Consumer Complaint: Navient is reporting negative information in a form of late payments to the consumer reporting agencies ( XXXX, XXXX, XXXX ) in reference to me as the consumer. Pursuant to 15 USC 1681s-2 ( a ) ( 7 ) ( E ), no federal law under the Fair Credit Reporting Act requires a financial institution to furnish negative information about a consumer to a consumer reporting agency. As a financial institution, as defined under the XXXX XXXX XXXX XXXX Navient failed to perform their obligation to respect and protect my privacy. Navient failed to provide me an adequate opt out notice and Ive NEVER granted Navient any lawful consent to disclose my nonpublic personal information to any nonaffiliated third party pursuant to 12 CFR 1016.7. By willfully reporting negative information to the consumer reporting agencies WITHOUT MY CONSENT constitutes as a form of punishment to defame my character. Navient actions are identified under 18 USC 894 for knowingly participating in any way, or conspiring to do so, by using extortionate means to punish me as the consumer. Consumer Complaint: I have contacted Navient on XX/XX/XXXX And advised of my refusal to pay the private loan debt according to my rights under the Fair Trade Commission 805 : c. I have requested that communication cease amongst myself, co-signer and other acquaintances. Since my request I have been unlawfully contacted by Navient on XX/XX/XXXX and XX/XX/XXXX. My rights are being violated by Navient once again. Please have Navient cease all contact according to ftc.gov code 805 : c ( c ) Ceasing communication If a consumer notifies a debt collector in writing that the consumer refuses to pay a debt or that the consumer wishes the debt collector to cease further communication with the consumer, the debt collector shall not communicate further with the consumer with respect to such debt, except -- ( 1 ) to advise the consumer that the debt collector 's further efforts are being terminated ; ( 2 ) to notify the consumer that the debt collector or creditor may invoke specified remedies which are ordinarily invoked by such debt collector or creditor; or ( 3 ) where applicable, to notify the consumer that the debt collector or creditor intends to invoke a specified remedy. Consumer Complaint: I have my loans through Navient. I've been paying student loans for many many years ( I graduated from XXXX in 1999 ). I remember my loans were need-based, and they changed hands many times. I think they began as federal loans then went to XXXX XXXX and now Navient. I can't remember exactly because it was so long ago! Anyway, when it came out in the news that Biden had plans to " forgive them, '' I was excited, as I still have over {$4000.00} left to pay. I was always an A-student, graduating with a GPA of over 3.9, so it seems strange to still have such a debt from a school in my home state! Anyway, I had tried to contact Navient to ask if my loans were eligible for forgiveness and the pause. They are categorized as FFELP loans. I was on hold for a very long time. Finally I got somebody who made it sound like mine would be forgiven because they are federal, and they said they would give me the pause. I hung up from that conversation with high hopes. I assumed that the forbearance I was offered was what Biden was talking about, a pause until the end of XXXX, by which point eligible loans would be forgiven ( I had filled out a federal application for forgiveness and it was approved- but this doesn't necessarily mean I am eligible ). Later I would get an email from Navient with my next bill for the following month! I had already paid in XXXX for my XXXX due date, and now I had a bill for XXXX! I tried calling them but couldn't get through. That's when I began to email them from their website. The response I got didn't make sense. It insisted I did have a forbearance and ignored my points about the bill dates. I went back and forth a couple of times to no avail. Long story short, I ended up paying for each month through now ( once I paid a double bill because I was waiting to get this resolved, but it wasn't ). So there was no real forbearance! I am concerned that because my loans are through Navient, they won't be forgiven. I had read something about " Direct Consolidation '' but that was confusing ( even the term " consolidation '' threw me off- I only have one loan so how can you consolidate one thing- it doesn't fit the definition of the word ) and I wasn't in the country at the time, and trying to get through to Navient isn't straight-forward. I found out there was a deadline for that, and I missed it because of communication problems with Navient, plus originally they had made it sound like I was all set. It's not fair if I missed the Direct Consolidation deadline due to this confusion- I don't know why there had to be such a short deadline in this mixed up period of time. So I continue to pay my monthly bills as usual... I am very concerned I'm going to miss out on forgiveness even though I am the perfect candidate for it!

Consumer Complaint: Since XXXX my student loan payments have been ~ $ XXXX per month. Suddenly in XXXX I got a letter from Navient stating that my payments were being adjusted and now they are {$50.00} per month. The letter said this : " You are currently receiving or are eligible to receive an interest rate discount benefit ( e.g., XXXX XXXX ) on your student loans. However, your Monthly Payment Amount was calculated using the loans original interest rate potentially making your XXXX XXXX slightly higher than necessary. " I have been enrolled in autopay for as long as I can remember, so my questions is why is it ok that Navient was charging me a higher interest rate for so many years by not applying the autopay discount? Shouldn't I ( and other borrowers ) recieve compensation for the years of overcalculated interest?

Consumer Complaint: I am writing to make you aware of ongoing problems I have experienced with Navient Private Student Loans inaccurately reporting delinquencies to credit bureaus, lacking any reasonable process to resolve these errors, and being generally unhelpful with regard to these issues. As a first generation college student from a modest background, it was necessary for me to take out PRIVATE student loans, in addition to public ones, in order to pay for my Master's-level education. As you know, private student loans are not impacted by any of the student loan relief programs that were ( thankfully ) enacted by the XXXX administration due to the pandemic, and monthly payments have been required for the duration of that time period. Like many others, I struggled financially during the pandemic due to a job loss, and was barely getting by doing freelance work. I am also a single parent solely responsible for supporting my teenage daughter. Navient put me on a " rate reduction '' program for both my private loans during this time period, under which I pay reduced, interest-only payments for XXXX months, at which point my eligibility for the program must be re-evaluated. If I am delinquent at the time I start the program ( I believe delinquency may be a requirement for enrollment but I'm not entirely sure ), I have to make XXXX on-time payments before my credit report is corrected. This means that the loans in question have to show XXXX days overdue before they are corrected, provided payments are made. The problem is, Navient promises to correct this information, and never does. Having recently obtained a full-time, staff reporter position at a news publication, I feel like maybe I can actually look at buying a house in the next year, so I recently took a look at my credit report. Navient reported me 60 days delinquent for XXXX of the private loans THIS MONTH ( XX/XX/XXXX ), despite automatic payments for both loans going through my account successfully this month and in recent months. I called Navient to correct this issue today ( XX/XX/XXXX ) and was told their system shows that I owe more per month than what they are charging me.?? This is not the first time this has happened -- the last time I had to call to request a correction was just XXXX months ago ( XXXX XXXX ), when an identical error occurred. Furthermore, I have delinquencies between XXXX and 120 days for XXXX loan or the other on my credit report for XXXX through XXXX of XXXX, XXXX through XXXX of XXXX, and XXXX of XXXX. All of these instances occurred when I was on a rate reduction program and required to make XXXX consecutive payments in order to have the delinquencies corrected, but this never happened. When I mentioned these instances today, I was told by the person I spoke with ( XXXX XXXX XXXX, # XXXX ), that I would need to WRITE A LETTER to their dispute XXXX department in order to have these errors corrected. It is unbelievable to me that Navient does not have a more efficient process for rectifying these errors, especially for the ones occurring over the last 12 months. I don't think I've had to use snail mail for anything other than personal correspondence for at least a decade. These recurring errors negatively impact people 's financial prospects, and lead to someone like me, a single parent with a stressful full-time job, having to spend hours on the phone and WRITE LETTERS to resolve them. It seems that Navient should consider overhauling its systems to dramatically reduce the frequency with which these errors occur, and a much more efficient and rapid system for resolution should be implemented for when they do occur. I was also informed by the person I just spoke with that Navient 's private loan rate reduction department " has been dissolved '' which concerns me in terms of how these issues will be handled in future. I am seeking efficient and timely correction of the errors on my credit report related to private student loans serviced by Navient, and for errors of this nature to cease occurring, so I can begin the process of looking at purchasing a residence for myself and my daughter. I appreciate your time and attention to this matter.

Consumer Complaint: I borrowed {$15000.00} in a private loan from Navient on XX/XX/XXXX to prepare for the bar exam. Unfortunately, my husband and I had to filed XXXX XXXX bankruptcy in XXXX. During the XXXX years of my bankruptcy, my trustee made XXXX payments on my behalf to Navient totaling {$12000.00}. Instead of discharging the remainder of my private loan debt in bankruptcy, Navient put me in a long-term forbearance claiming I now owe them over {$26000.00}!! Navient claims that the Texas lawsuit prevented them from collecting on private loans and that they are entitled to charge this interest. I had hoped that my remaining debt would be XXXX in the XXXX class action lawsuit. However, my state was not included in the suit. I am hoping your office can help me reach a fair settlement and payment plan with Navient. It seems very unfair that they are making me start all over on payments on a debt that was nearly paid for. Any assistance you can provide would be greatly appreciated!

Consumer Complaint: In XXXX I was served with a lawsuit to garnish my wages after asking XXXX XXXX to combine my loans into XXXX. I was sued for XXXX loans. I hired a lawyer. We set up a payment agreement on all loans and I've never missed a payment. Around XXXX a different creditor pretended I had no agreement and tried to sue me again. I showed my paperwork and my payment history. Around XXXX this happened for a XXXX time. At all points when creditors tried to change I showed my agreement and never missing a payment. Finally those loans are gone. HOWEVER when I log into my navient account I see an account that I was never served, never once discussed and I XXXX in XXXX. So surprise there is a XXXX loan that was never once mentioned in any documentation. When I log in and saw this I tried to continue my payments but creditors have returned payment. When i log into Navient website to pay for a mystery loan, I made XXXX payment and the payment button was XXXX. I don't even know what it is. I don't know why in XXXX years this was never discussed with me ; I was never served ; I have no knowledge of the mysterious XXXX loan that is still showing up on my account. I don't even know if it's real or just some other manifestation of the loans that were paid off in full. The company doesn't explain. I want this XXXX loan XXXX for time alone. I was never notified of its existence in XXXX years despite how I was threatened to take to court 3 times over student loans that I had every payment documented.
