Consumer Complaint: In XXXX of XXXX, I applied for assistance with my mortgage company because it was the Pandemic and the govt had put out assistance programs to help homeowners that were financially impacted by Covid-19. This program allowed deferment or payment pause of a homeowners payments along with assistance. My Mortgage company never responded to my request for Mortgage assistance and never offer me any help. I continued to struggle to make my payments up until XXXX of XXXX. I found out that the program had been extended by the govt through XXXX but had expired in XX/XX/XXXX. I was livid. I reached out to my Mortgage company again on or around XX/XX/XXXX or XXXX XXXX through the online portal and requested assistance again. I also inquired about a deferment in that request. The mortgage company ignored my request for assistance again for another month. A friend had enlightened me about trust accounts and banks committing securities fraud and me being able to take back my house from the mortgage company because they were defrauding me. So, I began the process to take back my property from the mortgage company and discharge/cancel my mortgage debt. On XXXX XXXX XXXX I submitted some Trust acknowledgement documents to the mortgage company through the online portal. On XX/XX/XXXX, the mortgage company uploaded a Letter stating that my Loss Mitigation application had been approved. What?! ... After their time had expired. They deleted my XXXX request for assistance out of the system so that I could not argue of their non-response and expiration of their actions of the response to my 2 ( two ) previous requests for assistance on XX/XX/XXXX and XX/XX/XXXX to prevent me from having any legal grounds to sue them for this. They never responded to my request for a deferment. They took their precious time to send me out a loss mitigation package, dragging their feet as to cause my mortgage to fall further behind. The entire 3 months they were wrongfully reporting my Mortgage as late when they were not supposed to be because I was suppose to be in Loss mitigation. Sometime in late XX/XX/XXXX, I received a loss mitigation package from the mortgage company which contained another promissory note attached to a partial claim deed for the delinquent mortgage amount owed which they wanted me to sign and return back to them by, I believe it was XX/XX/XXXX. On XX/XX/XXXX, I sent the Trustee ( s ) 2 ( two ) registered securities, a 1099, a rescission letter, and some other documents in order to settle the mortgage debt and retrieve the mortgage release. The Trustee ( XXXX ) received those registered securities and other documents on XX/XX/XXXX. On XX/XX/XXXX, I received a response letter dated XX/XX/XXXX, from the General Counsel of the mortgage company only acknowledging that the Trustee ( XXXX ) received the rescission letter and they were denying me ALL of my requests in the letter. There was no acknowledgment of receipt of the registered securities or no mention processing those registered securities and crediting my account, nor of returning them or any of the other documents back to me ( owner ). This is clearly fraud. I am also filing a whistleblower SEC complaint with the Securities and Exchange Commission.
