Consumer Complaint: My name is XXXX XXXX, and I am writing to you today to file a complaint against Navient. I called Navient on XX/XX/2023. The purpose of my call was to notify Navient that I am invoking a defense to repayment of the loans because the school I attended, XXXX, defrauded me. The response I received from the Navient customer service representative was that Navient could not help with this. The representative told me that it was an issue between me and the school, and the money was given to me in good faith and that it would need to be paid back. He said he spoke to his manager and that there was nothing on their end that they can do. I then sent a written summary of this call and asked for more information about what the representative said to the general Navient email account as well as to the Navient office of the Customer Advocate. On XX/XX/2023, I received a communication from XXXX XXXX, from the Office of the Customer Advocate ( I have attached a copy ). In the communication, XXXX said that theres no discharge program available at this time for students who claim a defense to repay a private loan due to misinformation or the quality of education they received at their school. Were not able to respond to any information or guidance provided by a customers school, financial aid advisor, or other financial advisor. You are welcome to review your enclosed Loan Agreements for any additional legal remedies that may be available to you. I believe there is a problem with these responses and there should be a process for providingme with more information and relief. In addition, I have also requested documents for Navient pursuant to California Civil Code section 1788.202 and section 1788.102. On XX/XX/2023, I requested ( XXXX ) A complete transaction history for the loan ( XXXX ) The name of the owner of the loan ( XXXX ) Any payments, settlement, or financial remuneration of any kind paid to the creditor by a guarantor, surety, or other party not obligated on the loan, if applicable ; ( XXXX ) Documentation establishing that the creditor is the owner of the specific loan at issue. including all assignments and written evidence of transfers of ownership. These assignments should include the account number, my name, and the date of each transfer or assignment. They must be the documents by which each creditor or assignee acquired the loan, and not prepared after the fact or in response to this letter; and ( XXXX ) A copy of all pages of the contract, application, and any other documents evidencing my supposed liability for the loan, stating all terms and conditions applicable to the loan. Navient responded to this request on XX/XX/2023. However, they only appeared to provide ( XXXX ) from above, a complete transaction history of my loans. They did not provide any of the information I requested on my loans ( XXXX ). Having attended XXXX has left me with significant debt and a worthless degree, leading among other harms to financial and emotional distress. The weight of the debt has limited my financial freedom, hindered my ability to pursue career and personal advancement, and created a constant state of stress and uncertainly in my life. My mental and physical health have diminished and I am always in a state of panic and fear. The consequences of attending a defrauded school extends beyond my own life and has had a profound impact on the lives of my co-signers, who supported me, further highlighting the far-reaching harm caused by such deceitful educational practices.

Consumer Complaint: I recently reviewed my consumer credit reports and noticed that I have two accounts with Navient that are both reporting inaccurate for the month of XX/XX/2023 for all three credit bureaus in which I were never late for. The reports are showing on time for all months prior to XXXX than 90 days late for month of XXXX. The stated accounts accounts XXXX XXXX- XXXX XXXX XXXX XXXX {$4500.00} Principal and {$2600.00} Principal Please investigate and provide proof that with statements that these payments were late. These two accounts can not report 90days late without first showing 30days and 60days late. I will like these two payments with this lender to be rightfully updated to paid on time as I were never late. Proof of inaccurate reporting is also attached.

However, Navient refuses to process any sort of forbearance on my student loan account and only refers me back to the DOE because they havent received any guidance on how to process the forbearances.

Consumer Complaint: The Department of Transportation has reported false information and statements regarding this debt. I was cleared for no wrong doing regarding this debt. I responded to the lawsuit to attend court and the Department of Transportation never contacted me or responded to my response and continued to look for money that I do not owe. This is a 3 year old debt and out of state. The incident this sent took place was in Michigan at the airport. Please remove this false allegations of debt owed off of my credit report and please ask this company to stop harassing me for debt that is not owed.

Consumer Complaint: My daughter took out 2 parent plus loans that Navient harassed me for an entire year bc my daughter wasnt paying them so I took those 2 loans totaling XXXX into my loans. My loans have never been late. Now, recently they have begun harassing me alleging i co-signed for these private loans for my daughter who I have not communicated with for 7 years. I KNOW I NEVER SIGNED FOR ANY PRIVATE LOANS. I HAVE REQUESTED A COPY OF ORIGINAL LOAN PROMISSORY NOTE AND ANYTHING WITH MY SIGNATURE. They have not complied. The loans were taken out XXXX XXXX before Sallie Mae was using XXXX. However, they must produce something with my signature for a private loan. If they changed the terms of my daughters loans and allegedly I am the co-signer, then they are required to notify me and I must agree to it. AGAIN, I NEVER SIGNED FOR XXXX PRIVATE LOAN AND THEY ARE REQUIRED TO PROVIDE PROOF OR REMOVE MY NAME FROM ANY RESPONSIBILITY FOR HER LOANS. THEY MUST PROVIDE ORIGINAL DOCUMENTATION TO PROVE LIABILITY ALONG WITH SOME SORT OF SIGNATURE. They stated it was XXXX but Sallie Mae was not using XXXX in XXXX and XXXX. My credit is being negatively affected now so I am going to sue for damages and attorneys fees. Please assist with Navient. They are seriously not following the rules.

Consumer Complaint: Spoke with Navient representative XXXX on today I informed her I could make my payment today. However, moving forward for the next three months I will not be able to make payments due to being out of work. She began asking me personal questions on who can help me make my payments such as my cosigner I told her she is not working anymore she is XXXX. She then asked me if the childs father can make the payment. I find this question so unprofessional and personal this is her second time posing this questions Ive never had a company go down a list of people to help you make payments as if I havent thought of that my own. Then she asked it my parents can help and I informed her they were deceased. She stated there is no forbearance or any program that can pause or stop me from making payments until after my three month leave period and I begin my job back. She told me maybe by next month I can have something figured out to make these payments I find them so unprofessional and insensitive every time I speak with this company. I dislike them they are the worst private loan company a person can have. I get upset everytime I have to answer their calls. They dont care about customers they dont accept payments a customer can make. They do everything like poke in people personal business but accept what they do have to give. They need to be shut down already all the lawsuits they have received in the last couple of years!

Consumer Complaint: Navient is claiming that I have declined repayment options. This is innaccurate and not true. I called Navient on Friday, XX/XX/XXXX and multiple times I explained to the two separate agents that I was wanting to move forward and explore my repayment options. The first agent, XXXX, declined to answer specifics about what they needed from me to bring the account current. Instead, XXXX started the conversation by laughing and behaving unprofessionally. When I asked again what my repayment options were, he asked to put me on a brief hold. A second agent, XXXX XXXX, came back on the line. XXXX gave me XXXXwo repayment options, but would not go into detail of what the future steps were. I simply stated to XXXX XXXX that I did not have the capacity to make a payment that day ( XX/XX/XXXX ) and she then began interrupting me and stating I had until XX/XX/XXXX to make a payment, repeatedly called me irresponsible, and also acted in an unprofessional manner and would not allow me to speak. She then ended the call by stating she would update my account and that I was refusing to make payment. As a result of that call, I made my initial complaint with the CFBP ( XXXX ) and this was the response to that complaint below : Thank you for reaching out to the CFPB with your concerns regarding your student loan account. We have reviewed your phone call with our Representatives on XX/XX/XXXX. While we understand your frustration, please note that the account was delinquent, and attempts were made to prevent delinquency escalation. Our review confirms that you were offered a roll back payment of {$490.00} and Hardship Forbearance that required a good faith payment in the amount of {$150.00}, but you declined these options. Unlike federal student loans, private student loan options vary by lender, loan program, and loan agreement. Some private loan repayment programs may be described in your loan agreements. Additional options may also be available at the lenders discretion. Options for private loans may include repayment programs, deferments and/or forbearance. Loan forgiveness and discharge may also be available for borrowers and families in the event of disability, loss of life, and certain other circumstances. We know financial challenges can come up unexpectedly, and we want to help you stay on track with your repayment schedule. Please give us a call if your situation should change. I did not refuse to make a payment. In fact, I have made a payment on XX/XX/XXXX in the amount of {$500.00}. Navient continues to not address my questions, complaints or concerns. Now they are inaccurately updating my account as a declining to pursue repayment options. The call on Friday XX/XX/XXXX was recorded, per Navient. Nowhere did I state or intend to convey that I was refusing to make payment. I simply was trying to reiterate that I could not make any payment on Friday XXXX and wanted to explore other options. Additionally, the response says that other repayment options may be available, but Navient will not take the time to discuss the options. In the recorded call on XXXX I was quickly given two options and told a payment must be made that day or by XX/XX/XXXX. No further information or additional options were given. I did not refuse to make payment, but I did reiterate multiple times that I could not entertain either of those options on the day of XXXX and needed more time. XXXX refused to provide any additional information or repayment options. Therefore, the response on the initial complaint is inaccurate as it relates to repayment options and them falsely stating I declined to make a payment. Navient 's inability and refusal to speak with me on this account followed by an inaccurate response to my initial complaint really needs to be looked at.

Consumer Complaint: I have been unemployed on and off for the better part of two years. I am currently 7 months behind on my Private Student loans serviced through Navient. I responded to Navient on XX/XX/XXXX to begin communication with this account and determine what my options were to get the account current, and informed Navient that I currently was unable to make a payment. Today, XX/XX/XXXX, I was able to speak to two representatives -- XXXX and XXXX XXXX at XXXX Extension XXXX after receiving an unprofessional voicemail from XXXX on XX/XX/XXXX stating that I was " uncooperative and unwilling to communicate properly '' and as a result he aggressively stated that " they would be forwarding my account to the compliance team in the month of XXXX. '' I obviously want to avoid my account being deliquent, possibly being sued, and having my credit ruined because of this scenario. I was given two options on XX/XX/XXXX over the phone after being forwarded over to XXXX XXXX, both of which must be executed by XX/XX/XXXX. One of the options was to make a minimum payment of around {$500.00} or to file for forebearance, which would cost {$150.00} to process. I informed XXXX that I could not execute either option today or by XX/XX/XXXX but I was still interested in exploring options. Unfortunately, I was not given any other options, was told that I was irresponsible and needed to take accountability for this loan and have had 7 months to make a payment. As a result, XXXX XXXX stated she would mark my account as delinquent or that I would not be making a payment. The conversation spiraled out of control with XXXX and XXXX using their tactics to try and provoke anger or get a response from me over a recorded line. I am wanting to make a payment and to work on bringing this account current but the limited options they are providing do not allow me the time to do so. Additionally, it is incredibly unprofessional to have the representatives from Navient laugh at me, put me on unnecessary holds, and then tell me that I am irresponsible for not keeping my account up to date.
