Consumer Complaint: XXXX XXXX XXXX XXXX XXXX XXXX XXXX, Tx XXXX XX/XX/2023 Capital One Subject : Notice of Dispute Regarding Inaccurate Credit Reporting I am writing this letter to dispute and rectify the inaccurate information being reported on my credit report by Capital One. I believe that Capital One 's reporting of my account has violated the provisions outlined in the Fair Credit Reporting Act ( 15 USC 1681 et seq. ), specifically sections 1681c ( a ) ( 4 ) and 1681n. According to my credit report obtained on XX/XX/2023, it has come to my attention that my account with Capital One is not accurately reflecting the true status of the account. The incorrect information on my credit report indicates that the account is not paid in full, and furthermore, it does not accurately reflect that the account was paid as agreed. Consumer Complaint: On XX/XX/, I purchased a living room set ( sofa, love seat, ottoman, chair and tv stand ) from a store location closing sale at XXXX XXXX XXXX XXXX XXXX XXXXXXXX for {$3000.00} at XXXX and left to pick up my daughter from XXXX and came back at XXXX. I was interested in a bunk bed and wanted to show her, eventually setting on a queen bedroom set and mattress for {$1500.00}. 3 days later after researching the company online and the statements regarding quality of the merchandise, I got out my receipt to try and call and cancel, not realizing at the time it said final sale. I called my credit card because I didn't know how to contact the merchant because the sales person said they would only be there until Saturday afternoon and it was Sunday. Capital One agent said, " don't worry, we will work with the merchant to get your money back '' and they opened a dispute. I didn't worry until I got my credit card statement emailed to me and saw the charges had been reapplied. I realized I received a document via email with the merchants response to the chargeback. I didn't know I was signed up for paperless statements including disputes upon opening the card 6 months prior. The merchant provided a false statement that they delivered the first set of furniture and then I returned and purchased more furniture that they couldn't deliver until XX/XX/XXXX. On the paper it says Thursday and it says XX/XX/XXXX and it says XXXX. The merchant is claiming to have delivered the merchandise between XXXX on XX/XX/XXXX when the transaction did not occur until XXXX that day. The credit card is ignoring my documentation based on a missed deadline of XX/XX/XXXX after stating on XX/XX/XXXX that I had 14 more days to continue the dispute. Calls to customer service resulted in conflicting and triggering information each time as they each gave different responses as to what I could do in order to continue the dispute. My issue is this merchant provided false conflicting evidence as well as a forged delivery acceptance paper, forging my signature and initials on it to influence Capital One to reverse the charges and gave the merchant more time to respond than it did me, as well as failed to make sure that I received their emailed document that involved {$4600.00} worth of merchandise that I never received. They are telling me, this is mastercards rules and that's it and failed to give me a valid phone number to reach mastercard and wasted my time forcing me to talk to inexperienced customer service reps.

CAPITAL ONE states that the account they created is in cease and desist status and they will not communicate about alleged debt. CAPITAL ONE has lied in their deceitful practices by reporting my private information to third parties such as XXXX, XXXX, and XXXX. These are third parties and CAPITAL ONE must have my consent before reporting my information and false debt. This alleged debt is disputed and not verified. Consumer Complaint: I retrieved my credit scoring in an attempt to familiarize myself with what it was and whats on it before purchasing a home. Upon inspection I seen several accounts, names, phone numbers and addresses that didnt belong to me. I reached out to each company who just investigated the issue with the updated info I provided them during the dispute to make the accounts seem accurate. This is discrimination against me because of the discrepancies are making it hard for me to begin the process of owning my own home for my family and I. I have not supplied proof under the doctrine of the estoppel by silence, Engelhardt v. Gravens 281 SW 715719, I presume that no proof of the alleged debt, nor therefore any such debt, in fact therefore exists.

Consumer Complaint: Hello! I spoke with XXXX at Capital One for over 30 minutes to try to resolve this issue. On XX/XX/XXXX, I opened a bank account and used my Quicksilver card to make a {$1000.00} deposit. I was surprised to realize that this was considered a cash advance. I immediately called Capital One and was informed that I would not have any further charges ( I had already been charged {$7.00} on XX/XX/XXXX ). I immediately made two payments ( one for {$990.00} and another for {$100.00}. This should have negated the cash advance. I also made purchases and paid those off. I was wrongfully charged another {$5.00} in cash advance interest. Spoke to XXXX to try and resolve this issue and while he was nice in explaining what happened I still do not feel I should have been charged and he would not waive the charge.

I contacted the company and had an agreement set up where, if I made a payment arraignment they would remove and not report any late payments. I completed that arraignment and have never been late again with them. Yet they continue to report those late payments XX/XX/22 XX/XX/22 are the dates of the payment being reposted as late.
