Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: We are currently on a graduated repayment plan. We have to pay XXXX per month. I have 2 loans through Navient. In XX/XX/2019, we used our household tax refund to attempt to pay off the lower of the two loans. We paid online using the option provided to pay more, allocating the extra to the lower loan. Between XX/XX/XXXX to XX/XX/2019 we paid {$2400.00} on the accounts, allocating the extra to the lower loan. Meaning the extra {$2200.00} should have been enough to pay off the lower loan. Instead of Navient putting the extra to the lower loan, as I had specified, instead Navient applied it proportionally between both loans. Now instead of having my lower loan paid off, I still owe on it.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Good morning, I have been struggling over the years to pay my loan. However, recently I spoke with Navient and agreed to auto pay in which funds would be deducted from my account every XXXX of the month. I have the email confirmation about this. Navient broke this agreement by deducting from my account on the XXXX causing my account to be overdrawn. This is not fair, especially because I am trying my best to repay but they are making difficult. Please help.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Navient grossly mishandles loan payments. While it is apparent that the lender receives the overwhelming majority of protections compared to students that take out loans, Navient payment processing is worse than any other payment processing I encounter for various other loans/recurring payment apps ( car loan, bank loan, credit card payments, etc. ). If I make a student loan payment on the same day as the other payment types mentioned above, Navient will withdraw the money from my bank account before the other institutions that I make a payment to - and yet my Navient payment posts to my Navient account after every other payment I make. This is not a problem, except that Navient is constantly assessing interest on the amount prior to the payment. There is no reason that Navient should be able to charge interest on an amount they have already withdrawn from my bank account. Not only do they mistreat lenders financially, but they leave no other alternative to changing loan servicer other than consolidating loans to switch servicer. This is a poor option for myself and many other lenders since interest rates and amounts borrowed can fluctuate from one academic year to the next, especially if you receive a graduate degree and use federal student loans to pay a portion of expenses ( since these interest rates are higher than those for undergraduates ).

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I enrolled in XXXX College from XXXX XXXX-XXXX. Once I graduated I recieved my XXXX Degree in XXXX. I decided to go back to XXXX College of Rhode Island to work on my XXXX degree. I was finishing my third class when the college informed me my degree was not acceptable towards the XXXX program. I questioned WHY?? and was told XXXX is not an accredited college. I dropped out of school and felt dissapointed and confused. I was discouraged to continue my education due to the financial hardships. My federal loan had been deferred several times during this time. I paid my private loan in full and began making payments towards my federal student loans. I was consistenly making good and on time payments. In XXXX I was having financial difficulties in making payments. Navient suggested I go in to forbearance. They did not attempt to inquire if I could make small monthly payments. In XXXX I contacted Navient several times in regards to making payments. I offered Navient between $ 50- {$70.00} a month because during that time it was all I could afford. They stated the minimum was {$140.00} and that was the best they could do. I contunied back and forth for months and was finally able to negotiate {$70.00} a month. The bill came in and it was {$150.00} " DUE IMMEDIATELY ''. I could not get them to work with me as I tried over and over. More recently I began conducting my own research and I'll admit due to my own negligence did not realize that my original loan of {$12000.00} somehow doubled to {$24.00}. I understand navient took over for Sallie Mae and somehow aquired my loans. I'm still confused as too how much interest and how it was calculated. I need someone to help assist. I am presently reaching out to the Dept of Education and have filed an application for a borrower defense to loan repayment. I would like some understanding into how and why this happened.

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I've been struggling to pay off this Student loan for over 15 years now with Navient back then was Sallie Mae kept increasing balances with Forbearance and deferments. I was unable to include my student loan in my recent bankruptcy case and I am still having to make payments for this loan. The school I originally attended has since closed it's doors and lost all accreditation. My diploma is technically invalid and I am still stuck with this Navient debt. Need professional help to clear debt.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Problem with personal statement of dispute

Consumer Complaint: I filed a previous complaint XXXX # XXXX XXXX. The essence of the complaint was that Navient issued a negative report against me to credit reporting agencies based on a payment default on a student loan on which I was the co-signor WITHOUT GIVING ME PRIOR NOTICE THAT THE LOAN WAS IN DEFAULT. In its response, Navient provided me with a copies of the promissory note in question ( Note ) and Navients written notices of default. Navients contention is that my contact information had not been updated, thus making it impossible for Navient to have notified me of the default. To the contrary, both my cell phone number ( XXXX ) and office email address ( XXXX ) are provided on the first page of the Note. This contact information remains correct to this date. Had Navient exercised even a modicum of diligence, it could have notified me of the default using either cell phone or email contact information, prior to Issuing its damaging credit report. It did neither. Moreover, the address that appears on Navients notices of default ( XXXX XXXX XXXX, XXXX, ME ) has not been my address since 1974, when I was a student at the XXXX XXXX XXXX XXXX. This address does not appear on the Note and it is a mystery to me how Navient decided to send notices to this address.

Consumer Complaint: In XXXX, I became permanently XXXX and was on XXXX by XXXX. I never got anything in the mail until after my whole ssdi check was taken by law firm stating default on loan payments and until paid they will be taken out of my ssdi and i got on the phone and spoke to this law firm and they told me i was defaulted on A loan when i was actually in Forbearance, so after XXXX and more stress and worried about living without a check, they talked to me for hours and finally allowed XXXX month taken out of my bank account since XXXX and when they sold it to another company which then was XXXX XXXX XXXX they continued to take XXXX but i still got calls from those companies stating interest and fees Ill never pay the XXXX loan off and i would say well you said u dont have anything for those who are permanently XXXX like my other loans each time said no this is completely different So in XXXX my account should have dropped plus i noticed it was not and hasnt been showing on my credit report that i have a loan or made payments monthly since XXXX. Also when i discovered that this loan absolutely could have been written off i called and first i asked if they had anything to help some type of program for permanent XXXX she said no thats when i said well my lawyer said incorrect then she said oh Ill mail it to you now and i said i already mailed it in and reported you to the department of education and consumer complaints and 4 months later loan sold off to another company and they stopped taking money out of my account - i got calls from collection agency stating i owe on this loan i have not paid anything since XXXX and its been in default for A while which is not good for your credit. I said i have no idea what your talking about send me information and i also said this has been paid on since XXXX and current. He said no u are in default you stopped paying on this loan in XXXX and now we are attempting to collect. Then explained Im permanently XXXX and this should have been written off and they said well you really want to put this on your dad to pay he is your co signer i said he is permanently XXXX and has been my whole life so good luck but wanted money from me and i refused. I got 2 letters in the mail one for me and my dad offering us each to pay XXXX and one of us who takes the settlement will be removed from this and then the other one repays the loan and if agreement to settlement then we can not discuss any claims or actions and they will not take any liability for any claims made against them. Again they also have never had proof on my credit report that i paid on time since XXXX of XXXX which is when they sold it and stopped accepting payments. XXXX was when they had A debt collection lawsuit hired law firm and took my whole ssdi check Collection letters, high interest rates and fees also harass me about more money and i even told them i have XXXX and i can not be stressed out that many times Ive had one on the phone and also sent to the hospital over loan in fear i was in legal trouble Was never given any options and now i have XXXX XXXX XXXX XXXX calling and sending letters on behalf of Navient My bank account will prove that i never stopped paying and it was taken out monthly Also credit report shows nothing of this loan or debt owed or paying monthly - nothing at all.
