Issue: Improper use of your report
Subissue: Reporting company used your report improperly
Consumer Complaint: XX/XX/XXXX Capital One XXXX XXXX XXXX XXXX XXXX XXXXXXXX XXXX XXXX Acct # : XXXX Dear XXXX XXXX XXXX XXXX I am writing you this letter regarding payments that were marked late by your company for the following accounts on the following date ( s ) Late payment dates : XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX I understand that timely payments are crucial in maintaining a good credit score and a positive relationship with your company. Unfortunately, due to unforeseen circumstances, I have fallen behind on my payments. My grandmother whom lived in New Jersey passed away during the duration of missing payments listed above in XX/XX/XXXX. Also, when I finally returned to work months later XX/XX/XXXX, I was laid off collectively with my whole department of company. As a result of being laid off I fell behind on my lease having to pay multiple late fees associated with being late. I want to assure you that I am taking the necessary steps to improve my financial situation and ensure that I make timely payments going forward. I have setup automatic payments to ensure that I do not miss any future payments, and I am working on a budget to better manage my expenses. It is my understanding that per 15 USC 1681 ( a ) ( 2 ) ( A ) ( i ), my consumer report should not contain information solely as to transactions or experiences between the consumer ( me ) and the person ( you ) making the report. Payment history and the late payments associated with payment history negatively impacts my consumer report and are considered as part of my transactions and experiences between your company and me. Furthermore, I am requesting that you provide me with, in writing, the reasonable procedures ( according to 15 USC 1666 ( b ) ) that you have adopted to ensure that each periodic statement is mailed to me ( the consumer ) not later than 21 days before the payment due date. Include also all the information required by Section 1637 ( b ) of Title 15. You have 30 days from the date that you receive this letter to provide me with the information that I am requesting. If you do not provide this information in the allotted time given, then it will be assumed that you can not verify the late payments on the dates specified above ( lacking reasonable procedures to ensure the accuracy of my account ) and I would request that you remove the late payments from my account and consumer report with the following consumer reporting agencies ( XXXX, XXXX XXXX XXXX or all that apply ) and update the accounts to positive. Please forward any changes to my account to the address below. Thank you for your time and consideration on this matter. I look forward to hearing back something positive. Regards

Issue: Problem with the payoff process at the end of the loan
Subissue:
Consumer Complaint: During XXXX, I received a PPP loan online from Capital One. I have been paying on time each month. I now understand the loan is forgivable if I fill out the right form 3508S. On Capital One 's website it says Paycheck Protection Program ( PPP ) Loan Forgiveness Were accepting 3508S, 3508EZ and 3508 loan forgiveness applications for First and Second Draw Paycheck Protection Program ( PPP ) loans until their maturation dates. https : //www.capitalone.com/updates/coronavirus/small-businesses/ To fill out form 3508S I need a copy of my loan documents. I called and requested a copy, but they told me I have to call the XXXX. This didn't match any other information, including their own website, but I called the XXXX as instructed by Capital One. The XXXX told me I have to get these documents from the lender, and then submit the form to the lender. The was consistent with what I've read on both the Capital One and XXXX websites. I would like Capital One to provide me with a copy of my loan documents, and accept and process my forgiveness application. Thank you for any help you can provide.
