Issue: Struggling to repay your loan
Subissue: Can't get other flexible options for repaying your loan
Consumer Complaint: In early XXXX, there was a huge lawsuit against Navient from the state of California to wipe out private loans for those that attended the listed " for profit '' schools throughout the US in which one of the schools listed is XXXX XXXX University that I attending from XXXX. After reading an article about this lawsuit, I was expecting a letter for some or all forgiveness of my private loans but I received a statement of payment instead. I called Navient why my private loan was not part of the lawsuit and they mentioned it was because my loan was not in delinquency therefore my loan was not a part of the lawsuit. I explained to them that if I had not attended school in the past 2 years, my loans would have been in deliquency as my loans were in forbearance for several years because I couldn't pay what was expected from Navient. They tried to tell me that I would be able to pay off my interest only for 6 months for about $ XXXX month but even that isn't manageable for me. I asked them if I could someone come to the agreement of paying XXXX or XXXX a month toward my loan but they said I can but it would still put me in default. Since then I have not been able to make a payment and am now 5 months behind so recently they sent a letter that they are going to take legal action. I don't understand why my loan was not a part of the lawsuit. Despite the status of my loan, the lawsuit that won against Navient were allegations against the for-profit schools that took advantage of borrowers by adding illegitimate charges and predatory lending practices. I graduated in XXXX with XXXX in debt and now I am more than XXXX in debt in which I will never be able to pay off. Please see the link below about the lawsuit. https : //www.navientclassactionlawsuit.org/do-i-quality-for-navient-settlement/

Subissue: Trouble with how payments are being handled
Consumer Complaint: Navient has told me I am behind 2 payments! Interesting enough I made a payment of {$220.00} plus an additional amount which was less than the {$220.00} and am no longer 2 payments behind. Their accounting system is a joke!!! I have made payment to the lender, Navient-some payments were late, but not 30 days late in recent history ( meaning more than 18 -24 months ). I made 12 payments in XXXX and 7 in XXXX through XXXX XX/XX/XXXX. I expect to pay a late fee when paying late. I made 2 payments in XX/XX/XXXX and was told I had missed a payment as XXXX 's payment was never applied to XXXX from the extra XX/XX/XXXX payment. In addition, I was told I had missed several payments previously, did not qualify for the CARE plan, did not qualify for reduced payments in the past when I had made them per Navient or deferred payments in the past when their company had set them up. Also, I have never received a full payment history from this Lender when my loan was transferred to them from XXXX XXXX on XX/XX/XXXX and I am unable to get in contact with XXXX XXXX. In the past Navient would call me as many as 15 times per day when my payment was as much as 1 day late -to the point of harrasment. This was happening during the period of Covid. It became so disruptive to my workday-I was forced to block their calls! Lastly, the account history available does not give a clear understanding of when I am in deferment and when I am not. I believe I am not being properly credited for the timely payment I have made. I have attached this history. I paid a total of {$410.00} on XX/XX/XXXX and XXXX to bring my account current. They claim my payment is due on the XXXX. I have not seen a statement in over a year!!! I don't know my account number, because it is not readily available on the webpage and I do not receive a statement or an email document from Navient so I am forced to enter my social security information to access their website!! Payment history for XXXX and XXXX is below : XXXX {$220.00} XXXX {$210.00} XXXX {$220.00} XXXX {$210.00} XXXX {$220.00} XXXX {$220.00} XXXX {$220.00} XX/XX/XXXX -- $ {$220.00} XXXX $ {$220.00} XXXX {$220.00} XXXX {$220.00} XXXX {$220.00} XXXX {$220.00} XXXX {$220.00} XXXX {$220.00} XXXX {$220.00} XXXX {$170.00} XXXX {$220.00} XXXX {$220.00} Navient is a predatory lender that takes advantage of the system and twists it to their advantage. They have been the subject of multiple lawsuits for this very type of behavior they are exhibiting again and yet are still allowed to be in business and people such as myself are forced to deal with them. We can not just simply go somewhere else!!! Respectfully, XXXX

Consumer Complaint: I took out a private loan with Sallie Mae ( Navient ) on XX/XX/XXXX for the amount of {$53000.00} to attend the XXXX XXXX XXXX XXXX. During the last phase of my school, the school lost accreditation and the school was quietly sold to XXXX XXXX XXXX. After graduation the school 's president XXXX XXXX XXXX was convicted on federal fraud and tax evasion charges. Using student tuition to pay off house repairs, personal shopping bills, and gambling debts. Eventually the school closed I believe in XXXX making the backing of my technical degree invalid. During multiple instances I attempted to forbear my loan, which they did not offer, being unable to make anything but interest only payments not wanting my loan to default. Entering forbearance in XXXX of XXXX where I continued to struggle to make payments. Eventually there was the SWEET settlement offering cancellation to those who attended such for profit institutions like the XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, XXXX University and many, many others. The criteria being the dates, the schools and the loans being in default. My account balance has not reduced at all with my loan, instead it has gone up to {$58000.00} while I continue to struggle to make the interest only {$390.00} dollar payments. It seems as if that due to my attempts to keep my loan out of default, I am now ineligible for any sort of Loan forgiveness by Navient, even though the school has closed making my degree invalid, and the former president of the school was convicted of federal fraud and financial crimes. This, in my opinion is an egregious oversight on loan forgiveness and the crimes committed by the institution I attended.

Consumer Complaint: I have a loan through Navient. I'm eligible for Public Service Loan Forgiveness, yet it has been impossible to get clear instructions and help from them to apply before the XXXX deadline. I was on the phone with them yesterday for XXXX minutes. The rep finally told me she would send an email with a letter with all of the steps I needed to take. An email from Navient arrived hours later and had NO such information. Clearly, it's way too trusting and optimistic to think that a Loan Provider will want to help loanees to cancel part of their loan. Why was PLSF designed this way? Navient has every incentive NOT to help students, not to help them. I need help, Navient is the WORST lender, this is a dysfunctional process, and I'm running out of time.

Subissue: Need information about your loan balance or loan terms
Consumer Complaint: Following up from my previous complaint, I would like a detailed payment history and credit score history on all of my loans beginning at origination. XXXX was opened XX/XX/XXXX, XXXX was opened XX/XX/XXXX, XXXX was opened XX/XX/XXXX and XXXX was opened XX/XX/XXXX. I would like to see how the 2 loans that were opened before the 2 that are currently in default ( 1 was forgiven ) because if I was unable to pay on 2, I was clearly unable to pay on all of them. I would also like to see where my credit score was above XXXX on loan XXXX as that was opened just 3 months after XXXX which was forgiven as part of the settlement. The balance on loans XXXX and XXXX are now almost 3 times what the disbursement amount was, and I am currently on the rate reduction plan where I am making payments but my balance is steadily going up.

Consumer Complaint: I contacted Navinet to advised them they are incorrectly reporting I have had 2 missed payments. Student loans were on a pause by the Federal government under the Covid 19 relief for federal student loans and will continue through XX/XX/2022. Due to this federal law rights under the Fair Debt Collection Protection Act ( FDCPA ) ( 15 U.S.C. 1692 et seq. ) has been violated under 15 U.S.C 1692e and if not corrected immediately, legal action will follow.
