Consumer Complaint: I went to XXXX XXXX XXXX, XXXX and graduated in XXXX. I had to consolidate my student loans from my XXXX XXXX XXXX at XXXX, XXXX, in order to get loans for XXXX. I am now part of the class action law suit for the Borrower Defense to Repayment Act, Sweet vs. Devos. I applied in XXXX and was denied, under Devos ' tenure. Under the lawsuit, I am eligible for the forgiveness of my loans ( which has not happened yet ). I am not eligible for a refund of what is paid, because I was required to consolidate my loans into a privately held student loan by Navient XXXX XXXX XXXX ). There was another lawsuit against XXXX XXXX XXXX and Navient, which I did not qualify for because I did not miss any payments. I should not be punished for making on time payments to a school that was shown to have malicious, predatory lending practices. I believe that Navient should refund what was paid. I have XXXX children and another XXXX, child. Please help.

Consumer Complaint: According to the Fair Credit Reporting Act 15 USC 1681 section 602 a states " There is a need to insure that consumer reporting agencies exercise their grave responsibilities with fairness, impartiality, and a respect for the consumers right to privacy. '' XXXX and XXXX are consumer reporting agencies and I am the XXXX. I have the right to make sure my private information isn't shared which is backed by 15 USC 6801 which states '' It is the policy of the XXXX that each financial institution has an affirmative and continuing obligation to respect the privacy of its customers and to protect the security and confidentiality of those customers nonpublic personal information. '' ( Furnisher of information to credit agencies ) is a financial institution by definition under that title. 15 USC 1681 section 604 a section 2 states that " In general Subject to subsection ( c ), any consumer reporting agency may furnish a consumer report under the following circumstances and no other : in accordance with the written instructions of the consumer to whom it relates. '' ( Furnisher of information to credit agencies ) the XXXX XXXX and the Consumer reporting agencies XXXX and XXXX do not have my consent to furnish this information and they surely do not have my written consent. Any and all consent to XXXX, XXXX, ( Furnisher of information to credit agencies ) whether it be verbal, non-verbal, written, implied or otherwise is revoked. 15 USC 6802 ( b ) ( c ) states that " A financial institution may not disclose nonpublic personal information to a nonaffiliated third party unless the consumer is given an explanation of how the consumer can exercise that nondisclosure option. '' ( Furnisher of information to credit agencies ) Never informed me of my right to exercise my nondisclosure option. Not only that 15 USC 1681C ( a ) ( 5 ) states '' Except as authorized under subsection ( b ), no consumer reporting agency may make any consumer report containing any of the following items of information Any other adverse item of information, other than records of convictions of crimes which antedates the report by more than seven years. '' This account is an adverse item they are reporting again without my permission whichis against the law. 15 U.S. Code 1681s2 ( A ) ( 1 ) A states " A person shall not furnish any information relating to a consumer to any consumer reporting agency if the person knows or has reasonable cause to believe that the information is inaccurate. 15 U.S. Code 1681e states '' Every consumer reporting agency shall maintain reasonable procedures designed to avoid violations of section 1681c of this title and to limit the furnishing of consumer reports to the purposes listed under section 1681b of this title. XXXX and XXXX are not maintaining reasonable procedures. Also 12 CFR 1016.7 states that " A consumer may exercise the right to opt out at any time. '' I am opting out of your reporting services.

Consumer Complaint: Navient A XXXX Nightmare After the high-pressure recruiting calls and promises of XXXX XXXX I enrolled in the XXXX XXXX program in XX/XX/XXXX. The program tuition was {$21000.00}. I was able to get federal student loans but XXXX then wanted {$5800.00} cash for the remaining amount. I did not have the cash, so they told me about a XXXX XXXX XXXX. I took out the XXXX XXXX XXXX for {$5800.00} through Sallie Mae. And then, they gave me a pink sheet titled Need Money? Sallie Mae offers a loan program for students that need money. I was then introduced to the XXXX XXXX loans that exceeded the cost of tuition and I took out 2 XXXX XXXX Loans both for {$5200.00} each. Currently I owe {$18000.00} to Sallie Mae/Navient for the 3 private student loans that they continue to bill for. I ended up consolidating my federal loans with XXXX. My husband and I unfortunately had to file XXXX XXXX Bankruptcy on XX/XX/XXXX XXXX XX/XX/XXXX in the XXXX XXXX XXXX Illinois ; Sallie Mae was listed along with other creditors. My husband became ill shortly after the bankruptcy discharge and was diagnosed with XXXX XXXX in XX/XX/XXXX. After two XXXX at XXXX XXXX and living in XXXX away from our kids for treatment he passed away two days before XXXX XX/XX/XXXX. At XXXX I found myself a widower with XXXX girls and a mountain of debt again. I have continued to make payments to Navient because they kept calling and harassing. In and out of forbearance, payment reduction, interest only and have not made any progress. I feel like someone has been jabbing a fork in me now and turning it as hard as they can. Navient has done so much damage in so many ways through these years. Simply put, Navient preyed on me for several years. They threatened so I paid what I could. My husband died of XXXX, and I had XXXX girls to take care of and I was working as much as I could. I am emotionally drained by them. Every loan that I have applied for, the interest rate has been based on my credit. Navient has ruined my credit because they said I owed this money and come to find out it should have been discharged in XXXX. I recently had to co-sign on my youngest daughters student loan and her interest rate was high because of my credit due to Navient reporting my delinquency. Navient has continued to make collection attempts on my private loans that were discharged. Currently I am on a program with Navient where they automatically take out of my checking account monthly. They will no longer be receiving any payments from me again and need to cease collections immediately.

Consumer Complaint: For several years my Student Loan account at Navient displayed an old, incorrect email address when I checked the contact information. Live operators on the phone also corrected the email address at my request but later the old email would resurface. This can be proven in a court of law by examining logs and records at Navient. In XXXX I received a notice from my bank ( not Navient ) the negative items were on my credit report. Navient reported me 90 days late on 2 accounts. I had no knowledge they were due. All my loans were in deferment as far as I knew. My credit is good and I always pay on time. Check my history, please. Navient asked me previously to use " paperless '' notifications. Their system failed to perform correctly and caused me real harm in a XXXX point credit score drop. When I check ed with Navient on the day of the negative credit report, the contact page displayed my old, incorrect email address. I corrected it. This can be proven in a court of law by examining Navient computer logs and records. Ironically, my credit history suggests I am correct.

Now under the law sue of of sweet vs cardona i had me fed loans remove but cant get private one taken off. Navient became my service provider and as of today owe {$56000.00}. I was not properly explain the ramification of placing my loans on forbearance. I place my loans on forbearance multiple time. This lead me to exhausted forbearance. Because of this evetime i ask for any financial assistance they tell me to ask family members or ask my elderly mother for money. I made statement like " it sound like you want me to life on the street just to pay this deed and they reply that well i bowered the money and need to pay it back. This people have no heart or compassion for anything except their money please help me with this..

They have sent no correspondence to my place of residence or notified me of messages in an inbox Navient.com that I never knew they were sending things to. The only reason I even went on today XX/XX/23 was because on XXXX at XXXX i received my very 1st phone call from this company. the lack of communication is horrible. I know have a late fee for something I have no clue what it is for. I was told it was from something prior.
