Consumer Complaint: I placed an order for a XXXXXXXX XXXX through the CapitalOne Shopping app on XX/XX/XXXX at XXXX for {$1700.00} ( before tax ). The CapitalOne Shopping app was advertising 30 % rewards/cash back for XXXX purchases, which would give me {$510.00} cash back. I have screenshots from my XXXX showing I purchased the mattress through the app. The screenshots also reflect the 30 % cash back offer and that the offer was activated. On XX/XX/XXXX it will be 120 days since I made the purchase. I have emailed XXXX XXXX times over the past 4 months with the proof of order and multiple screenshots taken during the shopping and checkout process. Attachments reflect that I made the purchase at XXXX. The order confirmation I received from XXXX also confirms purchase time at XXXX. The first and only response I received was on XX/XX/XXXX. It confirms they know I made a purchase through the app. I have pasted their first and only response here. They refuse to respond to my emails since then : XXXX ( Capital One Shopping ) XX/XX/2023, XXXX XXXX Thanks for contacting Capital One Shopping! I've looked into your request, and it looks like it's been less than 30 days since your purchase was completed. At this time, your rewards are being confirmed and processed with the retailer. Unfortunately, the most I can do is ask that you wait until it's been at least 30-60 days, and then check again to see if your rewards are available. The retailers we work with need time to account for adjustments, returns, cancellations, and exclusions, so once that process is complete, your rewards will post to your account. Consumer Complaint: I noticed an account on my credit reports from a company called CAPITAL ONE that I never had any business relationship with. CAPITAL ONE was attempting to collect on a an alleged debt in the amount of {$1100.00}. I sent CAPITAL ONE a letter via certified mail XX/XX/2023 along with a copy of my identity theft report outlining that the account was fraudulent and a result of identity theft. I also disputed this fraudulent CAPITAL ONE account with the credit bureaus. CAPITAL ONE however continued reporting this fraudulent CAPITAL ONE account with the credit bureaus. I saw the fraudulent CAPITAL ONE account XXXX, XXXX, XXXX and XX/XX/2023 on my credit reports. I sent CAPITAL ONE a DEBT VALIDATION LETTER via certified mail XX/XX/2023 requesting the agreement between CAPITAL ONE and myself and the original application for the account. CAPITAL ONE violated the FCRA 15 U.S.C. 1681g ( d ) by failing to provide the evidence requested after being notified about the identity theft. FCRA 15 U.S.C. 1681g ( e ) states .... a business entity that has provided credit to, provided for consideration products, goods, or services to, accepted payment from, or otherwise entered into a commercial transaction for consideration with, a person who has allegedly made unauthorized use of the means of identification of the victim, shall provide a copy of application and business transaction records in the control of the business entity.. Pursuant to the FDCPA 15 U.S.C. 1692g ( b ) CAPITAL ONE was required to cease collection efforts until the alleged debt was validated but failed to do so. CAPITAL ONE continued reporting the alleged debt to the credit bureaus in its attempts to collect on the alleged debt thereby violating the FDCPA 15 U.S.C. 1692g ( b ). I then sent CAPITAL ONE a FAILURE TO RESPOND letter via mail September 5, 2023. CAPITAL ONE violated the FDCPA 15 U.S.C. 1692e ( 2 ) In its attempt to collect on an alleged debt by falsely representing the character, amount, or legal status of any debt. CAPITAL ONE violated the FDCPA 15 U.S.C. 1692f In their attempts to collect on the alleged debt by collecting an amount that was not expressly authorized by an agreement creating the debt or permitted by law. CAPITAL ONE violated the FDCPA 15 U.S.C. 1692g ( b ) by not ceasing collection efforts until the debt was validated. Case law is well settled that reporting an alleged debt to the credit reporting agencies is " an attempt to collect on a debt ''. Pursuant to the FDCPA 15 U.S.C. 1692g ( b ) CAPITAL ONE was required to cease collection efforts until the alleged debt was validated but failed to do so. CAPITAL ONE continued reporting the alleged debt to the credit bureaus in its attempts to collect on the alleged debt thereby violating the FDCPA 15 U.S.C. 1692g ( b ). Additionally, CAPITAL ONE FAILED TO RESPOND to the DEBT VALIDATION LETTER within 30 days causing me to send a FAILURE TO RESPOND letter via mail XX/XX/2023 and did not receive the documents. CAPITAL ONE violated the FCRA 15 U.S.C. 1681i by not validating the alleged debt within 30 days. I saw the fraudulent CAPITAL ONE account XX/XX/2023 on my credit reports and it is still there as of this filing.

Consumer Complaint: On XX/XX/XXXX I submitted CFPB complaint # XXXX requesting my account be investigated due to a billing error. I gave notice that I, dispute, all past outstanding amounts and, present, or future debts and ask that the account be placed into cease and desist status. Capital one was also notified of several other violations to my reputation including but not limited to late payments and account balances. On XX/XX/XXXX Capital one closed my accounts ending in XXXX and XXXX without specific reason or proof for why my accounts required closure or how I may have violated the terms of their user agreement. This was done simply in discrimination due to me exercising my rights under the Consumer Credit Protection act and opening my complaint on XX/XX/XXXX. Capital One has continued its abuse by reporting monthly late payments to the credit reporting agencies XXXX, XXXX and XXXX despite my instructions to cease communication for my privacy and due to the lack of sufficient evidence bearing proof. Capital one has also sold the alleged debt to a debt collector XXXX who simultaneously reports the same inaccurate information to the credit reporting agencies XXXX, XXXX and XXXX further harming my reputation and opportunities to credit.
