Consumer Complaint: Or around XX/XX/XXXX I found a complaint against Trans Union and XXXX in regard to improper use of my report. Trans Union and XXXX has continued to report my income on my consumer report. IRS publication states that charge offs are considered income. As a federally protected, consumer, I expect these credit reporting agencies to follow the fair credit reporting act. It is their policy to do so as well as it is the LAW. According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to ensure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' Transunion and XXXX are consumer reporting agencies and I am the Consumer. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the Congress that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. Trans Union and XXXX has also violated The Privacy Act of 1974, 5 U.S. Code 552 ( a ) ( 4 ) the term record means any item, collection, or grouping of information about an individual that is maintained by an agency, including, but not limited to, his education, financial transactions, medical history, and criminal or employment history and that contains his name, or the identifying number, symbol, or other identifying particular assigned to the individual, such as a finger or voice print or a photograph ; ( 5 ) states Definitions ; the term system of records means a group of any records under the control of any agency from which information is retrieved by the name of the individual or by some identifying number, symbol, or other identifying particular assigned to the individual ; b ) Conditions of Disclosure.No agency shall disclose any record which is contained in a system of records by any means of communication to any person, or to another agency, except pursuant to a written request by, or with the prior written consent of, the individual to whom the record pertains, unless disclosure of the record would be trans Union and XXXX has deliberately after multiple warning continue to violate my federally protected rights under the law. I have the right to bring a civil suit against Trans Union and XXXX for violating multiple US Codes. XXXX XXXX XXXX, XXXX XXXX, XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX are ALL financial institution by definition under 15 US Code 6801. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' After giving XXXX and Trans Union the law, they steal willfully broke the law in need to be held accountable. XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX the financial institution and the Consumer reporting agencies XXXX, and Transunion do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX and Transunion, XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXXXXXX whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission which is against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and Transunion are not maintaining reasonable procedures. They continue to report my non public information onto my consumer report for people to see. They have humiliated me and embarrassed me by continuing to report this information. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services. All these companies are in direct violation of the Privacy Act of 1974 and the Fair Credit Reporting Act.

Consumer Complaint: Again, Per the FCRA as a federal protected consumer I am now opting out of any and all authorization, I the consumer may have given you. Written /unwritten, verbal or non verbal per USC 6802, Also per the Privacy Act of 1974. Also, This does validate any debt that I have with this company. The company XXXX XXXX XXXX XXXX XXXX XXXX wrote this debt as a charge of and put the balance as XXXX per page three of this same report that you XXXX XXXX XXXX XXXX XXXX XXXX provide as attachment. According to the IRS when a company has a charge-off on a debt, it is considered a certificate of indebtedness. A certificate of indebtedness is considered income and income can not be reported to the credit report. Since the debt is considered a charge off and the balance is XXXX dollars according to the attachment that was sent by XXXX XXXX XXXX XXXX, how do I owe this company the alleged debt. All in all, you do not have proof on how you obtained my information. That is considered IDENTITY FRAUD. Also, per your attachment you included interest charges on a fictitious debt. According to Nevada Revised Statutes 649.375 attempting to collect interest charges or fees is prohibited. All in all, you do not have proof on how you obtained my information. That is considered IDENTITY FRAUD. Included in your attachment, it states that the debt is charge-off and the balance is XXXX. That means You ( XXXX XXXX XXXX XXXX ) obtained my information without my consent ( illegally ), reported it to my credit report, slandered of my name, violated my Consumer Rights and stole my identity. According to the FCRA, fines are XXXX per violation. The company has been reporting to my credit report since XX/XX/XXXX. Per, NRS11.190 This company is past the statue of limitation reporting on the alleged debt. Violation one : Charging interest per month since XX/XX/XXXX Violation two : Identity Fraud With XXXX2 months in a year multiplied by 6 years, that total out to be XXXX XXXX dollars. times 2 worth of violations that XXXX XXXX XXXX XXXX is admitting they have committed. This does not include the emotional embarrassment that came from being denied credit because of this account.

'' XXXX is a financial institution under the title. 15 USC 1681 section 604 ( a ) section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the WRITTEN instructions of the consumer to whom it relates. '' XXXX XXXX XXXX and the Consumer reporting agencies Transunion, XXXX and XXXX DO NOT have my consent to furnish this information and they do not have my written consent. I would like XXXX XXXX XXXX to provide myself and CFPB my written consent that authorizes them to furnish information. The Cardmember service agreement is NOT MY written consent and Discover can not provide my written consent because I never submitted ANY written consent. Any and all consent to Transunion, XXXX, XXXX, XXXX XXXX XXXX, whether it is verbal, non-verbal, written, implied or otherwise is now REVOKED. 15 USC 6802 ( b ) ( c ) states that " A financial institution XXXX not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. I have stated in previous claims that the reporting was inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX XXXX XXXX, Transunion, XXXX and XXXX are not maintaining reasonable procedures. Prematurely closing out complaints to charge interest and collect payment is not a reasonable procedure. Failing to read initial claims and grouping it under a similar issue is also not a reasonable procedure. 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am REVOKING any and ALL implied consent to furnish information to ANY credit reporting Agency. I am now opting out of your reporting services.

Consumer Complaint: On XX/XX/2023 I initially contacted XXXX XXXX XXXX XXXX for a hardship request for my account. I then spoke to a " Collections XXXX '' who had me email over documents and never heard anything back. I then started to receive phone calls asking why I had not paid. When I told them I filed for a hardship on my account, I was then told I was good to go. These calls continued for approximately a month until I was told there was no knowledge of this. On XX/XX/2023, I then spoke to another " Collections XXXX '' and they had me resend the documents and restart the process. It was then approved a few days later which led to me being allowed to skip the payments for XXXX and XXXX. Following this, I was then reported as >30 days late on my credit report. On XX/XX/2023 I filed a dispute with the two credit reporting agencies that my auto loan is being reported to regarding the reporting of a late payment for XXXX. I then received notification that my account was being reported accurately and this is not true. According to the FCRA : 623. Responsibilities of furnishers of information to consumer reporting agencies [ 15 U.S.C. 1681s-2 ] ( a ) Duty of Furnishers of Information to Provide Accurate Information ( 1 ) Prohibition ( A ) Reporting information with actual knowledge of errors. A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. ( B ) Reporting information after notice and confirmation of errors. A person shall not furnish information relating to a consumer to any consumer reporting agency if ( i ) the person has been notified by the consumer, at the address specified by the person for such notices, that specific information is inaccurate; and ( ii ) the information is, in fact, inaccurate.
