Issue: Dealing with your lender or servicer
Subissue: Trouble with how payments are being handled
Consumer Complaint: I consolidated my student loans in XXXX with Direct Loans through XXXX XXXX XXXX. The loan was then transferred to XXXX XXXX XXXX via XXXX in XX/XX/XXXX. XXXX fulfilled the drop in interest rate to 4.125 % after 24 consecutive months of timely payments resulting in monthly payments of {$350.00}. I qualified for an economic hardship forbearance from XX/XX/XXXX to XX/XX/XXXX, at which time XXXX raised my interest rate to 4.375 %. I paid interest payments only during that time. At the end of the forbearance, XXXX sent a bill for {$2600.00} in remaining interest, which I paid in full. I then signed up for EZ pay automatic student loan payments, which dropped my interest rate back down to 4.125 %. The loan suddenly increased by over {$5000.00} and the payments then increased to {$520.00} per month. I paid {$100.00} to principal on XX/XX/XXXX and XX/XX/XXXX, which were credited properly. I received a 1 % drop in interest rate after 36 consecutive timely payments, dropping my interest rate to 3.125 % and payments to {$450.00} per month. Sallie Mae took over my loans around XXXX and changed names to Navient in XXXX. Auto-debit was set up with Navient and payments of {$450.00} were taken from my account on the first of each month. Despite paying this loan consistently on the 1st of each month, as an automatic withdrawal, extra payments sent were applied to interest and principal both or only to interest. I recently called Navient to have them explain this to me and they told me this was happening because I had outstanding interest charges. I asked how this could possibly happen with consistent on-time payments and the rep could not explain it to me. She did say that if I paid the outstanding {$15.00} in interest, that all future extra payments would be applied to principal. I paid the {$15.00} that same day by having the rep complete a bank draft on XX/XX/XXXX. On XX/XX/XXXX, I made an extra payment sent in with a letter asking that it be applied to principal only and the payment was applied to both interest and principal despite my express request. I am not sure what is going on with Navient, but there is something that just isn't right. I have made over {$4500.00} in extra payments since XXXX and none of them have been applied to principal only. I also think there were some extra funds erroneously applied to my loan by XXXX after the forbearance. I would appreciate some help in evaluating what is happening with this loan and why I keep incurring interest fees despite consistently timely payments. Thank you very much.

Subissue: Received bad information about your loan
Consumer Complaint: On XX/XX/XXXX I received notification from Navient stating that my loan was leaving forbearance and would be due in approximately 30 days. the letter was dated XX/XX/XXXX. In XXXX I received notice stating that my account was 30 days delinquent and a double payment would need to be made. I contacted navient directly and after an extended phone call including a supervisor and a representative It was agreed that there would be a payment plan of three payments to bring the account current and the delinquency notices would be stopped. this did not happen and my cosigner has told me that they are receiving calls regarding my account after my phone call and agreement with Navient and it appears that navient has also erroneously applied a payment they sent for another account to my loans instead. I was unaware of this extra payment until today, XX/XX/XXXX when I called them to ask why I received another delinquency notice today when we were on an agreed payment arrangement that was supposed to stop these communications. their system has had these same issues for the entire time I have been in repayment. they will send a notice that magically isn't reflected in their system, but will show that instead a statement was sent during the time the loan was on forbearance and no account payment due documents should have been generated.

Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: There is no way that these companies investigated this student loan. The same information continues to report on my credit. I honestly don't believe I was late and I don't agree with the total balance that they are reporting on my credit. It continues to report several inaccuracies among the 3 credit reporting agencies from the last student loan company. How is that possible? For example, Each bureau reports that I was late on a different date Also, Hows it possible that youve reported me 90 days late with no late payments prior to that? Wasn't Navient sued by Cfpb before for not applying payments to consumers accounts correctly?

Consumer Complaint: I have three Navient private student loans originated in approximately XXXX. I had difficulty making payments and was unable to arrange suitable payment agreements for these loans in the far past. Eventually the three loans charged off in approximately XXXX and remain on my credit report. I would like to now establish a payment agreement with Navient for these loans, but I have had great difficulty dealing with this process over the past 5 months. I have made many calls to both Navient and also XXXX XXXX, who apparently places Navient loans with collection agencies or attorneys with whom I would be able to negotiate payment agreements for repayment. To summarize, Navient seems to continually ask XXXX XXXX to place the loans. Then XXXX XXXX is unable to place the loans, as it seems that there is no agency or attorney interested in these accounts, as these loans have passed the statue of limitations in my state of residence, Pennsylvania. XXXX XXXX continues to return the accounts back to Navient since they can not be placed. Then Navient again starts the whole circular process over again. I have made many phone calls, even trying to resolve this issue with the Navient escalation department, but all of my efforts have been unsuccessful. Navient certainly seems willing to receive any monies that I might send them, but appear to be completely unwilling to discuss or establish any formal agreement with me. I need a formal payment agreement with documentation that I can provide to other future lenders so that I can demonstrate I am making efforts to address these past arrears.

Consumer Complaint: I took out the loan in XXXX for $ XXXX I've paid {$250.00} a month since XXXX. Today, I owe {$19000.00}. The interest rate on my loan is currently XXXX. My debt has been bought from Sally Mae and sold at an unfair rate that I never approved. I lost my job due to the pandemic and took as much forbearance as they allowed. Now I'm all out of deferment/forbearance time and they're punishing me by raising the interest. I can not make any more full payments. They do not give options for partial payments. Because I can not make payments, they've started charging penalty fees. Navient calls my house 20+ times a day. They have called the police on me XXXX XX/XX/XXXX XXXX They will not let up, and now they are harassing my father. I am a single mom. I fear we will be homeless by the end of the year due to their predatory nature. How is this allowed?

Issue: Attempts to collect debt not owed
Subissue: Debt was result of identity theft
Consumer Complaint: I have repeatedly asked Navient for validation of this debt. I have never acknowledged the debt as being mine and neither has Navient. Letters were sent out XX/XX/XXXX. It was received by Navient on XX/XX/XXXX. No response from Navient. The next letter was sent XX/XX/XXXX. Letter was received by Navient on XX/XX/XXXX. No response. Next letter was sent XX/XX/XXXX. Letter was received XX/XX/XXXX. No response. In the letters that they have receipt of, I also asked them to cease and desist any communication ( including phone calls or electronic ( email, text, social media ). I did permit communication via US postal mail. They have blatantly refused validation and have ignored my request to cease and desist any form of communication except for US postal mail and have called me 121 times since XX/XX/XXXX. Sometimes 6 or 7 times in one day. On XX/XX/XXXX, I have mailed them an Affidavit of Truth, asking a final time to validate that this debt is mine by sending me the original contracts with my wet ink signature between myself and Navient. They still continue to call me throughout the days and just Monday, XX/XX/XXXX threatened me with XX/XX/XXXX is my " last chance '' to respond. However, I have been responding since XX/XX/XXXX. In the packet, that I sent XX/XX/XXXX, I have listed every violation as it relates to Navient continued harassment, non-validation of this account, inaccurate reporting to credit bureaus that is harming the reputation of my natural person. They have reported this account to the credit bureaus 4 times saying that the payment is late. They sent me a letter on XX/XX/XXXX saying that they conducted an investigation with the credit bureaus saying that the information they are reporting is accurate. What was included in the investigation? Who conducted it? Why don't I have any information from them as I requested in my letters I sent to them on XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. That is what I was requesting that they mail/send to me. Instead, they are reporting me as delinquent without showing me proof of anything. I also have strong reason to believe identity theft has occurred as I believe transactions have occurred using a credit card in my name by someone affiliated with Navient and now they have turned around and reported negative remarks on my consumer credit file fraudulently. The entire packet that was mailed to Navient on XX/XX/XXXX is attached.

Issue: Incorrect information on your report
Subissue: Account information incorrect
Consumer Complaint: My loan was first due for repayment XX/XX/XXXX. There has been no payments made by me or any representative of me through any fashion in well over the SOL for this loan. This loan was removed from my credit report several years ago due to the SOL and there are several inaccurate payments reported on my account that were never made in an effort to re-age this debt and begin collecting on it again. I have sent several requests to navient to provide proof of payments made including where there came from and they refuse to provide me with this vital information that would prove that this debt is well past the SOL to collect and report on. They now have debt lawyers contacting me daily and harassing me for debt that is well past the SOL and unable to do so on. they also are reporting on my credit a last payment of XX/XX/XXXX currently, which does not reflect the inaccurate information they have of XXXX in their own documents.

Consumer Complaint: Good Afternoon, I am filing a complaint against Navient. My student loans have fallen behind due to covid and financial difficulties. In their attempts to collect on this debt they constantly call my family, friends, references, in an attempt to both locate me and pressure me to pay money I dont have. ON XX/XX/XXXX I called them and told them specifically that they could not contact my family or friends. they had my contact information and address and knew where and how to find me. they continue to call my family leaving information that is private and personal in regards to my status with Navient and I desperately ask the CFPB to help
