Consumer Complaint: On XX/XX/2021, I used my open-ended credit card ( under 15 USC 1605, a credit card is defined as any card, plate, coupon book, or other credit device existing to obtain money, property services, or CREDIT for family or household purposes, ) In this transaction, the only card I could have used was my social security card administered to be by the social security administration. I am aware that I am the original creditor, natural person, and consumer and because a finance charge ( under 15 USC 1602 a finance charge is defined as information in connection with any consumer credit transaction shall be determined as the sum of all charges, payable directly or indirectly by the person to whom the credit is extended and imposed by the creditor as an incident to the extension of credit. ) When American Express used my credit card inside my application, I administered my right to credit for American Express to extend back to me. In the form of an American Express XXXX XXXX and all the benefits that come along with it. After completing the application, to my surprise, I was denied by American Express despite me being the original creditor and a natural person. Because American Express received compensation for this finance charge under 18 USC 8, I was left with nothing. 30 days later, the company has not mailed the reason for the denial. According to this section 15 USC 1681m ( a ), ( 1 ) If any person takes any adverse action concerning any consumer that is based in whole or in part on any information contained in a consumer report, the person shall ( 1 ) provide oral, written, or electronic notice of the adverse action to the consumer. I am aware that American Express viola tes 15 USC 1681m ( a ), ( 1 ). American Express violates 15 USC 1691. It shall be unlawful for any creditor ( a creditor is defined as a person, and because a person is defined as a natural person meaning born of two human beings, myself, not a corporation, organization, or agency ) to discriminate against any applicant, ( under this section an applicant is defined as any person ) concerning any aspect of a credit transaction ( meaning the right granted to a creditor ). Because I am the original creditor and the natural person, American Express can not deny my right to credit once a finance charge is involved. This transaction is derived from the use of my social security card. I am aware that to complete the application, I had to provide that information.

Consumer Complaint: I disputed a {$650.00} transaction to American Express in XXXX of 2020 for a transaction that occurred in XX/XX/2020. American Express has continued to close, reopen, close, reopen my case multiple times with no resolution. They continuously tell me that they will have it resolved in 15-60 days but it never happens. The last time I went through this they wanted me to upload a document to their website. However, their website does not allow videos ( it was a voice recording at night where you can hear the bats that are still in my house ). I called back in again explaining and they said oh yes that's just the way it works. I asked for a manager to call me back. They promised one would and then never followed through. It is not right that I am having to dispute this EIGHT months after I originally disputed it. They have not listened to what I have stated multiple times - there was a one year warranty - not on the quarterly pest control services ( they continuously have gotten this mixed up with the {$80.00} dispute I filed at the same time ) - on removal of the bats. It states, " When requested by the customer or deemed necessary by the company additional treatments for wildlife services covered under this agreement will be promptly rendered between regularly scheduled services at no extra charge ... '' I called the company about 5 times between XXXX and XXXX because the bats did not go away. They came out each time - until the last - when they stopped coming or calling. ( A separate part of the company in charge of quarterly pest control called about coming by for their service but never about the wildlife program. That one call and one text which I have proof of were related specifically to pest control - NOT wildlife. ) Please make American Express do the right thing. I have spent in excess of 40 hours trying to get this resolved.

Consumer Complaint: I tried to send AMEX a letter last XX/XX/2021 asking for a copy of a signed contract bearing my signature, a copy of the payment statements of this account from which AMEX is reporting to the credit reporting agency. I am asking for proof that I was late on payment because they are reporting erroneous inconsistent account information. I never received any response from them and they did not update the credit report as disputed. AMEX is violating the FCRA for reporting this account with inconsistent and inaccurate information that I disputed which they then did not update to the credit reporting agencies as " disputed '' and continues to report inconsistent account information which is in direct violation of the FCRA, CCRAA and XXXX FDCPA. I have attached a copy of CFPB Mandate on Removing Items on Credit Report.

Consumer Complaint: In early XXXX I entered financial hardship and became late paying my American Express credit card account. I closed the account in XXXX of XXXX with an outstanding balance and already late on payments. American Express reported my account with late payments / delinquent then soon after in collections / charge-off. Years later, the payment history on my account was removed from XXXX ( earliest payment history record available as of today ) through XX/XX/XXXX. This payment history was previously reported as late, then updated to " no information ''. American Express has reported the date delinquent on the account as XX/XX/XXXX - more than 15 moths later than the actual date of delinquency. This allows the account to [ fraudulently and unethically ] remain on my credit reports for 7 years from the " date delinquent '' and impedes the CRAs from determining the actual date of first delinquency as advised by FCRA 623 ( a ) ( 5 ) ( B ) 5 or the factual date first delinquent. It is my belief that American Express is purposely and knowingly using unethical and illegal collections practices whereby they remove payment history from consumer accounts and choosing a significantly later date of reported delinquency than the 'actual ' - preventing the consumer from having the account removed from their credit reports thereby continuing to negatively impact their ongoing credit worthiness and financial health. I can include a copy of my credit reports showing the missing information if required - but prefer to not attach it at this time ... only if it is necessary.

Consumer Complaint: American Express advertised a 0 % interest promotion for 12 months for my existing American Express card. I went to the website indicated to sign up. On XX/XX/XXXX, I received confirmation by email that I was approved for the promotion : " We're writing to confirm your new promotional Annual Percentage Rate ( APR ) for eligible purchases as described below. Your promotional APR for purchases is 0.00 %. Your promotional APR is valid from XX/XX/XXXX through your billing period ending in XX/XX/XXXX. '' I went to the website to change my autopay from the full amount to the minimum payment. At the time I made the change of payment amount, the system without my knowledge also changed the payment date. A payment had been scheduled for XX/XX/XXXX, and my changing the payment amount apparently cancelled that payment. On XX/XX/XXXX, I got a notice of a late payment. I contacted American Express. After much discussion, they waived the fee. I made the payment manually and I thought that was the end of it. On XX/XX/XXXX, I saw a charge for $ XXXX in interest. I contacted American Express immediately. According to the representative, the one-day-late payment invalidated the 0 % interest promotion. I paid off the entire amount then and there. After more back and forth and supervisors called in, they agreed to a {$50.00} goodwill refund, but said that they would not completely reverse the interest charge and in fact they would charge " trailing interest '' on the balance that I had had from XX/XX/XXXX until XX/XX/XXXX. I always pay off my balance in full. It seems clear to me that this 0 % promotion was set up to sucker unwitting customers into paying interest.

Consumer Complaint: Around XX/XX/XXXX, I opened an American Express Gold Card after being offered a sign-up bonus of XXXX points after spending a minimum of {$4000.00} in 6 months. I exceeded the minimum spending by the end of the 6 months in early XX/XX/XXXX but did not receive the bonus. When I contacted Amex through mobile chat to figure out why, I was told that the offer for my account was 3 months, not 6 months, and that there was nothing they could do. I called Amex phone support and was told the same thing and, in addition, that after 92 days I was only {$10.00} short of {$4000.00}, which added to my frustration. I then reached out to Amex support through XXXX, which led to an online chat with the same response, even though I told them I had written down the terms of the offer when I was approved and had found information on Amexs own website dated XX/XX/XXXX, that said that the promotional offer was 6 months. When I was approved for the credit card, Amex did not specify the terms of the promotional offer that applied to my account, and I assumed nothing was amiss because I didnt receive any further information about it. Its frustrating because its my word against theirs and whatever their system coded is considered infallible. The same sign-up bonus is being offered to this day. If other people had the same experience as I did, it means that Amex is misleading consumers into opening credit cards by enticing them with a sign-up bonus worth at least {$600.00} and later denying that bonus if they cant satisfy the more restrictive terms. I believe that is unfair.

Again, Amex cites the XX/XX/2021 XXXX not XX/XX/2021 XXXX chat, without providing the transcripts, so allow me to provide the transcript to the CFBP and Amex so that Amex is fully aware of Amexs fraud. -- XXXX.Amex Chat ( XXXX ) : XXXX : Why is my account showing a XX/XX/2021 Removal of Credit Balance? Amex : Upon checking your account, I was able to verify that the removal of credit balance youre seeing on your account is about your credit balance of {$23.00} thats been left on your account for 3 consecutive months now. For those instances, the system automatically clears the said credit balance by creating a request to have a check sent out to the card member. That is to clear the account, which is now {$0.00} balance. XXXX : Tell the system to replace the stolen funds or close my account. XXXX, you are costing me more than {$30.00} of my time reporting this issue. Amex : I understand. We can request for the credit balance refund check to be cancelled and have it brought back to the account. -- Again, Tell the system to replace the stolen funds or close my account. XXXX/Amex failed to return the stolen funds, and Amex failed to close the account. Everything since is Amexs failure and harassment of me. I have given explicit directions with every one of my communications to Amex and the CFPB. The CFPB has failed to protect me from Amexs XXXX and failure. I want nothing to do with Amex ever again. Best of luck in Amexs continued culture of ignorance, discrimination, and predatory revenue creation. XXXX

Consumer Complaint: American Express Lies, once again, through Customer Advocate Services Charlatan Team 1st lie : American Express says and I quote : " We are accurately reporting your accounts to the credit reporting agencies ''.. False : American Express is not a collection agency but the original financial institution which granted my charge and credit card with American Express. This fact alone, disqualifies American Express to be a collection agency at all. They can't report my accounts with them as handled by a collection agency when all of my 3 accounts with them never left American Express and were paid only to them and directly to them, as the American Express Receipts clearly show. Is not accurate and is not precise to keep reporting them as under collection and profit loss when all that is false, is a violation to the Fair Credit Reporting Act and Fair Debt Collection Practices Act they keep doing month after month year after year ever since. 2. 2nd Lie, repeating the first paragraph lie on 2nd paragraph, and I quote : We are accurately reporting your accounts to the credit reporting agencies in accordance with FCRA and are unable to remove any past due reporting. FALSE : They are not reporting my accounts accurately at all, and they can remove this horror by forcing them though the Courts with all the evidence, because the Fair Credit Reporting Act requires precisely what they don not do with my accounts. 3. 3rd Lie and I quote : " We mentioned that we located multiple correspondence from you about your account that were reviewed beginning in XXXX and enclosed copies of prior CFPB responses sent on XX/XX/XXXX and XX/XX/XXXX. '' FALSE : They only recognized this several years after the faxes were sent, and with a letter I never received back then and that they can't show not even a tracking number or certified mail for it proving it was received, because was never sent by them. They do not want to mention the many phone calls and Online Live Chat sessions I had with their Bad Customer Service in which they repeatedly informed to me that they did not had my faxes, no matter I informed during all those phone calls and Live Chats, that my fax reported everything was sent correctly. 4th Lie, and I quote : " Additionally, because of the past due status of your account, it was assigned to a collection agency in XX/XX/XXXX. '' FALSE : NO REAL COLLECTION AGENCY RECEIVED ANY OF MY 3 ACCOUNTS WITH THEM : IT IS IMPOSSIBLE TO PAY DIRECTLY TO THE ORIGINAL FINANCIAL INSTITUTION WHILE HAVING THE ACCOUNT AT THE SAME TIME AT A COLLECTION AGENCY : MY AMERICAN EXPRESS PAYMENT RECEIPTS WHICH WERE ALL RECEIVED AT THE CFPB, ARE PROOF OF THIS. I HAVE NO RECEIPT OF ANY PAYMENT TO ANY COLLECTION AGENCY AT ALL BECAUSE I NEVER PAID NOT EVEN ONE PAYMENT TO ANY REAL COLLECTION AGENCY AT ALL. FALSE : THEY SENT THAT APPLICATION ORIGINALLY AS EVIDENCED HERE IN THE YEAR XXXX : THE ONLY THING THEY REALLY SENT BACK THEN, NOT ANY LETTER RECOGNIZING MY FAXES. THEY CAN'T RECOGNIZE THE PRINTED DATE MADE BY THEM ON THAT LETTER EITHER. 7th Lie, and I quote : " Additionally, because of the length of time from when your account was closed and paid off, we are unable to review any of the calls or validate the phone numbers that you were called from in XXXX as referenced in your correspondence. '' FALSE : THEY ARE UNABLE TO REVIEW THE PHONE CALLS OR VALIDATE THE PHONE NUMBERS BECAUSE THEY, ON PURPOSE AND NO MATTER MY COMPLAINTS SPECIFICALLY FILED HERE ABOUT THIS, THEY AMERICAN EXPRESS DECIDED TO KEEP CALLING ME FROM UNKNOWN PHONE NUMBERS WHICH WERE NOT APPEARING ON MY FAMILY CELL PHONE BILLS AND THERE WAS NO WAY TO IDENTIFY THOSE PHONE NUMBERS AS COMINGFROM AMERICAN EXPRESS AT ALL NOT EVEN WITH MY CFPB COMPLAINTS THEY DECIDED TO CHANGE AND START USING ANY OFFICIAL AMERICAN EXPRESS PHONE NUMBER BACK THEN SO IT COULD BE EASILY SEEN AND IDENTIFIED IN THE PHONE BILL BACK THEN. 8. 8th Lie, and I quote : " We consider this matter closed. This office will file your future correspondence regarding this matter, but we will not respond. '' FALSE : IS NOT CLOSED BECAUSE YOU KEEP VIOLATING THE FCRA AND THE FAIR DEBT COLLECTION PRACTICES ACT AND CAUSING UNFAIR DAMAGES TO ME AGAINST THE LAWS.
