Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I originally obtained the student loan with sallie mae from XXXX to XXXX. I call myself consolidating the loans for {$1000.00} with an 8 % interest rate and another loan for {$19000.00} with an 4 % interest rate, and the {$19000.00} had got to be that high because I could not keep up with the payments and needed forbearances. My original loan was only {$10000.00}. I didn't know that the {$1000.00} loan of 8 % would bring my {$19000.00} loan of 4 % would be combined and rise to the highest 8 %. I was under the impression that it would come down to the 4 % or at least close to it, but the total loan shot up to the 8 %. That caused me to have a {$20000.00} loan with an 8 % interest rate. I was not told it would go up the highest 8 % loan. I filed a complaint with you all on sallie mae stating that sallie mae should have informed me that my payments would go up because the interest rate went higher on the {$10000.00} loan which is loan shark practice. Nothing happened from my complaint. Sallie mae only transferred or sold my loans to Navient. Now Navient is the loan company who is only resulting in me struggling to make almost {$400.00} per month payment for an original {$10000.00} loan and ruining my credit because my loan have exploded to almost {$30000.00} even though I have paid over {$20000.00} on it. Also, I tried to take advantage of the presidential deferment offered by the federal government due to the COVID-19 pandemic but i was not able to do but a few months, and the Federal government said that we had until the end of XXXX. But Navient was having me to re-apply for deferment on a MONTHLY basis, and on top of that charging me deferment interest which I thought the federal government said that no deferment was to be charged. Now the federal government has extended the COVID-19 student loans until the middle of XXXX, but I am still struggling to make XXXX XXXX monthly payments and if I ask for a deferment I would have do it on a monthly basis. I got FEDERAL STUDENT LOANS when I borrowed them and not private loans so I should be given the same chance to have my FEDERAL STUDENT LOANS deferred without interest charged and not a monthly basis with interest charged. I also should be granted a payment reduction due to not being lawfully and rightfully informed that my payments would skyrocket if I combine my {$1000.00} ( with 4 % interest ) student loan with my {$19000.00} student loan ( with the 8 % interest ) and not have them both shoot up to 8 %.

Issue: Incorrect information on your report

Subissue: Account status incorrect

Consumer Complaint: We chose Navient in an effort to consolidate student loans. We were under the impression Navient provided loan consolidation. Instead, Navient set up payments to the individual loans, each with varying interests, charging fees for their " consolidation '' services. After several years of payments, we noticed that the principal balance had reduced very little and decided to seek a new company that provided true debt consolidation. The final balance of {$41.00}, XXXX was paid to Navient on XX/XX/XXXX. On XX/XX/XXXX, Navient showed a XXXX XXXX XXXX in the amount of {$820.00}, which was never disbursed. In XXXX, Navient continued to charge us even after the balance was paid off. We called Navient and they said they would correct the problem. According to the attached statements, Navient did reverse the charges on XX/XX/XXXX and still had not distributed the XXXX XXXX XXXX shown on the statement. Beginning in XX/XX/XXXX, Navient began charging late fees on a nonexistent balance and continued to do so through XXXX of XXXX. After several calls to Navient, they promised to open an investigation and correct the errors. The customer service representative admitted there was a problem, stating that it was " a mystery and a puzzle ''. Despite repeated attempt at correcting the issue and a promise of an investigation, Navient proceeded to report the balance to my credit agency which has now affected my credit. The company has still provided no solution, has not disbursed the {$820.00} Credit Balance Refund, and continues to charge late fees and report balances as unpaid when the statement clearly shows the opposite as evidenced by the attached statements.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I have two XXXX loans that are being serviced by Navient, and per their own website these are federal loans. I have been under an XXXX repayment plan since graduation but this is now the second time that I have been kicked out of the XXXX program and had my interest capitalized. I will NEVER pay my loans off at this rate. They are saying that my loans are actually private loans and that they don't qualify for the XXXX pause. They sent me one letter saying my payment was going up a month ago, and then just after that the student loan pause was extended again. And now when I log into the XXXX website, it shows those Navient loans listed and when I go in to fill out the recertification paperwork for the XXXX it says I'm not due to recertify until XXXX. I got screwed over once already a few years ago when they rejected my XXXX application and didn't tell me and I only find out when I see a huge charge on my bank account and find I had thousands in interest capitalize.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: I borrowed money XXXX XXXX XXXX XXXX XXXX in XXXX. Due to a family health crisis, we had this loan in forbearance for about 4 years from XXXX XXXX. Then due to losing our family business, we declared bankruptcy in XXXX and were successfully discharged in XXXX. We were told that student loans can NEVER be erased in bankruptcy. Navient told us nothing about the hardship discharge that we could apply for just that when we ended bankruptcy this loan would still be there. The entire 7 years while we were in bankruptcy the loan that started out at XXXX $ had over XXXX $ in interest added on to it. Since we can only make the minimum payment and interest rate of 7.25 % that is still accruing on the loan, it has ballooned to over XXXX XXXX Since leaving bankruptcy we have not missed a payment and the loan still does go down. I am a public school teacher and have applied for forgiveness and have been turned down. I have tried to refinance and have been turned down. I have applied for income based repayment and been turned down. At this rate we will NEVER pay this loan off.

Issue: Written notification about debt

Subissue: Didn't receive enough information to verify debt

Consumer Complaint: I do no know the origin of this loan as when I contact Navient they state they have no record of me at all. However I have two charge offs my credit report in which I disputed and they reaffirmed as XX/XX/2022. How can you re affirm a debt you can not prove the orgin of? I am trying VERY diligently to purchase a home and this is standing in the way of me having a stable place to live. I need these two negative items removed from my XXXX credit report so I can have a home.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I am writing in regards to Navient Private Student loan company. In 2013 My husband and I filed XXXX XXXX bankruptcy and included Navient formally known as Sallie Mae in to my list of creditors. This company has been aggressively contacting me after my bankruptcy discharge trying to collect payment. I did not voluntarily make payments. At the initial meeting of creditors Navient formally Sallie Mae never showed up at court to make a claim. At the meeting of creditors Navient would have been able to make any claims for payment to them. Navient Instead waited till the end of our bankruptcy to collect the principal plus interest during the entire time of my bankruptcy. After been harassed several times by Navient we agreed to pay them because of the undue stress they were putting on myself and my family. After my bankruptcy was discharged, I initially told Navient that I didnt owe them any more money because it was discharged in our XXXX XXXX XXXXankruptcy as being a non-qualifying student loan. I verified this information from the college I attended to. Navient did not give us a Private qualifying student loan. After the bankruptcy discharge Navient repeated to call me and my husband and sent me letters colleting payment. I was told that I must make payments and my student loans cant be discharged and they would report me late to the credit bureaus if I didnt send in a payment. After going through the bankruptcy process, I was in fear of them reporting me to the credit bureau late and messing up my credit. At this time, I have records of my bankruptcy and a record of every qualifying student loan that I received during the time enrolled at XXXX during my enrollment.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: In the past I have written to XXXX XXXX, XXXX XXXX, Department of Education, and the XXXX XXXX XXXX. In all my efforts to obtain resolution I have failed. I borrowed roughly {$10000.00} in XXXX loans from XXXX. I did rehabilitate my loans and have been paying for 28 years now. I have paid already more than {$28000.00}. I am almost finished. Yet, I am not finished with the fight. I was an incarcerated individual for a period exceeding 10 years. During that time I was sent many many bills from Sallie Mae which is now Navient. Though I was pushed into forbearance and financial hardship conditions, never was I told that I couldve applied for public service loan forgiveness as I was incarcerated and working the entire time. It would have been an impossibility to make payments and continue correspondence with the company. During incarceration there a long stretches where an individual makes anywhere from $ XXXX {$.00} an hour. It would take months just to buy a book of stamps. Though my life has completely changed and I have achieved a successful status Im still facing debt with the embattled Navient company. On the Internet I found terms that state, from federal student loan.org-the government will write off loans if the borrower is to be incarcerated for a period exceeding 10 years and the debts can be reinstated when the individual is released. I was never informed of this condition and my loans were sold from company to company before landing with Navient. I watched the interest to get capitalized and fees accrue while I remained helpless. I am confident there is more than just me that face this. And, it is an incredible burden to be faced with as soon as you step out of a long-term incarceration. I should like to see this group of people get some resolution where college debt is concerned. Currently, there is much talk about loan forgiveness and pause in payments, but no one talks about those who have paid the price and changed their lives. It has been personally, as if I am being punished forever and I dont think thats fair. Im confident that I am not alone. And I am also confident that no one has yet addressed this group of indebted folks. Please, take the time to look into this kind of situation and if you need any of my records I have saved everything. Feel free to contact me. Thank you for your time. I appreciate your attention to this matter.

Issue: Getting a loan

Subissue: Confusing or misleading advertising

Consumer Complaint: When I applied and received my loans I did not want to use a cosigner. I could not get the loans without one. At the time my loans were issued they assured me that after 6 months of on-time payments I could have my cosigner released. I have made on-time payments ( most of which are set on auto-pay ) for over 2 years. I completed the paperwork to have my cosigner released and was denied. Had I known they would have refused to release my cosigner as they said I would not have taken out the private loans.
