Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: Last year in XXXX I noticed some irregular charges that looked like my life insurance policy but were not. Upon further investigation we were able to identify that someone was siphoning money from my checking account using a XXXX. We were not able to recover more than two months of charges and the case has hit a road block. We were able to track the number back to a company that provides credit processing and it kind of ended there. In XXXX of XXXX began getting calls from XXXX XXXX. They stated I owed money on account related to properties. I denied these charges and told them these were not my accounts and I had no knowledge of them. On XX/XX/XXXX, my XXXX XXXX XXXX began sending me alarms that there were major effects on my credit score. I was in XXXX at the time so I was not able to do much. On XX/XX/XXXX, I was able to start freezing my accounts and reporting the fraud to the credit bureaus, the two power companies and XXXX XXXX. I was able to speak with a rep at reliant energy and was able to find out that 14 utility accounts were started with my personal information. XXXX of those accounts have already been sent to collections. I was able to contact XXXX XXXX and they identified XXXX accounts in collections. Both of these power companies only service TX. I have been able to identify three property addresses where my information was used fraudulently. This information was sent to the police department and will be attached to the police report. Today I was called again by XXXX XXXX to report another account that was sent to collections. This one was from XXXX XXXX for over $ XXXX. This makes a total of 4 accounts with XXXX XXXX and XXXX accounts with XXXX XXXX. All of which will end up in collections effecting my credit score. My score in the last 2 weeks has dropped over XXXX points and getting worse as more collections are sent in. Last week we received a letter from XXXX XXXX our mortgage company that they identified a data leak in XXXX of last year. They letter takes no responsibilty and offers no help outside of contacting the credit companies. This is effecting my credit score, has potentially stolen thousands of dollars from my personal bank accounts and has racked up over XXXX hours of working time on this since XX/XX/XXXX. I am not sure what to do here but I am wondering if we have any legal right to sue XXXX XXXX for their inability to protect my information and the damages it has caused, further the complete lack of support from and issue they knew about back in XXXX of XXXX. Today I got the police report back and will be sending copies to the credit monitors, the XXXX power companies and XXXX XXXX My credit is frozen right now and I have to follow up with the credit monitors once I have sent the doc to their XXXX XXXX XXXX.

Consumer Complaint: On XX/XX/2023, XXXX XXXX XXXX put my XXXX XXXX account into collections. They put it into collections because XXXX XXXX was in a company corporate name that wasn't personally guaranteed. This account never belonged on my credit in the first place. They took my consumer information and placed it on my credit report and that's not what should have happened. 16 CFR 313.7 15 usc 6802 Per the FCRA as a federally protected consumer I am now opting out of any and all authorizations I the consumer may have given you written, unwritten, verbally and non verbally per 15 USC 6802 it is effective immediately and indefinitely. Since the debt is now with a third-party collection agency, it has already been charged off. As outlined in Tax Topic 431, this represents a certificate of indebtedness, which is categorized as income. It's important to note that income is not reportable on my credit report. " If your debt is forgiven or discharged for less than the full amount owed, the debt is considered canceled for the forgiven or discharged amount that you no longer need to pay. Cancellation of a debt may occur if the creditor can't collect, or gives up on collecting, the amount you're obligated to pay. If you own property securing a debt, cancellation of the debt may occur due to foreclosure, repossession, voluntary transfer of the property to the lender, abandonment of the property, or a mortgage modification. Consumer Complaint: I want my credit cleared because I was paying to fix it last year and it is legal to report transaction history. XXXX won't let me cancel my account and I am getting ready to buy a house but it keeps reporting inaccuracies, and it's lowering my score dramatically. A charge which is a certificate of indictment, which means it is income and must be removed. Also Every 30 days they should let me opt out, but they don't. I would like you to please clear off everything reporting incorrectly on my credit because it is effecting my life and lowering my living standards. I appreciate your time for addressing all these concerns. Thank you very much and have a great day.

Consumer Complaint: I called the company on XXXX occasions asking them to send me validation of debt letters which one time they said that they did. I never received anything. I also disputed both online and over the phone with XXXX and XXXX to which they came back verified. When I asked how they verified the debt they said that the company verified it. I told them that it wasnt sufficient and that someone had to send me some kind of proof and that the company can not investigate itself.
