Consumer Complaint: I received a letter from Capital One Auto Finance dated XX/XX/2023. Reference number : XXXX. This serves as notice of discrimination and violation of the Equal Credit Opportunity Act. I am an injured consumer to whom you discriminated against and did not approve my application requesting to extend credit. Specifically, it states : " we're unable to provide you with a pre-qualified offer for auto financing. '' Capital One failed/never tried to make me a counter offer. I've submitted an application, pursuant to 12 CFR 1002.2f, to extend my credit to me. To my understanding, you are a corporation doing business with a living entity, a consumer. My personal information was given and used, including my credit card as defined by law : " any card, plate, or other like credit device existing for the purpose of obtaining money, property, labor or services on credit. '' This, to my understanding, was to be treated as a consumer credit transaction ( 15 USC 1679a ( 2 ). Being that I am an applicant pursuant to 12 CFR 1002.2 ( E ) I'm requesting an extension of my credit. How can I lawfully be denied extension of my own credit? 12 CFR 1002.2 ( h ) defines Consumer credit as credit EXTENDED to a natural person primarily for personal, family, or household purposes, in this case a car. Pursuant to 15 USC 1611 CAPITAL ONE AUTO FINANCE gave me false information. You are willingly and knowingly denying me an extension of my own credit. CAPITAL ONE AUTO FINANCE has discriminated against a consumer with an adverse action. Credit is the right granted to me under law, pursuant to 15 USC 1602 which Congress has set into place to protect the consumer. 15 USC 1681a, 12 CFR 1002.7 denial is an adverse action according to Congress ; it shall be UNLAWFUL FOR ANY CREDITOR TO DISCRIMINATE AGAINST ANY APPLICANTS WITH RESPECT TO ANY ASPECT OF A CREDIT TRANSACTION. Also according to15 USC 1691 ( a ) 3 : activities constituting discrimination also include : " because the applicant has in good faith exercised any right under this chapter. '' Corporate policies do not supersede law. I extended my credit in good faith, meaning a transaction has taken place and I, the consumer, have not received an equal benefit. I being the card holder as defined by 15 USC 1602 have received no benefit from this matter which under 15 USC 1602 ( p ) you have unauthorized use of this card. Adverse Action against a consumer is against the Law according to the Equal credit opportunity Act which is codified in 15 USC 1692 and is pursuant to civil liability under 15 USC 1692k. The letter you sent is deceptive and clear proof of such willful negligence under law. I expect that you will rectify this matter accordingly.

Consumer Complaint: Your company is reporting an account on my credit report inaccurately. I have never opened or given permission to anyone to do so. How did you obtain my personal information? It Is Violating, Intrusive and Illegal. These accounts were opened fraudulently, I'm very upset that you have included this inaccurate information on my credit report. I have wrongfully been denied credit recently due to the intentional inaccurate information that has caused me a world of trouble financially and emotionally. Please remove this from my credit report so I can start possibly rebuilding my credit and life. By law, in reference to my rights under the Fair Credit Reporting Act, I deserve and expect a timely response from your Credit Bureau to my dispute.
