Consumer Complaint: Im wondering what can be done about someone ( myself ) who went to a for profit school. I went to XXXX XXXX XXXX XXXX XXXX XXXX XXXX XXXX. Its no longer a school. When I was XXXX I didnt realize I was going to a school that was not accredited. I paid all my private loans in full. I tried contacting Navient loans but as you can probably guess they were less than helpful. None of my classes from XXXX XXXX can be transferred to a different school unfortunately. I would literally have to start from square one. I feel that this is fraudulent and not lawful. I paid {$38000.00} for a degree I can do nothing with.

Cease all illegal attempts to collect and communications ( see below ) XX/XX/2022 CEASE AND DESIST NOTICE OF DISPUTE I, XXXX XXXX, consumer, and natural person, am aware of all rights that I have, and which are protected by The Congress under the Fair Debt Collection Practices Act ( FDCPA ), and am disputing this alleged debt. Navient has violated my privacy and contributed to abusive practices, as I am a federally protected consumer under 15 USC 1692. As a third party debt collector, any debt being attempted to collect, the FDCPA requires that it is done so in a manner that is fair and equitable. Consumer Complaint: Dear Consumer Financial Protection Bureau, I am writing to bring to your attention my concern that Navient Solutions , LLC is unlawfully reporting to third party credit reporting bureaus in violation of several laws, including the Family Educational Rights and Privacy Act ( FERPA ) ( 20 U.S.C. 1232g ; 34 CFR Part 99 ), the Privacy Act of 1974, as amended ( 5 U.S.C. 552a ), and 15 U.S. Code 6801 ( a ). According to 15 U.S. Code 1681a, it is unlawful for a credit reporting agency to furnish a consumer report to any person, except as authorized by law. Additionally, under 15 U.S. Code 6805, it is unlawful for a person to furnish information to a consumer reporting agency if the person knows or consciously avoids knowing that the information is inaccurate. Furthermore, 16 CFR 433.3 and 16 CFR 433.2 require that all credit reporting agencies take reasonable steps to ensure the confidentiality, accuracy, and security of the information they report. I believe that NAVIENT has violated these laws and regulations by unlawfully reporting my personal information to third party credit reporting bureaus. I request that the Consumer Financial Protection Bureau investigates this matter and takes appropriate action to ensure that Navient Solutions , LLC ceases this unlawful activity and is held accountable for any harm caused by its actions. Consumer Complaint: I pled to have the XXXX days late payment status on both loans removed from my credit report. I was under the impression that the loans were still in deferment. I received a credit alert in XX/XX/XXXX that the loans were XXXX days past due. I was unaware that the loans had entered the re-payment. In XX/XX/XXXX the federal government entered student loan repay pause due to the Covid crisis. After several extensions the pause is extended to XX/XX/XXXX. I feel that the XXXX days late status is in error. It has made a very negative impact on my credit which is preventing me from closing my house. I have worked hard over the past few months trying to improve my credit score. This negative impact on my credit score, has caused me stress and anxiety. The housing market is unfair for minorities, and Im requesting removal immediately. If this matter is not resolved, I will have to reach out to an attorney to help get it rectified. Ive made several attempts to get Navient to resolve this matter. I was told theres nothing they can do.

Consumer Complaint: In XX/XX/XXXX, I was notified that the in-school deferment of both of my loans serviced by Navient would expire at different points in XXXX. I knew that this information was incorrect according to previously agreed upon terms of those loans, I was eligible for 48 months of in school deferment. In school deferment for both loans were first applied in XX/XX/XXXX and therefore should not expire until XX/XX/XXXX, without even considering a grace period. From XXXX to mid XXXX, I have contacted Navient in every means possible to try to update and correct this information. They have failed to do so. But over the course of several months, they have offered a variety of different reasons why they are unable to look further in this matter. Several times, I have been told that the reason for upcoming expiration is because in school deferment had been used under a previous loan provider. This is not true. So I have asked for evidence of their claim. They are not able to provide any. At one point, I requested the documents to them by the previous loan provider. They did send this to me. It is clear based on those documents that they have access to, that there was never in school deferement applied to the loans prior to the date that Navient started servicing the loans. They also, likely have access to the original promissory document that stated that I agreed and started paying back the loans immediately when they were disbursed the only other time that I was in school from XXXX to XXXX. For some reason, Navient is under the impression that when I was originally in school prior to XXXX, I had in school deferment applied to my account. I did not. Perhaps this is an human error that has happened somewhere over the years but since this has been pointed out nearly 90 days ago, Navient has been unwilling to rectify this issue. The documents that I attached are a portion of the batch of of files that Navient sent me. They are the previos lender account history. The months attached reflect the only other time that I was in school XXXX to XXXX and it is clear in these documents that I has being billed and paying my student loans. In school deferment was not applied to my account then.

The student loan payment pause is extended until the U.S. Department of Education is permitted to implement the debt relief program or the litigation is resolved. Payments will restart 60 days later. If the debt relief program has not been implemented and the litigation has not been resolved by XX/XX/XXXX payments will resume 60 days after that. We will notify borrowers before payments restart. The caller then stated that I had a past balance and we could work out a new payment plan. The caller never validated that it was indeed XXXX XXXX by asking for my social, birthday or address until I brought it up to her that she never validated who I was. She stated because she called me she didnt need to. I explained to her that anyone could have my phone and answer it and this was unlawful and then she asked for my address. Consumer Complaint: I was in a XXXX XXXXXXXX bankruptcy which just concluded. During the last 7 years I made payments totaling about {$80000.00} to Navient. The checks were all cashed but never applied to my account. I have made 3 separate requests to Navient to resolve this matter including providing written proof of payments to them showing their checks were cashed by them. My first request was not responded to. When I called I was told they could not read my documents I submitted. My second request was then escalated by a call center agent. Response received was a letter showing me the payments that were applied which did not include the payments I made. I already understand what Navient has applied to my account I need someone to take this seriously and actually do some research as to where the money had been applied. My 3rd request was resubmitting the documents showing my payments. No response.

Consumer Complaint: Per 15 USC 6805 and FCRA and as a federally protected consumer, I am opting out of any and all authorizations reporting of my personal data to anyone without my prior written consent. Any further sharing of my personal data will be in violation of my rights under the Privacy Act of 1974 and copyright protection. My right to have a fair and equitable consumer report has been and continues to be violated by DEPT OF EDUCATIONXXXX XXXX In addition to the above complaint, per 15 U.S CODE 1681 ( b ) PERMISSIBLE PURPOSE OF CONSUMER CREDIT, I did not give permission to report on my consumer credit. XXXX & the listed creditors and alleged debt collectors is in violation of the law. Under 15 U.S code 1681- Permissible purposes of consumer reports. a ) general subject to subsection ( c ) any consumer reporting agency may furnish a consumer report under the following circumstances and no other 2 ) in accordance with written instructions of the consumer to whom it may relates. I did not give any written instructions to furnish my transaction history on my consumer report and furthermore the FCRA 15 U.S. Code 1681a - definitions ; rules of construction SO EXCLUSION from a CONSUMER REPORT containing information solely as to transactions or experiences between the consumer and the person making the report. You ( DEPT OF EDUCATIONXXXX XXXX ) are not upholding your grave responsibilities with fairness, impartiality, and respect for my right to privacy in the vital role you assumed in collecting, storing, assembling, and sharing an accurate and equitable consumer credit profile on my behalf. This is MY consumer credit profile and reporting inaccurate information is a discriminatory practice and is prohibited pursuant per the Equal Credit Opportunity Act. Your failure in responsibilities includes but not limited to, a violation pursuant 15 USC 1681a ( 2 ) ( a ) ( I ) - XXXX, XXXX and XXXX continues to furnish reports containing my transactions histories, debt utilization, payment history, inquires, and credit card balances are a few examples of transactions and experiences. A violation pursuant 15 USC 1681c ( a ) ( 5 ) - any adverse information shall be excluded from the consumer report. I signed a privacy form, which indicated that my student loan servicer would provide my transaction history to any 3rd party company, therefore these must be deleted. My consumer report is a form of communication and advertising my transaction history is an attempt to coerce payment of the alleged debt. The provisions of 15 USC 6801 ( a ) this requires financial institutions to notify consumers of their information sharing practices and provide a right to opt out of certain sharing. I never received an opportunity to opt out of notice from DEPT OF EDUCATIONXXXX XXXXXXXX. As a violation of 15 USC 6802- you ( DEPT OF EDUCATION/ XXXXXXXX ) communicated my nonpublic personal information to unaffiliated 3rd parties without my consent and without giving me the opportunity to direct such information not be disclosed. All of the information contained in my consumer report is nonpublic personal information unless I give you permission. DEPT OF EDUCATIONXXXX XXXXXXXX are also in violation of 18 U.S.C 894 for using my consumer report with extortionate means as a way to coerce and swindle me into making payments on alleged debt not owed. I DID NOT AND DO NOT CONSENT to you DEPT OF EDUCATION/ XXXX furnishing this information to my consumer report. I did not give you authorization or permission to have my personal identifying information, which you have obtained by aggravated identity theft in accordance with 18 U.S.C 1028A. Per 15 U.S CODE 1681 ( b ) PERMISSIBLE PURPOSE OF CONSUMER CREDIT regarding inquiries, if the accounts are not open on my credit report all inquiries will have to be removed ; please provide documentation that you used to verify that the inquires ( i.e. promotional or otherwise ) are open accounts with the creditor. Please be advised that I dispute the validity of the listed alleged debt in its entirety. I request a copy of a contract or agreement signed by the alleged original creditor and all parties to any such contract provided. Be advised that a billing statement, notice or any unsigned document is not verification of the alleged debt. You are on notice that you are unlawfully attempting to collect the listed alleged debt. Consumer Complaint: Today, I called Navient today and spoke to a representative named XXXX. I called regarding being apart of the settlement. She said if I dont receive anything by the end of XXXX to call. She said someone would call me today about an application. I was confused until she said Navient would pay {$38000.00} and I would pay {$2700.00}. The plan is {$270.00} twice and {$59.00} over 36 months but I would have to make a payment that day or the settlement would be void and would be put in collections/default. I told her my account is already in debt consolidation so they will be paid. She said she did not care and it wasnt in collections even though it was sent to collections in about XXXX? She then threatened my SSDI by stating if its not paid, Navient is allowed to garnish my SSDI. My SSDI is all I have for income. I have it in debt collection for a reason. I have a witness who overheard the conversation : XXXX XXXX. If she takes my SSDI then XXXX be homeless and wont be able to survive. She didnt ask my income into consideration until I said something and told her that I would only live on {$800.00}. She said well this is the only payment plan I can offer for the settlement. I told her I would rather just the check and she just hung up on me without discussing the second settlement since we figured the address for the Navient settlement. I feel like I am going to lose my benefits.
