Consumer Complaint: In our contract it states that we have the option to convert our ARM rate to a fixed rate. We had to send a letter ( which I did a letter and an email ) along with a {$300.00} check. It is clearly stated in our mortgage note that this was an option. Select Portfolio declined our conversion because they say they do not do that. I am pretty sure that a signed contract is a signed contract! They took our {$300.00} and applied part of it to the principal and then charged us a fee. I submitted the paperwork along with the check XX/XX/2022. They have no grounds for denying our conversion to a fixed rate. I will be glad to send you our mortgage note with all of the information.

Consumer Complaint: I attempted to modify my loan. I was denied after being strung along. They are aware that I was affected by death in my family and the Covid-19 pandemic. I requested to speak to my relationship advisor for MONTHS to no avail, despite having received numerous correspondence via mail stating that this is the person I should talk to. I had an attorney contact the lender with a proposed lump sum payment which was over half of my arrears which was also denied. The lender then did not allow us to fully appeal their decision and gave us an immediate sale date. I feel like the lender misled me and had XXXX intent on helping me to retain my home.

Teams of XXXX Lending Specialists operating the XXXX-Direct Toxic Mortgage Loan Origination Boiler-Room Explicitly-Targeting XXXX XXXX, XXXX, and XXXX Applicants ( and fraudulently utilized the Race Unavailable ( RNA ) Racial category ) ; and XXXX XXXXo XXXX HMDA-LAR Public Disclosures show that 193,088 Toxic Mortgage Loans with an approximate valuation of $ XXXX were originated using the Two-Tier XXXX Toxic Mortgage Loan origination Scheme. However, this number of toxic Mortgage Loans may haven just the tip of the Iceberg because most of the loans originated by these so-called mortgage brokers were via non-HMDA institution subsidiary : XXXX, which from XXXX through XXXX was the 12th largest subprime lender in the Nation. These so-called XXXX Lending Specialists would initially submit Borrower Loan Applications to XXXX, and if they were denied, they would then submit the same loan application to XXXX XXXX XXXX XXXX XXXX XXXX ; and if it failed, they would then submit the same application to XXXX XXXX XXXX XXXXXXXX XXXX XXXX ) XXXX XXXX XXXX XXXX XXXX XXXX where it was a certainty to be approved. HMDA-LAR Public Disclosures show that 183,176 loans originated at XXXX XXXX XXXX XXXX XXXX XXXX XXXX, and then sold to XXXX. Additionally, hundreds of thousands of Toxic Mortgage Loans with an approximate valuation of hundreds of billions of dollars were originated by XXXX non-bank subsidiaries XXXX and its successor : XXXX, and all origination after XXXX were unreported to HMDA-LAR. Both XXXX XXXX XXXX XXXX XXXX, and XXXXXXXX XXXX XXXX have pleaded guilty to " Civil Violations '' related to the $ XXXX XXXX XXXX Lawsuit against XXXX XXXX XXXX XXXX XXXX, and the $ XXXX XXXX RMBS Trust Certificate Fraud, Lawsuit against XXXX XXXX XXXX XXXX XXXX XXXX Both of these multi-Billion Dollar Lawsuits settlements included a total of $ XXXX for Consumer Relief Restitution that was to be given to Victims of these Trust Certificate frauds. I need to appeal HAF there decision I am low income and my XXXX XXXX payments are to high because of arrears being paid back. Please help me find who I should be appealing this to? The XXXX counsel did a three way call with HAF and nobody can tell us why I was denied or how to appeal this decision. Since applying my income has gone down more with my partner leaving.
