Consumer Complaint: In XXXX XXXX, I sent you an e-mail regarding and request for Home Affordable Modification ( HAMP ) through Aurora Loan Servicing. I was very pleased to receive help from the Department of Treasury ( XXXX XXXX ) from the XXXX who was able to help me. Aurora presented a 2.0 % loan modification as my only option to stay in my home. This brought my payment to down to {$2100.00} of course this was still over 50 % of my income and because of this I was not able to make the payments. Of course, you know that Aurora went out of business they of course sold my loan to Nationstar Mortgage ( Loan # XXXX ). Since XXXX to presently, I have applied for numerous modifications attempting to get the HARP2- the principal reduction. My home is currently worth XXXX in value while my loan is {$460000.00} and of course I have been denied several times. In the XX/XX/XXXX, I received a phone call after XXXX from a XXXX XXXX XXXX XXXX offering me in the range of $ XXXX {$5000.00} in cash to sign a legal document for Nationstar that would resolve a minor clerical error. Of course, I did not agree to sign and became very skeptical of his request. Days later, on XXXX/XXXX/XXXX a complaint was filed and served at my door step at XXXX from this attorney representing Nationstar Mortgage company case # XXXX XXXX out of XXXX XXXX court. Of course, I responded to this complaint myself on XXXX/XXXX/XXXX without any legal assistance. I attended the case management conference hearing on XXXX/XXXX/XXXX. In which the judge set a mediation date to resolve this matter. On XXXX/XXXX/XXXX, I attended the mediation with the court mediator XXXX XXXX who told me that I should sign the letter. Of course, the mediator would not let me see the letter and I was told that a trial date has been set for XXXX/XXXX/XXXX during this meeting. I requested that I see the letter and requested for them to grant me a modification so that I may stay in my home. The below is what is requested from the mediator and he showed this information to the attorney : Principal Reduction ; Current balance - {$460000.00} Principal reduction - {$200000.00} New loan amount - {$260000.00} Interest rate 2 % - principal n interest - {$970.00} Taxes and Insurance- {$520.00} New total payment- {$1500.00}. They denied my request and I was told they would see me in court. Since XXXX/XXXX/XXXX, I have spoken to countless attorney 's that said they would take my case at a starting rate of {$4500.00} and {$500.00} a month retainer. I was able to meet with XXXX XXXX XXXX from XXXX XXXX XXXX who was able to pull up the deed of trust and showed me that my legal discloser was blank. In which, either Aurora or Nationstar failed to record the legal discloser which is a major clerical error which puts my secure property as an unsecure debt which is not attached to my property. Mr. Obama, I am a hard working XXXX XXXX woman who is a divorced mother of XXXX daughters. I am the original home owner and I work for XXXX for 15-years. I am in desperate need of your help, I am asking for help to keep me and my children in our home. Based on my income, property and the principal reduction program, my mortgage should be in {$1200.00} to {$1300.00} range. My fear is that when I go to my XXXX/XXXX/XXXX, the judge will force me to sign the corrected documents and they will foreclose on my property ; leaving me and my children homeless. I have tried XXXX, XXXX California and other programs they have not helped me. I can not afford an attorney and since my recent experience with the court appointed mediator ; I do not trust that if the judge assigns me a court appointed attorney that he/she would not be in my best interest. Please help me and XXXX daughter stay in our home.

For 10 years at XXXX I paid my mortgage bi-monthly as a term of my mortgage and there was never a problem, I was never late. I continued this practice when Nationstar took over. I have NEVER missed a payment. Now, they call me constantly telling me I 'm late, when I am not. Apparently they misapplied a payment initially which makes them think I am late. I have assured them that I have not missed a single payment. They are telling me that I now have to pay a private company {$290.00} plus a monthly fee to make my payments like this. Are you kidding me?? When I spoke with them in XXXX, the operator assured me that the misapplied payment had been corrected and that my account was current, but that never happened according to the call I got yesterday. It is very difficult to deal with these people as everyone I have spoken to has difficulty with the XXXX language. Now for the ultimate insult, they are now reporting to the credit bureaus that we ar 30-59 days late on our mortgage. This is slander of the highest degree since my account only shows that I am 15 days late even tough that is not accurate either. I have never been late on this loan and I do n't intend to be treated like this. They are ruining my credit for no reason at all. I will await the result of this inquiry and pursue legal action if necessary.

Consumer Complaint: Nationstar MortgageXXXX XXXX, Texas XXXX am writing because of the nightmare we have experienced since Nationstar purchased our mortgage from XXXX 's First 10 months ago. This will be my last attempt to resolve this before I file a lawsuit and register complaints with all of the relevant government agencies. We purchased the residence in XX/XX/XXXX and took out a mortgage with XXXX XXXX. We have never had a late payment and always maintained proper insurance. In XX/XX/XXXX our house was completely ruined by Hurricane XXXX. We requested permission and received it to knock down the house from XXXX 's XXXX. XX/XX/XXXX we knocked down the house, gave XXXX 's XXXX all required documents proving the house was gone and they gave us permission to cancel the flood and hazard insurance. Nationstar purchased our mortgage XX/XX/XXXX. After a few months, Nationstar asked why we did not have flood and hazard insurance. We explained and sent all the required documentation at least 3 times. XX/XX/XXXX, Nationstar put a charge in my escrow for {$2200.00} for purchasing flood insurance. We immediately called and called and after months of calling, they credited the {$2200.00}. We started building a new house in XXXX, XXXX and received the Certificate of Occupancy XX/XX/XXXX. As soon as we received the Certificate of Occupancy, we purchased Flood and Hazard Insurance paid both for a full year naming Nationstar as the Mortgage holder. Now XX/XX/XXXX, I see a new charge of {$2100.00} for Hazard Insurance. We again called and called, resent all of the same paperwork that we did in the previous months and the escrow department told us that they are sorry, the charge will be deleted. It was not deleted in XX/XX/XXXX, I called and they said it is OK, it is set for deletion. It was not deleted in XX/XX/XXXX, I called and called and when I got through, they said it was set for deletion. Now I received my XX/XX/XXXX escrow statement and not only was the charge not deleted, they estimated my XX/XX/XXXX insurance and the same rip-off rate that they are charging me through this company XXXX. Now due to the incompetence of the insurance and escrow departments, my mortgage is {$1600.00} per month when I was paying {$1000.00}. My new payment should be {$1000.00} plus insurance ( {$570.00} for floor and {$610.00} for hazard ) which is {$99.00} equals {$1000.00} plus taxes {$87.00} equals {$1100.00}. Very simple. My wife and I are exhausted dealing with this, I tried calling 3 times today and after waiting on the phone for a long time, I was suddenly disconnected. I would refinance with another company, but simply do n't have the time right now. I need Nationstar to remove the charges for the insurance, refund the escrow money and estimate my escrow correctly within 60 days.

Consumer Complaint: On XXXX XXXX, XXXX I began a 3 year loan modification term with XXXX XXXX XXXX whereby my {$1.00} XXXX mortgage ( Loan No. XXXX ) interest rate was reduce to 3 % and interest only monthly payments of {$6600.00}. This interest rate was to last for 3 years and then it would be raised to 5.25 % with 25 year amortized monthly payments of {$12000.00}. Although I was aware that I could not afford the terms of the mortgage after 3 years, I had no other recourse as I did not want the Bank to foreclose on my home. I also was of the expectation that the real estate market may re-emerge from the 'Great Recession ' to allow the sale of my house during that time period. I was current with the {$6600.00} payment when the 3 years ended. Being aware prior to the 3 years ending that the real estate market had not returned to where I can be successful with a conventional sale of my home, and furthermore, that I could not pay the new upcoming monthly mortgage amount of {$12000.00} come XXXX XXXX, XXXX, I began to request from XXXX XXXX XXXX in writing early in XXXX to revise the loan modification agreement so that the 3 % rate will be extended beyond XXXX XXXX, XXXX. XXXX XXXX XXXX delayed and did not revise my loan terms, but instead, on XXXX XXXX, XXXX, my loan was transferred to Nationstar Mortgage for servicing ( Loan No. XXXX ). My appeals for a modification of the loan terms continue with Nationstar, however, I am being quickly denied the modification on the basis of negative income, and at this time am being threatened with foreclosure. A Notice of Default was filed against me earlier this month ( XXXX XXXX ). My income is presently {$120000.00} per year and my income will increase by another {$25000.00} per year come XXXX XXXX, XXXX due to an upcoming monthly retirement payment that will begin at age XXXX. I have the means to pay a lower interest mortgage payment on my current home. Furthermore, the real estate market condition in California has improved dramatically during the past several months to where it is feasible for me to now sell my home and pay my outstanding loan balance. Accordingly, in an effort to avoid the foreclosure, my home is presently listed for sale. It has not sold yet but we have a good level of activity and expect to have a sale soon. However, the looming threat of foreclosure from Nationstar, and the filing of the Notice of Default, have reduced our options in comfortably pursuing the sale. My loan violates Fair Lending laws and practices as it increased to an unaffordable monthly payment of {$12000.00}. Furthermore, I have become aware that my loan had been electronically sold via MERS on several occasions and the rightful holder of my Deed of Trust is not known. I am requesting your help in assessing the violation of fair lending laws and guidelines with regards to my loan. I ask for your assistance to curtail an unjust foreclosure before I succeed in selling my home.

They reported the Balance incorrectly, They reported the High Credit incorrectly, They reported the Term incorrectly, They reported late payment in which I never had Incorrectly. I disputed each and every incorrect report to all XXXX credit bureaus. Which I have internet and Alert with each of these XXXX. XXXX, XXXX and XXXX .. I pay for it every month. Nationstar would only correct XXXX Item when I was disputing XXXX. Then After correcting My Balance and High Credit then the would they would report My original balance and term incorrectly. Then they would would correct My term and my original Balance correctly and then report that I have only been paying for 1 month when I havent missed or been late since XX/XX/XXXX when the loan was modifed. This bank is costing me 1000s of dollars ..on My Insurance, My loans, my car payments etc. Now today I found out they have fixed everything on my credit report and are now reporting it as a closed account.. This is credit sabotage. I called them this morning and they confirmed they have NOT closed my Account and or transfered it. I have my latest Statement for XX/XX/XXXX and it shows my account open and on time ... I even printed out my transaction statement and I have not been late and I am current. This continues sabatage of My credit By this institution should be held accountable and have to pay me for my losses. The FCRA states that incorrectly reporting my credit is a FEDERAL OFFENSE .. I expect them to pay ... Even when they get some things right they turn around and reoprt it wrong the following month

Consumer Complaint: I had a mortgage with Nationstar Mortgage which I refinanced elsewhere. I had to complain to get all of my escrow refund, but they finally sent a second check. Now, I am reviewing the statements from them and doing an audit and I find that they XXXX paid my PMI in XX/XX/XXXX. I am attaching the annual escrow statement dated XX/XX/XXXX showing the previous year 's payments, which shows they paid PMI in all 12 months ( no skipped payments to be made up later ). It also shows an ending balance of XXXX. I am also attaching the last escrow statement dated XX/XX/XXXX which strangely shows a beginning balance of XXXX. That statement goes on to show XXXX payments for PMI were made on the same day XX/XX/XXXX. When I called them they said the second payment on XX/XX/XXXX was to make up for a missed payment in XXXX. The problem with that is the statement says there was no missing payment, in XXXX or anytime in the year. They then tried to explain that the Annual Statement is a projection and not actually what was paid. This is again ridiculous as the statement was issued XX/XX/XXXX but included what they said are projections of what had happened in XX/XX/XXXX? Additionally the statement says the figures are " Actual Disbursements '' not projections.

Consumer Complaint: In XXXX we had to refinance our home mortgage due to lose of employment. We went with a mortgage company called XXXX. We were told this was a 30 year mortgage. After a while we kept being sold with my mortgage company always changing. In XXXX my husband pay had decreased. I had to close my business and we fell behind I tried to refinance at that time our bank was XXXX XXXX XXXX they would not refinance and stopped accepting our payments we could afford. My husband became very ill in XXXX of XXXX. We had XXXX childreen move back home and grandchildren. We had to meet a man in XXXX from XXXX XXXX XXXX who had told us to stop paying our payments and then i would qualified for the relief program. After a few months I got a foreclosure notice. I tried to find help and ended up being a victim of a scram. Now I we are working with Nationstar martgage where again I thought we were on a 30 year fixed mortgage that is what they lead us to believe. I was making payments of XXXX every month then in XXXX our loan went up XXXX I did not know this until XXXX when I called the bank to find out how i could be behind. At this time our wages our being garnished for medical bills which is more than our mortgage payment. I tried to explain we could not afford that they said it was due to my escrow. I kept making my payment of XXXX a month which they held and did not put towards loan until they had enough to make the payment so then it looked like I was behind then then two months ago they stopped accepting payment. I have lived in my house for 27 years and always made a house payment except for the aboved mentions. I bought my house in XXXX for XXXX which was paid off in fall of XXXX thats when we went with the XXXX Mortgage company I believe the amount we were financed for was around XXXX. I just dont understand how after paying all these years I now owe XXXX. I have been deciding to give my house back to the bank I found out after checking different options I am not on a fixed mortgage and my current loan is for 45 years. Consumer Complaint: On XXXX XXXX, XXXX, I filed a loan modification with my primary home mortgage lender, Aurora Loan Services LLC. They have since changed their name to Nationstar Mortgage. ( I have XXXX loan with Nationstar and smaller mortgage loan with XXXX Lender for the same house ) I was XXXX of those homeowners that signed a balloon home loan agreement back in XXXX. I did n't realize before I signed the loan modification documents, but on the schedule of payments table it shows that in the year XXXX I have to pay a one-time payment of {$180000.00} in interest. I believe this is absolutely absurd, because if I had the money to pay the mortgage payment, I would 've never asked for a loan modification. Instead they lumped up the mortgage payment at the end of my loan agreement and in XXXX I will still not have the {$180000.00} lump sum they are going to come after. ( Please see page XXXX of the Aurora loan modification documents I have scanned and attached for that table ). Keep in mind that there are XXXX difference loan numbers. The loan number I had with Aurora Loans used to be # XXXX. When the loan was transferred to Nationstar, my loan number changed to : # XXXX. I read in the XXXX magazine this year that consumerfinance.gov put penalties on Aurora for doing bad business with other homeowners and I 'm wondering if I qualify as XXXX of those homeowners, but they slipped through the cracks with my loan because Aurora was able to transfer my loan over to another name ( Nationstar ). Please help me look into this, because I think it is wrong on so many levels. Please assist me with getting Nationstar to rectify my loan modification agreement and take out that last payment of {$180000.00}. I 'm XXXX with XXXX income. Consumer Complaint: I wanted to add my original contract to my complaint. Showing my payments were XXXX no taxes and no ins. We took out an earthquake loan with XXXX. After several years turned it over to ALS. Who after several more years turned it over to Nationstar. The loan did not include Insurance and taxes. My XXXX Mtg holder paid that. XXXX was a XXXX loan. Everything was fine until Nationstar took it over and opened up an escrow. I kept telling them someone else paid taxes and ins. but it did n't matter. About the same month they took over I completed a form so they would not pay insurance and taxes. I faxed it back the same day I got the form in XX/XX/XXXX the same month they started receiving my payments. Then I faxed it again. Then some time later I faxed it a third time. Each time I faxed it I had to send them the orginal with my signature on it. They said they would not just go with a fax. I told them again and again that XXXX was my payment that cover principal and interest. They insisted opening an escrow account, takeing part of my payment, part of the XXXX and placeing into an escrow acct. This would leave my payment short and they then said I did n't make the payment. This went on for 3 years. They kept telling me I was late and payments were due. All along I paid the whole XXXX and no payments were late. They added late payments onto my account. They told me I had to pay XXXX which I did above and beyond my payments. Then I paid more money above and beyond my payments, which I did. Then the company wrote me a check, then again, and again. I guess they found out I was not supose to have the taxes and insurance taken out and started refunding the money in my escrow acct. Instead of putting the back with my payments. All along telling me I was not makeing my payments. I sent them back XXXX checks in the same amount of the checks they sent to me. I called and explained. what the checks were for. They still have me late on my payments of over {$1500.00}. No one of any importance will talk to me ( anyone that could correct the problem ) Everytime I telephone I get a different person, they are on a rotory line. This problem will never be corrected. I 'm trying to get it corrected so I can refiance with the people I bank with. They said as soon as I get my credit score up they will refinance. They say they know all my payments were made and on time because I made the payments thru them. But they said they cant turn in a payment application until my credit score is raised. My credit score will not go up until Nationstar corrects the problem they caused. I can reduce my interest rate but not until Nationstar corrects the problem. I will attemp to attach the documents, Im not real good on the computer. My payment is XXXX but my recent payment coupon said {$3000.00} is due.

Consumer Complaint: ever since my loan was transferred from XXXX to this lender Nationstar there have been major discrepencies in the billing. For many months they would send a bill that i owe {$25000.00}. and another month stating something different. I have a loan modification agreeme nt since XX/XX/XXXX. But it seems like Natiotnstar is attempting to change my modification without my consent or official acknowledgement. My modification, which was signed by me and XXXX should be in effect until XX/XX/XXXX. In XXXX, i fell upon financial hardships and i missed XXXX payment. Hence, in XXXX i mailed XXXX payments to rectify and catch up. both payments have been cashed ( i had to pay post office to do research ) both money orders have been cashed via their records. Hence the payments havent been posted. When i called Nationstar ( mostly bc during my bankruptcy, they kept sending me collections via certified mail ) so i called to get some answers then i was informed that my mortgage payment has been DOUBLED. When i call every time i receive differnt answers, XXXX answer was my home insurance was increased, i called state farm ( my insurer ) and they only increased by {$110.00}. Then i was told that XXXX made error in their calculations years ago. I have requested several times for a copy of my modification, a copy of these increases and a copy of changes being made. I have not recieved anything i requested. I would like your help in this matter. I would like a copy of necessary documents and a ledger of all transactions made between me and this lender. I dont really like how they are doing business. I feel like they violated the banckruptcy terms and i would like the XXXX lien, to be stripped via the bankruptcy. this home is underwater. I am being harrassed and hoodwinked. i am poor but i do need a home to live in and i ffeeling real comfortable making my payments prior to getting with Nationstar. they are causing me undue stress and it is affecting my health.
