Consumer Complaint: -- SPS provides contradictory information to Borrower regarding status of forbearance during COVID-19 pandemic. On XX/XX/XXXX SPS stated, " You previously indicated that you have been impacted by the COVID-19 pandemic. The existing payment relief provided on your account is coming to and end. '' -- SPS actively disregards requests for forbearance extension as allowed under the CARES ACT. Multiple requests for forbearance extension have been submitted ( XX/XX/XXXX, XX/XX/XXXX, XX/XX/XXXX ), SPS has failed to respond or states that forbearance has ended while providing conflicting information stating that forbearance is " comding to and end '' without providing a specific date on when the forbearance is ending. -- SPS actively disregards completed applications for loss mitigation. Multiple loss mitigation applications have been submitted and SPS simply responds with vague statements that information is missing, fails to provide detail on what information is missing, or when details of missing informaton are provided, the information has already been submitted. SPS states that signatures are missing or parts of pages are missing when all pages submitted with application are legible and signed where necessary.

Consumer Complaint: Our family has been impacted by Covid 19. My husband 's company is in the hospitality industry and I lost one of my two jobs significantly impacting our ability to pay our mortgage. We have been in constant communication with the mortgage company the whole time. Initially our loan was placed in forbearance. During the forbearance period we communicated with several representatives of the lending company in order to work out what the next steps would be. We repeatedly spoke with them asking for assistance and tried to make sure that we would not be put into a situation in which we would have to pay a balloon payment at the end of the forbearance period or be forced into a repayment plan that was unaffordable. We were assured multiple times that this would not be the case, conversations that we recorded. At the end of the forbearance we reached out again order to come up with a sensible repayment plan. After the forbearance expired ( according to the lender ) we were asked to pay $ XXXX for XXXX, XXXX, and XX/XX/XXXX respectively. As of XX/XX/XXXX we resumed our contact with the lender. We were told to submit documents in order to apply for mortgage assistance or a possible trial modification, which were some of the options that were presented to us before we were told to make the {$1000.00} payments. As we supplied the requested documentation, we kept getting in touch with the lender only to find out that the documents were not being processed in a timely manner, and the lender was " dragging their feet '' coming up with a solution for us, while starting to make threatening calls requesting us to pay the balloon or in the end offering us a repayment plan in which we would have to pay our current mortgage amount as well as satisfy the balloon debt within a year. This payment plan is not a sensible mortgage assistance program and is not showing that the lender is trying to offer any real support to it's borrowers during these trying times. We would be very happy with a loan modification in which the balloon payment would be placed at the end of the loan and the interest rate would be reduced. Apparently, even though initially that option was offered by the lender, it is no longer available. We are willing to make significant payments to our mortgage in good faith. Our lender is acting in bad faith, only offering options that they know are not feasible given our financial circumstances.

Consumer Complaint: SPS grossly violation RESPA regulations by sitting on a short sale request for months to time out the file that was being service released. Everything should of been submitted to the investor back in XXXX of 2020 but SPS kept asking for something that was never needed because of the incompetence of one person in underwriting who didn't understand that an HOA doc release fee isn't part of past due HOA dues. Now the new servicer SN Servicing is trying to renegotiate fees that were already negotiated with SPS. This is unacceptable. I demand SPS take back the loan and complete the short sale request that they should of completed 2 months ago.

Issue: Incorrect information on your report

Subissue: Information belongs to someone else

Consumer Complaint: My name is XXXX XXXX. I have submitted many complaints regarding ID Theft, Mortgage Fraud and Bankruptcy Issues. Both myself and my Husband the Co-Debtor sought out to the XXXX XXXX XXXX XXXX XXXX as a resource to obtain assistance with both Residential Mortgage Fraud and also after my business partner abandoned the mental health agencies owned by us I was forced to buy him out. Also the level of retaliation against me was very strange. I began to investigate which led to uncovering excessive Mortgage fraud on my personal properties. I filed Bankruptcy in XX/XX/XXXX my business partner abandoned the agency in XX/XX/XXXX despite what he notated. I was forced to represent myself Pro Se due to attorney 's being told not to take my case on. All properties were abandoned by the Chapter XXXX Trustee and no investigation was completed. I have researched my situation for approximately 5 years and the XXXX Trustee and his court ordered Legal Counsel and others have violated me in every way possible. I was in Chapter XXXX, but was basically informed all mortgageswere required to be paid until it was decided they would be investigated? XXXX XXXXXXXX LRC. I understand the Trustee has the ability to Abandoned Real Property is they are Burdensome. Of course, they are burdensome if you know your colleagues have committed Mortgage Fraud within the case you are assigned to and you in no way want to be apart of a fraud investigation, It's easier to abandon a property and pass it through a third party flow through and collect your profits from the creditor. But, you leave the fraudulent loans in the hands of the Debtor who is once again the VICTIM! We can not file taxes due to IRS/ID Theft and also because one of the Fraudulent Mortgage Companies has sent both myself any my spouse 1099-C 's. One for myself and one for him AFTER the receipt of a letter regarding a release of Lien, Select Portfolio Servicing. This is just one aspect. All of the secured properties have been liquidated without a validation of debt and now this. In closing we do not own this money. This is not our loan. We were under the impression we received loans to purchase properties only to find our information to obtain loans for others to pocket. Further, the titles were clouded PRIOR to the purchase of each home and our credit, was damaged and money stolen. SPS needs to fix this issue, We have reached out to them and received no response. We are totally traumatized as we are basically transient in addition, to being exposed with COVID which is still a healing process. The number of loans taken against this home utilizing our credit is unbelievable. Basically, we. were renting every property we thought we owned, New Fraudulent Deeds are being created every second whenever there is a Fraudulent Foreclosure AKA Non-judicial. I am an XXXX female who is painted to be disruptive and have no standing in the court due to me serving a STRONG AND DETERMINED voice knowing what is being done to both myself and Spouse, No I am not an Attorney by for, but trust and believe it doesn't take a rocket scientist to figure this out! In closing, I received an order on XXXX from the presiding XXXX XXXXdge stating the Trustee abandoned referenced home on XXXX, however it was XXXX ( Refer to Item 155 ) on Bankruptcy Activity Docket XXXXXXXX XXXX Also, the home was sold twice due to the Trustee putting the incorrect address on his Trustee ; s Report date for XX/XX/XXXX, The home was referred to as XXXX XXXX XXXX XXXX, XXXX Ga XXXX.

Issue: Struggling to pay mortgage

Subissue:

Consumer Complaint: Hi, I was under a mortgage forbearance with XXXX XXXX that started in 2020. I also did one other 3 month extension with XXXX. In the meantime, my loan servicer changed from XXXX to Select Portfolio Services ( SPS ). According to what XXXX told me, SPS would honor any agreement I entered into with XXXX. XXXX told me about the many options I would have to pay off the balance at the end of the forbearance. XXXX stressed to me not to worry and that SPS would honor any previous agreement. XXXX told me I can add the forbearance balance at the end of the loan. SPS did not give me this option. SPS only gave me the option of a repayment plan to bring my payments current. They want me to spread my payments over 24 mos. This would increase my current mortgage payment by around {$520.00} each month. This is not affordable. The only other options being offered by SPS are non-home retention that includes only a, 1. Short Sale or 2. Deed In lieu of foreclosure. I have not been given any other options. Currently, my family and I are afraid of losing our home. The letters I receive from SPS indicate starting foreclosure proceedings. SPS is telling me the only reason why they are giving me the high repayment plan, and nothing else, is because of the private investor. This is the only answer I receive. I am ready and can resume making my mortgage payments but it seems as though I'm being forced out of our home and into foreclosure. I asked if they can put the balance at the end of the loan, or do a modification and I was told NO. SPS told me the reason is because that's what the private investor wants. There seems to be a disconnect between what XXXX told me and what SPS is doing. I was led to believe by XXXX that I have other more reasonable options.

Consumer Complaint: Hello, My mortgage was sold in XX/XX/XXXX to a company named Select Portfolio Servicing while I was in COVID forbearance from my prior company dating back to XX/XX/XXXX. The forbearance was honored with a end date of XX/XX/XXXX. During that time I contacted this new lender with info I was ready to resume payments shortly. I was sent to fill out a RMA package. On XX/XX/XXXX I received a letter stating I had 180 days of COVID relief plus an additional 180 if requested. Due to changes in income and status with Maryland schools being closed on XX/XX/XXXX I requested the forbearance to continue until XX/XX/XXXX. I made the request two separate times. On XX/XX/XXXX I received a notice that I was not eligible for loan relief options. On XX/XX/XXXX I received a demand notice requesting the lump sum payment be made within 30 days or foreclosure would start. I have made at least 5 phone calls to the company and have written 6 emails all documented with dates and requests. To this date I have no received resolution on a proper payback option or allowing forbearance through the dates offered.
