Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I consolidated my loans in XXXX. In XXXX Navient told me that if I want a new loan servicer I had to consolidate again. The consolidated my loan and assigned me back to Navient. I paid {$42000.00}. I called Navient and said to cancel the consolidation because my servicer was not changed. They refused and all of the money I paid was stolen by Navient except for {$1000.00} that was credited toward principle. I have applied for PSLF and XXXX only has payment history from XXXX. Navient must provide them with my full payment history in order for me to have my loans forgiven. Navient is a criminal corporation and is exiting the student loan servicing business after pillaging students for decades.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Navient is trying to break their terms of the IBR program by mis-reporting my payments and 'fixing ' the estimated payoff date to some time far further in the future than the Federal Guidelines allow under the IBR program. I believe they " fixed ' the date by putting me in forbearance when I actually qualified for {$0.00} payment structure under the IBR program. This may have illegally extended my payoff date. Their 'no action ' correspondence has been attached. Navient, my loan servicer, illegally extended the " forgiveness date estimate '' for three of my loans ending in XXXX, XXXX, and XXXX to XXXX. Under the IBR program, they are estimated to end roughly 25 years after origination. That estimated date is around XXXX based on my loan origination. All of my other loans, that were originated within the same timeframe are being reported much differently. Loans ending in XXXX, XXXX, XXXX, XXXX, and so on. These three are being widely mis-reported, while the other loans are showing to estimate loan forgiveness at a later date also, XXXX and beyond. When Navient customer service emailed me back after my inquiry, they refused to make the proper adjustments whereby potentially collecting beyond the Federal forgiveness date based on IBR guidelines.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: Navient has contacted me on several occasions about 'special programs ' they have to help reduce private loan debt faster. I have applied for 2 different programs, one in XXXX of XXXX, in which I made 20 payments at $ XXXXmonth to a company called XXXX XXXX ( supposedly an affiliate of Navient ), and another I enrolled in for a loan for the amount of {$5500.00} in XXXX of XXXX. I paid Navient $ XXXX/month from XXXX XXXX XXXX. The company ( Navient ) then asked me to 'reenroll ' for the program because they had to assess my income again. I went through the process, then started receiving debt collector calls the month after from Navient, stating my loans are now in arrears. Original loan amount # 1 : {$5500.00} Today 's loan amount : {$17000.00} Original loan amount # 2 : {$2800.00} Today 's loan amount : {$7100.00} Original loan amount # 3 : XXXX Today 's loan amount : {$6100.00} Clearly Navient is making it impossible to pay off any loan, even the small ones. No one can explain why the amount keeps rising, even as I make payments. These are private loans that I am requesting be absolved, as they are clearly unable to work with consumers, unwilling to assist during financial difficulty, and unable to clearly explain why to ANY question asked.

Issue: Dealing with your lender or servicer

Subissue: Need information about your loan balance or loan terms

Consumer Complaint: The Spousal Consolidation loan program originated in XXXX as a way for married borrowers with student loans to consolidate their individual student loans into XXXX loan for which they were both jointly and severally liable. Due to loan terms, couples would be forever bound to each other, equally responsible for each other 's debt, even if they later divorce, became XXXX or even died. However, by XXXX the disastrous spousal loan consolidation program was done away with by Congress. These loans essentially tied spouses to each other for life, even though they may have divorced or been a victim of spousal abuse. Today, there are only XXXX in payment, yet there could be many more in default or forbearance. Our Story In XXXX, with a balance of about {$130000.00} in student loans, we were advised and recommended by our loan servicer Sallie Mae ( a government entity, at that time ) to consolidate our loans into a FFELP Joint Spousal Consolidation loan. Based on our low income, again at the recommendation and advice of the loan servicer, we agreed to pay based on the Income Driven Repayment plan. The effect has been disastrous. To date, we have paid close to an unconscionable {$200000.00}. We have not missed XXXX payment, even during the Covid pandemic, as Spousal Consolidation loans did not qualify for the payment pause, granted to most all other student loans, by the President. Each year we continue to pay, yet make no progress on the principal balance. Currently we pay approximately {$1600.00} per month. The current balance owed is a shocking $ XXXX. This is predatory lending, an action allowable and partaken in by the U.S. government. Together, we have served the public in our careers for a combined forty-four years. Unfortunately, even with the requisite number of years, we do not qualify for public service loan forgiveness ( PSLF ) program because our FFEL joint spousal consolidation loan is " barred. '' In XXXX of XXXX President Biden, through the Department of Education declared a temporary expansion to the previously strenuous requirements of the Public Service Loan Forgiveness ( PSLF ) program. Specifically, the declaration/executive order stated, [ b ] orrowers who currently have FFEL, Perkins, or other non-Direct Loans, will get the benefit of this limited waiver if they applyby XX/XX/XXXX. Having an FFELP spousal consolidation loan I was excited and took the steps outlined in the Press Release. However, our current service provider Navient, informed us that FFELP Spousal Consolidation loans will not qualify under the waiver, despite the announcements that all FFELP loans would be waived. For the PSLF program waiver, FFELP borrowers must consolidate their FFELP loans via the federal direct consolidation loan program ( FDLP ) before XX/XX/XXXX, to qualify for the benefit. Currently Spousal Consolidation loans can not be re-consolidated into a FDLP consolidation loan, and therefore these public servants, after a lifetime of service, can not take advantage of the PSLF program. Generally, consolidating loans is a good financial plan. However, in this case when we consolidated our loans, we were unaware and never told : that we would never be allowed to reconsolidate into the direct consolidation loan ; that we would never be allowed to refinance at another rate ; that we would never be able to have the loan forgiven in bankruptcy ; that we would never be allowed to enter public loan service forgiveness. THERE ARE NO OTHER LOANS AS RESTRICTIVE AS THE FFELP JOINT SPOUSAL CONSOLIDATION LOAN, offered by or on behalf of the US Government. We have paid our original loan amounts plus an additional $ XXXX, yet still owe $ XXXX. While we agree that we should be responsible for paying our debt, which we have done, we believe it is irresponsible for the government to charge interest in the amount of $ XXXX over the life of a {$130000.00} student loan.

Consumer Complaint: Today on XX/XX/25 I spoke to two representatives both who questioned me while sick and while I lost my job due to my illness questioning me about my future. They have failed to document my account with the facts for years which is that I never graduated XXXX due to a recession, false information provided by the school, and XXXX giving out more loans than they knew I could actually pay back.. those are the facts.. they have been harrsssing me for years even while Ive been sick they have harassed me.. I wish for them to no longer contact me unless it is documented. I also would like a full record of the communication transcripts between me and their representatives because I plan on matching it up with my documents and using it fully against them. And they can also take me to court .. and Im not talking about small claims court either.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: I entered into a rehabilitation agreement with Navient ( made payments to XXXX XXXX XXXX- see below from their website ) in XXXX and paid XXXX on-time payments. Based on the Federal Moratorium Law instituted by the Federal Government I did not make my last XXXX payments. Based on the new law I would receive rehabilitation credit for the last XXXX payments even though I did not actually submit these payments. Consequently, I believed my rehab program was successfully completed on XX/XX/XXXX. I initially called XXXX and spoke to XXXX ( XXXX XXXX ) to check the status of my rehab program. She advised me that I indeed completed the rehab program with their company and sent the information to Navient. She also advised me to ask a representative at Navient about my post-claim status. I called Navient on XX/XX/XXXX and spoke to XXXX. She advised me ( after getting guidance from her supervisor ) that I would have to pay the last XXXX remaining rehab payments to XXXX or I would have to " wait in the back of the line '' behind all of those who made the XXXX required rehab payments per Federal law. I explained to her about the Federal rehab payment moratorium and that I should have received credit for the last XXXX remaining payments based on this law. She said she could only tell me what her supervisor stated I must do to finally have my loans rehabilitated. I was highly upset as I am finally trying to pay my loans back and improve my credit. This is not possible if they do not allow me to rehab my loans, successfully. I feel Navient is ignoring the law and reviewing my rehab program with prejudice. Subissue: Don't agree with the fees charged

Consumer Complaint: a federal loan was taken 2010 for my daughter. She defaulted and Navient picked up her loan. She has been paying them for her loan. The IRS has been keeping my ( her mother ) tax return saying that I owe for her defaulted loan. She is still paying Navient and is current on her account. I have tried to contact Navient for the past few years and can not get an answer as to why this is happening. Initially I was told that I owed somewhere around {$24000.00}. The IRS has been keeping my returns of approximately {$1200.00} - {$1800.00} a year. I have tried to find answers thru them and was told to go thru Navient to no avail. Is there anything that you can do to help us?

Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: I was in college XXXX. I was advised to consolidate my loans and they locked me into an 8.25 % interest rate. I struggled to pay my loans after college, I was advised to go into economic hardship forebearance for 3 years. I was also then advised to go into regular forebearance for 3 years. I was in forebearance for 6 years. NO ONE at Sallie Mae or then it became NAVIENT ever explained to me that the interest that accrued would be added to the PRINCIPAL of my loan and then I would get charged 8.25 % on that even higher amount. " CAPITALIZATION '' is what it was called and I never knew what this meant or the detrimental effects it would have on my loans. My loans started at XXXX and are now {$230000.00}. This is ridiculous. I will be paying these until I die. Sallie Mae and Navient had predatory practices to me with my XXXX loans that they locked me into 8.25 % forever. These loans were further complicated because I could not afford to pay them or keep up with my credit card debt after graduation. I was being sued by XXXX so I was forced to declare bankruptcy. I was told that my loans were not eligible for bankruptcy discharge. The judge ruled that I was not eligible for Chapter 7 to have my credit card debt wiped, but that I must declare chapter 13 and PAY all the XXXX in credit card debt I owed. The IRS put all of my student loans into forebearance again and forced me to pay off my credit cards over a 5 year time frame. The credit card companies were also predatory. XXXX especially. They came to my college campus in XXXX and teased us with free XXXX XXXX tshirts to get a credit card and then gave all of us HUGE spending limits. All my friends did the same thing I did. I had NO parental help in college, I was struggling to make it myself. My parents refused to support me financially. I had 2 jobs the entire time in college. So my student loans were in forebearance for several years. I was a victim of predatory practices by Sallie Mae/Navient as well as XXXX. The banks have ruined my life. They locked me into 8.25 %. I never understood that I have private loans -- and someone explained to me that I could switch them over to Federal loans and then I would be eligible for more benefits. I did this and sadly it STARTED OVER my payment clock. So ALL the payments I made do not go towards my XXXX Also, because I graduated earlier, I am NOT eligible for the newer XXXX plans. This is ridiculous. This system has failed me over and over again. The banks have ruined my life. The banks have had a XXXX XXXX XXXX XXXX for all these years. I request a review of these issues and some kind of hopeful relief.
