Consumer Complaint: Hi, my name is XXXX and I had a Tuition Answer loan with Navient. I filed bankruptcy in 2016, but continued to make payments after. Citing the recent court injunction- Homaidan et al., v. Navient Solutions LLC et al., case number 1:17-ap-01085 - Navient has been ordered to halt collection on this loan ( they have since transferred the loan to my co-signer ). Your website states that Navient has been ordered to return payments made after a bankruptcy case. Navient has refused to do so. I have called customer service to no avail.

Consumer Complaint: I was making payments to the company off {$150.00} I thought this was my new payment. Then I received a call saying I was no longer enrolled in this program. My family of XXXX and XXXX XXXX are struggling. The company asked for all my bills and I gave them everything and they could clearly see I can not afford to repay this without sacrificing food, housing, utilities and transportation for my family. No one cared and told me I was basically out of luck. Now I have defaulted on my loan and it is negatively effecting my credit score making it impossible to crawl out of this hole.

Consumer Complaint: I have a spousal consolidation FFEL through Navient with my husband as the co-signer. We opened account in XXXX, still married, and have been paying every bill until we were granted administrative forbearance in XX/XX/XXXX while we wait for Federal Student Aid to implement a way for us to separate our loans. Our forbearance has been extended 2 times, 60-days, and will come to an end soon. In our case, we have both worked at US public higher education institutions since XXXX, and we qualify for PSLF under the limited waiver that ended XX/XX/XXXX. We have submitted what we had to by the waiver deadline, and other have confirmation from Federal Student Aid that they have received what we needed to submit to them. In XX/XX/XXXX Federal Student Aid announced that the procedures regarding separating spousal loans will not be put into place until end of XXXX, and loan holders are encouraged to contact their servicer to obtain forbearances. Navient apparently created a company-wide policy for not allowing administrative forbearances for FFEL joint consolidation holder because Navient is waiting for a direct communication from Federal Student Aid. On the phone and through chat communications ( on XX/XX/XXXX ), Navient would not tell me what form of communication they are waiting to receive from Federal Student Aid, and when I asked whether they need communication regarding my account or a general communication they told me general communication. I have attached the chat transcript. I filed a complaint with the Federal Student Aid Ombudsman 's Office on XX/XX/XXXX, and they have already closed my case without communicating with me an outcome ( Feedback Case # XXXX ). I called FSA ombuds and they told me that my name is now on a special list, and that the information on https : //studentaid.gov/announcements-events/joint-consolidation-loans is the direct communication to loan servicers. It seems conversations between Navient and FSA are going into a never ending cycle, and as a consumer we are caught in the middle with the least power to move things in a manner to be treated fairly.

Consumer Complaint: This complaint is regarding my student loans with Navient. There has been a National pause on all federal student loans which included my student loans with Navient since the beginning of the Pandemic outrage. On XX/XX/XXXX I received a notification from my XXXX credit monitoring service that Navient reported a XXXX XXXX XXXX ) late payment to my credit report that devoured my credit rating! This is UNACCEPTABLE as I have held a perfect payment history with all my creditors! I immediately called Navient on XX/XX/XXXX and XX/XX/XXXX to ask how this happened and why Navient had not made me aware that I was past due or that my loan was no longer on pause!? I was told on both occasions that they had been trying to call me and supposedly emailed me regarding my past due balance. I NEVER received any phone calls or emails from Navient regarding a past due amount and I had no knowledge of a payment due since the payments have been on pause since the Covid Pandemic! They reported a XXXX day late payment without even reporting a XX/XX/XXXX day late payment ( see attached ) and that is a violation on the FCRA! If Navient says they called and emailed me regarding a past due amount I demand to see all call records and emails showing this. I verified my email and phone number with the representatives I spoke with on XX/XX/XXXX and XX/XX/XXXX. I brought the account current and made a payment arrangement for my loan with Navient. I've had every intention of paying off my student loans!

Under 15USC1666B a creditor may not treat a payment on a credit card account under an open-end consumer credit plan as late for any purpose.
