Consumer Complaint: On XX/XX/2023, I received a letter from my mortgage servicer ( Select Portfolio Servicing, Inc. ), ( after my previous complaint to the CFPB ) which stated they had sent additional funds and exhausted my restricted escrow account funds. In response, I began contacting SPS to report the information sent was inaccurate and there should have been another {$7800.00} remaining in my restricted escrow. I have yet to receive confirmation of the restricted escrow balance. I have called on 6 different occasions and keep getting told there is no resolution and that a supervisor will call back within a few days. To date, I have not received any calls or other means of communication to settle this issue. When I asked to speak to a supervisor during todays call, I was advised they were too busy returning calls to take my call. As of today, SPS has deposited {$64000.00} in insurance proceed checks from my claim and have disbursed checks totaling XXXX. The restricted escrow balance should be {$14000.00}. However, I was advised by their representative today that my current balance is {$6200.00}. I am at a loss to understand how this matter has not been resolved in the six months since I have brought it to their attention. Considering SPS is apparently using some arbitrary system of inspections ( which has never been explained ) to determine the percentage of completion for the repairs, an accurate escrow balance is vital to ensure that their clients receive funds that are proportional to the repairs completed. As of now, after spending over {$100000.00} in repairs out of pocket, SPS is indicating we have only reached the 25 % repair threshold ( which is ridiculous ).

Consumer Complaint: After receiving a XXXX insurance settlement check from XXXX XXXX in the amount of {$41000.00}, I contacted Select Portfolio Servicing for the payoff of my mortgage. On XX/XX/XXXX I received by mail a payoff quote in the amount of {$25000.00} that would expire on XX/XX/XXXX. I contacted the company that day inquiring the process of getting the check endorsed to payoff my mortgage and the 3rd party insurance adjuster also on the check. Was told we had to get the 3rd party to endorse the check as well as myself and send it to them. I offered to send a bank check if they would endorse the check, but they refused. On XXXX XXXX, XXXX I drove XXXX XXXX way from XXXX XXXX XXXX to the XXXX XXXX area for the endorsement of the insurance adjuster. I had to post date a personal check XX/XX/XXXX, for their payment which they would cash once SPS returned the proceeds after payoff. I contacted SPS once again about enorsing the check so I could send them a bank check which they again refused. On XX/XX/XXXX, I received yet another payoff now in the amount of {$26000.00}. I followed their protocol on XX/XX/XXXX, by overnighting the XXXX check, along with, the documents they required : a letter of request to pay off the mortgage and the new pay off quote, which they received and signed for on XX/XX/XXXX mid afternoon. On XX/XX/XXXX task was opened, on XX/XX/XXXX Loss claims submitted to documents and check to the payoff department where the check has been sitting since XX/XX/XXXX. After calling every couple of days, not XXXX single person can explain why the payoff hasn't taken place. Every person says it is pending, though several have stated they submitted an " expedite order '' for payoff. On XX/XX/XXXX, it is my understanding that " XXXX '' noticed that the XX/XX/XXXX payoff quote expired and an new one had to be sent to me which I received a week later in the amount of {$27000.00} and expires in XXXX days, XX/XX/XXXX. My post dated check to the 3rd party on the XXXX settlement check is now more than 60 days beyond. On XX/XX/XXXX, I received a now escrow payment schedule where my monthly payment will go up from {$480.00} to {$730.00} due to homeowners insurance increase since XXXX XXXX. I had found another Insurance company to cover my homeowners insurance at 3rd the cost back in XXXX ( why requested to payoff amount in XXXX ) but was unable to act on it because of my property still having this " open claim '' which should have been closed back in XXXX. It is now XXXX so I'm sure that rate quoted me is no longer effective. After speaking with XXXX different people today, XX/XX/XXXX with SPS, my insurance claim check is still sitting in " restricted escrow pending ''

EVERY DAY I CALL FOR A STATUS UPDATE I AM TOLD THAT THEY ARE ESCALING THE FILE. THE REAL REASON THE FILE IS SITTING AT A STANDSTILL AND NOT BEING WORKED ON IS BECAUSE THE FILE IS DUE FOR A SERVICE TRANSFER ON XX/XX/ TO XXXX XXXX. FOR THIS REASON SPS HAS REFUSED TO CONTINUE TO SERVICE THE LOAN WHICH THEY ARE REQUIRED TO DO UP UNTIL THE SERVICE TRANSFER DATE. IF THE CUSTOMER OWED SPS MONIES THEY WOULD NOT JUST IGNORE THAT POINT THEY WOULD HOUND THE CUSTOMER FOR THE PAYMENT UP UNTIL THE SERVICE TRANSFER DATE. PLEASE INVESTIGATE THIS COMPANY FOR FAILURE TO PERFORM THEIR REQUIRED DUTIES UNDER THE SERVICING CONTRACT AGREEMENT WITH THE INVESTOR AND THE HOMEOWNERS A RESOLUTION TO THIS MATTER WOULD BE FOR THE CURRENT SERVICER SPS TO APPROVE THE SHORT SALE OR ASK FOR A HIGHER OFFER

Consumer Complaint: I called in on XX/XX/XXXX to discuss my mortgage and escrow amounts in detail for at least 30-45minutes. On XXXX/XXXX/XXXX I receive a copy of my settlement statement from XX/XX/XXXX, this does not answer my questions. My escrow shortage seems extremely high They stated that my payment of {$2000.00} began on XX/XX/XXXX. I understood that a bulk of this was due to my homeowners insurance increasing. The escrow balance still does not make since for my loan payments to increase another {$500.00} a month. Furthermore, I am already struggling and received help from the state with a payment of {$12000.00}. My past due balance on XX/XX/XXXX statement states XXXX. Where is the rest of my balance from this payment and where is it being applied. These numbers are off for the escrow shortage as well as my payments due. It is not clear what is going on with my account an looks like money is being taken and egregious fees are being added to my mortgage payments.

Consumer Complaint: Today is XX/XX/2024 and Select Portfolio Service has not sent my monthly statement, Or my annual mortgage statement. There are thousands of complaints about Select Portfolio Servicing deliberately not mailing out customers mortgage statements so they can charge late fees. I have filled complaints about this issue. I have a paper trail of deceitful, fraudulent acts committed by Select Portfolio Servicing. They have copied and pasted my name to fraudulent documents and forged by name to fraudulent documents. Select Portfolio Service is a corrupt company. The law requires mortgage lenders or servers to send out monthly statements for each billing cycle. As well as an annual mortgage statement.

Consumer Complaint: On XX/XX/24 I received an email from an XXXX XXXX who states to be part of the XXXX XXXX XXXX for Select Portfolio Services , Inc however when I called the XXXX number I was advised by a XXXX that there were no notes from XXXX XXXX on my account. I was beyond elated to hear that a Loan Modification was being offered as I had requested and applied for however it seems this may not be the reality. Some how this XXXX XXXX XXXX XXXX XXXX through caller id had pertinent information about my home address, email and loan information, I called back due to my excitement to remedy the issues we have experienced for XXXX plus months with SPS Inc and not he has my phone number. He promised me nothing short of a miracle which may not even be true now. I am requesting for CFPB to have SPS assist in a similar Loan Modification, if it is not true yet and help to put the horror we have endured for nearly a year beyond us. We are just requesting to pay our mortgage monthly and have the COVID-19 forbearance balance placed on the end of our loan as a balloon payment as most forgiveness was given under the CARE Act. I am now concerned that a decent amount of my personal information has been sold or leaked to various entities that intend to do nothing but steal my money with a possible promise to fix all of our mortgage issues from the last year.

In XX/XX/2023, I discovered my home was put on a " foreclosure registry list data base '' by my mortgage company ( Select Portfolio Services ) without any type of proper notice. I ( only ) discovered the " listing '' because I discovered a XXXX XXXX code enforcement officer inspecting my property because of being " put on the foreclosure registry list ''. The code officer told me they download and use the list daily to inspect home foreclosures and abandoned homes. It's important to point out, I was not in forclosure so I immediately called my mortgage company. A call to my mortgage company quickly confirmed I was not in any foreclosure " proceedings '' or in foreclosure. I asked about the " foreclosure registry list '' and was told they had no knowledge of it, nothing appeared in my file. No current court records filed for foreclosure. I ( then ) contacted the XXXX XXXX Code division and was told I was put on the list by my mortgage company, Select Portfolio Services. I filed an " open records request '' and confirmed it was my mortgage company that paid the required fee and fraudulently filed my home on the registry list, without notice. The information required to submit the form, along with a required fee, was outdated, false/misleading, inaccurate and in violation of Florida law . ( 48-H, sec.8, 146 ). Repeated phone calls to the mortgage company call center didn't work because they repeatedly denied any knowledge of the list. I got zero customer service. The mortgage company fraudulently put me on a foreclosure list, failed to properly notify me and violated Florida law.

It was originally financed through XXXX XXXX XXXX. XXXX XXXX XXXX XXXX XXXX assumed the loan XXXX XXXX, XXXX. The problem is, the payment I made on XXXX XXXX, XXXX, online, was applied to Principal Only, not as the regular monthly payment which was due XXXX XXXX, XXXX. The transition was XXXX XXXX, XXXX. I have been in contact with XXXX and SPS over the last 3 months and all they ( SPS ) tell me is that I got credit for the payment. XXXX did acknowledge over the phone that is should have been applied as a loan payment, but they cant fix it since as of XXXX XXXX, XXXX SPS has to fix it. Please note I have attached a copy of my bank statement which demonstrates under the description debit unitedwholesale 1 time DFT XXXX which is a Friday that I made the payment online, thru their website. What I want from SPS is for them to apply the {$4000.00} I paid to the monthly payment balance showing me current, a letter stating my account is current and that I have always paid on time, them to advise all 3 credit bureaus that I have NEVER been past due NOR SLOW PAY, reverse the fee they have assessed on my account and reasonable compensation for my time to resolving this matter over the last 3 plus months. Consumer Complaint: I have called numerous times about this issue as well as sent more than XXXX letters on the topic ( sending a XXXX letter this evening ). XXXX approved a forbearance on my mortgage during XXXX in XXXX and payments started back XX/XX/XXXX. In XXXX of XXXX, XXXX tried to double my escrow thus increasing my mortgage by several XXXX dollars per month. I inquired with XXXX regarding why my escrow was so short but they refused to answer. Eventually, I presumed that the escrow owed during forbearance was being added back to my account ( although this did not happen on my other mortgage, I think that it was pushed to the end of the mortgage instead ). Regardless, they never provided an explanation so I continued to pay the correct amount due while satisfying my taxes & insurance myself ( paid both in full ). So ever since XXXX of XXXX to date I have made the correct mortgage payment and in XXXX, I paid full taxes and insurance ( on top of my mortgage payment ) to compensate for the missing XXXX escrow caused during forbearance. On XXXX occasions, XXXX lost my payment and I had to resend the payment. Around XXXX of XXXX, my loan was sold to SPS and they have refused to adequately investigate this issue. They are still claiming that I am a full month behind on payments yet there was no where near a XXXX XXXX delta in escrow between the XXXX and XXXX years thus this can not be correct. I am being requested to make another full payment and I'm being charged late fees and being mistreated through this whole ordeal. I hope that you can provide some assistance to finally get this resolved and force SPS to adequately correct this error on my account.

Consumer Complaint: I am XXXX XXXX, surviving spouse of the late XXXX XXXX ( XXXX XXXX ). On XX/XX/XXXX, my late husband executed a refinance promissory note as the sole obligor, in favor of XXXX XXXX XXXX XXXX ( XXXX ) as the lender. To secure said promise, my late husband and I both executed a deed of trust security instrument of even date of the foregoing note, and also in favor of XXXX. In XXXX, my husband died, at which time, XXXX was the party demanding monies towards the foregoing XXXXXXXX refinance mortgage loan. For the remainder of XXXX through XXXX, I continued forwarding monthly installments demanded by XXXX, despite the increase in payments due to an adjustable interest rate. In XXXX, after I requested a modification from XXXX, the latter informed me by letter dated XX/XX/XXXX and also addressed to United States XXXX XXXX XXXX, that XXXX was unable to provide the requested relief by stating : A review of this loan has found that you are not a co-signer on the Note for XXXX XXXX ' loan. Since you are not financially responsible for this loan, we are unable to consider you for a loan modification .... ( See Exhibit A ). Shortly after the foregoing communication, an employee from XXXX instructed me over the telephone to not forward at least XXXX installments towards the XXXXXXXX refinance mortgage loan in order for XXXX to consider me for a modification. After I complied with the foregoing instructions given to me my XXXX, the latter being foreclosure proceedings, which caused me to file a XXXX XXXXXXXX bankruptcy petition to stop the sale of my home. At some point in or shortly after I filed bankruptcy in XXXX, Select Portfolio Servicing ( SPS ) begin demanding monies towards the foregoing XXXXXXXX XXXX XXXX loan, and continued to threaten me with foreclosure of my home. Furthermore, SPS ( and/or its predecessor XXXX ) caused my signatures to be forged upon the following documents : 1. A modification dated in XXXX and attached hereto as Exhibit B, which is not recorded in the local land records ; which neither me nor my late husband signed ; and which was not needed nor requested by my late husband or myself because installments towards the XXXXXXXX refinance mortgage loan were being paid in full and on time. ; and 2. A promissory note wherein someone authored, lifted, and/or forged my name and signature on page four of four ( See Exhibit C ), because my late husband is the sole obligor that signed the XXXX note on XX/XX/XXXX. Furthermore, at some time on or after XXXX through XXXX, SPS begin to unlawfully traffic my social security number and other personal identifying information to : 1. report me to the credit bureaus as an obligor for the XXXX refinance mortgage loan when, from the inception of said transaction, my late husband was the sole obligor. ; and 2. unlawfully convert a loan modification designating me as the sole obligor when my late husband was the sole obligor for the underlying debt. ; Additionally, with installments that were demanded, received, and cashed towards the XXXX refinance mortgage loan and the unlawfully converted loan modification, SPS created an escrow account for property taxes and overcharged me when I received annual exemptions from the County due to my status as a XXXXXXXX XXXX XXXX Lastly, to present date, SPS continues to threaten me with the possibility of foreclosure, and does so by trafficking and relying upon forgeries, of which includes, a forged assignment instrument recorded in the local land records in the year XXXX ( See Exhibit D ), that is subject to the following consent judgments, cease and desist orders, and injunctions, and has yet to be rectified by SPS : 1. the XX/XX/XXXX, Final Judgment entered by the U.S. District Court for the District of Massachusetts in United States of America v. Fairbanks Capital Corp. , et al., ( Civil No. 03-12219 ), and modified on XX/XX/XXXX to include Select Portfolio Servicing Inc. ( formerly known as XXXX XXXX XXXX and XXXX XXXX XXXX XXXX XXXX XXXX ; 2. In the Matter of XXXX, XXXX, et al. ( XXXX XXXX.
