Issue: Dealing with your lender or servicer

Subissue: Received bad information about your loan

Consumer Complaint: This complaint is to report continuing a issue of Navient illegally altering the terms of my loan without my consent, forging my signature and harassing my family. The complaint XXXX This complaint documents that Navient has XXXX providing false and misleading information about my student loans for years. After the company responded to complaint XXXX Navient placed one of my student loans on forbearance at a very high interest rate without my knowledge or consent. Altering the loan in such a manner clearly violates the initial loan agreement on the lenders side and thus makes this loan eligible for discharge under new federal law.

Issue: Dealing with your lender or servicer

Subissue: Trouble with how payments are being handled

Consumer Complaint: Upon looking into my payment history and my account in general I have noticed several areas of discrepancy. I have not requested years of forbearance yet there are years or forbearance periods on my account. I have had this consolidation loan with Navient formally XXXX XXXX since XX/XX/XXXX. I XXXX college in XXXX. Yet instead of having repayment each year I have huge gaps in my repayment using forbearance that I did not request, the first being from XX/XX/XXXX XXXX when it then states I entered repayment. Then I have Forbearance periods for a month or 2 in-between repayments until XX/XX/XXXX when against my knowledge I was placed in Forbearance status again this time from XX/XX/XXXX to XX/XX/XXXX. ( during COVID ). I am a family of XXXX and have had a " XXXX '' payment each time I have recertified my plan so there is no reason that I would request forbearance since my income has remained stable. I am more that happy to provide family size and tax return information during the years of unauthorized periods of forbearance. I have called and attempted to speak to representatives who hang up on me. This is unacceptable practice and if not resolved I will be seeking further action.

Issue: Dealing with your lender or servicer

Subissue: Don't agree with the fees charged

Consumer Complaint: I'm the co-signer with a Navient account. This loan started in 2008 at {$15000.00} and now the balance is {$11000.00}. I have automatic deduction from my bank account. The accrued interest just went up this month to {$54.00}. My payment is {$130.00}. The interest rate went up to 5.75 %. I had no warning. I called about this today and the person helping me ( kids playing in the background ) just kept repeating what was on my bill over and over. At this rate, I will be dead before it's paid off. She let me know my interest rate was better than most people. If this was a car loan, no one would buy a car. I just had to vent.

Issue: Problem with a credit reporting company's investigation into an existing problem

Subissue: Their investigation did not fix an error on your report

Consumer Complaint: In XXXX after my credit score dropped almost 60 points Navient reported my loans 90 days past due but I did a deferment. I was not notified by Navient before deferment ended. I submitted a dispute the same day Navient put a forbearance in place that I was not aware that I had available to me. On each loan with XXXX and XXXX XXXX I placed reporting wrong and in forbearance. Yesterday XXXX sent me a notification that my dispute was completed and Navient changed nothing and left all loans as is. I called XXXX and they told me to upload proof so I did. This morning I got another notification that another dispute was opened giving Navient another 30 days to fix it. I brought this to Navient attention yesterday and quickly they reported to XXXX XXXX that my loans were current. Also I called Navient about the Settlement list and they would not provide any information at all. I called the Sc Attorney General 's office in SC and got a call this morning stating I wasn't on the list and I have loans that were private and also loans for for-profit schools. And again Navient will not give me any information. I have had nothing but headaches with Navient since they were Sallie Mae. I did a rehabilitation in XXXX for Navient loans and was told by XXXX the guarantor that I could have those loans transferred to my other servicer who is wonderful but that never happen. For the damage to my credit I would like to sue Navient and XXXX. The loans for XXXX XXXX also belong to once was XXXX XXXX. In XXXX I believe XXXX XXXX switched the name to XXXX XXXX. I only had a few months left until I finished and they made me start all over again and take out loans for classes I already took. XXXX XXXX took a numerous amount of financial aid from me and when my step dad passed I took a short break and when I tried to return I was denied entry. The dean said I had attended too many colleges???? I just attended there almost a year????? They were also a for profit school that closed down along with XXXX. My XXXX XXXX loans are with XXXX I believe. I asked Navient for the forms for forgiveness on those loans and they stated they didn't have the forms and that if the school did not close I probably wouldn't get. I am so so upset and tired of Navient.

Consumer Complaint: This company appeared on my credit report about 3 years ago, with a debt that shows from 2008. They have called my mother tell her that I had an emergency situation and that they need to get in contact with me. They have called my local union hall and relatives. I have requested that Navient validate the debt on 3 different occasions, once over verbally and twice in writing. I have filed with fraud claims with all three credit bureau and have successful at removing item from one. I reached out for legal advise and the stated that I should file my complaint with the Consumer Financial Protection Bureau.

Consumer Complaint: ( 1 ) Already Approved IDR from StudentAid.gov : I am attempting to provide real facts for already approved IDR for a New Navient email received on XX/XX/XXXX. I followed Navients prior suggested and continued suggested link TO StudentAid.gov. The message stated on StudentAid.gov that my already approved IDR is not due to recertify income until XX/XX/XXXX. ( XXXX XXXX ) ( XXXX ) XXXX XXXX XXXX Navient logged in web account already approved IDR from studentaid.gov complimentary copy uploaded with Navients system confirmation. The already approved IDR was embedded within a PDF document. I provided this three times to Navient to clear up communications and validate IDR. The first uploaded Navient PDF didnt get acknowledge via phone communications, therefore, I took image receipts of the other two from Navients system confirmation. Navient kept saying they didnt receive anything from me, however, again, my logged in web account, Navients system confirmation stated otherwise. Issue: False statements or representation

Subissue: Attempted to collect wrong amount

Consumer Complaint: On XX/XX/2022, I filed a complaint ( XXXX ) against XXXX XXXX XXXX with the Consumer Financial Protection Bureau XXXX The complaint stated, " On XX/XX/2022, XXXX XXXX XXXX -- XXXX XXXX XXXX, XXXX, XXXX XXXX, XXXX, XXXX XXXX XXXX accessed my XXXX Credit Report purportedly under the guise of " servicing my account. '' I have no account with XXXX XXXX XXXX. I suspect what occurred to me is a regular practice of XXXX XXXX XXXX. Clearly, charges, either of a criminal or, at the minimum, civil nature are warranted. Furthermore, XXXX XXXX XXXX must not be allowed to purport to any entity, including credit reporting agencies such as XXXX, that it has a business relationship with me of any kind that would meet any required jurisdictional parameters. '' XXXX XXXX XXXX responded by stating, " On XX/XX/2022, there was an account placed by Navient Solutions , LLC ( Navient ) with XXXX for collection. You were listed as the party responsible for the account. XXXX does not own the account but was attempting to collect the account on behalf of Navient. Navient contracted with XXXX as a Third-Party Collection agency for the purpose of collecting the above-mentioned account. Any actions taken by XXXX were in connection with proper attempts to collect the account. However, XXXX did not report this account to the credit bureau. On XX/XX/2022, the account was returned to Navient. If you have any questions regarding the account, please contact Navient at XXXX. We apologize for any inconvenience you may have experienced, and hope this brings this matter to a conclusion. '' I already in the past have addressed a complaint against Navient 's methodologies and its purported jurisdiction to be attempting to collect any debt from me. So, clearly, what Navient has chosen to do, also in retaliation, is direct the same purported debt to an outside party, XXXX XXXX XXXX most recently, to aggresively engage me while Navient pretends to sit out the sidelines with clean hands.

Issue: Getting a loan

Subissue: Fraudulent loan

Consumer Complaint: Navient states I am not eligible for the private loan forgiveness settlement because my private loans were in forbearance, but the qualifications state only that a person needs to have missed XXXX consecutive payments before XX/XX/XXXX, and states nothing about forbearance. I was in forbearance because they stated at the time that was my only option since I couldn't pay and if I didn't that the loans would go into default and then they could garnish wages and put a lien on my house and ruin my credit. So I was forced to go into forbearance because of their threats. Even today, XX/XX/XXXX when I tried to speak to a supervisor, she stated my loans are set to go into default next month and that they can garnish my wages and put liens on my home, which is their scare tactic. My interest rates are really large and they won't lower the rates and they refuse to acknowledge that I do qualify for the forgiveness. They harass me at least 4-5 times per day. I pulled up my payment records to Navient and it clearly shows I've missed payment numerous times and the ONLY reason I did the forbearance was due to them stating what would happen to me if I didn't and they never clearly stated the truth to me. Again, no where does it state that if your accounts were in forbearance you couldn't get the forgiveness. When I brought this up to the supervisor she then stated I didn't qualify because I had to miss XXXX consecutive payments. When I told her I missed XXXX payments she then stated I didn't qualify because of forbearance. It's not right if I don't get it when I felt pushed into forbearance in order to keep my wages from being garnished. I did a printout of my account with Navient and I didn't make any payments from XX/XX/XXXX - XX/XX/XXXX which is 13 months AND from XX/XX/XXXX - XX/XX/XXXX which is 9 months. The requirement for forgiveness states : " The private loan debt relief will primarily go to borrowers who took out private subprime student loans ( made to borrowers with low credit scores ) through Navients predecessor, XXXX XXXX, between XXXX and XXXX, and then had more than seven consecutive months of delinquent payments prior to XX/XX/XXXX. '' It states nothing about forbearance and I definitely qualify. I told the supervisor that I was filing a complaint and she then told me that my account is going into default next month and she didn't think this complaint would be addressed by that time and therefore they could put a lien on my house, ruin my credit and garnish my wages. I DON'T DESERVE THESE THREATS.

Issue: Struggling to repay your loan

Subissue: Can't get other flexible options for repaying your loan

Consumer Complaint: In XX/XX/XXXX I applied to Navient to waive the balance of my private student loans based on my XXXX XXXX XXXX XXXXXXXX. XXXX ( for the federal student loans ) has an 'income-based repayment program ' and when I informed that company of my situation, and of my current lack of any income, they immediately placed me on a XXXX ' repayment program with an annual review of my income. I am awaiting a determination of social security XXXX ( which I also applied for in XX/XX/XXXX ) and in the interim I have no income and have had no income since XX/XX/XXXX. Navient has no 'income-based repayment ' program. I paid on all the loans for twelve ( 12 ) years straight from XX/XX/XXXX without missing a payment until XX/XX/XXXX when they stopped due to the pandemic. My income never returned and then I found out in mid/end XXXX that I have brain issues involving lesions, structural abnormalities and mental cognitive/processing deficiencies. I applied to Navient for the discharge of my private loans and had to send medical records- including a direct report from my board-certified neurologist - to their guarantor, XXXX XXXXXXXX XXXX I was informed via a teleconference with a XXXX XXXXXXXX representative in XX/XX/XXXX that their recommendation to Navient would be that I am truly totally and permanently XXXX. At the end of XXXX, I received two ( 2 ) letters, each dated XX/XX/XXXX, from Navient. XXXX letter acknowledges my total and permanent XXXX and waives a portion of the loans ( {$3800.00} ) entirely. The other letter states Navient is removing interest accrued and capitalized ( which there shouldn't have been any, as I never missed a payment throughout my repayment period until the pandemic ), is setting my interest rate at '0 % ' and then instead of waiving the remaining amount, Navient assigns a random amount due of {$17000.00}. Then the letter sets forth what sounds like a joke : If I can pay {$14000.00} within 30 days of the date of the letter - namely by XX/XX/XXXX - then it will waive the remaining amount due, ( thereby apparently saving me {$2600.00} ). Needless to say, with XXXX income I can not afford to pay any amount, and I find their response to be cruel. It is as if they acknowledge the total and permanent XXXX and then say, 'we don't care ; pay anyway. ' When I called the XXXX ' number on both letters ( the same number was on both ) I was told there was nothing they could do and that 'I signed a promissory note ' ( back in XXXX with XXXX XXXX and not Navient... ) and then gave me another number to call within Navient to possibly help. That number turned out to be their 'default ' department, and of course that department had no clue, as they had no record of my loans, as the loans have never been in default. I was then given the number for a federal aid group - XXXX - and when I called them, I was told they only address federal student loans and not private loans, and I was referred to this consumer financial protection bureau. Up until this time, I was unaware of this group 's existence. I am at a loss as to what else I can do. I have followed all directions given and was amazed that Navient can find me to be totally and permanently XXXX and yet still demand payment. I have no sources of income or family members who could help. I am single and without children. Social Security has informed me a decision to award XXXX might be made by XX/XX/XXXX. Meanwhile I am living off credit cards to keep food in the fridge and keep the lights on. I need this student loan XXXX based upon my total and permanent XXXX within the next thirty ( 30 ) days, by the end of XX/XX/XXXX, as it appears that Navient will be all too happy to destroy my credit rating when they receive no further payments from me, let alone a payment for five figures! Thank you for your time and attention to this matter.
