Consumer Complaint: My student loan servicer : NAVIENT continues report loan payments for Loan number 3 and also Loan number 4 which directly violates my loan borrowers ' right under the Cares Act as well federal and state consumer protection laws and the Fair Credit reporting Act. I have reached out to Navient at the beginning of the year XXXX or XXXX regarding a significant drop in my credit score by 30 points in attempts to resolve the dispute to no avail and then I attempted to dispute the action to the three major credit bureaus with no resolution. Lastly..I reached out to the Attorney Genersl office in writing this past XXXX and the correspondence received stated.. '' It was an civil matter. '' The way that they are reporting my payments and my account has drastically affected my score therefore causing more hardship financially during the COVID 19 pandemic ... .This is equally heartbreaking since I am a XXXX worker that has been struggling to work nonstop during the Pandemic.

Issue: Getting a loan
Subissue: Fraudulent loan
Consumer Complaint: I received a letter from XXXX in response to my previous complaint about the private loan threw Sallie mae. I spoke to a reprensative from XXXX and they told me to file a complaint threw your company which I am doing so. XXXX told me I could sue Sallie Mae. Sallie Mae was the original company I paid my private loan threw. I had previously spoke to Sallie mae .about this private loan and Sallie mae said that every thing was transferred to Navient.. Well since I did pay this private loan in full of which was taken out while I was a student at XXXX XXXX ( XXXX XXXX ) . And yes Salle Mae was my student loan company the change to XXXX also while I was still in school. I feel I have a right to file a complain about Salle Mae. I feel Sallie Mae should pay me back since they were the original loan company who knew about the private student loan in the first place. Most persons who attend school are more than likely to be thinking about completing the education not just what their student loan will have to be paid back after you finish your education.

Issue: Problem with a credit reporting company's investigation into an existing problem
Subissue: Their investigation did not fix an error on your report
Consumer Complaint: The company did not provide adequate information as to how the information was verified as accurate. The company did not provide additional information as to proof they are within legal reporting time limits to report the derogatory information I would like for the derogatory information to remove old outdated information from my credit file. The Department of Education has been reporting for over 7 years that I have or had made a late payment on a student loan account that was once owned by SalleMae. The loans were consolidated and have since been submitted to The Department of Education for discharge. I attended XXXX XXXX in 2009 the school was sued and closed down which made me eligible for a loan discharge. The derogatory remarks on my report are damaging. I would like you to consider removing the negative payment from my credit reports. I say this not to justify why my payments were late, but rather to show that the later payments are not a good indicator of my actual current credit worthiness. At the time of the late payment my hours were slowed due to caring for my mother who has now passed. I have been denied credit on several loan request due to these reporting Im unable to get a reasonable house loan and since Covid-19 with the economic impact lenders are hesitate to provide funding at reasonable interest rates. my loans are currently on an administrative deferment due to the class action lawsuit against the Department of Education and currently my application status for discharge is pending. I hope that department of education is willing to work with us on erasing these marks from my credit reports.

Subissue: Can't get other flexible options for repaying your loan
Consumer Complaint: I contact Navient on XX/XX/2021 about the late payments. They asked me if I am going to make the payments. I told them that I can not make the payments because of my work wages are not cover that monthly payment. I am currently still in school as part-time. Unfortunely I was taking one class because I had mental issues. I could take two classes but my mental issues hit me the hardest. So Navient had remove me from school deferment and start to demand me to make the payments on time. I can not afford that amount. I have tried to explain to them my situation and still make the demand for the payments which I still can't.

Consumer Complaint: Navient has taken immediate negative action against me because I filed a borrowers defense loan forgiveness request : 1. Before I filed a borrowers defense loan forgiveness request ( case # XXXX ), I had a forbearance in effect with a payment start date of XX/XX/XXXXper letter dated XX/XX/XXXX. 2. On XX/XX/XXXX, I filed a borrower 's defense loan forgiveness with Federal Student Aid : an office of the U.S. Department of Education 3. On XX/XX/XXXX, I received two letters from Navient dated the very same date of XX/XX/XXXX a. The first letter says, The U.S. Dept of Ed has notified us to process an administrative forbearance on your loans. b. The second letter said that there has been an adjustment of my forbearance and says, your forbearance period started XX/XX/XXXX and ends on XX/XX/XXXX. 4. Again, before I filed a borrowers defense loan forgiveness request, I had a forbearance in effect with a payment start date of XXXXper letter dated XX/XX/XXXX. 5. In sum and substance, after I filed a borrowers defense loan forgiveness request, Navient changed my loan repayment date to 4 months earlier than when it was scheduled to move from forbearance to repayment. To be clear, I had an existing forbearance before I filed for Borrowers Defense and that forbearance was scheduled to end with a XX/XX/XXXX repayment start date. 6. In addition, late fees have also been applied to my account. 7. Note that this is not the first time that US DEPT OF ED followed my loan forgiveness request with prompt negative actions. The first time I filed a loan forgiveness directly with Navient, two XXXX Police Department Squad cars came to my apartment to remove me based on a call that Navient placed to the police department ; at least six police officers came into my apartment geared up to forcefully remove me all because I made a loan forgiveness request based on XXXX and provided Navient with medical record ( To this day, I am traumatized by this event because a man in my area had a similar issue someone sent the police to his house to bring him to the XXXX ward and the police ended up XXXX the man ). When I contacted US DEPT OF ED about this matter, a representative by the name of XXXX XXXX who represented that he was with investigations threatened me with arrest and he called me a XXXX XXXX. XXXX XXXX also stated that he was with investigations, and if I did not pay my loans, the police would return to arrest me. I have kept this experience privately and have been suffering inside because of it, but I hope that you can help me. 8. For various legitimate reasons, I have requested documents from US DEPT OF ED so that I can verify and calculate the purported student loans but US DEPT OF ED has not provided the requested documents.
