Consumer Complaint: I had to file a complaint to get under a repayment plan. I have paid the repayment plan on time to date. The repayment plan is near expirations and I seek to file for a loan modification. The company will not proceed with my application for a loan modification. I am unable to get any type of answer as to why. I keep submitting the application and it just will not proceed. I need assistance in getting the process to commence.

Consumer Complaint: I've requested a loan amortization schedule from SPS Loan Servicing. During Covid-19, my loan was modified and converted from a conventional mortgage into a balloon mortgage. I've requested clarification as to how the balloon payment works with respect to the current principal & interest payments ( P & I ) over the remaining term of the loan. As of XXXXXXXX XXXX : Interest bearing principal balance : {$310000.00} Monthly P & I is {$1400.00} ( {$1200.00} interest and {$270.00} principal ) I need clarification as why the interest amount being charged and collected each month includes the balloon payment or deferred principal of {$250000.00}? SPS Loan Servicing is unwilling to provide a copy of the loan amortization schedule or any discussion whatsoever.

Consumer Complaint: These past weeks we have moved forward on the closing of my short sale but the second lender SPS has lied and upheld the deal in many ways. On Thursday XXXX our firm called three different times to confirm that we would get out HUD approval and extension approval so we cloud close today XXXX. We were told Friday we would get them by end of the day, then both on Monday and Tuesday had a total number of 7 different calls with 7 different representatives all saying different things. We were lied to many times and it held up the deal. Parties have already paid out money for this deal to close. XXXX XXXX XXXX is battling XXXX and recently lost his mother. SPS has held this deal in limbo for almost three years and now as we are this close to close they hold up and jeopardize the deal.

Consumer Complaint: My Grandparents XXXX and XXXX XXXX died in XXXX and XXXX respectively. Select Portfolio Servicing Inc was the servicer and failed to file a claim in probate for XXXX XXXX. SPS Inc hired XXXX XXXX to collect the Note as it had fallen into default due to XXXX XXXX death. SPS Inc initiated a lawsuit against the heirs of the XXXX in XX/XX/XXXX. The lawsuit is currently before the New Mexico Appeals Court # XXXX. During the lawsuit it was found that SPS Inc was using manufactured document in order to foreclose of properties. The Case in New Mexico is Carmen Pennington v. OneMain Financial Group. The case file has documentation, depositions an evidence which shows SPS Inc committed fraud against the XXXX. The XXXX 's filed a racketeering count against sps XXXX, XXXX XXXX XXXX XXXX and XXXX XXXX XXXX XXXX who are all debt collectors for thier actions. This is all pending before the New Mexico Court of Appeals. This week, XXXX XXXX XXXX XXXX sent a letter to my deceased Grandfather XXXX XXXX telling him his house was going to be in Auction on XX/XX/XXXX. Select Portfolio Service Inc has continued to charge XXXX XXXX over {$20000.00} in interest after his death. XXXX XXXX the daughter of XXXX and XXXX XXXX and heir to the XXXX XXXX XXXX XXXX, died in XXXX XXXX. Select Portfolio Service, XXXX XXXX and XXXX XXXX XXXX XXXX. Filed a summary judgment against a dead person and the court awarded it. You cannt obtain a summary Judgment against a dead person The XXXX loan file number is XXXX Select Portfolio also sends letters to the deceased XXXX telling them they qualify for re finance and or forbearance. The the New Mexico Court wanted a stay due to corona vires XXXX XXXX XXXX XXXX through SPS Inc and XXXX XXXX objected. a complaint for Fair Debt Collection Practice act is also before the court of appeals.

Consumer Complaint: On XX/XX/2022 we submitted a payoff of the mortgage via wire transfer on behalf of the borrower in the exact amount provided by the mortgage company SPS, Select Portfolio Servicing , Inc . The good thru date of the payoff was XX/XX/2022. On XX/XX/2022, we received the wire back from SPS. When we called to find out why it was sent back we were told that the payoff was " short. '' They never reached out to us via email or phone ( our phone number was included on the wire confirmation ). They claim they called the borrower a few times, but admitted to never reaching out to us. We accrued almost 2 months of interest because of their lack of communication. When I spoke to a supervisor about it, he said it was " weird '' and was of no help. I believe SPS did this to make more money on the daily interest.

Consumer Complaint: On a previous complaint that I made against Select Portfolio Servicing , Inc . ( SPS ), the company made a blatantly fraudulent statement to the CFPB in their Companys Response. This is regarding their statement We received a P & L on XX/XX/2022 ; however, the P & L was dated more than 90 days, which is not acceptable. This is blatantly and provably false by their own phone calls and letters. The quarterly P & L statements were for XXXX, XXXX and XXXX of 2022. They claim to have received them on XX/XX/2022, just 20 days after the end of XXXX, or the first quarter of 2022. How could they possibly be dated more than 90 days? They were acknowledged to have been received just 20 days after the end of the quarter. Unfortunately, this type of tactic is completely consistent with the practices of this company, as we have tried repeatedly to get a resolution to this COVID-19 forbearance amount over the last year.

Consumer Complaint: The company holding my mortgage is Select Portfolio Servicing , inc . My mortgage payment amount will be increased in XXXX due to increases in property taxes and homeowner insurance. Hence, there will be a future shortage in my Escrow account for XXXX. I want to make the additional payment for the shortage for the upcoming year, but the company refused to give me that option. They are going to increase my Escrow payment instead of giving me an option to pay for the difference. I tried to call them, but they kept telling me no and that I could not pay for the difference. Other mortgage companies always give me the option to either pay or add to my mortgage, but this is the first company that never gives me the option. I want to keep my mortgage the same by paying the difference instead of adding on the mortgage.

Consumer Complaint: Dear CFPB, In XXXX through XX/XX/XXXX Select Portfolio Servicing ( SPS ) approved me for COVID-19 Forbearance Plans ( *with no impact and no negative credit reporting to my credit file ) of which I rmade all of the payments. SPS then approved me for a COVID-19 Permanent Modification ( {$1500.00} per month ) in XX/XX/XXXX, which was also under conditions that the COVID-19 Permanent Modification would not negatively impact my credit. SPS Representatives informed me on their website, by telephone and written correspondence that my account would be reported as current and there would not be any negative impact to my Credit File/Credit Score for being approved for SPS 's XXXX Forbearance and Loan Modification Plans. As of today, XX/XX/XXXX, I have remained current and have never been late on any of my mortgage payments On XX/XX/XXXX, I received a Credit Alert from XXXX that indicated SPS Flagged my Credit File as a Loan Modification. By " Flagging '' my mortgage as a Loan Modification, SPS has caused negative impact and negative credit reporting to be placed in my Credit File. As a result, SPS has not honored their stated/agreed upon conditions that the COVID-19 Forbearance Plans and COVID-19 Loan Modification would not have any impact to and would not negatively impact my Credit File/Score. As of XX/XX/XXXX, my Experian Dispute Results on my Credit File reflect SPS listing my Principle Balance as {$190000.00}. This is incorrect as my Outstanding Principle Balance on my SPS Statement reflects the correct balance as {$190000.00} ( see uploaded attachment ). Please note that I DO NOT have PMI and my mortgage payment of {$1500.00} includes property taxes, escrow and Home Owner 's Insurance. It may be possible that SPS is not properly and/or inaccurately distributing and not taking into account my mortgage payments since Late XXXX through XXXX of XXXX to include property Taxes, Escrow, and Home Owner 's These are SPS 's error to correct and not mine. My Credit File/Credit Report should not be negatively impacted because of SPS not keeping their conditions by placing negative information on my Credit File/Credit Report, along with errors, inaccuracies, and incorrect information reported by SPS. Additionally, I have made several complaints with the CFPB against SPS in the recent past of XXXX and in XXXX for inaccurate credit reporting ( inaccurate balances ) and related issues that have negatively impacted my Credit File/Credit Report, but were subsequently corrected by SPS.
