Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: On XX/XX/XXXX XXXX was debited from my checking by Navient through an electronic check ; the check noted " Verbally Authorized by Your Depositor ''. While Navient has my permission to obtain electronic monthly payments from me on the last day of every month, for a calculated payment, mine for the past six since months ( since XX/XX/XXXX ) has been XXXX. I never received any correspondence informing me my payment was going to increase. I went through this same dilemma back in XX/XX/XXXX when they charged me {$700.00} without informing me of the changes. While they did refund me for that incorrect amount at the time, it was painstaking. While I have confidence they will also refund me this time around, I am so angered that anyone should have to go through this in the first place. They continually fail to inform borrowers that their payments will be changing and for how much ; it has to stop. I am taking this action today as it is really the only action I can take on a Saturday. This transaction was posted to my account on a Friday evening and I have been unable to resolve any issues with Navient as they're closed over the weekend. I attempted to make headway with my personal financial institution but their dispute department is also closed for the weekend. I am requesting three things : First, to be refunded in the total of {$590.00} immediately. I never received any correspondence for monthly payments increasing to the deducted amount. My permission, verbal or otherwise, to be charged for {$590.00} was never obtained by the company. If, after the fact, Navient tries to inform me that an IBR plan expired and I did not complete the required paperwork, I will note that I never received correspondence about an IBR plan expiring, nor about what my new monthly payment would look like. My second request is to be sent correspondence at least 60 days prior to a plan expiring that contains detailed information on how to renew and/or extend your plan. Finally, Navient should never be allowed to charge a borrower anything other than what is reflected in their monthly billing statements. If Navient has intent to the aforementioned, then I am requesting for notification at least 30 days in advance to when a fee will increase, explaining why, and listing in detail what actions the borrower can take if they are unable to afford to make those payments.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: My loan is a parent plus loan with Navient. Loan # XXXX. The loan was originally consolodated for 30 years. I asked Navient to refinance for a shorter period of time and they told me I couldn't. Additionally I've noticed throughout the loan that they keep adding a thing called " capitalized '' interest. Nobody has been able to explain to me what that means. They are adding interest to my loan on a daily basis and periodically adding lump sum interest amounts to the loan. I've been paying on the loan for 2.5 years and my loan amount has gone up instead of down. I applied through student loan.gov to refinance the loan and change service companies. Navient blocked by ability to go with another service company. I had chosen XXXX. Instead they changed my loan to a 12 year payback. I had requested a 10 year payback with XXXX. I'm attaching the document so you can see how my loan terms have changed in just the last 30 days. Additionally on XXXX XXXX it showed my unpaid interest was {$480.00}. I made a payment of {$490.00} thinking they would finally apply a partial payment to the principle. The next day they added {$3800.00} in " capitalized '' interest therefore negating any money being applied to the principle. As of now I have not had {$1.00} applied to principle in 2.5 years. I called Navient and asked for an audit of my account with a printout of my accumulated interest for 2 years. I told them I did not want a generic letter. I did not get the audit and instead got a generic letter advising how they calculate interest on a loan.

Subissue: Received bad information about your loan

Consumer Complaint: In XXXX of 2018 Navient agreed to a rate reduction program. Come to find out it was " processed incorrectly '' Went thru the footwork again in XXXX of 2018 for the rate reduction program. Have since received numerous notices about delinquencies while they were automatically withdrawing payments from the checking account. Each time customer service was called, no one knew anything about the rate reduction program. Part of the rate reduction program says it would take effect after 3 consecutive payments. Because the program wasn't processed correctly originally, the first payment didn't count. They did an automatic withdrawal for XXXX and XX/XX/2018. They did not automatically withdraw XXXX 's payment and then came looking for payment as if to purposely force a default on the loan, so they wouldn't have to keep up their end of the deal. They have also put thru a forbearance, that was never asked for or applied for, and have not reduced the rates as promised. Every phone correspondence I have gotten the runaround and harrassed about paying more money. Every agent I have spoken with says " Well I don't know what the last person said or did, so I can't help you. '' The loan has continued to accrue late fees eve though I have kept up with my end of the agreement. I believe I have been misled, lied to, and taken advantage of.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: Navient is continuing to stick by the lie that they attempted to notify me about my deferment and forbearance periods ending. They never did, until my loan was almost in default. Then of course I responded immediately, as I would have if they actually would have attempted to contact me in any way, shape, or form. I believe they deliberately denied me information and avoided contacting me as long as possible to maximize the amount of interest on my loans.I had the same loans previously with Sallie Mae, XXXX, XXXX XXXX XXXX XXXX, and XXXX/ XXXX XXXX XXXX and never once had a problem with a late payment or communication issue. It is only when my loan was transferred to Navient that I began to have problems. Not a single phone call, automated or not, to me until I was almost 180 days past due, when I know I should have been in forbearance or had a XXXX payment due to my income based repayment plan. Seriously if Navient the only option available to you, it is best to flip burgers. You'll likely come out ahead in the end, read any other complaint listed here or just search for news articles about them on the internet. They are not difficult to find.

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I called Navient to see about getting a deferment or forbearance for my student loan with them, as I lost my job due to layoff in XXXX and my unemployment has run out. I initially called on XX/XX/XXXX but was told they won't even speak to me about this until a payment is due, with my last payment having been made on the due date of XX/XX/XXXX. I called back on XX/XX/XXXX as I now had a payment due and was told that I could not get a forbearance without first paying a fee of {$50.00} per 3 month period of forbearance. I explained I can not afford this as I have no income and they ultimately suggested I speak to someone about payment options and I was transferred. After reaching someone in collections, I was asked a series of questions to determine eligibility. When we reached how much can I afford to pay a month, I answered that I can't afford a payment as this time as I have no income and I also have other obligations, such as my rent, car payment, and phone payment, all of which are necessary for me to obtain a job. I was told at that time that, since I can't afford a payment, they can do nothing for me. I requested to speak to a supervisor ( XXXX ) and explained I have no income, I can not predict the future and determine when I will be able to make a payment ( they specifically asked when I could pay ), and that I have other financial matters which take a priority. He stated that the {$50.00} for a forbearance serves as a " good faith payment '', to which I asked what about my years of making payments on time every month, to which he replied that past payment history has no bearing on these matters. They further stated that there was nothing they would do for me. I pointed out that my other loan providers were able to assist me when I explained my situation to which he replied " Well, we're not you're other loan providers ''. I informed them they could disconnect the call so I could take their survey at which point he replied " this is the collections department. There is no survey. '' I specifically stated that this was a matter of a financial hardship, that I have other financial obligations, and that I am working to resolve this hardship by actively seeking employment, and still they would not do anything to help with the matter.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: Navient acknowledges that I am completely and XXXX XXXX and I have received a federal student loan discharge based on that ( the discharge monitoring period for that ended XXXX of XXXX ). I have no income and no assets and am in the process re-applying for SSI. When I applied for TPD relief with Navient for my private students loans, they " restructured '' some of my loans, but the payments are still completely unmanageable ( over {$200.00} per month ). I've repeatedly asked them about at least lowering my payments and am told this is impossible. Being completely unable to pay them, at this point I am going into default and my credit is trashed. I filed for bankruptcy in XXXX, but the legal aid company I used does not do adversary proceedings and so could not address the student loans. I currently owe Navient {$27000.00}, with about {$1500.00} of it being past-due. I have 4 loans : 2 were dispersed in XXXX at XXXX University, one in XXXX at University XXXX XXXX, and one in XXXX at University XXXX XXXX XXXX. Navient says I became legally XXXX in XXXX, before taking out the final loan, so they don't consider that to be included under TPD restructuring options.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I've been dealing with navient for several years now. When I've called to get any kind of help with my loan payments to either try and lower when they were close to 500.00 per month to just making a simple payment they stick to script and will not budge. They always incite by laws in the agreement that gives them complete control over the loans and leaves me with few options. Based on the current lawsuits against Navient I can not help but feel me and many others have been taken advantage of. Just one of the five loans I have began at XXXX and I am at XXXX after several years of paying.
