Consumer Complaint: I filed for XXXX XXXX bankruptcy which was ultimately discharged in XXXX. At the time I had delinquent private Tuition Answer loans through Navient that I used for expenses during school. I was told they could not be discharged and ended up settling with them as a charge off for a percentage of the balance in XXXX. Now I am seeing the pending lawsuit claiming these loans should have been discharged and I have not received anything from Navient notifying me of my eligibility to possibly obtain a refund/damages. My spouse had the exact same situation with his private loans and he is eligible. I am not sure if I trust the company to offer this to me without being prompted. If I am not eligible I would like to know why since my situation seems to meet the necessary criteria.

Consumer Complaint: I receive a call from Navient at least 3-4 times per day starting at XXXX XXXX and ending at XXXX XXXX Ive been told that navient had a meeting and they decided to no longer be apart of the group of student loan companies that are delaying payments until XX/XX/2023. It also appears that interest has accumulated, when Biden placed loan payments on hold my account was approx {$10000.00} now its over {$11000.00}. This company is awful, they bully people and when you ask for deferments or loan payment reductions Navient will tell you that youre not eligible for anything.

Consumer Complaint: I was enrolled in an interest only repayment plan and when the plan was over, on XX/XX/XXXX, an unauthorized amount of money was taken from my bank account. All letters and account information showed one amount due and a larger amount was taken. I emailed and called and was told that the loan payments were applied incorrectly for 2 months and that the larger payment was taken for their mistake. I was also told that they had open access to the account and I had given blanket authorization. I asked for the call recording and for a case review and no one has been able to find them. I have been calling, filing complaints, emailing since XXXX and no one has found an answer.

Under 15 USC 1666b a creditor can not treat a payment on a credit card account under a open and consumer credit plan as late for any purpose.

Consumer Complaint: After over 10 years of having this loan I have not been able to make a dent. Back in 2014 my loan amount was {$230.00} and today it is {$720.00}. I have spoken to multiple reps and they have told me explicitly that there is not much they can do. My terms continue to change and have no recourse. I understand that Navient is permitted to call to collect a payment but they are not permitted to harass me with phone calls where I answer and no one is on the other line. Second, they should not call me when the state I am in is in a State of Emergency yet they do it anyway. The last thing on my mind when I am preparing for a Hurricane is to make a payment towards a loan that is impossible to pay without it affecting me. I made a payment and in the process was unable to pay my rent but they do not care. They practice predatory lending and have targeted me as prey. This is unconscionable. In XXXX the payments were in the $ XXXX and not it is up to {$700.00} plus for one loan. I've already paid over {$40000.00} to them, almost the total amount of my original loans yet I still have another {$72000.00} to pay them. They have changed the index that was used before, they do not offer any options for lowering my payment making it so unmanageable that I can't actually care for my child or myself. I have a variable interest rate that keeps going up and up and up and up and up. They knew exactly what they were doing and they took advantage of me. No degree on Earth goes up in value and definitely not mine. I have double digit interest rates and my accrued interest is more than twice the amount of my original loans. I can no longer afford to make my payments and they refuse to work with me. The worst part about it is that I have tried talking to them about it and they truly refuse to do anything. I draw the line when I have made my payments consistently, every single month until now, only to be harassed by phone where either they don't speak at all or call me during a state of emergency when I need to be caring for my XXXX XXXX XXXX baby. I have tried to do my part but they don't do theirs and my loan should be completely discharged as punishment for their predatory lending practices. They have a history and they are preying on me because my loan is private and they think they can get away with more because they are a large, XXXX dollar company and I am only one person. I get charged fees but they never tell me what those amounts are because they apparently can do whatever they want but if I don't make a payment on time I don't hear the end of it. I will be filing suit because this is not longer fair and is actually against the law. I also will attempt to go to the media local governments to see what other recourse I have because they can't get away with this. Especially not with people who try doing the right thing. They took advantage of me and have failed to follow the law accordingly. This is not the end and I will make sure that something is done about this because I should not have to be bothered with something like a payment for a loan over my rent during a state of emergency. I caution every single parent and student, be smart, do your research. They want you to follow the rules like good people do but they fail to follow the rules themselves that's why they are being sued already. The rules don't seem to apply to them. Just because I have a private student loan doesn't mean they can treat me however they want. I requested recordings of my conversations with them and they refused to provide them to me. They will never admit fault, though there are things their reps have recorded where they have given me inaccurate information. All of this is part of their plan to get over on people like me who are simply trying to live and take care of their children.

Navient FAILED to properly notified loan borrowers about the status of their loans in a timely fashion. Navient FAILED to offer income base repayment plan as allowed by the new federal law. Navient FAILEDto help loan borrowers understand any and all options available under the new student law. In fact, Navient violates the new federal law by making struggling low-income borrowers pay their loans, when the new federal law is suppose to help them in income driven repayment status.

When I was employed I was working at a temp agency making only enough money to cover my rent and bills and they STILL would not lower my payments based on my income. When I was telling them of my situation each time they made excuse on why they could not or would not lower my payment. When I was unemployed a csr agent advised me to sell my plasma. I thought it was rude of them to ask me to do something like that. But I did not know who to complain too.

Consumer Complaint: My daughter became 100 % XXXX and is on XXXX and can not afford the debt. I am now XXXX years old and retired and live only on XXXX XXXX and some odd job income and I can not afford the debt. We were way behind on payments and agreed to pay a reduced balance of {$1500.00} at {$300.00} a month for 5 months, but every month we still get DEMAND letters asking us to pay the entire balance of the loan off. I have contacted the collections department and told them we are in a payment plan with them and they should know this and stop sending demand letters because they are harassing us and I think it is a violation of the Fair Debt Collections Practices Act. They told me they would fix it in their system so we would not get the letters anymore but we're still getting them. These people contacted all of my neighbors by telephone before I agreed to this payment plan, and they claim they were just asking if we still lived here. But every one of my neighbors told me they were calling because they were trying to collect a debt from me. I had to explain to them that my daughter was XXXX and was unable to pay her college loans and that was what it was about. Everyone just blew it off because it was college loans, but again, these people are out of control in attempting to collect debts. For what it's worth - I worked in the credit industry for 23 years and we would never have done some of the things these people have done.

Consumer Complaint: Navient posted incorrect late payments on my credit reports. I was unable to qualify for a home and this issue has been devastating to me and my family. Starting in XXXX, Navient promised to remove two last payments if I made three timely payments in a row. They did not correct the issue. Furthermore, they also confirmed that my loan was approved for forbearance between XXXX to XX/XX/XXXX. My accounts still show 5 late payments on them each. I have contacted them multiple times and have had no success.
