Consumer Complaint: In XXXX we hired an attorney to handle a loan document problem and he contacted our loan servicer asking for them to sign a document and return that document to him. This was for an application for affidavit of affixture. We found later that they would not be the party to sign the document and other avenues were pursued to completion. Meanwhile the loan servicing company SP servicing, XXXX XXXX XXXX XXXX XXXX XXXX, UT XXXX, changed our mailing address for our loan to the attorneys address. The letter he sent did not ask for that to be done. Our XXXX, 2022 and our 1098 statements all were sent to his address. I contacted customer service and spoke to XXXX and she indicated she would change it back. She could not tell me who made that decision to change the address. I also sent an email to their ombudsman department and cc 'd our attorney. I want this on record that their practices of doing things like this is heavily recorded with the XXXX XXXX XXXX When we were first transferred to them for servicing our loan, we sent additional principal and they placed it in a holding account, even though we were not late nor had ever been late. I had to call then as well to get this applied to principal. We do not have anything in our loan preventing prepayment of principal. So unless we had outstanding late fees, it should automatically go to that.

There is an Interest Bearing Principle amount of {$180000.00} and right below that amount is showing as " Outstanding Principle '' of {$180000.00} - we're told that either should be reported to the Credit Bureaus. The amount being reported to all three credit bureaurs is " {$190000.00} We called into SPS to find out why the amount reported to the bureaus exceeded the amount on the XXXX monthly statement, but did not get an concise answer or heard anything that made explained the amount.

Consumer Complaint: SPS assumed my 2nd mortgage effective XX/XX/XXXX. We submitted a subordination request in conjunction with a refinance of our primary mortgage loan & rec 'd confirmation of the request from SPS dated XX/XX/XXXX. On XX/XX/XXXX, we were informed that they couldn't complete the subordination agreement b/c they were not listed on the deed/title as the 2nd lienholder. For more than 6 months, we called and waited for them to get the matter resolved. In XX/XX/XXXX, we were informed that the subordination was approved. On XX/XX/XXXX, SPS finally mailed the signed subordination agreement. However, they added a clause that the refi couldn't exceed a certain amount, which was lower than the refi. So, we had to go back to them yet again to get the subordination agreement revised and re-signed. It is now XX/XX/XXXX and we still have not received the correct and executed subordination agreement. This has been going on for 9 months and has cost of countless hours and thousands of dollars in interest paying on our first mortgage with an 8 % interest rate b/c we haven't been able to close on the refinance at a 4 % rate while waiting on SPS. We also have had two appraisals expire during that time and have had to order and pay for two new ones.

Consumer Complaint: Every XXXX for the past 3 years the new servicing mortgage company, SPS Select Portfolio Servicing, doubles my mortgage payment owed. The loan was originated by XXXX XXXX Bank. Now they claim I am 3 payments behind. I have sent complaints about this every year to CFPB showing and explaining this. It is illegal and unfair practices. This is also a HARP loan and as such regulated further against discrimination and unfair practices. The regular monthly payment is {$730.00} Now they are saying I owe {$2900.00} even though I have made 12 payments every year without fail on this loan. They just keep illegally adding an extra payment every XXXX. I have written to them about this more than once and they ignore me and in fact charge me additional late fees and fines. I must also write XXXX on this.

Consumer Complaint: On XX/XX/XXXX I submitted an application to Select Portfolio Servicing for a loan modification due to Covid and was denied for contradictory reasons. I lost my primary income of XXXX in my home when Covid hit and was on Pandemic Unemployment Assistance ( PUA ) until it ended on XX/XX/XXXX. During the period of time I was receiving PUA I was able to afford my mortgage payment. Since PUA ended, I have been struggling financially to make an income that will pay my bills. There are two people on the loan, myself and XXXX. XXXX and I have been not living together since XXXX, but remain married on paper for the purposes of retirement ( his retirement goes to me upon his death ). I don't have a retirement so I can't afford to lose this benefit. XXXX is also XXXX XXXX XXXX than me. In XXXX I was able to successfully obtain a loan modification from the same company because they understood the situation and took into consideration XXXX expenses as well as his income, including the fact his income covers his household. When denied the loan modification, they gave me several reasons : 1 ) There was too much money ( they failed to take into account XXXX expenses and allocated all his income to this household ). 2 ) There wasn't enough income. ( which is it, not enough or too much? ) 3 ) I wasn't on unemployment. ( I would be on it if the federal government extended it ) I have tried to communicate numerous times the specific situation I am in, including voluntarily sending letters of explanation, and expenses statements for XXXX. However, I have been unable to ascertain if the underwriter actually has reviewed them. Furthermore, I am being told there XXXX be other reasons for denial from the investors, such as not wanting to do a second loan modification. Nothing of this was stated in my denial letter, and this is not being transparent. I understand that mortgage companies received federal monies to assist people that have been affected by Covid. This is me. I'm trying very hard to make ends meet and generate an income. I'm borrowing money to pay the mortgage and it's not sustainable. If I had received a loan modification, even a temporary one, it would be easier to make the payments. I am scared to death to get behind on my payments because I am afraid of losing my home that I've lived in since XXXX and have no intentions of ever selling or moving. I would like my mortgage company to review my file in detail and acknowledge that the scenario is the same as XXXX when they granted me a loan modification, only this time it is directly a result of Covid. This is eerily like XXXX when mortgage companies received government funds, but did not pass along to the consumers. I wonder how much they received in government funding due to Covid.

The house is in very bad condition and needs a lot of work. We submitted the offer to SPS who did their own BPO and countered the offer at XXXX mil which everyone believes is too high ... .so we asked SPS to review their BPO appraisal..they sent us an appraisal from 2010 by mistake... so we then asked for a copy again..which they eventually sent ; so I called the bank and asked to appeal this BPO... the rep said..sorry its too late and now I am no longer eligible for any help... .we could have appealed on time if they sent the correct appraisal..wed like to just finish the short sale please

Consumer Complaint: XX/XX/2021 I filed for a modification under the : Biden approved help for homeowners on XX/XX/2021 for {$10.00} XXXX dollars so is the program. I have requested a modification to not only lower my monthly payment but to include escrow arrears. Before I applied for the modification I called SPS and was informed that there were several types of modifications and that there was a modification that could do what I was requesting and that underwriting would make the decision. I was not asking for a forbearance, nor deferral. I requested a full modification that would bring me fully current with no arrears period. It is now coming up on 7months since I filed under Biden 's homeowner program and I am still waiting for processing. I used one of their suggested HUD approved agencies as suggested in their communication for assistance. All documents were submitted by that agency whose name is XXXX and several times and even recently two days ago upon request sent again paystubs. Still today they underwriting are delaying processing by saying that don't receive or they can't make out the copy all while the HUD agency continues to follow up calls and receive recorded confirmation that all is received and very legible. I have received once a valuation report on my home and now today received another only a month later with the nerve to lower the value of my home if I would go into foreclosure. They are continually sending me foreclosure threat notices all awhile they are supposed to be processing my application. I have now today sent communication to my town manager, state rep, congressman and senator alerting them of this activity. I am active in my community so not too much is a secret around here and for what I a trying to get done. today a rep at their company told me when I called that even if they modify the mortgage that the escrows would be in a payment plan and I called out the conversation I had BEFORE I applied for the modification that I was told that there were several types of modifications that could help me. I am 60 years of age and nearing retirement age ( Biden 's program is very inclusive and high on the list of someone like myself to get any assistance I need according to the documents that I have read in the Program details ). I applied for a modification due to XXXX relief that I so desperately needed from the onset since my first ever application to them not even this one. Last year, 2021 was a very hard tough year having had 4 deaths and my home XXXX in 2021 and trying to help my family, etc. It's a lot. I told them in my letter of hardship that I needed a modification that would include my escrows and did not care how long they had to extend the term of my mortgage loan just make it affordable so that I would not need worry about this in the near future. I share the 1st letter to SPS below that I sent to them and then I had to send another one thereafter only a few days ago because they have now asked me for 16 weeks of paystubs when the hardship application XXXX only required 2 paystubs. It frustrated me but I sent them. Every time they say they need something they push the processing time clock back to 30 days-so you can easily see how they got to be up to almost 7 months processing time. This to me is deliberate. This is the letter that I sent to them and now forwarded to my local community politicians to be on notice for complaints like this. I hope that you could help. THE LETTER READ AS FOLLOW : Dear Servicer, I am fully concerned about the status of my modification. It has been since XX/XX/2021, that I have applied. It is now XX/XX/2021, and still no status. You sent me correspondence that if this is not resolved by XX/XX/2021 I will face foreclosure. Yet you deliberately have delayed my application not trying to move things along. I used a credit counseling agency as you suggested in your correspondence to me for help in resolving debt stress. I particularly did not want to be responsible for submitting this application since it is as serious as applying for a mortgage. That said, all documents that you have requested have been submitted not once, not twice, not three times but now four times and they were submitted by an agency that you suggested that I refer to for assistance through HUD. Still you keep saying you have not received them. All of a sudden, I am $ XXXX and 5 months behind on my mortgage facing a possible foreclosure argument on XX/XX/XXXX only two days before XXXX. I have now had 4 deaths this year, my home vandalized and still trying to recover from the all of it and here you are working against me to take my home away regardless of what was written in my Hardship letter and regardless of what Biden has put in place for us homeowners. So why don't you tell me what a Covid-19 recovery modification is? Or why qualifying for a modification is taking 5-6 months for processing when you say even on your announcement message when calling that it could take UP TO 30 days for processing. It has to be a deliberate action to be put 5 months behind on a mortgage. I just can't seem to see it any other way... what is this? You have constantly asked me to continue to send pay stub after paystub and bank statement after bank statement. I am a single XXXX mother trying to make it just like the rest of us. And you do know that I am XXXX the documents ask for race, you do know my age, the document ask for it, you do know my home location address the document ask for it. Please confirm that I have not entered into some sort of XXXX category where you deliberately continue as history goes to set up XXXX folk to loose their home especially if our home somehow ended up in an affluent neighborhood that used to just be so so when purchased. The activity that is occurring is unacceptable on so many levels. I have contacted the agency that I am using ( at your suggestion via your correspondence A HUD AGENCY ) XXXX XXXX to intervene further on my behalf to bring this to a close. What is this below? Biden signed $ XXXX in mortgage help for homeowners. Biden extends mortgage relief : What it means for you. XXXX XXXX got a huge chunk of this money to help homeowners. Explain to me who gets the money that was issued to XXXX XXXX who is also listed on my mortgage as being sold from XXXX. Biden 's plan also includes specific mortgage assistance for us 60 years and older. What is all of this pacifying written XXXX about? Who is really benefitting from this? I guess I would literally have to call the White House to find out for myself, the XXXX XXXX and the Department of Treasury to learn what I guess I can't read. Please respond to this letter before XX/XX/2021. I deserve answers. I deserve an apology for all of the delay as well. Why do yall put people through all of this mess and say that you are not into the housing realestate business. Well, I am concerned every time that remark is heard.
