Consumer Complaint: As of today, we received a letter from the note holder or investor, XXXX XXXX, regarding our loan XXXX stating that as the nominal mortgage owner, XXXXXXXX XXXX does not have the authority to review or approve loan modifications. When we requested a loan modification in XX/XX/XXXX based on a very serious XXXX, which caused us a considerable loss of income, the response from the unscrupulous underwriting at SPS was to extend the maturity date until XX/XX/XXXX, PLUS a balloon payment of {$110000.00} which does not make sense because if the loan was extended the lender would benefit because we would end paying more interests. SPS alleged that the lender did not authorize to match the amortization term and the maturity term and this statement is utterly false because the investor responded to my letter and clearly stated that they did not have anything to do with this abusive proposal. This modification has been reported to the USA Housing Department and is being evaluated. The purpose of this complaint is that after all these lies, I requested on XX/XX/XXXX, an analysis of our escrow account. This evaluation is pretty simple and consists in adding all the money deposited since SPS started servicing our loan in XX/XX/XXXX as of XX/XX/XXXX, and subtract the payments made in flood and hazard insurance and property taxes. A simple addition and substraction that I gathered and reflected in a simple spreadsheet that was contradicted by SPS. On a letter dated XX/XX/XXXX SPS stated that we have only paid {$38000.00}. This amount is incorrect, we have paid since XXXX to the escrow account {$40000.00}. There is not way around when talking about numbers, the sum of all the deposited money appear in multiple statements, and despite having sent to SPS proof of payments, SPS still insists that we have a negative escrow account balance of {$1300.00} and this information is wrong. We decided to close the Escrow account and requested a refund that we have not received yet. In short, in addition to the abusive loan modification proposal, SPS is holding our money deposited in an escrow account and is asking us to pay for an inexistent and made up shortage.

Consumer Complaint: I requested assistance from my lender and have been verbally advised that they are refusing to even acknowledge my documentation. They say I have no options. I do not have the covid assistance option even though my immediate family has passed and I am out of town as I write this up. Even though per the website, I qualify for the streamline, they stated they will NOT look at my 2 page applications that does not even require any documentation.. I am being denied any assistance based on the opinions of someone who is sitting at home collecting a paycheck. I have called numerous times and each time I was told " your home is selling and next time you call in just call the REO department. '' I was told " your home is selling stop calling us we are not going to help you. " I was told " XXXX XXXX XXXX ( the investor ) wants your home and they are not helping you. '' I was told " XXXX XXXX has not even looked at your paperwork, they do not help people like you. '' I can't believe that I call SPS and am treated this way. At this point I think I feel as if I am being discriminated against based on my race, ethnicity, language, and national origin. There is no valid reason why I should be denied any type of assistance. I did also advise SPS that I was approved for a new loan. I did request the payoff back in XXXX as I started the refi process, however it has since expired and I was told it was " too late we are taking your home ''. I should have been advise bank when I first started looking into the refinance, etc, that I could have applied for a loan modification to keep my home.. Civil Code section XXXX states-Guaranteed single point of contact : If you ask for a loan modification or other foreclosure-prevention option, your servicer must assign you a specific person or team who can walk you through application requirements and deadlines, knows the facts and status of your application, including missing documents needed to complete your application, and can get you a decision on your application. I was never advised of the streamline 2 page package. I found it on my own! I have called numerous time regarding attempts to retain my home. In CA, as long as my package was in 7 days before the sale date I should have been reviewed. Also, Please see attached loan approval that I finally received. Escrow is also open ( see attached ) My main goal was to try to keep the property, however, SPS flat out refused me every time Ive called. Who are these people to make such accusations or comments on any of those things. The blatant disregard, the rudeness, and the lack of compassion for my situation is horrid. Why would SPS/ XXXX not to want to be paid in full. The number of times that I have called in should extinguish any excuse for the type of behavior I had to endure. There is no tangible reason why I can't receive assistance. I have asked why I am being denied assistance and never once got a clear reason and was told nothing other than the insults regarding my situation by SPS employees. I have asked for a supervisor on numerous occasion and I was always told there were in a meeting or that the employee was unsupervised at the time. The way I have been treated is unacceptable.

Consumer Complaint: In XXXX of XXXX Select Portfolio Servicing paid my homeowner 's insurance a month before it was due. I was going with a new company due to a lower rate. I contacted SPS and they informed me that they had paid the previous company the higher amount. At that time they paid the new amount out of my escrow account. The old insurance sent me a refund and I sent SPS {$1300.00} via my online bank stating escrow only on XX/XX/XXXX. This payment was applied to monthly payments. I have been contacting them since then when I receive my monthly statement and it has not been corrected. I am told it has to go for review and will take 30 days for approval to be placed back into my escrow. On other occasions i am told that an email has been sent to a supervisor to escalate the situation. I ask to be sent to the escrow department and the representative tells me she is the escrow department. They also state a manager can't help me. I have been transferred to managers who state the same thing. " Let me email my manager to escalate this. My escrow analysis arrived in the mail that shows my payment will increase from {$620.00} to {$680.00} to cover the {$1600.00} escrow shortage. Even though they show my insurance and taxes have decreased. This is the second increase since they took over servicing my account. My escrow never increased while through XXXX. I even set my payments to be {$50.00} extra towards principal every month. I am needing someone to help me correct this issue because they are not moving the money into my escrow. My statements still say I don't have a payment due until XX/XX/XXXX. As of this date my second installment of my property taxes have not been paid. Consumer Complaint: We fell behind on the mortgage XXXX of 2021 as result of job loss, covid illnesses in our household. We started the procedure with the loan servicer SPS. We sent them multple copies of paperwork for several months. We did not feel comfortable continuing to send payments during this time because they seemed to always misplace or lose documents. We sent them all financials several times. After several months they asked for hardship paperwork again. Finally they denied any help to resolve the issue except paying the full amount, which we did not have. Since XXXX we have continued to try to deal with SPS Servicers, but they are unwilling to assist us in new mortgage assistance in anyway. We will be able to pay the mortgage now that we have sources of income to pay the mortage and past due. Meanwhile SPS servicers have continued to add multiple and multiple expenses to the loan including an unlimited supply of drive by inspection charges and other unknown charges m eanwhile we continue to feel like we have been getting the runaround. We have been willing to do what we can to save our home of 27 years, our childrens home. On several occasions they have allowed the homeowners insurance to be cancelled. We paid to have it reinstated and SPS improperly dealt with the insurance allstate and told them no one was living in the house. This house has been occupied almost daily for 27 years. With all the drive by 's they have done supposedly, I am not sure how they have been unable to see all the cars in our driveway.One of the agents at SPS recently said if we could afford to pay the insurance to get it reinstated after they SPS messed up then why can't we pay the mortgage. We feel like they have been harassing us for several months, leading us on and tacking on a multitude of expenses. Recently we received another notice to pay homeowners again since they SPS had mandatory insurance placed and now XXXX said SPS dropped the ball again.We will be able to pay the mortgage from this period on, we just want to be treating fairly. This has been a true nightmare dealing with this company. Please help us save our house. We have plenty of equity at stake, and am sure the SPS company and loan owners are well aware. Now we received a letter from an attorney today requesting the loan and all the fees added by SPS is due in full {$150000.00} Dollars or we will be foreclosed on.

He replied their statement was printed XX/XX/2022 so it didn't account for the payment I made on XX/XX/2022. He said the statement could not be changed. But the vast majority of my mortgage statements are late. In XX/XX/XXXX I did not receive it until XX/XX/XXXX and in XXXX, again I received it late, on XX/XX/XXXX. As of today, I have not receive my end of the year statement. I also sent two letters in XXXX, XXXX requesting the closure of my escrow account. I called SPS on XX/XX/XXXX and spoke with XXXX regarding my escrow closure request and he said to email the request. I emailed the request and received confirmation from SPS they they had received it. I could send a copy of the email and confirmation per your request. After receiving a letter from SPS to upload the escrow closure request. I uploaded it and again received confirmation that it was successfully uploaded. On XX/XX/XXXX I spoke with XXXX who also confirmed that the escrow closure request had been received via email and uploaded from me, and my home insurer had emailed the declaration page home.

I learned after the 3rd month that I only qualified for a repayment plan. I have been sending them documentation for the last 10 months and have yet to be given a repayment plan or any finalized plan to move forward with!!! We have sent them the same documentation over and over just to have them change how the document reads or what is needed on it. we have given them 7 different profit/loss statements from my Company that they denied by changing how they want it to read or dates, ownership, expenses, etc. They have asked for a verification letter at least 6 time and denying it for various reasons that they did not inform us of until they denied it. When we started this process after the first for months, we owed a back balance of {$16000.00}, which would have been hard enough to pay back in a specific time like 4yrs, yet they still have not given us a final plan and if we didn't keep sending new clarifications, they could proceed with foreclosure.
