Consumer Complaint: Navient has taken immediate negative action against me because I filed a borrowers defense loan forgiveness request : 1. Before I filed a borrowers defense loan forgiveness request ( case # XXXX ), I had a forbearance in effect with a payment start date of XX/XX/XXXXper letter dated XX/XX/XXXX. 2. On XX/XX/XXXX, I filed a borrower 's defense loan forgiveness with Federal Student Aid : an office of the U.S. Department of Education 3. On XX/XX/XXXX, I received two letters from Navient dated the very same date of XX/XX/XXXX a. The first letter says, The U.S. Dept of Ed has notified us to process an administrative forbearance on your loans. b. The second letter said that there has been an adjustment of my forbearance and says, your forbearance period started XX/XX/XXXX and ends on XX/XX/XXXX. 4. Again, before I filed a borrowers defense loan forgiveness request, I had a forbearance in effect with a payment start date of XXXXper letter dated XX/XX/XXXX. 5. In sum and substance, after I filed a borrowers defense loan forgiveness request, Navient changed my loan repayment date to 4 months earlier than when it was scheduled to move from forbearance to repayment. To be clear, I had an existing forbearance before I filed for Borrowers Defense and that forbearance was scheduled to end with a XX/XX/XXXX repayment start date. 6. In addition, late fees have also been applied to my account. 7. Note that this is not the first time that Navient followed my loan forgiveness request with prompt negative actions. The first time I filed a loan forgiveness directly with Navient, two XXXX Police Department Squad cars came to my apartment to remove me based on a call that Navient placed to the police department ; at least six police officers came into my apartment geared up to forcefully remove me all because I made a loan forgiveness request based on XXXX and provided Navient with medical record ( To this day, I am traumatized by this event because a man in my area had a similar issuesomeone sent the police to his house to bring him to the XXXX ward and the police ended up XXXX the man ). When I contacted Navient about this matter, a representative by the name of XXXX XXXX who represented that he was with investigations threatened me with arrest and he called me a XXXX XXXX. XXXX XXXX also stated that he was with investigations, and if I did not pay my loans, the police would return to arrest me. I have kept this experience privately and have been suffering inside because of it, but I hope that you can help me. 8. For various legitimate reasons, I have requested documents from Navient so that I can verify and calculate the purported student loans but Navient has not provided the requested documents.

Consumer Complaint: I originally filed a complaint in XXXX # XXXX. The response from the company was they sent you a copy of my note. Which I have. I have paid more than the minimum payments and even paid extra payments ahead for this improperly handled loan, attempting to get it paid off. I recently on XX/XX/XXXX got notified that my XX/XX/XXXX payment was due on XX/XX/XXXX. I paid the XXXX payment on XX/XX/XXXX. I called and the customer Service person XXXX, who after multiple reviews agreed that the payment was made and there is some kind of glitch in the system. She said it would be corrected within 48 hours. It isn't and I don't want my credit ruined because of this worthless and corrupt company. 2nd Issue - While reviewing the payments I pulled the history of my account from the Navient website and downloaded the XXXX file Navient supplies showing all my payments. Wasn't I surprised to find they have been ADDING the payments I make to the principle TO THE balance for 6 years from about XXXX to XXXX. EXACTLY what I complained about originally in my complaint in XXXX. Called back Navient, spoke with a person named XXXX who stated " what you are seeing on the screen DOESN'T MATCH what I am seeing. I will send it to IT Dept. '' Additionally, they capitalized interest WHEN I ALREADY PAID THE INTEREST. 3rd Issue. XXXX XXXX Made my XXXX Payment loan balance is {$40000.00}. Navient " sells '' the loan for {$41000.00} - 12 days later. Why is this the Principal balance, I don't know. I make 3 payments more, All on-time XXXX, XXXX, XXXX. XX/XX/XXXX Navient " sells '' the loan again and puts back the principal balance of {$40000.00}. WHAT DID MY XXXX, XXXX, XXXX payment go to?????? Not MY Principle Balance!!!!! I need someone to do FORENSIC ACCOUNTING to get to the bottom of this since I can't see how they applied anything on my account. PLEASE DO YOUR JOB AND HELP!!!!!

I have disputed the account information as Fraud/Identity Theft with you, and you have come back to me and stated you were able to verify this debt. How is this possible? Under the laws of the FDCPA, I have contacted the collection agency myself and have been unable to get them to verify that this is indeed my debt. Consumer Complaint: I do not wish to file a complaint, but I had a question on the reporting/deletion process. there was no other way for me to submit my question online. I am currently working with a consumer advocate at Navient trying to get an old paid/settled loan deleted from my credit report. this loan was paid off in a settlement back in 2015. in the past, Navient has deleted old account, that have been closed/transferred for more than 24 months. I submitted a request to have a " goodwill '' deletion of my old paid off account as it was holding up the process of me buying a house. my consumer advocate stated that the Fair credit reporting act prohibits them from deleting the account at their discretion. I was advised to dispute the account with the reporting agencies in hopes of them deleting it. I forwarded them a letter they had sent to someone else granting them the deletion of an old closed account that was transferred to another lender after 24 months of being closed. I questioned the difference between a transferred and a paid account, at which they could not provide me with an answer. either way, the account is satisfied with Navient, and the same at least 24 months had passed. Why could the account not be deleted? The only answer I got was the FCRA forbids them from deleting this. I found this hard to believe. I asked them to mention what section forbids them from doing so. they can not provide the answer, they advised they will have their legal team look into it. I have had success from other banks and lenders on deleting accounts at their discretion. do you know of any parts of the FCRA that prohibits Navient from making the judgement to delete an old, paid off account?

Consumer Complaint: On XX/XX/XXXX, I received a call from Navient asking me if I wanted support in paying off my student loan balanced. I paid off my student loan balances in XXXX and had not heard anything since XXXX and now they want me to pay late fees on a student loan account I paid off in XXXX, 5 years ago. When prompted to review, they indicated they reversed payments but never told me in XXXX at the end of my last student loan payment though I clearly recall a phone conversation with a Navient aid to walk me through final payments on my loan. I do not have records as was in an old email account and can not locate the final letter but have not received bills or statements from Navient since XXXX and just now getting this call that I have a balance including late fees 5 years later. I have not received any mail even though I verified they had my correct mailing address on file. It is clearly documented on my account that it there are reversed charges in XXXX and not contact until XXXX. I am unclear on how to file a formal complaint and they will continue to file late charges. They said they reversed charges because I had paid it off but are now charging me for the reverse charges with late fees. The manager who authorized this is XXXX XXXX at Navient. Now my credit score is being impacted.

Consumer Complaint: Navient is practicing fraudulent and deceptive practices with its student loan repayment processing. When attempting to repay student loans Navient calculates the amount due three ways ( 1 ) Total Amount Due ( 2 ) Current Amount Due and ( 3 ) Unpaid Fees. Navient has two options to repay those amounts ( 1 ) Quick Pay which is the Total Amount Due OR ( 2 ) Custom Pay which allows you to manually input payment amounts totaling the Total Amount Due. However, this is a fraudulent and deceptive practice because the Borrower is forced to pay the Total Amount Due regardless of intention or desire. The Borrower can not pay the Current Amount Due or Unpaid Fees as the system would suggest. ( See attachment for clarity ) Further, when attempting to complete a Custom Pay Navient forces the Borrower to pay the Total Payment Due ( rather than the Current Amount Due ). The repayment tool does NOT allow the Borrower to pay the Current Amount Due. The fraudulent and deceptive practice becomes even more apparent when attempting to make a payment to Unpaid Fees. When selecting to make a payment of Unpaid Fees the tool calculates the Unpaid Fee amount and submit that payment amount toward interest and principal, NOT toward the Unpaid Fees as the system indicates. Thus, the Borrower CAN NOT pay the Current Amount OR Unpaid Fee Amount. In this case, the unpaid fees occurred in XX/XX/2012. Thus, Navient has been calculating and receiving an additional {$81.00} per month and allocating it toward principal. Borrowers under IBR plans have been paying, and Navient has been receiving, amounts that are more than required under law. It took me 8 years before I figured this deception out. I am sure hundreds of other Borrowers are incurring the same fraud and deception as I have, costing them hundreds and thousands of dollars per year.
