Consumer Complaint: On XXXX/XXXX/XXXX, I called Nationstar Mortgage to make my XX/XX/XXXX mortgage payment. The representative told me that there is {$2500.00} unused ( un-applied ) funds in my account. The only payment I needed to make was {$3000.00}. I made that payment plus a {$19.00} service fee for making the payment over the phone. The payment was never applied to my account because when I made the XX/XX/XXXX payment on XXXX/XXXX/XXXX, Nationstar Mortgage applied it as XX/XX/XXXX payment. I received a letter XX/XX/XXXX to contact them if I have trouble paying my mortgage. I got alarmed and called them on XXXX/XXXX/XXXX. I was told that my XX/XX/XXXX payment was not made and what I paid in XX/XX/XXXX was in fact for XX/XX/XXXX. When I explained about the {$3000.00} payment in XXXX and the {$2500.00} of unused funds, the representative was able to confirm it and said that they would correct the issue. On XXXX/XXXX/XXXX, when I received my credit score, I noticed a drop in my score. When I pulled my credit report, I noticed that they reported a 30 day late for XX/XX/XXXX and they never fixed the XX/XX/XXXX paymentFurthermore, I noticed that they reported 120 days late for XX/XX/XXXX, XX/XX/XXXX, and XX/XX/XXXX. Nationstar Mortgage received the servicing of my mortgage starting XXXX XXXX. They have received every single payment on time and should not have reported 120 days late to the credit agencies. The payments starting XXXX XXXX until XXXX XXXX are as follows. As shown, there is no late payment since the loan was Nationstar:XX/XX/XXXX Payment of XXXX Payment of XXXX Payment of XXXX Payment of XXXX Payment of XXXX Payment of XXXXXX/XX/XXXX Payment of XXXXWhen I called Nationstar, I spoke to an agent for one hour and he found the problem, but dropped the call before fixing it. I called again and after another whole hour, the agent said that he is transferring me to account resolution and instead of transferring, he dropped the call again. When I called back the customer service was closed.

Consumer Complaint: Our mortgage was with XXXX for several years. Payment was debited from our checking acct. never late on payments, never missed a payment. For unknown reasons XXXX XXXX XXXX sold a bunch of mortgages to Nation Star Mortgage Company located in XXXX. Prior to the mortgage being sold XXXX XXXX XXXX sent a letter stating there would be no change to our mortgage that the transfer would be transparent. From day XXXX we received numerous phone calls from Nation Star. When we returned their call they were not nice at all, stated our loan was in a bankruptcy. I tried to explain to him that the mortgage was not included, not on the list of debts in the bankruptcy not included in the discharge of debts. The man just kept repeating that the mortgage was included regardless. If that was the case it would have been listed in the court documents. The man made me feel like I was a dead beat.. I did file a chpt XXXX and only included debts incurred by my deceased wife. The mortgage was never included in the chpt XXXX bankruptcy..The bankruptcy was discharged in XX/XX/XXXX all the while payments were being taken out of my bank acct by XXXX.I tried repeatedly to explain this to the man at Nation Star he became belligerent. He told me to contact a lawyer that I was wrong. We have made our payments each month to Nation Star.Yet we have people driving by our home taking pictures and this all started when the mortgage was sold to Nation Star. I do not like the harrassing phone calls every month..we are making our payments and will continue to do so. When I googled Nation Star on the internet there are numerous complaints about this company, their tactics, they are failing to honor the mortgage agreements made with XXXX It is not right what they are doing to us. I have owned this home since XX/XX/XXXX, had it built and have no intentions of not making our payments. Plus we own another home that is mortgaged with another company and there is no problem with them, no phone calls nothing and all payment are made every month since XX/XX/XXXX, we have never missed a payment on either home. SO I do not understand the harrassment because we have a mortgage that was sold to them. XXXX XXXX XXXX never harrassed me, never called me every month.

Consumer Complaint: I submitted a request for mortgage modification from my Nationstar Mortgage and I am into the 3rd and final month of trail modification awaiting new loan. I found yesterday from my home insurance company ( XXXX ), after I notice they have not been paid by Nationstar and we called to see why. I have left several messages for my ever changing " Dedicated Loan Specialist, '' who is now, XXXX XXXX ( XXXX ) but, have yet to speak with her. Her assistant call me and I attempted to call back at number provided, but of course no one answered. Get to the point, my insurance company was told by a Nationstar representative that they were going to forclose on my home and they do n't intend to paid escrow insurance payments to them. They never intended to give me a modification! They are valuing my house at {$320000.00} and I had an independent real estate company pull comps and they determined that our home at max is worth {$100000.00} on today 's market and that they suggested it be listed at {$94000.00}. I sent all info since they said assumed the value at about {$160000.00} initially. Well if that is the case then why are you basing the modification loan at {$320000.00}? Also, I had asked who is my lender and they would not give me a straight answer. I am still trying to find out who actually brought the foreclosure or if even they had the right. It was not XXXX XXXX the trustee and it was n't Nationstar the servicer. The court just walk over the issue and allowed this to happen without have them produce valid proof. We did not sign anything in bright blue ink! Loan documents or at least ours, was done in black! I do n't believe that there assignment docs are in order either and I have been unable to get copy. That was part of my formal request to them to know who the real lender and holder of my mortgage was.

Consumer Complaint: My mortgage Co, Nationstar has not given me credit for one of the monthly mortgages payments I made this year. Between XX/XX/XXXX and XX/XX/XXXX I made partial payments which were misapplied to my account by Nationstar. I have been on the phone multiply times with their representatives in an effort to correct this without success. At my request they sent me a transaction history on my account it confirmed that through XX/XX/XXXX my records agreed with theirs. However after XX/XX/XXXX it is impossible for me to decipher the transaction history they sent me. But the bottom line is this, between XX/XX/XXXX and XX/XX/XXXX I paid a total of 6 payments and their records only give me credit for 5 payments As of XX/XX/XXXX they say that I was past due for the XXXX XXXX payment and that 's not true. At that date I was next due for the XX/XX/XXXX payment. Please see attached the transaction history they sent me, together with my notes listing the payments I 've made since XX/XX/XXXX

Consumer Complaint: I made XXXX payments in XXXX of this year however I miscalculated because the taxes had increased. Instead of applying the additional funds to my account Nationstar held the funds for 90 days. I was unaware but received foreclosure notices in the mail in XXXX. I contacted Nationstar in XXXX and was under the impression everything would be resolved paid the difference that night plus charged an additional fee because of a handling charge when doing it over the phone. To my surprise this did n't get taken care of so I had to call again in XXXX. In the meantime Nationstar had been reporting me late to the bureaus a rolling late since XXXX. I 'm devastated over the issue and the mental anguish\concern has been difficult for us as a family. I received an email regarding late fee charges instead of addressing my issue. I was suppose to receive a letter from Nationstar where they were going to fix the reporting error with the bureau 's however that has n't happened yet. Nationstar had someone come out to my house and knock on the door, left a notice on the door knob as well but it was in another language so we were n't even sure who left it. I threw it away but now I 'm extremely embarrassed now that I know why the person was sent. Not to mention I do not understand the lack of common sense used by this company. Nationstar was aware they were holding a whole loan payment shy of XXXX but did n't apply the funds and sent a foreclosure notice instead.

Consumer Complaint: Lost our house because Nationstar forced us to insure our home for XXXX ( only worth XXXX ) because it was over XXXX square feet. On top of that we are in a flood plain and had to purchase matching flood insurance. our payment went from a comfortable XXXX to almost XXXX per month. This was our home. We were proud of it and had to make a very difficult decision to walk away because after after 4 years of paying the high payment we were drowning and no one from Nationstar was willing to help. I 'm sad to drive by and see that the house has been sitting empty for almost three years. Would n't it have been wiser to work with us oon making it affordable. They tried to auction it off and could n't even get any buyers. It breaks my heart everyday cause our memories are there and we miss it. Now it just sits empty falling apart unsellable.

Consumer Complaint: I was approved for Mortgage Modification by Nationstar Mortgage. This approval allowed me to seek a short sale or possibly pursue deed in lieu. I then found a buyer for the short sale. The short sale was eventually approved and we were moving towards an appraisal and requesting a title. That process took 10 months and literally dozens of emails, phone calls, attachments, etc. I went through XXXX realtors just to make it happen. Then I got this message from the bank : " There is a sale date on XXXX/XXXX/2015. The inspection is set for XXXX. there is no way to postpone the sale date so we will remove this file due to not having sufficient time to complete the short sale. The short sale transaction on property located at XXXX XXXX XXXX XXXX, XXXX TX XXXX has been cancelled by the seller. " In other words I believe that they stalled this process long enough to where they eventually had to approve the short sale, only to schedule the foreclosure auction before they allowed it to go through. I truly do not believe they ever had any intention of allowing Loan Modification ( required by the Dodd-Frank law ) to take place. I have multiple witnesses and dozens of emails which reveal either their ineptitude or their intention to deceive me through this process. As a result my house is being foreclosed on and I am being left out in the cold for 7 years of bad finance, despite the fact that I qualify for government relief.

Issue: Cont'd attempts collect debt not owed
Subissue: Debt was discharged in bankruptcy
Consumer Complaint: I declared bankruptcy and had to make planned payments to the chapter XXXX trustee. All of my payments were made to Nationstar Mortgage and never missed a payment for the last 5 years. All of my payments were made in a timely manner. The bankruptcy was supposed to have been discharged XXXX, 2015. It was not. Nationstar Mortgage stated I was 7 months in default. They stated which months were not paid. I submitted copies of my cancelled checks to my attorney. Some of these checks were dated years ago. I thought my bankruptcy was discharged and I continued making my payments. In XXXX, 2015, Nationstar Mortgage did not cash my mortgage payment check. I called Nationstar Mortgage and they stated I was 8 payments behind on my mortgage payments. They further stated that the payments that were in default were from XXXX, 2015 to XXXX, 2015. I have the cancelled checks from XXXX to XXXX. Nationstar Mortgage sent my XXXX mortgage payment back to my bankruptcy attorney. In closing, all of my payments have been made and proof can be provided. Nationstar Mortgage is now attempting to do a foreclosure on my house. Nationstar Mortgage sent me two checks back from my escrow eccount totaling almost {$6800.00} stating they were from my property taxes and homeowners insurance. Planned payments were made to the chapter XXXX trustee and they were all made and in a timely manner. Nationstar Mortgage took over my loan from XXXX when I declared bankruptcy. At that time, XXXX was doing fraudulent loan modifications. {$500.00} was returned to me after I submitted a complaint to the Independent Foreclosure Review.
