sunset 360 Savings accounts, they could easily have proactive communications and convert these accounts to 360 Performance Savings accounts. But they did not do so. This is deceptive at best and fraudulent at worst. CFPB may also want to look at the history of names on 360 savings accounts and 360 performance savings account, see how much balances are still held in 360 savings account, when Capital One started diverging the interest rates between these two accounts, and the bank 's rationale for using these deceptive tactics.

Consumer Complaint: I opened a savings account and checking account with Capital One banking. On XX/XX/XXXX I asked my mother XXXX XXXX to transfer XXXX from a joint savings account we shared at XXXX & XXXX XXXX, to the Savings account at Captial One. My mother has in the past paid my credit card that I have with Capital One from her checking account because I did not have phone access at the time. on XX/XX/XXXX she transferred XXXX from our joint savings account to her checking and then on the same day she transferred XXXX from her checking to my savings at Capital One. She was not aware that a transfer could be done via savings to savings. Around XX/XX/XXXX I was contacted from Capital One that I had committed fraud because my name was not on the account that the money was being transferred from. I talked to many people at Capital One and was met with the answer I can never open an account with them again. My mother tried from XXXX & XXXX XXXX to resolve the issue but they told her it was on Capital One. I was told the money would be returned up to 90 days later. It has been 7 months and each time I call I get forwarded to a voicemail and then it does not let me leave a message.

Consumer Complaint: I called the company ( Capital One ) on XX/XX/23 in effort to reconcile my past due account. The representative I spoke to offered a fee-depression plan ( that will stop the account from incurring anymore fees. I welcomed the idea and asked to be enrolled in that after explaining that Ive been going thru a hardship after I lost my job, and I also asked to speak the supervisor to work out the monthly payment amount. The representative was eager to transfer me and When I finally got to speak to the supervisor, she told me that I cant have the offer anymore because I declined it. The representative that I spoke to or her supervisor must have declined the offer that was given to me on the account against my will so I can pay more than I should. It is just another way of collecting more money from people.

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: Firstly, I would like to bring to your attention Capital One 's violation of the FCRA, specifically 15 USC 1681s-2. This section outlines the duties of furnishers of information to consumer reporting agencies, requiring them to provide accurate and complete information. Prohibition of reporting delinquent debt without notice : Before reporting a delinquent debt to a consumer reporting agency, furnishers must notify the consumer in writing about the impending reporting of the debt .This notification should be given at least 30 days before the information is reported. THIS WAS NOT SENT TO ME. Additionally, Capital One 's non-compliance with IRS regulations is concerning. According to IRS guidelines, when a lender cancels or forgives a debt of {$600.00} or more, they are required to issue a Form 1099-C to the debtor, notifying them of the cancelled debt amount that may be taxable income. Despite the debt exceeding the {$600.00} threshold, Capital One has failed to fulfill their legal obligation to provide me with the necessary Form 1099-C, thereby violating the IRS regulations.NO 1099C SENT TO ME As defined by the irs even if you have not received a 1099c you must report cancelled debt as gross income. The irs clearly defines a charge off as gross or ordinary INCOME. INCOME DOES NOT GET REPORTED ON THE CONSUMER REPORT. By definition of the irs it clearly states a canceled debt or charge off is income, the reporting of this account as debt is INACCURATE. You are hereby put on notice you are furnishing inaccurate information. I demand the following actions be taken : Direct Capitol One to contact the credit reporting agencies and request the immediate removal of the charge off from my credit report, as it reporting inaccurately This inaccurate reporting not only harms my creditworthiness but also violates the FCRA 's requirement for accurate and fair credit reporting. This is a final opportunity to cure and delete this erroneous inaccurate account from my consumer report.

Issue: Problem with a purchase shown on your statement
Subissue: Card was charged for something you did not purchase with the card
Consumer Complaint: I have filed dispute charges several times for unauthorized charges on my capital one credit card. I have made several attempts to cancel my crunch fitness gym membership dating back in XXXX. XXXX XXXX refused to cancel. So, I contacted my capital one credit card submitting charge disputes. I provided information of the situation, such that they removed the charges from the credit card. Additionally they communicated they would block all future charges from crunch fitness gym. However, I see the charges removed from my credit card by crunch fitness, but, a new charge has taken place from crunch fitness in the amount of XXXX. Therefore, they did not block nor prevent any future charges. I have contacted capital one several times today, where I am not getting through, much less getting this matter with crunch fitness resolved.
