Consumer Complaint: on XX/XX/XXXX we filed for XXXX XXXX bankruptcy Navient removed the debt from my credit report after the filing meeting of creditors was on XX/XX/XXXX, there were no objections raised by any creditors whatsoever. none even attended the call my credit report stays blank all thru XXXX and XXXX bankruptcy was discharged on XX/XX/XXXX with no contests or any exceptions whatsoever case number XXXX on XX/XX/XXXX or shortly thereafter, Navient re-listed the debt on my credit report, sent me a demand for payment, and began charging me interest and late fees this is a private student loan that was found to be predatory in nature. the loan is involved in a federal lawsuit AGAINST Navient for being unfair, and calling for it's discharge this debt should not be collected upon. it is a student loan for XXXX XXXX XXXX, which was found in federal court to have defrauded attendees and borrowers of federally backed student loans. the money was loaned to me by Navient, a company accused in federal court of defrauding and misleading me and thousands of others and trapping them in these private loans unfairly and with known collaboration with the education institutions to hike the prices and make the common person foot the bill

Consumer Complaint: My student Loan provider Navient has reported me XXXX plus days past due on my federal student loan. I was under the assumption that my loan was still in deferment as i was not notified otherwise. and I was also under the assumption that my loan was on hold due to the government placing loans on hold by the Biden administration. I reached out to them and they brought my account back current and placed it back in deferment due to hardship with no problem and the person that i spoke with said that the " late fees '' would stay on my account until my loan comes out of deferment that i did NOT need to make a payment until i started paying the loans back in XXXX. Now my credit report is showing a 3 time delinquency of {$160.00} dollars due to the late fees. I called again and they stated that I could send them a letter of dispute and they could resolve the fees. i sent the letter the same day last month and nothing has been resolved and now i can not get housing due to a late fee. Today I went into my account and paid the late fees because i have not heard back from them and did not know what to do.

Consumer Complaint: In XXXX, I took out a private loan for {$25000.00} through Sallie Mae. After deferments and switching to Navient, my loan went up to {$41000.00}. It doubled. I have called and spoken to Navient about the unfairness and illegality of this, and have had no luck. I understand accruing interest, but doubling a private student loan after 1 year in college is illegal. Currently, my payments are up to {$450.00} a month. I have called several times to get them lowered, to which they tell me I don't qualify for lower payments. I am a XXXX in an underpaid district, who also has federal student loans. I am also a mother of XXXX. I am struggling to get by. According to the Navient lawsuit settlement involving private loans, I should qualify for some forgiveness, if not all. 1. My private student loan was issued by Navient or its predecessor, Sallie Mae. 2. My student loans must have been disbursed between XXXX and XXXX. 3. My student loans must have been delinquent ( behind on payments ) for at least seven monthly billing cycles prior to XX/XX/XXXX. 4. I live in New York, which is a qualifying state. I am extremely upset and do not know what else to do. My next step is to seek legal counsel.

My loan was in forbearance for several years. Struggling to make payments due to my husband illness after he retired from the military XXXX. My salary at the time couldnt handle making school payments and helpi take care of our household. Therefore, the forbearance options help our family tremendously. I checked on the Studentaid.gov website to find out the total cost of attending XXXX. What I discovered was overwhelming to my eye site. The total listed was more than double the original amount of my loan. I contacted XXXX to request a copy of my account. XXXX email me the copy which indicated the amount of all my classes where {$20000.00} not {$70000.00} that is listed in on the Student Aid website. It is dates listed on the website that dont apply to me. Also, they switch my servicer several times, making my loans attached to different services. Last but not least, I believe XXXX was one of the schools that was in some kind of scandal with how they managed getting students to apply for tuition and/or allowing the services to grant students longer forbearances in order to gain additional money to that servicer.

Consumer Complaint: I have had private loans with Navient since 2007. In the 16 years I have had these loans, I have used up all of my forbearance allotment - I work for a Nonprofit and cant always make payments. I still owe over XXXX. I have been on interest only payments for a while. Interest only went from {$100.00} a month to almost {$200.00} a month very recently- without a reasonable or consistent explanation. I contacted Navient and was completely honest with them - I can pay no more than {$150.00} a month. There were XXXX options for me. I told them I would be forced to just not pay. Now they call me multiple times a day starting at XXXX. I talk with them for over 45mins at least XXXX a week, explaining the same thing over and over. They cant offer any solutions that work within my budget. And the calls keep coming. The company has no way of working with me to find a solution. They suggested that I apply to refinance with NaviRiFi which I did and I was denied a refinance loan - leaving yet another negative mark on my credit report. They offer no solution to my issue. please help.

This was to take effect in XXXX. Navient continues to demand payment, of which I had agreed to making minimum payments of {$75.00} per month. I inquired as to why my student loan is still being collected on after receiving notification stating that it would be dismissed and should expect repayment for a portion of the payments I have made in the past and was told my loan was from a private institution and doesn't qualify. I don't understand, after receiving notifications that I qualified, that Navient could state that I don't. I would appreciate a clarification as to why I don't. I meet all the criteria as outlined in the description of the lawsuit. What am I missing?

Consumer Complaint: Note : it is now my understanding that my Sallie Mae FFEL student loans from XXXX, and consolidated in XXXX in to one loan with Navient ( formerly Sallie Mae XXXX XXXX are now considered " private '' ( and not Dept. of XXXX. ). On XX/XX/XXXX, I submitted to Navient an XXXX recertification application that included all XXXX YTD income information, with documentation and explanation. This documentation clearly identified an IRS Form XXXX Gross Income projection for XXXX ( " something less than {$17000.00} '' ), and a most recent XXXX detail of Form XXXX Gross Income ( averaging $ XXXX, which would project to just under $ XXXX ). Both of these yearly amounts are well below 150 % of the federal poverty level required for XXXX. In a letter from Navient dated XX/XX/XXXX, I was informed my XXXX recertification had been declined because my " financial circumstances do not meet the federal definition of 'partial financial hardship ' required for Income-based Repayment. '' This is clearly an error. Since, to no avail, I have had several communications with Navient XXXX XXXX XXXX XXXX XXXX XXXX to address this error. On XX/XX/XXXX, I filed a complaint with XXXX XXXX and only just learned in the last week that my Navient consolidated loan is considered private and not, apparently, under the purview of StudentAid/FSA ( hence, my filing a complaint with CFPB ). In a letter from Navient dated XX/XX/XXXX, I was informed that Navient had somehow determined my XXXX to be {$38000.00}!? ( hence, the recertification declination ). Your assistance is greatly desired/needed.
