Consumer Complaint: As a result of a divorce in XXXX, the judge ruled that my ex-wife would be solely responsible to pay the mortgage, homeowner 's association, taxes, and insurance on the home. We signed a quitclaim deed that removed the home out of my name. However, 5 years later, my ex-wife did not comply with the judge 's orders and has missed several payments on the home, along with forging my name on a loan modification which has decreased my credit score, tremendously. The forging of the loan modification took place on XX/XX/XXXX, a year after the divorce was final. I am hoping that with all submitted documentation my credit score will be restored to it's rightful score. On XX/XX/XXXX, I filed a complaint of forgery with law enforcement. Consumer Complaint: As the executor of my mother 's estate I sold her apartment in XXXX of this year. We closed on XX/XX/2022. Select Portfolio Servicing Inc ( SPS ) finished processing the payoff of the loan, according to the documents they sent me, on XX/XX/2022. However, after closing I was no longer able to access the auto-pay settings on the account, and an auto-payment was deducted after the loan was paid off. Additionally the payoff quote used in closing was dated in XXXX and so included multiple days of per diem interest after the loan was paid off. I contacted SPS in XXXX to inquire about the extra payment that was removed from my account after the loan was paid off. I was told that this amount, as well as the per diem interest, would be sent to me via a check in the mail. I was also told it would be sent within 30 days of the payoff being processed. The check was never sent to me. I contacted SPS again on XX/XX/2022, well past the 30 days, to inquiry about the issue. I was told by the Ombudsman department that the check had been mailed on XX/XX/2022. I informed them that I had never received the check, and that according to the Daily Digests from USPS 's Informed Delivery service during that period the only mail coming from SPS was the letter informing me the loan had been paid off, but that no check had been sent. I also requested the payment and escrow history for the account. I was then told that the check would be reprocessed and sent again, and the payment and account history would be sent to my e-mail. I was also again told it could take up to 30 days for that to happen. I did receive the payment and escrow history on XX/XX/2022 but not the check with the money. I responded to the e-mail with the account history to inquire about the check but never received a response. I again waited passed the 30 day period and contacted them today, XX/XX/2022. Not only has the check not yet been sent, they claimed that they had not even finished getting the approval to reprocess it. I was also told the request to reprocess was submitted on XX/XX/2022, meaning they delayed two weeks from the time I called to even submit the request and they were trying to retroactively add that two weeks to the 30 day waiting period. Which, of course, comes on top of the previous 30 day waiting period when they never actually sent the check they claimed to have sent. The end result is 85 days have now passed since SPS processed the payoff and I am still waiting for them to return to me the per diem interest as well as the payment they stole from account after payoff.

Consumer Complaint: Select Portfolio Servicing has unjustly refused to process my exit from COVID forbearance for over a year. SPS has caused me great mental and financial hardship because of their actions. I was granted a COVID based forbearance because my income was negatively impacted as a result of the COVID shutdown of the Superior Court system in California. The negative impact of COVID continued after the shutdown was lifted because of the subsequent back- log of case filings, hearings and trials resulted in the inability to collect professional fees owed to me. Representatives of the mortgage servicer Select Portfolio Servicing ( SPServicing ) repeatedly contacted me from XXXXXXXX XXXX XXXXXXXX via phone promising to work with me during my COVID related hardship. In approximately XX/XX/XXXX, the servicer in a phone call and in a letter I subsequently received, informed me that the forbearance would be terminated at the end of XX/XX/XXXX regardless of any continuing COVID hardship. I received conflicting and contradictory information in numerous phone calls regarding the process for exiting the forbearance and resuming monthly mortgage payments. The forbearance ended XXXX XXXX. I was instructed to pay my mortgage if I could and paid my full mortgage XXXX and XX/XX/XXXX. I was given information on the on-line process to fill out forms that was incorrect. I attended a virtual seminar by the servicer on mortgage assistance on XX/XX/XXXX. Prior to and subsequent I repeatedly told the servicer 's agents about difficulties in in filling out the form. I was told that this was being entered into my file but not to submit any part of the mortgage form until I had all of the requested information. I was not informed that I would my mortgage loan would be put in default if the form wasn't in by XXXX. 1. The post forbearance process was not adequately explained so I was never informed that there was date in XXXX when my loan would automatically go into default 2. I was misled into believing that when I reinstituted my mortgage payments it would count as mortgage payments ; instead the mortgage payments were applied as forbearance debt repayment and I was sent default notices without the opportunity to file mortgage assistance forms. 3. I was repeatedly given erroneous instruction that delayed my filling out the mortgage assistance form on the corporate website. The relationship manager or single point of contact was a joke as she was generally unavailable and stopped returning my calls ( I subsequently found out that my relationship manager had been changed three times but I was never informed of the changes. ) a. The website had more than one mortgage assistance form. The instruction led me to a form that had repeated error messages and would not permit me to submit the form or upload documents. 4. The information on the website said that SPS personnel would help in determining the various options after the Forbearance was over. Each agent I spoke to said that they could provide no assistance in determining my eligibility for the various options. 5. There was no offer of assistance prior to the default process. 6. I was blocked from any escalation o f my complaints or for my requests for assistance and was repeatedly told that SPS had no escalation process. 7. Through this difficult process I informed SP servicing that my employment would be in effect terminated by a negative credit rating caused by a mortgage default. I was told that no assistance was available. 8. After four months of delays, conflicting or wrong information, SPS agents informed me that there was no record of instructions given to me, calls and requests for information that I made and had documented proof ( names & dates ). 9. I went to a HUD approved Counseling Agency ( XXXX XXXX ) at the beginning of XXXX. I filled out the forms which authorized the agency to act on my behalf. 10. SPS ignored the HUD authorized agency. Continued to contact me directly and refused to stop the continuous harassing calls. 11. Even though the XXXX XXXX representative had registered his name and the proper identifiers, SPS had refused to accept any of my documents, because they had entered the wrong name in their files. It wasn't until four months had passed did they inform the representative of the problem. 12. Even though I repeated provide the HUD counseling agency information, I was threatened and forced to repeatedly submit ( over and over and over... ) documents. Four of the times it was because SPS had lost documents and ruled what had been submitted ( when they found the previously submitted documents ) as stale. 13. Because I have never exited forbearance, I could not refinance and bring down my high interest rate. 14. My HUD representative finally was told by SPS that his name was accurately entered into my file. 15. My documents were sent by XXXX XXXX and confirmed as complete by SPS several months. I am terrified that I will be put into default as I have not received any communication. 16. My profession requires that I am able to be bonded in order for me to receive Court appointments. Any record of default would prevent me from being bonded. I am in fear of losing the ability to earn a living.

Consumer Complaint: I was offered Covid relief. I had the paperwork signed and notarized. I uploaded it to the portal and received conformation it had been received. They are saying I did not accept the partial claim that was offered to me from the Covid relief application. I called and told them I had accepted and signed the paperwork and sent it in and had confirmation they received it. They then informed me the underwriter had not accepted it. I explained they had not informed me of that and asked to speak to the supervisor. The supervisor told me to have new papers resigned and notarized and upload them again and received confirmation they received them to the portal and she told me she would have them expedited to ensure it was done. I did my part However, she did nothing with them and they once again I was told I did not accept the partial claim and they let the time lapse for the acceptance date. They have been no help in addressing this matter and I did indeed accept the partial claim that was offered to me from the Covid relief application. I NEVER received any communication from Select Portfolio that it had been reject from the underwriter and a new one needed to be signed and re-uploaded to the portal or it would not be completed. I did my part to find out all the information I could to complete the process and make sure it was done. Therefore the process was complete and the partial claim had been accepted on my end. However, I received a letter after the date had expired for the partial claim stating I had not accepted the partial claim and other documentation was still needed to complete the application for other options for home retention. Now the home is being forced into foreclosure due to their lack of communication and lack of attention to detail. I have tried repeatedly to pay payments on the account and they have rejected payments, blocks payments from being made on my account, destroyed checks that have been sent and would not post the payments to the account, rejected wire transfer payments from the bank. I have done everything humanly possible to pay the mortgage company and they have refused to accept it. They also keep going in circles with the additional paper work required for additional programs available for help stating it is not complete paperwork or out of date, when that is not true. I have sent them complete paperwork need multiple times over the past 6 months with no avail. I have reached out to Select Portfolio repeatedly to correct this issue and the responses I have received from Select Portfolio Servicing in the form of paper mailings via XXXX do not address the specific problems nor fix any of the issues. They just keep asking for additional paperwork, saying I did not accept the original offer and now say I am in Foreclosure and have added additional Corporate Advance fees of {$4200.00} saying I have to pay it in addition to the mortgage payments in full or they are going to Foreclose on my property. They are the ones who screwed up here and I should not be forced to pay they additional {$4200.00} when they have made the mistake that caused this. They are refusing payments and now adding additional fees that are forcing me into Foreclosure. I also have copies of the payments sent with the letter they sent showing they destroyed it, me sending documentation showing I accepted the Covid relief, twice and documentation of constant communication trying to fix this problem yet they are still giving me the run around. I have been trying to pay payments for months and they are not accepting them and them not helping with the paperwork for the original offer for Covid help. I am XXXX. I receive Social Security XXXX due to XXXX XXXX XXXXXXXX XXXX and they know I do. They are purposely trying to make my house go into Foreclosure by not accepting paperwork and not communicating with me. I DID accept the Quick Claim on XX/XX/2022. Which is the date of the first notarized application paperwork that I sent back and have conformation of on the portal. The second paperwork was signed XX/XX/2022 and uploaded to the portal which I also have conformation of. Therefore, Select Portfolio was in receipt of my acceptance and the failure to complete the paperwork was on their end not mine. Select Portfolio has also made it where I could not make payments online. I had XXXX XXXX XXXX XXXX XXXX XXXX XXXX Mail a bank check from bill pay in the amount of {$2300.00} from the branch to Select Portfolio servicing on XX/XX/2022 however, Select Portfolio sent me a letter that they destroyed the check and payment would not be accepted. I also sent an electronic payment of {$4000.00} through XXXX XXXX XXXX and {$360.00} XXXX XXXX XXXX XXXX XX/XX/2022. That they refused and sent back to me. I filed a formal complaint with HUD and was sent to you. Now I need to know how to proceed. Please advice. Thank you, XXXX XXXX

Consumer Complaint: This letter is to try to contact the correct department that has attached my property as collateral in the Trust for Towed Point Master Funding and or XXXX XXXX Funding XXXX-A Collateral Trust. Ex. 1 I enclosed the address of the property which has been included in the XXXX. XXXX Bank states theyre the Trustee for the investors mentioned above, at this point I am not sure, which investor is being represented by XXXX Bank XXXX XXXX XXXX Ex.2 the question is : was my loan funded I need copies of the wire or certified sent to the seller. the seller indicates that the loan was not funded or there is no record of a loan. Where are the origination documents, it's not legal for XXXX Bank and the investor to collect mortgage payments without proof they funded the loan initially. It is my understanding and I need clarification where this asset was pick up, was it on the secondary market as XXXX or other securities. My complaint has been ongoing for years without proper attention from XXXX Bank or any of the Servicers. However, as the years pass, I have been able to research now able to get to the bottom of the issues. The XXXX or the Investor which ever one is supposed to have the rights to my property has clearly misrepresented the truth concerning the origination and the recording of the Mortgage and the Note. The question concerning this asset is whether there was funding or money exchanged. The answer is NO Ex.3 Instead of the issue being a mortgage, it turns out to be a violation regulation Z and X. I recently reported this issue to the SEC and XXXX. The property was securitized several times without my permission from XXXX Bank and XXXX. The deed is in my name and there were no liens on the property when the warranty deed was issued by the seller or the Trustee in XXXX. I did not authorize XXXX or XXXX Bank or any other business to use my property in a securitization scam. XXXX There are several problems with this deception that stand out. First, the property was sold to me direct from XXXX XXXX, XXXX XXXX as the Trustee who had already securitized the property prior to the chapter XXXX as it reads on the Deed, Book XXXX Page XXXX. I will include the history concerning these issues which were covered up and portrayed as a legitimate mortgage assignment when there was never funding confirmed for this property. Debtor in Possession After filing a voluntary or involuntary petition, the business is considered a debtor in possession, which means it retains control of its assets while undergoing XXXX XXXX. XXXX The XXXX XXXX XXXX XXXX XXXX registered in XXXX and administratively dissolved in XXXX, last annual report was in XXXX. The banks were aware they were using an illegal company to lure investors for Trading. The XXXX XXXX was acquired by XXXX XX/XX/XXXX but had been working on the acquisition for over a year. The purchase was completed before there was a recorded assignment to Associates by the XXXX XXXX XXXX XXXX concerning my property. XXXX XXXX and XXXX were aware of the issues with the XXXX XXXX XXXX XXXX they knew the loan was not funded but continued to perpetrate this lie. If the loan was funded, then the XXXX for XXXX XXXX or XXXX XXXX as the XXXX would have had the closing documents. The Document the Trustee sent to me states that they abandon this asset. Ex.6 It would be impossible for the XXXX XXXX to authorize the signature for the POA to record the note and mortgage when the corporate officers had resigned over year prior to the recorded date. Who hired the POA.? In addition, there were no records of certified funds or wires sent to the Trustee. I received that information several years ago from the Trustee for the XXXXXXXX XXXX for XXXX XXXX XXXX. I forwarded that information to CitiMortgage or the XXXX XXXX Mortgage XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX, they quickly sold or transferred my asset to Towed Point Master Funding in XXXX. XXXX I also sent this information to XXXX Bank XXXX but I was focusing on the payments that were not posted correctly to my mortgage that I made for almost 24 years to those companies that have no legal rights to accept those payments. In addition, they fabricated the Note and Mortgage they recorded. XXXX XXXX from XXXX was a Robo signer for the XXXX XXXX, XXXX as the XXXX, this was not his correct name, therefore those record should be voided. Ex.9 The issue is that the Banks have been collecting money from me for years with no legal authority to do so. They can not show supporting documents that prove they funded a loan for me, nor can they show that the rights were assigned to them by XXXX the rightful owner that was also dissolved by the SEC. The evidence is clear and needs to be verified by the authorities. My money should be refunded ASAP because of this. The sellers were involved in the XXXX XXXX Bankruptcy, and then received the bailout for the banks, its my understanding that this Asset because of the bankruptcy the debt was forgiven. There are no origination or loan documents for this transaction because the XXXX XXXX, XXXX was not licensed to do business in the state of KY nor the ( XXXX ) XXXX other states included. Ex.11 I have the original warranty deed dated XX/XX/XXXX recorded in my name from the seller. XXXX year later I have several fabricated liens and mortgages on my home but no proof of funding. XXXX XXXX assets were already in the XXXX XXXX, in addition they received funds from the government from the bail out, these assets were written off, Again the Trustee indicated this loan was forgiven., Ex.12 I look forward to discussing this matter with someone in the department. The regulators need to see that the loan was never funded by the XXXX XXXX, the originator is no longer in existence and no other company has legal authority to file foreclosure. Again, the company was not registered or licensed in this state which causes another issue with the state XXXX. I am asking that someone from the XXXX Bank XXXX XXXX Department research this information and release the lien on my home immediately. Thanks

Consumer Complaint: The loan was initially bought/originated by XXXX, through an independent mortgage broker. When XXXX went out of business, the loan was acquired by XXXX XXXX XXXX. Until a few months ago, XXXX XXXX XXXX ( XXXX ) was servicing the loan. They recently sold the loan to " '' and now Select Portfolio Services ( SPS ) is servicing the loan. The first payment to SPS included an extra {$3000.00}, and using the stub from the XXXX statement, I specified that the extra {$3000.00} was to go towards paying down the principal on the loan. However, the money was instead used to prepay 2 or 3 months of future payments, with the remainder being applied to principal. I called SPS and the representative went ahead and reapplied the payment to principal. The second month, this time using SPS 's own statement, I paid an extra {$2000.00} towards principal and specified on SPS 's stub that the extra should be applied towards principal. Again, the extra was misapplied to prepay several months in advance, depriving us of the interest reduction we expect when paying extra towards principal. Again I call SPS and the representative said they would reapply the amounts towards principal as I originally requested. However, the representative on my 2nd call also mentioned that payment by mailing a check would ALWAYS be applied first toward prepaying future months ' regular payments before applying anything towards principal. And that is was is prompting this complaint. Not that the representative made that statement, but what that statement implies about SPS : they ignore the mortgagor 's stated allocation of extra payment amounts and apply it as SPS sees fit! I have already submitted the 3rd month 's payment since the switch to SPS. I'll likely learn how it was applied when I receive the 4th month 's statement in a couple weeks. But based upon the conversation above, I am expecting the same misapplication of funds.

Consumer Complaint: This is the second time in two years that I am submitting the same exact complaint about Select Portfolio Servicing. Nothing was truly done then other than receiving their reply and closing my complaint. They also settled with the federal government for these very same practices that are occurring. I have been paying my mortgage, I am not 30 days late. I have paid my XXXX, XXXX and now XXXX payment this month. All my payments have been placed in a pending status yet again ( same as last year ). My account has three pending payments, also shows my account has a payment due date of XX/XX/2022, if all these payments were applied as they should be, my payment due date would be XX/XX/2022. Today on a phone call with SPS at XXXX XXXX the customer service rep acknowledged my payments were not being applied, but he was trying to talk me into a mortgage modification which I said I would not discuss if they can not apply my payments correctly. The rep then tried to submit to correct this, his supervisor refused stating my account was in " forbearance '' with an outstanding modification offer. At no point did I ask for my mortgage to be put into forbearance or modified. I am asking my payments to be applied as they should when paid and for them to do their contractual duty with regard to servicing this mortgage. The federal government forced them into a previous settlement that SPS refuses to abide by yet again. I am also asking the government to do their duty and protect us from predatory practices like SPS continues to partake in. THIS IS MY SECOND COMPLAINT FOR THE SAME ISSUE IN TWO YEARS, DO SOMETHING AND FIX IT.
