Issue: Trouble during payment process

Consumer Complaint: Two issues Lender : SPS Servicing Address : XXXX XXXX XXXXXXXX, XXXX RI XXXX XXXX. Shortage in escrow, unsure how. Payments on time ( absent for covid relief, then forbearance to loan modification ). I began to make split payment around XXXX, did so for a few months. I believe that SPS servicing made a mistake and put " extra '' payment towards mortgage and not to escrow. Therefore, giving me less in escrow and a not payment " not due " til XXXX. Id like for the payment analysis to be reviewed and corrected so my monthly payments do not unnecessarily increase. I do have XXXX 's payment, just waiting to see this corrected before I send out it out. I DO NOT want any this to reflect negatively on my credit report. I'm not late and it was a mistake on SPS, hoping they can rectify it quickly. 2. I received a notice for mediation on a foreclosure from SPS, WHY? I'm not late and don't understand the problem. When I told the person that over the phone, they told me to simply disregard. Absolutely not, this also needs to be corrected in writing as the other issue. Please let me know how best to move for with these matters.

Consumer Complaint: I was granted {$20000.00} from the HAF grant program to keep our home from going into foreclosure. They agreed to receive the HAF funds when they went through the onboarding process, held on to the money for over 2 months, never applied the funds, then rejected the funds & returned them. They stated because I have arrearage in bankruptcy & the {$20000.00} would not settle that amount, they would reject it because they have no way secure the balance. I stated multiple time to them that the bankruptcy balance is secured, my trustee makes those payments & the {$20000.00} was to go to post petition arrearage not the bankruptcy. I have been working with the AHEAD program & they have been unable to get a straight answer as well. They received the {$20000.00} grant money on XX/XX/XXXX & returned the funds on XX/XX/XXXX

The XX/XX/XXXX, Fully Executed Loan Modification Agreement states as follows : This Loan Modification Agreement ( " Agreement '' ) is effective XX/XX/XXXX, between XXXX XXXX XXXX ( Borrower ) and Select Portfolio Servicing , Inc., acting on behalf of the owner of the note ( " Lender '' ). Paragraph 1. Borrower Representations and Covenants. Borrower certifies, represents, covenants, and agrees as follows : e. Borrower has made or will make all payments required under a trial modification plan or loan workout plan, if applicable. Paragraph 2. The Modification. b. The modified principle balance of the Note will include all amounts and arrearages that will be past due as of the Modification Effective Date ( INCLUDING unpaid and deferred interest, fees, ESCROW ADVANCES and other costs, but excluding unpaid late charges... The new principle balance of the Note will be {$190000.00}. d. Borrower has agreed to establish an escrow account to pay for property taxes, and homeowner 's insurance and pay a MONTHLY ESCROW PAYMENT in the initial amount of {$780.00}. Borrower 's total monthly payment of principle, interest and ESCROW WILL THEREFORE BE EQUAL TO {$1500.00} ... BORROWER WILL BE NOTIFIED OF ANY CHANGES. Paragraph 3. Other Agreements- Borrower and Lender also agree to the following : a. This Agreement shall supersede any modification, forbearance, trial period plan, or other workout plan that Borrower previously entered into with Lender. On XX/XX/XXXX, SPS Customer Advocate XXXX XXXX provided a response to Complaint ID : XXXX via the CFPB website and the SPS website XXXX SPS/Customer Advocate Representative XXXX XXXX has broken the terms of the XX/XX/XXXX Fully Executed Loan Modification Agreement, engaged in predatory lending practices, retaliated against the Complainant, threatened to continue reporting knowingly false and inaccurate information to the Credit Reporting Agencies , and has intentionally mislead the CFPB by submitting documentation that does not supersede the XX/XX/XXXX, Fully Executed Loan Modification Agreement that was signed and dated by XXXX XXXX XXXX on XX/XX/XXXX and by SPS Document Control Officer XXXX XXXX on XX/XX/XXXX. Consumer Complaint: They deferred the behind payments which was too much! I was never XXXX behind. Plus, they added an extension on to the modification without my knowledge. Also, there are a lot of fees that I am unaware. The escrow amount I am unaware of as well. They just keep adding fees and I need this investigated. They sent me a copy of some investors that supposedly own the property. I pay my mortgage to them and have never seen the names listed.

Consumer Complaint: I was alerted by XXXX my mortgage balance increased by {$5000.00}. I purchased my home in XXXX of XXXX. After my down payments etc ... my mortgage balance is {$330000.00}. This was being reported to the credit bureaus, until around XX/XX/XXXX, when I received a credit alert my mortgage balance increased by {$5000.00}. I began making the classes to XXXX and to our current mortgage servicer, SPS ( Select Portfolio Servicing ) XXXX states this information is coming from the mortgage holder. SPS is not the mortgage holder, however they are my contact for discussing my mortgage. I called SPS, and they are saying they are not reporting this increase to my credit report. They told me the county tax accessor must be reporting to the credit bureau. Today, XX/XX/XXXX, I placed a called to the tax accessor about my concerns. They expressed to me, they do not report to credit agencies. This brings me back to SPS, who told me yesterday they are not reporting this {$5000.00} increase to my credit report. At this point, this is holding me up from being able to secure a line of equity to help us continue to rehab this dilapidated property. I watch my credit score closely to try and secure financing with the lowest interest rate possible. This situation continues to lower my score, while it's false reporting of information. I don't owe taxes until XXXX, for which I have already paid into my escrow account to cover these taxes, as this is what takes place when you purchase a home. Taxes are paid in the rears. The former owner of the home, ( a bank ) is responsible for the XXXX taxes for my property. XXXX XXXX XXXX, XXXX XXXX. This is my second complaint filing, as the first is when I discovered what has happened and no one can give me a straight answer. Mortgage Processor pointing the finger at the tax authority is absurd! The entire process for purchasing this home began with XXXX XXXXXXXX XXXX, when I caught them discriminating against me, as I have a XXXX last name. Had everything not been so stressful, while running a business I would have filed suit against XXXX XXXXXXXX XXXX. This is my husbands last name, as I am a XXXX, born and raised in the XXXX, cousins to XXXX XXXX the great Senator of Minnesota. I have never felt the feelings of discrimination until now as people assume I am XXXX. I need this false reporting to be fixed and I do not know where to turn.

Consumer Complaint: On or before XX/XX/XXXX, I contacted Select Portfolio Services asking about the maturation date of the loan. They told me XXXX. I told them that can't be right because I brought the house in XXXX. However, she told me I received a loan modification in XXXX. I never had a loan modification in XXXX it was XXXX. So, I asked for all the paperwork and they didn't send it. I have requested all my paperwork for the XXXX time. I received 3 years of payments and the amounts were changed... Showing, XXXX XXXX XXXX placed at the end of the loan. I asked her where did the XXXX additional years come from because I did not agree to that and had no knowledge of that amount. She started ro make excuses telling me that they didn't own the loan because XXXXXXXX XXXX owned the loan. I was told my loan was transferred to SPS and now they're telling me that they are not responsible for anything and not the owners. I have been making payment to SPS and all the paperwork comes from them. They have fraudulently placed an additional XXXX years on to the house plus a XXXX XXXX XXXX at the end of the loan.

Issue: Problem with a credit reporting company's investigation into an existing problem

Consumer Complaint: I received an alert from XXXX on XX/XX/2022 my home mortgage increased by {$4300.00}. My mortgage balance was {$330000.00}. I have called SPS Mortgage Servicing to find out why they are reporting this increase to XXXX. They tell me they are not reporting this increase in my mortgage as there is no increase for my mortgage. XXXX tells me they are getting this information from SPS Loan Services. Now I am caught in the middle of this, as it reduces my credit score showing an increase of balances on my credit file with XXXX, XXXX and XXXX. To this day, no one is able to fix this for me. It is false information and it is holding me up from achieving a refinance for my home mortgage. What resources do I have to get this false reporting fixed?

Consumer Complaint: I refinanced my house back in XX/XX/XXXX and escrow sent an overpayment of {$550.00} to SPS servicing at the close of escrow. After three weeks of waiting, I contacted Sps servicing to find out when I will be receiving my overpayment of interest and thats when the runaround started. First I was told I have to wait longer and after two months of still not receiving I contacted them again and I was told that check has been cashed, I notified them that I have never received the check and checked with my own bank and no check from you or that amounts or any amount has been received. Finally, I was mailed a canceled check with a signature that did not belong to me, or even have my signature name on it. After another couple of months of waiting and runaround in XX/XX/XXXX I was told I need to file a fraud report with their bank XXXX, which I did. and I was told it takes up to 120 days to get resolved. After 120 days passed and still not hearing from them, I contacted them again on XX/XX/XXXX and a customer service representative told me that he sees my fraud filing back in XXXX but it doesnt look like anything has been done with it and passed me on to the ombudsman department that asked me to give them another two weeks to get a response. Then I get a call last week that they can not get a response from their own bank or banks that they have sent the check to, therefore they wont pay me and they have closed the case.

Consumer Complaint: Please HELP! I have submitted info to everyone I could think of, nobody has been able to help or able to tell me where to go next! Quick summary, in 2019 my mortgage was a month and a half passed due, in fear of foreclosure, I agreed to sale my home of +20 yrs to a man who called me from local court House whom explain to me I could rent the home from him stay in the home and have the option to purchase two years later while that day came and when I went to go purchase the home again I found out that the mortgage was still in my name you cant get a new mortgage on a home that you already have a mortgage on so then I went to the title company and there were a few title pages that I had never seen before but had supposedly had my second signature on them but I believe they were added at a later date without my knowledge also I keep getting informed that Im late or behind on payments for the home and that the mortgage company had changed and the information had also changed he had gone in and change the addresses so that I wasnt getting any of the statements or so I never found out about it and he changed it to his address in southern Utah well now he has stopped making the payments on the home XXXX late at least the last 10 months in a row and finally there is a notice from the bank on the door for repossession and it is killing my credit. I cant even rent an apartment or do anything with that on my credit report that is so not fair I want my house back and thats off of my credit it is out of my control and was not my fault please somebody help me thank you XXXX XXXX XXXX
