I researched on how to remove the fraudulent items in my report and found that I need to visit FEDERAL TRADE COMMISION or https : //www.ftc.gov to file a report and Per FCRA section 605b Credit Reporting Agencies are required to remove/block any items listed on an id theft report. Consumer Complaint: Dear Sir/Madam, I am writing to inform you that you have violated provisions of the Fair Credit Reporting Act ( FCRA ) in your reporting of inaccurate eviction information on my consumer file after I disputed this information. Specifically, you failed to delete inaccurate past due amounts related to a 2018 eviction on my report as required by FCRA Section 611 ( a ) ( 5 ) ( A ). This section states that if a reinvestigation of disputed information finds the information to be inaccurate or unverifiable, you must " promptly delete that item from the file of the consumer '' By simply modifying the incorrect past due amounts and not removing the eviction information on my report, you violated the FCRAs requirements. Furnishers of information have a duty under Section 623 ( a ) ( 1 ) ( A ) to provide accurate consumer data. And none of the FCRAs exceptions allowing modified but undeleted information apply here, since the core issue is that the past due amounts themselves were inaccurate. I previously disputed this eviction record information based on these inaccuracies. Now I am demanding that you immediately delete this eviction information altogether to comply with FCRA Section 611s obligations for consumer reporting agencies. If you fail to do so, I will be forced to exercise my rights under Sections 616 and 617 of the Fair Credit Reporting Act to pursue legal damages against you for non-compliance with the statute.

Consumer Complaint: Today, at approximately XXXX XXXX in Hawaii, I received an alert on my phone from my credit monitoring service that a major derogatory account has been detected on my XXXX and Transunion consumer reports by XXXX XXXX XXXX ( a bulk debt buyer ) on XX/XX/2024. According to the law, a debt collector must follow certain criteria before furnishing an alleged debt on a consumers consumer report or face penalties or legal action for its deliberate consumer rights violations. Under the XXXX XXXX XXXX, my rights to privacy have been violated, which is protected by law. XXXX XXXX XXXX XXXX states as law that my personal information be protected and remain confidential by the institution involved, and If violated, there are grounds for legal action against all parties involved, including XXXX XXXX XXXX. 15 U.S. Code 6802 - Obligations with respect to disclosures of personal information ( a ) Notice requirements : Except as otherwise provided in this subchapter, a financial institution may not, directly or through any affiliate, disclose to a nonaffiliated third party any nonpublic personal information unless such financial institution provides or has provided to the consumer a notice that complies with Section 6803 of this title ( b ) Opt out ( 1 ) In general A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless ( A ) such financial institution clearly and conspicuously discloses to the consumer, in writing or in electronic form or other form permitted by the regulations prescribed under section 6804 of this title, that such information may be disclosed to such third party ; ( B ) The consumer is given the opportunity, before the time that such information is initially disclosed, to direct that such information not be disclosed to such third party ; and ( C ) The consumer is given an explanation of how the consumer can exercise that nondisclosure option According to this section of the law, XXXX XXXX XXXX has violated my consumer rights ; they did not follow any of these requirements before furnishing my private information to the CRAs, and it should not be on any of my consumer reports, including Transunion, XXXX, and XXXX, and must be deleted immediately. 15 U.S. Code 1692c - Communication in connection with debt collection ( a ) Communication with the consumer generally Without the prior consent of the consumer given directly to the debt collector or the express permission of a court of competent jurisdiction, a debt collector may not communicate with a consumer in connection with the collection of any debt. Cease and desist all communication from this debt collector. Transunion and XXXX shall also begin an independent investigation on this account to ensure that it is 100 % accurate, complete, and fair, according to FCRA. or delete it from my consumer report!
