Consumer Complaint: This is my 18th complaint against Select Portfolio Servicing ( SPS ). SPS never mails RESPA complaint monthly mortgage statement on time always after each month ( 30/35 days late ). For example, I have not received XX/XX/XXXX mortgage statement, even after paying the XXXX mortgage on XX/XX/XXXX. This corporation sends a copy to CFPB, showing how they are complaint on everything. SPS sends very much delayed monthly mortgage statement with an intention that consumer will not know how much to really to pay every month ( as principal gets reduced - interest amount is also reduced ), so that SPS can illegally foreclose consumers home. But if CFPB opens an in-depth investigation into SPSs practices ; CFPB will find ( as other consumers found out ) that SPS is NOTHING but a XXXX, so say the least.

Consumer Complaint: My written complaint : Select Portfolio Serving ( SPS ), a home loan servicer, was responsible for paying my XXXX taxes out of my escrow account. The money in the escrow account was more than enough to cover the taxes. They did not pay the taxes, and I had to pay a delinquency fee on my XXXX taxes. I am owed {$260.00} due to SPSs lax business practices and faulty error-checking. In XX/XX/XXXX I bought a condominium using a conventional home loan, with a standard escrow account, initially serviced by XXXX XXXX XXXX. In XXXX XXXX the loan servicer changed to XXXX XXXX XXXX and the escrow account followed. Starting around late XX/XX/XXXX, I received notice that my XXXX property taxes had not been paid. I had always had an escrow account with sufficient funds from which the property taxes and homeowners insurance should have been paid. I called the tax body and they told me to contact my loan servicer. I called Select Portfolio Servicing ( around XX/XX/XXXX XXXX and they asked that I fax them the delinquent tax notice, which I did. I did not receive a response for several weeks, so I called again ( around XX/XX/XXXX ) and was told that the forms had not been attached to my profile and to wait another week. I did not get a response. In XXXX I had started looking into refinancing my property, but the process did not begin in XXXX until XXXX XXXX. Around XX/XX/XXXX I called Select Portfolio Servicing again and was told that taxes had been paid on the wrong address, though the person on the phone seemed new and was interpreting another employees notes. He asked me to call back in a couple weeks. In XX/XX/XXXX, my refinance process was coming to a close and I was ready to pay the fees involved. The fees included my delinquent XXXX taxes and my XXXX taxes. At close, my loan was transferred to XXXX XXXX XXXX XXXX. I received a check from XXXX XXXX XXXX with my entire escrow amount, from which clearly no taxes or insurance had been paid. On the note of insurance my insurance company had contacted me when the insurance had not been paid in XXXX, and I paid with my credit card. They said that they had tried to get in contact with Select Portfolio Servicing to no avail. I understand that since there were no delinquent fees on the insurance, the escrow return had covered the insurance amount, albeit several months late. The issue here is the property taxes. After receiving the escrow return check from Select Portfolio Servicing, I called again. They told me that the previous servicer to them ( XXXX XXXX XXXX ) should have paid the taxes, since they had held the loan when taxes are normally paid. However, SPSs tax department is responsible for checking that taxes had been paid before transferring a loan. The XXXX taxes were never paid, all my calls and faxes have gone nowhere, and I am still owed the delinquent amount as of XX/XX/XXXX. Numbers : Original XXXX Taxes : {$2400.00}. Amount I paid when I closed on my refinance : {$2700.00}. Amount owed me by Select Portfolio Servicing : {$260.00}.

Consumer Complaint: CONSUMER FINANCIAL PROTECTION BUREAU : Consumer Complaint- SELECT PORTFOLIO SERVICING, INC. ( SPS ) in ref : Failure to Accept Funds from Settlement on a Short Sale Contract I, XXXX XXXX XXXX and my daughter, XXXX XXXX XXXX are co-owners and co-mortgagors. We are writing due to our hardship and urgency, to ask you to demand of SELECTPORTFOLIO SERVICING, INC. ( SPS ) to honor their signed short sale agreement of XX/XX/XXXX, XXXX. SPS refusal to accept the buyers funds from XXXX XXXX XXXX XXXX XXXX XXXX see attached Closing Disclosure and Settlement Statement dated XX/XX/XXXX, abrogated the short sale agreement which is and will continue to bring extreme hardship for us ( sellers ) and the buyers, XXXX XXXX and his wife XXXX XXXX , who have also filed a complaint with your office. XXXX XXXX and XXXX XXXX submitted an offer to buy our home on XX/XX/XXXX. Their offer was ratified on XX/XX/XXXX, after six months of extremely poor and frustrating communication with SPS, on XX/XX/XXXX the short sale was signed for SPS by XXXX XXXX, Servicer Representative/Senior Vice President Mitigation, with the closing date of Friday, XX/XX/XXXX. On XX/XX/XXXX we closed per the contract at XXXX XXXX XXXX XXXX XXXX, conducted by XXXX XXXX XXXX, XXXX, owner of the title company. We gave the keys to the property to the buyers once they signed their closing documents later the same day. Mr. XXXX and Mrs. XXXX moved into the home the very next day. On XX/XX/XXXX XXXX XXXX XXXX XXXX Settlement Coordinator XXXX XXXX contacted us inquiring if we had heard from SPS as they were not responding back to sign and finalize the closing documents. As we also had not received any communication from them, we contacted them via a three-way call so Ms. XXXX could speak with a supervisor directly to inquire when the title company would receive back the approval of the signed Closing Disclosure & HUD-1 Settlement Statement. She emphasized to SPS its timely receipt was vital to adhere to Maryland State law. The SPS supervisor told Ms. XXXX to call back within 4 to 5 days, that there was not a problem, and the HUD-1 should be accepted. That never happened, and therefore the buyers funds were returned to their lender per Maryland law. Instead, with no SPS communication with the title company or us, the following sequence of events occurred 2 weeks after settlement. On XX/XX/XXXX SPS emailed a letter- attached, stating in para 2 : The short sale approval for XXXX XXXX and XXXX XXXX XXXX the above referenced account has expired. para 3 : This expiration is in reference to the purchase offer from XXXX XXXX and XXXX XXXX ( the Buyer ). If you have another offer, it XXXX still be eligible for review. On XX/XX/XXXX SPS emailed us a very confused letter- attached, stating in para 2 : SPS has reviewed your request for workout assistance. We are unable to approve your request for assistance involving a Short Sale for the reason marked below This denial is based on the criteria where your account did not pass the program eligibility requirements ; Denial Reason ( s ) : you requested that we not consider you for this option. This denial is very specific to the offer provided by XXXX XXXX XXXX XXXX XXXX ( The Buyer ). If you have another offer it may still be eligible for review. Please submit the required documents as soon as possible for consideration. We are mentally exhausted dealing with SPS. For the entire six months we were never able to speak to anyone in authority, always speaking to a different person in Customer Service who knew little or nothing about our previous contact ( s ). The assigned Relationship Manager, XXXX XXXX XXXX was never to be found. We ask for your help in dealing with this predatory mortgage servicing company who are planning to begin foreclosure on the property and evict the Buyers through no fault of their own. Consumer Complaint: Hi, I have contacted SPS servicing about my mortgage due to COVID displacement. They approved a forbearance. As time progressed and things still hadnt improved with COVID I contacted them to request they place the arrears at the end of my loan term. I was told they would get back to me because the large number of people in the identical circumstances. In the interim they asked that I submit my monthly bank statement and let them know if anything changed. To date XXXX havent heard back with an affirmative to help me. As soon as the moratorium was set to end-I received a statement from SPS with a demand for fill payment, a deed in lieu of foreclosure or telling me they will consider me for a refinance. I have contacted SPS multiple times and still havent been helped. I need help thats tangible and realistic as Ive been in this situation for almost a year. I can not make a balloon payment for the full amt without income ; I havent received my tax returns because State and a federal have essentially been closed, understaffed or incompetent in follow through. I need SPS to please place the arrears in the back of the loan term so I can realistically catch up with my entire life. Thank you for your help.

Loan # XXXX Letter dated XX/XX/XXXX, regarding requirement for XXXX XXXX Please be advised that I was approved for a XXXX XXXX XXXX XXXX Loan on XX/XX/XXXX, said loan having been owned by XXXX since XXXX and serviced by XXXX XXXX XXXXXXXX XXXX XXXX XXXX XXXX did not require XXXX coverage until you purchased the loan on XX/XX/XXXX, and your servicer claimed they needed said coverage. I have spoken to XXXX in your servicer 's insurance department, and she indicated that this is an arbitrary requirement of their company. I have had mortgages on the subject property since XXXX, and I have NEVER been required to provide such coverage. As indicated, this is a Flex Modification Loan, approved with specific income guidelines. Because your servicer has indicated that this is an arbitrary requirement, that the property is not located in a Windstorm Zone ( Outside of 10 miles of the Atlantic Ocean ), and that said coverage would pose an extreme financial hardship to me, I respectfully request that this arbitrary requirement be waived. Consumer Complaint: Due to Covid19, My wife and I have nothing but hardship in the last 6 to 9 months. Select Portfolio Servicing is unwilling to do a home modification. They have increased my Forberence by {$1000.00} per month on top of my standard payment. ( {$1600.00} PM, + {$1000.00} more for a total of {$2600.00} XXXX They have also added extra Fees ( {$450.00} XXXX to the loan. Total reinstatement {$13000.00} We can not afford this! We don't have the funds saved to payback over XXXX in payments. My wife and I over the course of the last 6 to 9 months have been temporary and permanently laid off from work with and without unemployment. Hrs. have been reduced due to the State of Georgia and US Federal Covid19 guideline. The loan is a XXXX XXXX, Why do we not qualify for a Loan Mod? I have enclosed the Quit Deed for your review. This case has been in legal litigation here in XXXX, TN. I am requesting you to immediately stop reporting this Home Mortgage to the credit Bureaus and Remove this tradeline from my credit profile. In addition, you have falsified my credit profile since XX/XX/XXXX. I have not paid you any money since XX/XX/XXXX. However, you continue to falsify my credit report as if I have been paying you. On my credit report it shows 120 days late since XXXX. However, you have erroneously and willingly reporting current late payments monthly from XXXX until present. This address should have been in foreclosed years ago. I have telephoned you and written you on this matter and you have ignored my requests. To date, you have not corrected this issue. I do have a record of my certified mailings with my letters. In addition, I am requesting my mortgage documents as I have enclosed within this letter. This is my second attempt. This is my right under the Real Estate Settlement Procedures Act of 1974 in which you have already violated. If I do not hear from you within 15 days, I will seek legal counsel. Consumer Complaint: Loan Number : XXXX Servicer Name : Select Portfolio Servicing Inc. On XX/XX/21 I, XXXX XXXX received a letter from Select Portfolio Servicing Inc. ( SPS ). In that letter SPS mentioned that its removing me from forbearance status due to a payment it received from State of Illinois Emergency Mortgage Assistance ( EMA ) behalf me. I called SPS many times snd mentioned that I am still unemployed and put me back in forbearance status but its is refusing to do so. SPS saying that I dont qualify for anymore forbearance and only option I have is to sell the property. I told the bank I dont want to sell my property and I just need forbearance for little bit longer. I also mentioned to SPS that under CARES Act I qualify for 12 months of relief but it is saying I dont qualify for that program. I am kindly requesting CFPB to reach out to SPS and find out why I dont qualify for full 12 months of forbearance. Thank you and I look forward to hearing from you soon.
