Consumer Complaint: I got a loan from XXXX XXXX XXXX in XXXX, PA for XXXX XXXX almost 13 years ago from Sallie Mae. I wanted to go for the XXXX XXXX XXXX but was told by this school that I had to complete a XXXX XXXX class first for 9 months so I completed the class with XXXX and completed my XXXX but when I asked the school to help me with getting a job they told me I had to have an email set up which I did not at that time so they then told me they couldn't help me get a job because of having no email address. I paid on my loans every month as ordered and could not pay it for a couple months it was lowered so I could pay on it but my Sallie Mae loan then got taken over by navient in XXXX and they harrassed me non stop with phone calls, calls to my brother in law 's family and people there not aloud by law to tell that information to except a spouse they then told me my only option was paying {$10000.00} at that time or go into forbearance and not for a while and then promised to lower payments well then the interst rated went crazy and I could no longer afford it. It's been almost 13 years and it finally closed this month but it's still on my credit report under XXXX it's open now taken over by XXXX and under my XXXX report it says closed but the date my loan opened says XXXX, I wasn't born until XXXX. Can you please help and also let me know if I'm able to claim taxes because they took my refunds the last 2 years. I'm a single mother of XXXX little girls and I currently live with my parents because I lost my fiancee and father of my children a year ago. I'm XXXX years old and have XXXX daughters ages XXXX & XXXX and need help with closing this loan and removing it from my credit reports

Subissue: Debt was paid

Consumer Complaint: My student loan servicer is Pioneer Credit. I let them know that I was having a financial hardship because my husband was now XXXX and i had small children and i didn't know when i could pay them, they set me up with a payment rehab, but it was an individual one for each of the loans that I had and they told me that that was the only thing that I could do, i did it to try not to damage my credit any worse ... once my time ran out there I then called back and was told that had I not taken the rehab program that I would have qualified for forebarance, but now i don't because i agreed to the repayment option and because i didn't make all six payments for the rehab program that I didn't qualify for that anymore either. I didn't work for 7 years because of his accident and my children. Now i begin working and im going through foreclosure and so i file all three years of my tax returns and i am set to recieve back {$10000.00} and of course they garnish my taxes .... I then call and tell the that money was supposed to save my house and they tell me if i fill out an application and send foreclosure paperwork that they will give me my money back, but i have to do it within 30 days they don't send the papers after a week i call back and the representative admitted that they didn't send the paperwork, but said if she sent it out now i wouldn't get it in enough time to send it back to them anyway ... .. I now can't file my taxes even though we are in a pandemic because when I do they are going to take that again because when i called pioneer to say ok so you have {$10000.00} of my money can i go into repayment so you don't take my next years taxes she says no because you have to set up a repayment plan and you need to pay {$150.00} to begin the repayment plan!!!!! I said you just got a {$10000.00} payment that doesn't count and she says no ....

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: Since 1996 I've been having to place the Loan in forbearance because at the time it was a single income family. We have just know been offered the income-driven option, this is the first time anyone from Navient has told us about the program. It's been well over 20 years and to just now tell a client about this repayment option is unthinkable.

Issue: Struggling to repay your loan

Subissue: Problem lowering your monthly payments

Consumer Complaint: I have 8 private loans obtained by Sallie Mae back in XXXX. I was an XXXX XXXX at XXXX XXXX XXXX and needed additional funds to pay for my XXXX degree. I remember the interest rate being a fixed interest rate at 4.5 %. The total borrowed amount was around {$39000.00}. I went to graduate school after XXXX and my loans were placed into deferment. Upon completing graduate school in XXXX, my payments fluctuated often. Upon looking into the loans, I realized that Navient ( who was and is now servicing my loans ) was charging 10 % interest. I established a payment with them to keep my credit in good standing. I also asked for my initial loan documents to see why my interest rate has changed. After years of battling back and forth, I have only received my initial application with the terms for the loan, but the terms and conditions are not specific enough to understand if they are allowed to change my interest rate and other issues in terms of repayment. I was even told by multiple representatives that I would have to go into delinquency to get a payment plan established even when I was proactive in trying to receive payment plan. To date, the loans are over {$83000.00} in total and the interest rate is constantly fluctuation ( as high as 10 % and currently at 9.5 % ). My current payment plan will end in XX/XX/XXXX. I have applied for a new payment plan ; however, with the changing terms and conditions, it is not likely that I will be able to afford the payments. Given the issue of changing terms and conditions, I am submitting a complaint to CFPB. To date, I have paid back somewhere around {$20000.00} ; however, the overall amount keeps increasing given the interest rate changes so an end to paying these loans are not in site. I would like assistance in this matter. My current payment is {$470.00}, {$460.00} of which goes to interest.

Issue: Incorrect information on your report

Subissue: Account information incorrect

Consumer Complaint: Navient is reporting 13 separate student loans on one account to the credit bureaus who use their information to compute credit scores based on proprietary formulas using several factors including but not limited to the number of accounts, payment amounts, number of late payments, etc. The problem with Navient is in consideration of the following : -Navient won't accept payments less than the combined minimum payment amount for all 13 loans, treating them as one account but reporting them as 13 accounts, -Navient allows borrowers to direct overpayments, meaning any additional payment made over the combined minimum for all loans is able to be designated to pay down certain particular loans, but Navient does not allow borrowers to direct underpayments, meaning if I can only afford to pay some of the 13 loans instead of the combined minimum payments on all of the loans on the account then it gets reported to the credit bureaus as 13 late payments instead of one or however many the loan payments I could not afford to pay on time which adversely and untruthfully affects my credit report multiple times, -Navient should accept payment of less the combined minimums off all loans on the account, allow borrowers to direct the underpayments as it allows borrowers to direct overpayments, and report truthfully to or instruct the credit bureaus in the manner in which multiple loans on one account are treated so the penalties for late payments are not unfairly multiplied against the borrower, and -Navient should be held accountable to some extent for their servicing and reporting errors, mishandling of account information ( misleading reporting practices ), the negative financial impact it has had on the student loan borrowers, etc.

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I took out a @ {$9700.00} student loan for my wife 's education in XXXX. In XXXX I entered into chapter XXXX. Navient, the private student loan servicer, did not respond to the bankruptcy courts request for debtors. Having not responded, Navient was not included in the repayment ( 100 % ). In XXXX I cleared bankruptcy. In the Spring of XXXX, my wife called Navient to start making payments and ensure I was removed from the loan. At that time, she was under the assumption she was the primary on the loan and did see a Navient student loan on her credit report at that time. She then began making payments. Those payments still showed on my credit report so it appeared all was well. In XX/XX/XXXX, I recieved a notice from Navient saying I was in default, and had not made a payment since XXXX. They also said the loan amount was over {$20000.00} at that time and I was the only person listed on the loan as the student. I asked for paperwork to prove the amount and that I was financially responsible and copies of the " notes about bankruptcy '' which the CSR told me existed. They did not send ANY paperwork until XXXX after me repeatedly requesting every piece of paper. In XXXX, I recieved only a copy of the original @ {$9700.00} loan and nothing further. I have since requested the remainder of the Information to no avail. I am NOT going to just pay {$24000.00} without proof of responsibility. Furthermore, I was not given any payment options in XX/XX/XXXX other than pay the balance. I need this documentation to see how to proceed. They have listed this debt as a charge off even though I told them I was in fact considered permanently XXXX back in XXXX as well as a Veteran. I read the CFPB complaint against Navient and many parts of my case sound similar. Can you please help?

Issue: Struggling to repay your loan

Subissue: Can't temporarily delay making payments

Consumer Complaint: I am currently in a furlough due to Covid-19, and while Federally owned loans are furloughed interest free by the Cares Act, Navient refuses to do the same because the Cares Act didn't say they had to. What this means is someone like me who has loans both federally owned and Navient owned, I have to recertify my Income repayment plan for half my loans now and still pay accrue interest on a XXXX payment as I am unemployed due to the coronavirus and do not know when I will be going back. It seems backwards if not outright hurtful to borrowers to make them go through channels to get payments put off when they insist on collecting during this national disaster.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: On XXXX Navient advised me via email that my interest only payment plan would end with my payment of {$82.00} on XXXX. Accordingly on XXXX, I called Navient to set up a renewal of the plan or a lower payment plan, given the economic realities resulting from the COVID-19 pandemic. However, Navient told me I needed to call after the XXXX of XXXX, because Navient could not do anything regarding my payments until the XXXX payment was completed. The following is the timeline of events : 1. XXXX : Completed auto payment of {$82.00} from my account. 2. XXXX : I called Navient and applied for what the representative told me would be an interest and principal payment of {$100.00} for 6 months. 3. XXXX : Navient approves my application and emails a letter ; however, the letter states that the {$100.00} payment is for interest only and it contains the following info : Late Fee : {$0.00} - Repayment Fee : {$0.00} - Returned Item ( NSF ) Fee : {$0.00}. This conduct amounts to violations of the Truth in Lending Act, misleading information, and deceiving practices. 4. XXXX : Navient sends me a statement showing that I have a past due amount of {$26.00} and a balance due of {$230.00}. This conduct amounts to violations of the Truth in Lending Act, surprise late fees, misleading information, and deceiving practices. 5. XXXX : I called Navient to explain that it had made an obvious mistake as my auto payment of {$82.00} was indeed completed and as such I could not possibly have an amount due. To my surprise, I was automatically forwarded to collections! I talked to 1 representative and 2 managers to no avail. Navient 's response was limited to saying " You are in collections because you have an amount due and we will send a request to research the matter. '' I requested a number or some confirmation that in fact that would be done and asked when could I expect a response. Navient 's kept the past due amount posted in its system and had no explanation as to how that due amount reconciles with my next payment per the plan approved XXXX. Again, both managers refused to provide me with answers, stating simply that neither of them could do anything about my problem. This conduct amounts to violations of the Truth in Lending Act, surprise late fees, misleading information, and deceiving practices.
