Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: My mortgage initiated with XXXX XXXX XXXX XX/XX/XXXX, than transferred to Ocwen Loan Servicing. My last payment on the mortgage account with XXXX XXXX XXXX was in XX/XX/XXXX. The mortgage loan was initially reported as default by XXXX XXXX XXXX in XXXX XXXX. The delinquent status on the mortgage account would have matured in XX/XX/XXXX, seven years has passed and this mortgage account is still being reported to XXXX. Ocwen Loan Servicing has submitted fraudulent documents to XXXX in the investigation of this mortgage account. Documents from XXXX XXXX XXXX to contest Ocwen Loan Servicing will be submitted. XXXX allegedly conducted an investigation with XXXX XXXX XXXX. XXXX was reporting the account being as being charged off. I disputed this claim. I contacted the XXXX XXXX XXXX and did my own investigative due diligence and obtained an Obligation Summary letter on my account which actually had a credit of XXXX. Documents from XXXX XXXX XXXX to contest XXXX credit reporting will be submitted.

Issue: Attempts to collect debt not owed
Subissue: Debt was paid
Consumer Complaint: my mortgage has been paid off since XX/XX/XXXX through the bankruptcy of XXXX XXXX. Ocwen reported this to IRS that the debt has been paid in full. my property has a pre-foreclosure notice since XX/XX/XXXX and I sent Ocwen a " written request ' to justified the mortgage debts that balloons up to {$3.00}. XXXX. Today, XX/XX/XXXX, I received their response and have no intention to correct any errors on their records. Ocwen fraudulent misrepresentation is still continuing to affect homeowners of their deceptive practice of collecting a paid off debt. The XXXX XXXX penalty is not a deterrence for them to follow the government regulations, for Ocwen, it is still business as usual even though there was a pending lawsuit against Ocwen in Florida by CFPB, not updating their records through their use of technology that spits out incorrect information that damage homeowners as a whole. I can provide documentation to prove their misconduct. thank you.

Consumer Complaint: Ocwen put me on forced placed escrow, {$1100.00}, in XX/XX/2017. I completed the agreement with no late payment, with payment in full for an entire year, so my mortgage was supposed to go back to {$620.00}! XXXX payment was {$800.00} because the agent said there was some sort of " negative balance '' I still owed and once I paid that, which ironically was the final payment towards said " negative balance '', call back in a couple of weeks to make sure the process was completed. I called back, mid XXXX, to inquire. I was told there had to be some sort of evaluation to see if it would be accepted. I stated that I completed my end of the deal so my mortgage should be regular. Also, as a note included on my account was, my mortgage would continue to increase if I didnt take advantage of a refinance option with them. I would rather die than continue any relationship with this company. I spoke with an agent today who stated, all I had to do was submit a written request to be taken off of the forced placed escrow, and it SHOULD go back to normal, once I submit the {$470.00} that I owed for some other " negative balance '' that I had absolutely no knowledge of. I am currently paying {$800.00}, after a deduction, and a review of my account from mid XXXX inquiry!

Consumer Complaint: Hello, I certainly hope you can help me. This problem originally began as a foreclose. We had a mortgage with OCWEN. We tried time after time to modify our loan with no chance of it happening. This was back in XX/XX/2013. They kept losing our paperwork, thus leading to deadlines not being met. We never got to speak to the same person. We were struggling to pay our mortgage and we needed to remortgage it in order to keep our home. Something was always wrong with the documents we sent in or they lost something. They ended up encouraging us to do a short sale and we followed their advice to the letter. In the end, we lost our house to a foreclosure. This was our first house. We moved from XXXX to XXXX to be with family. A couple of years later we received a couple thousand settlement because they were sued. I am asking for OCWEN to remove their name and account from our credit report. That is it. We can't go back and get our house back. Yes, they should have helped us, they could have helped us, but they did not. They can remove this from our credit reports. It's the least they can do. Please help me.

Consumer Complaint: XXXX XXXX XXXX has violated the Debtors confirmed Bankruptcy Plan Docket XXXX in Case XXXX XXXX. XXXX XXXX XXXX proceeded with the violations until the loan was transferred to the new service company Ocwen Loan Servicing LLC on XX/XX/XXXX. Due to XXXX XXXX XXXX negligents XXXX XXXX XXXX transferred incorrect documentation to Ocwen Loan Servicing Llc See Exhibit J. Ocwen then proceeded because of XXXX XXXX XXXX negligent trying to collect discharged debt from XXXX XXXX. Mr XXXX XXXX contacted Ocwen after receiving the ( RESPA ) loan servicing transfer and noticing more errors on the loan and contacted Ocwen pleading for Ocwen to rectify the incorrect loan information only to be ignored by the loan servicing company over the phone and by fax this was a violation of the CFPB 1005.11 Procedures for resolving errors. Mr XXXX stay on course and determined to correct the loan forcing Ocwen to correct the issue by contacting the CFPB Consumer Financial Protection Bureau and filing serval complaints over a 12 month period. Ocwen did not responded to any of the CFPB complaints acknowledging the error of the negelinece of the pervious loan service company XXXX XXXX XXXX but did adjust the loan in XX/XX/XXXX to match the agreed reaffirmation agreement. Ocwen then proceeded to file a foreclosure on XXXX XXXX because the loan was behind on payments due to the incorrect data provided by XXXX XXXX XXXX. This action by Ocwen not pursuing any loss mitigation against XXXX XXXX XXXX was complete neglect of the debtors right.

Consumer Complaint: Previous Case # XXXX was closed for some reason - because Ocwen provided a response and explanation, however, my situation was NOT resolved and Ocwen 's response is completely incorrect. I am compelled to reopen another case. In an email from XXXX XXXX in the Ombudsman Office dated XX/XX/XXXX - It was stated that Ocwen was going to reverse all previous modifications completed on my account. It also stated that my Modification from previous servicer XXXX would be honored. Since then, Ocwen has completed two modifications on my account, however, none of these ever matched the XXXX monthly payment. It was still significantly higher. 1st Mod Completed/Executed in XX/XX/XXXX ( which is the one that was supposed to honor the XXXX Modification ) and 2nd Completed/Executed in XX/XX/XXXX. I was advised by Ocwen that if the terms were not satisfactory, that I could appeal and/or reapply for a new modification. All I ever wanted was for Ocwen to honor the exact terms of my XXXX modification. Yes it has since expired but it was never really honored to begin with. I applied for a new modification in XX/XX/XXXX and received a response back from Ocwen stating that I am denied because my " account is either 90 days or less than 90 days delinquent ''. Because of this letter, I went beyond 90-days delinquent and reapplied for a new modification in XX/XX/XXXX. I am now told that I am denied because I have " met the maximum amount of modifications allowed ''. On the denial letter dated XX/XX/XXXX, there was no mention of this. Upon opening my previous case with CFPB ( # XXXX ) - I began working with XXXX XXXX. XXXX advocated for me in trying to get the " Investor '' to agree to modify my mortgage account one last time. In an email from XXXX dated XX/XX/XXXX - it stated that my " account has reached the maximum number of modifications ( 3 ) allowed by the servicer but that he has reached out to the Investor to determine if an exception can be made to allow another modification. It was also verified with him via phone conversation that 3 is the maximum modifications allowed. I now realize that Investor approval was NOT necessary as there were only two actual modifications completed on my account. I was told just today by XXXX that allowing another modification was denied. However, I have not met the 3. I have only done 2 modifications so I should be allowed another. I also wanted to clarify a letter that I received from XXXX XXXX at Ocwen 's Ombudsman Office dated XX/XX/XXXX. Explaining all previous modifications done on my account - it states throughout the letter that X modification brought the account due for X through X installment. This is absolutely incorrect. As explained by my Attorney, upon my filing for Chapter XXXX - all delinquency gets placed in an " arrears '' account and payments made to my Bankruptcy Trustee covers that. Therefore, as of XX/XX/XXXX upon finalization of my Bankruptcy Chapter XXXX - I would have been due FOR XX/XX/XXXX. I had made all payments accordingly since filing. As already verified by Ocwen, in XX/XX/XXXX, previous Servicer XXXX had modified my mortgage in its entirety - so XXXXXXXX XXXX statements referencing " satisfying X through X payments '' - is an incorrect and basically MOOT point. RECAP : XX/XX/XXXX - I am delinquent {$24000.00} with XXXX. XX/XX/XXXX - I file for Bankruptcy Chapter XXXX - Approved by the Court. XX/XX/XXXX - I pay accordingly each and every month thereafter. XX/XX/XXXX - XXXX modified my Mortgage and therefore, I am no longer delinquent. The {$24000.00} goes away ( as it is in the modification ). My Attorney moves to convert to Chapter XXXX as a result of this. XX/XX/XXXX - Ocwen acquires my loan as if none of the above ever occurred. Yes Ocwen tried to modify my mortgage terms and rectify matters but they failed to honor any of the above. Ocwen won't allow repayment on my account as they say that I am protected by Chapter XXXX. However, my Attorney says that Court documentation proves that I have reaffirmed my mortgage ( regardless that Ocwen did not send me an actual Reaffirmation Agreement ) - and that Court document DOES allow Ocwen to work with me on repayment terms. Per XXXX, their hands are tied. This is not correct. Where I stand today is trying to get Ocwen, to modify me one last time - and as I see - as explained all above - I should be allowed this. Documentation is attached and referenced by asterisk. I am only attaching a few pages of back up - as I have 3 LARGE files of back up. I am hoping that the backup provided will suffice. I would love to provide more backup if needed and on request.
