Consumer Complaint: My name is XXXX XXXX. I am the son of XXXX XXXX who was the owner of a property located at XXXX XXXX XXXXXXXX XXXX XXXX MO XXXX. My mother passed away in XXXX of XXXX and left her estate in a living trust. She executed a Beneficiary Deed to transfer the subject property in to her trust upon her death. I am the Successor Trustee of her Living Trust. I had her power of attorney when she was living, but upon her death, the POA was void and I am no longer considered an authorized third party on her mortgage loan with Select Portfolio Servicing. ( Loan # XXXX ). The company is speaking with me about the property, but since XXXX of this year, they have not accepted the Living Trust and Transfer deed documentation that should allow me as the Successor Trustee, to become the authorized party ( Successor-in-Interest ) of my mother 's home. I suffered an injury and was off work for almost two years. I was able to keep up with my mother 's house payment until XXXX of this year when I fell behind. I went to the state of Missouri Homeowner Assistance Fund to request assistance since my mother 's passing was XXXX related. They have told me they will assist me to reinstate the loan but the mortgage statement must be in my name. The lender keeps asking me for trust documents that do not exist. My mother 's estate attorney set up her trust in order to avoid a probate. I have consulted with three other attorneys, all of whom have assured me that the documents we have provided the lender are in order. They do not understand why the lender will not accept the documents. In the meantime. the lender has filed a Notice of Default to foreclose on the home and as time goes on without any contact or assistance from SPS, my family home is now in grave jeopardy of being foreclosed upon.

Consumer Complaint: I have a loan modification that is serviced by Select Portfolio Servicing Inc.. My corrected email is XXXX I tried to update my profile but had trouble opdating it. I am supposed to have differed amount waived after XXXX consecutive payments, I have asked for several months including my attorney asked to be corrected over a year ago. They continue to refuse to correct and are using a delay tactic when I call them they tell me that I am incorrect about the deferred amount, I have submitted the loan modification documents several times and they continue to delay the process. They also failed to explain why there is a {$260.00} monthly fee under other charges and fees. " We are submitting your request to the appropriate department '' is their response. I have talked to other people who are having the same issues with servicing companies.

Consumer Complaint: XX/XX/2022, sold premises. Received payoff statement from Select Portfolio Servicing which confirmed at closing by title company. Payoff check sent to SPS.. XXXX. SPS confirmed received XXXX. SPS paid from escrow on XXXX insurance due XXXX and real estate tax on XXXX due XXXX neither disclosed on statement or confirmation. Insurance cancelled on XX/XX/2022 and payment and per diem refunded to XXXX. Tax payment made by title company and duplicate payment returned to SPS. SPS refused to issue satisfaction of mortgage and is paying excessive insurance each month as well as paying real estate taxes and will not return duplicate payment. SPS received full payment of mortgage. With the return of the duplicate tax payment SPS had money in escrow. SPS continues to run up blll for payment of insuance on property paid off and pay property tax which new lender is paying. Lender not about to commence foreclosure action on mortgage fully paid off. Spoke to SPS and they refused to stop paying insurance and real estate taxes or state how much was in escrow when they received the payoff payment

Consumer Complaint: Our mortgage has been transferred to Select Portfolio Servicing in XXXX this year. Since then, we have been paying our mortgage on time every month. However, SPS has created false debits and credits to our account, creating a manufactured negative balance. As a result, their customer support people have been calling us every week about missed payments. Every week, we explain all payments have been made and every week they say the error will be corrected on their end. However, every week, some different associate calls us with the same issue with no record of any previous conversation. They have also said the account will go into delinquency and that it will be reported to our credit reports, ruining our credit scores, due to SPSs fault. This company is totally incompetent and should not be in the loan servicing business.

Consumer Complaint: Predatory Billing Practices of SPS Select Portfolio Servicing , Inc . This mortgage company, I believe, is illegally charging fees for monthly mortgage payments to be made both over the phone and online on their site. In addition, they do not accept electronic transfer payments through XXXX 's Bill-Payer system. My previous loan company XXXX XXXX XXXX never charged fees for their online service, by phone fee was nominal. SPS charges {$10.00} online from the XXXX XXXX ( there is a XXXX day grace period ) {$15.00} after & phone. The loan is FHA and according to research I've done, the illegality is collecting fees for a specific payment method where the mortgage agreement stipulates that charging a fee based on payment type is not allowed they are in violation of their own agreement since they've bought this loan from XXXX XXXX. It is noteworthy that, circa XXXX, XXXX, XXXX & XXXX XXXX have all in the past got in trouble for these practices. I was with XXXX who sold to XXXX who became XXXX XXXX who now sold to Select Portfolio Servicing , Inc. Shady goings on if you ask me! If there was no fee to use online with XXXX and XXXX XXXX, then SPS should have followed suit. The resolution I am looking for : eliminate all fees for making payments or force SPS 's hand to set up with XXXX and every other bank out there as a participating vendor for electronic drafts on the Bill-Payer system. People have the right to handle their own money and pay their bills as they see fit and as they are able to NOT when the SPSs of the world dictate. Yes by all means, please allow me to pay you to pay you ... Ridiculous!!!

I contacted the company to start an application for a modification as I know that I will not have this large balloon payment amount. Consumer Complaint: On XX/XX/2022 we received a letter from SPS explaining the process regarding our claim to CFPB and what they have done. The requirement that is addressed in this letter regarding that per investor guidelines they need the name of the XXXX Mortgage holder was not mentioned before until XX/XX/2022 in this letter and the dashboard. We have done everything required to complete the documentation for this case and we feel that they do not want to work with us to sell through a short sale process. Also, they assigned us a relationship manager, XXXX XXXX and we have not been able to reach this person the times we have called to SPS, once last week and once the week before. For this reason we have talked to other two representatives. One and a half week ago, after seeing that we had new comments on our dashboard regarding the XXXX mortgage, we called SPS with our Realtor and the representative explained to us what was needed. We uploaded the documents with the information required, hoping that everything was completed because as per the conversation, there was nothing else. But it was not like that. Some days passed and we continued to see comments in the dashboard. When we called last week on XX/XX/XXXX, we talked to another representative and he let us know that they were requiring us to include in the HUD-1 the name of the XXXX Mortgage holder in line 1108. This is really unacceptable, we are frustrated. Every time we call, there is a different comment that was not there before. As of today, we have been 108 days in this process since XX/XX/XXXX, it will be a total of four ( 4 ) months on XX/XX/2022. Even though they have not been clear during this process, they are giving us until this coming Wednesday XX/XX/2022 to submit all documents, after this date they will not evaluate our case, after almost 4 months in this process. Also, the process to make a decision will take another 30 days after all documents are complete. Today we checked the system and they have not given a response to the last document ( HUD-1 ) we uploaded on Thursday XX/XX/2022. We need help so SPS verify our documents on time before this due date they are giving us and let us know the documents are complete. We do not want to have a foreclosure, we need to continue the short sale process. Thank you XXXX XXXX and XXXX XXXX

Consumer Complaint: My mortgage company, XXXX XXXX through servicer Select Portfolio Servicing, has refused to give me an accounting of my payment history, yet monthly tells me that I am in arrears on my mortgage. They filed a Motion for Relief from Stay in my XXXX XXXX case, and I paid those arrears. Since XXXX of 2022, they have refused to provide an accounting of my payments or my payoff amount so that I may refinance my mortgage with another entity. The refusal to provide an accounting has caused numerous fees to accrue to my mortgage and is harming my bankruptcy case. It also prevented me from refinancing my mortgage with another lender.
