Consumer Complaint: In XXXX my mother passed away. I inherited the family home. My mother had a mortgage from XXXX which was serviced by Ocwen Loan Servicing LLC under account # XXXX. She was the sole owner of the home and was the sole borrower on the loan. After my mother passed there was a period when the loan was not being serviced as the estate was in probate and neither the property nor the loan were in my name. It took a long time for a loan modification to get approved. Ocwen rejected our attempts to modify the loan so that I would become the borrower and the deed would pass to my name. We finally got Ocwen to agree to a modification of the loan which became effective XX/XX/XXXX. From that point on I have faithfully paid the mortgage on time, every time as it has only now become my responsibility. In XXXX of XXXX I applied for a refinance on the property. Taking everything into account I did not anticipate a problem. I have always had good credit, always paid my bills on time and have also always paid the loan on my co-op and my car on time. My mortgage was denied due to the reporting from Ocwen which stated that my payment history went back to XXXX and had 32 late payments reported, many over 150 days. Clearly this goes back 4 years prior to my ownership of the deed and the loan and clearly is not my payment history. I discussed this with my mortgage rep and was advised to contact the Bank ( Ocwen ) and the credit reporting agencies. Ocwen has consistently refused to change their reporting and still shows me as maintaining a delinquent mortgage payment history. 2 of the 3 major agencies have agreed with me and are no longer reporting my mother 's delinquent history as mine. Experian has not done so and seems to be unwilling to deviate from the information provided by Ocwen. This is the sole block in my path to being able to refinance. What can the CFPB do to get this lender to truthfully report that my mother 's mortgage payment history is not mine and has never been mine? I have a letter from Ocwen claiming that they are correctly reporting the history on that account number. However it is equally very clear from the evidence presented, and the exact dates of ownership of the loan, that the payment history since the loan came into my name has been nothing but exemplary! Please help me!

Consumer Complaint: Ocwen is engaging in dual tracking and not in compliance with Loss Mitigation Procedures. Federal Law Restricts Dual Tracking I'm attaching Ocwen 's denial letter dated XX/XX/XXXX. I have appealed the denial within the required 30-day time frame. Therefore, I have not exhausted the appeal process. I also fully submitted documents again for mortgage assistance. Ocwen has not stopped the foreclosure sale scheduled for XX/XX/XXXX. The Consumer Financial Protection Bureau, which was established by the Dodd-Frank Wall Street Reform and Consumer Protection Act of XXXX, issued mortgage servicing rules that, after being codified into federal law, went into effect as of XX/XX/XXXX. Among other things, the rules restrict dual tracking. The servicer can't start the foreclosure process if a borrower submits a complete loss mitigation application and the application is pending. This means that if you submit all of the required paperwork, the foreclosure can't start until : the servicer informs you that you're not eligible for any loss mitigation option ( and any appeal you make has been exhausted ) you reject the workout option that the servicer offers to you, or you accept a workout but fail to comply with the terms of the deal ( like not making payments during a trial modification ). 12 C.F.R. 1024.41 governs a servicer 's response to a loss mitigation application. 12 C.F.R.1024.41 ( c ) ( 3 ) ( I ) ( D ) ( 2 ) provides that where a borrower makes application and a judicial foreclosure has already been commenced, " the servicer can not conduct a foreclosure sale before evaluating the borrower 's complete application. '' Further, 12 C.F.R.1024.41 ( g ) prohibits a servicer from either holding a foreclosure sale or moving for a sale if a borrower makes a loan mitigation application within certain time constraints.

Ocwen Loan Servicing, LLC foreclosed on a Deed of Trust # XXXX XXXX and conducted a foreclosure sale as it claimed there was a balance owed to the lender. QUESTION : What is the name of the lender it paid off? Ocwen has admitted it became the agent collecting the loan and was contracted by XXXX XXXX XXXX whom acquired certain liabilities from XXXX XXXX, XXXX. the purported originator of the loan, however, there is no recorded acquisition in public records from XXXX XXXX, XXXX. to XXXX XXXX ( now XXXX XXXX XXXX ). What is the NAME of the Lender, specifically the holder in due course of the contract? What is the name of the lender that claimed it suffered a loss and therefore having authority to real estate, land and building, immovable property? Please require someone having authority to act in the capacity of an officer answer under penalty of perjury. And also, reveal the name of the employee whom interfered with my right to due process in obtaining the name of the lender? State the name and position.

Consumer Complaint: I bought my first home in my early XXXX 's and was financed with XXXX. XXXX went out of business and I ended up with Ocwen. I recall during my application process an Ocwen representative coming to meet me in person. He was a XXXX male with XXXX hair all combed backwards. I got a call once all my information was submitted to be financed and I was asked to change something on my bank statements by this individual so I could be financed. I said I didn't know how to do anything like that ; he then said he would do it. I get a call back days later that i'm approved and I signed for a 30 year term mortgage. I learn many years later that I'm in a 50 year term mortgage not a 30 year. Also my rate isn't fixed and I now pay over {$1000.00} more per month and the amount I'm paying per month is for a home double the cost of my home. I called Ocwen numerous times about this issue in past few years. I was referred to their affiliate XXXX to be refinanced but they will deny me over the phone and never provide written documentation of denial. I am the victim and fraud and predatory lending practices. I learned Ocwen has settled many of these claims but because I was living in other states in XX/XX/XXXX-XX/XX/XXXX I was never notified about this. Ocwen is presently giving me trouble with being paid for an insurance claim that I have sent them the check but they will not send me the money although all the repairs were completed. Presently I pay Ocwen about $ 4000/month for a home that was finance at XXXX. I would be willing to hire a forensic expert to review my documents to prove that fraud has been done.

Consumer Complaint: After a house fire that i had in XX/XX/XXXX, I had home owners insurance with Owen which I paid and they did not found this out when I had a fire. They reinstated my policy then charged me to send my money to me. They kept XXXX dollars. While I was fighting for my insurance in XX/XX/XXXX XXXX had a freak storm and with out my sup pump to empty my flooding house it was finished and was commend. XX/XX/XXXX Ocwen filed for foreclosure proceedings. I had in fact paid of my loan. In XX/XX/XXXX in the court of XXXX my loan was in fact paid in full and on XX/XX/XXXX it was drooped and they had to pay court cost and everything else cause they lied. So instead of reporting on my credit report as paid in full they said it was a charge off.I want this corrected. It is a shame how the treat veterans and everyone else.

The mortgage loan was initially modified by XXXX XXXX XXXX prior to being transferred to Ocwen Loan Servicing. I sent 3 mortgage payments to Ocwen Loan Servicing. After Ocwen Loan Servicing received the 3 payments they submitted fraudulent documents for me to sign to double my monthly payments, which caused my home to go into foreclosure. I was forced to moved out of my home after all of the harassing phone calls from Ms. XXXX XXXX. Ocwen Loan Servicing are monsters.
