Consumer Complaint: I took out a student loan with Sallie Mae ( now Navient ) for my son attending XXXX University on XXXX. The end date is XXXX and the principal amount was {$44000.00}. XX/XX/2022 I received a letter from Navient informing me that the monthly payment decreased from {$270.00} to {$180.00} because they had overcharged my interest. I contacted them on several occasions to see if they could apply the interest amount that I overpaid to the current balance of the note and they declined. The overpayment is {$84.00} per month and if I paid through XXXX, that amounts to {$14000.00}. I want the interest taken off of the principal but I didn't get anywhere with Navient. Additionally, I paid off another student loan with Navient for my son attending XXXX and I'm concerned that I overpaid that interest too, but they never informed me. Please help me to resolve this issue.

Consumer Complaint: My name is XXXX XXXX and I am writing to you today to file a complaint against Navient. I called Navient on XX/XX/2023 at XXXX XXXX. The purpose of my call was to notify Navient that I am invoking a defense to repayment of the loans because the school I attended, XXXX XXXX XXXX XXXX XXXX ( XXXX ), defrauded me and for this reason I will no longer be making payments on my private student loans. The response I received from the Navient Customer Service representative when I called was that the loans are still in repayment, that they arent government loans and so do not qualify for forgiveness due to an institution being discredited. The Navient representative did not provide any other information in response to my asserting of this complete defense to repayment. I sent a written summary of this call by email to the general Navient account as well as to the Navient office of the Customer Advocate. I received a response from the XXXX XXXX XXXX XXXX XXXX dated XX/XX/2023. ( I have attached a copy ). In this letter, the Customer Advocate XXXX XXXX explained, among other statements, that private loans are not eligible for the Department of Educations Defense to Repayment Discharge Program. I believe there is a problem with this response and there should be a process for providingme with more information and relief. Further, since making this call they have emailed me twenty two times with payment reminders despite my defense to repayment. Having attended XXXX has left me with significant debt and a worthless degree, leading among other harms to financial and emotional distress. I lived for years with my family to ensure I could make payments and could not afford my own home. I have had to pay exorbitant interest rates all while the school XXXX was cited for numerous legal violations, leading to closure. One of these loans can only prove I took out XXXX, they claim the school called to request to add funds but have no paperwork to corroborate that claim. I now owe around XXXX on that loan. I have already paid a total of XXXX on that loan. The other loan is also predatory. I took out XXXX, have paid XXXX and still owe XXXX.

Consumer Complaint: Navient is reporting a 90 Day Delinquency in XX/XX/XXXX when the account was covered under the Federal Covid Relief Program established XXXX XXXX. The loan origination was established as a federal loan in XX/XX/XXXX, which covered the account 's payments, interest and collections activities under the Covid Relief Program. Navient has refused to acknowledge the loans origination as a federal loan and instead validated their actions by stating the loan was a private loan, therefore was not covered under the Covid Relief Act which was not true. It has been requested by myself that Navient validate their claim by providing the original loan Promissory Note to support their claim and has failed to comply. XX/XX/XXXX is also reporting 90 days by Navient and the account was under a Hardship Deferment as the other two loans 1 and 2, which was also managed by Navient through a acquistion of XXXX XXXX profile loans.

Consumer Complaint: Navient lost their class action lawsuit. I called to find out why I wasn't being updated when I signed up for the suit. Navient claimed they couldn't find me under my current name or my previous name ( XXXX XXXX XXXX, by my SSN, or anything. I told them I went to XXXX XXXX XXXX XXXX, which was bought out by XXXX before I had finished my first year, then XXXX was bought by XXXX XXXX a few years after I graduated. Navient told me that they didn't include loans taken out by students while they attended XXXX and even though their records showed I had loans while at XXXX, I was left out of the lawsuit because they never updated the records when XXXX was bought by XXXX. This is wrong. I don't think they didn't update the records based on the hundreds of phone calls I received from their collections dept. They always referenced XXXX. Navient knew, and they intentionally omitted me from the settlement. I honestly think it was because I had been fighting them since XXXX. I'm so tired of fighting them. Every dispute, every claim, everything has been denied by Navient and their denial has been accepted as truth, even after they lost a massive class action suit regarding their student loan practices. You can look back at my last two complaints about Navient to see all of the details as to why I signed up for the class action suit in the first place. I never would have if my experience didn't align with the lawsuit allegations. They're still on my report, I can not see past XXXX but the collections started well before I graduated in XXXX. Just based on that alone, " missing '' payments prior to graduating, puts me well past the 7yr mark from the date of the first missed payment, which means Navient should be removed from my credit. But when I dispute with the credit bureaus, they ask Navient and Navient says they didn't do anything wrong ( the lawsuit allegations say otherwise ), and the credit bureaus deny my claim. I'm tired, I'm so tired of fighting the one company that is keeping my credit score low and making it hard for me to obtain any future financing, re-financing, or anything. Please, please, please help me get them off of my credit. While I want to be re-paid for all the money I gave to Navient just to get them to stop calling me & my family numerous times a day for years without allowing forbearance or deferments or working with me on a realistic repayment plan, I'm not holding my breath. My husband, whom I hadn't even met yet when XXXX duped me out of XXXX of dollars and I XXXX 3 years before we met, borrowed from his 401k just to get Navient to settle and stop the harassment, the incessant phone calls to me, to him, my dead grandmother ( they'd call my number and leave a message for her ), the letters to me, my husband and my dead grandmother ( again, come to my address but her name on them ). 5 years ago, he did this, and he's still paying back his 401k to catch it back up. I don't even know how they got his name or phone number. My husband wasn't on any of my student loans and we filed our taxes married but separate. Yet, they started calling & mailing him regarding my loans. AND they got away with all of it by not updating their records to reflect the XXXX buyout and not disclosing that to the prosecution in the class action suit. I know I am not the only student from XXXX that has been financially & mentally hurt. Oh, and I contacted our state 's attorney general 's office involved in the lawsuit after I discovered this omission, but they said they couldn't help in this stage of the game.

These private loans were discharged in bankruptcy from the original borrower so now they have all been transferred to me-payments of over {$4000.00} per month. I can never repay this with interest rates of 14 %. If a loan is discharged through bankruptcy then it should be discharged!! Not transferred to me!! Please help!!

Consumer Complaint: I have repeatedly ask Navient to stop calling me because I do not owe this debt and am currently filing litigation. They continue to call me 2-3 times a day everyday even after sending this to collections. They have also called my Mother, sister, son, and former employer. In all of those instances they have stated they are calling for XXXX XXXX in regards to a debt. I know for a fact they are not allowed to mention a debt. They have also left messages with my mother asking her to call them back, and called her more than once. I also know this is illegal. Something needs to be done. They continue to harass me several times a day. I emailed them and told them to not call and they continue. I told them I have obtained a lawyer and it will be settled in court, yet they continue to call. The last woman called today XX/XX/24 and told me I was a liar and do not have a lawyer because I refused to give her information. I should not have to be called a liar on my own phone. I am following my lawyer 's advice and she tried to convince me I needed to do what she said. She basically told me I shouldn't listen to my lawyer.

Consumer Complaint: My private student loans are through Navient. These loans never went to me directly at the time at XXXXXXXX XXXX. I was frequently put into default/ forbearance without asking for forbearance. I have repeatedly asked to remove the cosigner 's from my private loans and been given multiple reasons they wouldn't. They said it is not in their best interest to remove a cosigner and I still have them almost 15 years later. I was granted borrows defense on my federal loans for my schools fraudulent practices but that does nothing to assist with the private loans they received. I had three private loans for a total of {$15.00}, XXXX. I graduated in XXXX I have paid on the loans the majority of that time. Having paid already double what I had borrowed with fluctuating interest rates and incorrect payment data I still owe an additional approximately XXXX dollars in private loans. What they claim to have received in total payments is not accurate based on payment history. I was in default for more than seven consecutive months being forced to make payments to prevent wage garnishments being told inaccurate information and for some reason was not included in the navient settlement. When going through their customer service and asking why I was not included in the settlement seeing as how I met the qualifications for the settlement they stated that because I had made a payment XXXX of XXXX it disqualified me and I had no further recourse and I have continued to make payments every month since then. I believe I should have been included in that settlement due to my loan status and I believe that navient coerced me. Based on the lawsuit that was posed against navient in that settlement any loan that had been in default or forbearance for seven consecutive months at any point prior to the issuing of the settlement was included. I request that my loans be evaluated for their qualifying factors in that settlement they be discharged and my payments be refunded. I was cruelly taking advantage of by a fraudulent predatory School that is created great financial harm since attending. I filed bankruptcy in XXXX however private student loans at that time were not included because I was not disabled. Navient upheld their private loans throughout my bankruptcy and the two years since. Navient refuses to settle the private loans unless your loan is in default this costs additional interest and fees.

Consumer Complaint: I have Private student loans through Navient which currently sit at a loan balance of {$66000.00} I am having several issues with this company. I have gone bankrupt twice. First time in XXXX and the second in XXXX. Both times I was told that my student loans could not be discharged without an adversary proceeding and proving undue hardship which I know to be almost impossible to do. I have a private consolidation loan that Navient has continued to collect on even though I went bankrupt. My dad is my cosigner on the loan who has also gone bankrupt in XXXX. I have continued to pay because I dont my dads credit report to be ruined. I have sent Navient my discharge papers and they wont respond. I have also requested all the information they have on the loan and they sent me the promissory note and the application which I had a lawyer look over and the lawyer said that it doesnt make any sense and that there is a lot of information missing. The lawyer called Navient with me on the line and requested that they send more info so we can figure out the origination of the loan. We spoke to a supervisor who seem very helpful and said that he assured me that he said a very large Manila envelope and I should be receiving it in the mail within the week. About a month has passed and I havent received anything and when I ask they are clueless. I am also a full class member of the Sweet v. Cardona lawsuit and my federal student loans are in the process of getting discharged. The school that I went to are XXXX XXXX and XXXX XXXX XXXX both of which are on the list of schools in the lawsuit. I have seen an article the CFPB has written about heightening its scrutiny against private student loan servicer on people who have gone bankrupt. I need help in figuring this all out. I am not sure if I am allowed to attach bankruptcy discharge papers which person info on it but will send upon request.
