Consumer Complaint: Due to Covid, I took a short forbearance on my FFELP loans owned and serviced by Navient last XXXX. I did not qualify for the Ed loan forbearance or zero interest program under the Cares act. However, Navient offered their FFELP consumers the option to do a 90 day forbearance. Due to the date I requested the forbearance XXXX late XXXX XXXX my XXXX payment was pulled as Im set up on auto pay. The XXXX payment appears to only have been applied as a half payment- despite the fact I paid the full amount. I did not pay for XXXX or XXXX of XXXX, but my payments resumed as usual in XXXX of XXXX. So the forbearance in my case was actually for 60 days, not 90. Last week, I was reviewing how my payments have been applied because my balance should be lower than Navient shows. When I viewed the individual payments for XXXX, XXXX, XXXX of XXXX, 100 % of $ 658 monthly payment had been applied to interest. Nothing had been applied to the principle. Prior to the 2 month forbearance, my payments had been {$8.00} less, so I was already paying the new interest amount that had accrued during the 60 days. I inquired why nothing had been applied to principle after my payments resumed, and received a one sentence email stating it was because I took a forbearance. This seems erroneous to me. They increased my payment by {$8.00} per month for the remainder of my loan to adjust for the 60 days of interest they didnt receive, then took 4 months of payments at {$650.00} each and applied it to interest only? Im disputing this because not only do I believe that forbearance scenario was handled in error, I believe that my entire account has been mishandled. I began making payments on these loans in XXXX with an original balance of {$34000.00} and now my outstanding balance is still $ XXXX. Something is just not adding up.

My tax returns were offset and when I retired the payments were garnished from my retirement payments and sent to the treasury department for disbursement for loans. In late XXXX I received a payoff letter. currently I have delinquent loans on my credit report however as of today XX/XX/XXXX those loans are listed with XXXX as having {$0.00} balance. Navient is stating I owe for a loan that XXXX is reporting has {$0.00} balance. Talking to a representative of Navient I was told that the loan was probably transferred to XXXX. If so. why is Navient still reporting on the same loan for the same exact loan type and disbursement date that XXXX is reporting with no balance as of today. Im confused and my credit is bad. Consumer Complaint: I was going through process of student loan forgiveness during Obama years. I was signed up, but Navient representative told me " they '' were offering a better program and that my loan would be forgiven due to low income. They advised me not to sign up for the Obama program, but to stay with Navient, as the Obama program was not a good choice for me. I panicked and canceled my application. Then, realized that I had been given false and misleading information. I was upset, embarrassed, and now I can not believe I listened to Navient! I have been XXXX for 20 years. I XXXX and work for XXXX. I do not make enough money to pay my loans. I am on income based payments. I feel like I am in a financial trap and wish I had signed up with the student loan program during Obama.

I then contacted their loan investigation department to find out more information about these loans. The loan investigation department sent me an email stating that they do not have any federal loans on file associated with the school in question. XXXX. XXXX, XXXX I sent Navient another debt dispute letter along with a copy of the email that was sent to me from their loan investigation department stating that there was no federal loan on file for the school in question. Navient 's response was that the loans were valid as they stated previously from the first response.

I understand that I have an 8 % interest rate, however, I also understand that I have other loans that have similar interest rates and the balances always go down. What is happening here? Consumer Complaint: I was offered a settlement for my loans via a settlement letter in XXXX XXXX. Neither the adjuster I spoke with, XXXX XXXX, nor the letter I received advised me that I was only paying one of three loans. Rather the letter references that the settlement offer, if paid by XXXX, NAVIENT would consider " the loans '' to be settled in full. In fact, the letter referenced " loans '', plural, three times. It never stated this was payment for only one loan. It also never made a distinction that Navient private sector was different from Navient Government Sector. It relied on me not knowing there was a difference. I was collecting unemployment due to Covid and had received a stimulus payment which I used to make that {$2200.00} settlement, believing I was paying my whole student loan debt. Again, at no time did the adjuster tell me there were three loans and nor did the settlement letter I received say I was only paying one. It said " loans '' plural. NAVIENT was deceptive in nature and banked on my ignorance. I paid the {$2200.00} in good faith on XXXX believing I was settling my whole loan obligation and was NEVER advised otherwise, either in writing or by an adjuster on the phone. The letter also promised to report this to all three credit bureaus. To date, this has also never happened. Another deception of NAVIENT. As far as I am concerned, my settlement payment was for all open loans, no matter what sector, that I had with NAVIENT. I consider the matter closed and demand that NAVIENT report as such to my credit bureaus, send me a letter confirming such in writing, and cease all emails and phone calls to the contrary. I don't owe them a XXXX more blood than they have already squeezed from my stone.

Gravens ( Mo ) 281 SW 715, 719, I may presume that no proof of the alleged debt, nor therefore any such debt, in fact exists. Note that the collector has to stop all collection activities until it can provide all the evidence. Under the FDCPA Section 809, Validation of debts [ 15 USC 1692g ] I have the right to verify any alleged debt on my credit report and if the alleged debt is being disputed, the debt collector shall cease.
