Consumer Complaint: To Whom it may concern, I 'm the owner of the property located at XXXX XXXX XXXX XXXX XXXX, FL XXXX. My attorney is working on the title and we have found that there 's a problem, specifically there is a wrongfully recorded deed by your Selene Finance LP. Due to this wrongfully recorded deed, I can re-finance my property until they correct this issue! I 'm refinancing this property to be able to fix it on time, due to structural violations with XXXX of XXXX. For this reason, this property needs to be fix right away, before XXXX of XXXX orders the demolition of this building!!! On an email from XXXX XXXX XXXX from XXXX ( Former Selene Finance LP ) and the company who actually did the recording, the solution at my problem will be for Selene Finance LP to recorded a deed from them back to us!! I have this email and I 'm attaching this email to this complaint. I have called several times to XXXX XXXX XXXX ( the Grantor on the deed ) to phone number listed on public records, XXXX but this phone number is always busy. I have also tried to send them a fax, but your fax number is always busy! I was able to sent them a fax ( Fax confirmation is attached ) and several email without response as of yet ... I also mail them all a certified letter via USPS ( receipt attached ) I also contacted XXXX XXXX XXXX XXXX, Senior Closer & Team Lead, and XXXX XXXX XXXX, XXXX Lead, both employees from `` XXXX '' this company was previously named : Selene Finance LP and they are showing as the one who requested this instrument to be recorded. SELENE FINANCE LP is named on the top portion of the wrong deed with their address as the " Return '' to company. Please take whatever necessary action to resolve this problem immediately, so I can continue with the fixing of this property!

Consumer Complaint: We missed several mortgage payments with Nation Star Mortgage. When we called to make our account current, they gave us an amount to pay for all months including XXXX ( on XXXX XXXX and we paid it ). Then in XXXX we received notice that we owed backpayment for XXXX as well as XXXX. Throughout the last several months we have submitted payments- which were held and returned eventually- ( they would hold them until new fees accrued and then say our payments were not enough to cover the amount plus those new fees. ) They have lied repeatedly about how and when we could make payments. They consistently 'lose ' faxed information- or even say that we did n't sign- even though we have copies of the faxed documents which show that we signed or included information which they say is " missing ''. Now they are foreclosing on our house. They will not provide a reinstatement quote. The amount we owe changes by hundreds of dollars between people in less than an hour of time. XXXX agent told me if I made my payment out to him personally, he could accept it and apply it to our balance. The fees are exorbitant, and they will not tell us what the fees are for. All we want to do is pay the money and keep our house, but they are making it impossible- by not allowing us to know the amount we would need to pay. Legal documents that we have received from them have things crossed out and handwritten in. Pages have been omitted, and then someone blacked the page numbers out so that it would appear no pages were omitted. We are never able to speak to the same person twice. It takes hours on hold to even talk to an actual person. They have terrible customer service, they lie, and I feel they are predatory.

Since them I have sent them cancelled checks, proofthat Nationstar both received these payments and cash the checks. Consumer Complaint: In XXXX 2015, the transition of the purchase of XXXX XXXX XXXX by XXXX XXXX, in Georgia occurred. I own rental property and payments to Nationstar Mortgage company were made from XXXX XXXX XXXX ; however, after the transition to XXXX XXXX, the automatic payments to Nationstar got messed up because the account at XXXX XXXX XXXX, now XXXX XXXX, XXXX XXXX XXXX misplaced a deposit ... one that we discovered that the deposit was moved to another account with XXXX XXXX. In the meantime, Nationstar drew the mortgage XX/XX/XXXX payment off of the former account resulting in a payment of insufficient funds. When Nationstar notified me of the failed payment, I made arrangements at XXXX XXXX to ensure that a payment would go through. Only XXXX XXXX, the payment went through to Nationstar. However, I began receiving calls from Nationstar stating that I had not made the XX/XX/XXXX payment. I told them that I had, and had evidence that the payment went through. They called me at least twice a day for several weeks. Finally my banker attempted to assist with resolution of the problem by calling Nationstar. It is very difficult to speak with anyone with authority there, and basically could only talk to customer service. She faxed a copy of the bank statement with evidence on the statement. Things were quiet for a week or so, but then customer service called again stating a payment had not been made. As XX/XX/XXXX rolled around, the payment to Nationstar on my new bank account went through, but Nationstar began calling me again stating I had not made the XX/XX/XXXX payment. I received more than XXXX calls all times of the day and night from them. There was no convincing customer service that the payment obviously went through. In fact on my online Nationstar account, I can see that both the XX/XX/XXXX and XX/XX/XXXX payments went through. I finally got my lawyer involved, who sent them a letter with the paper work as evidence of the issues and payments. They responded, stating they would not have a resolution to the problem until XX/XX/XXXX ... .and could n't even spell my lawyer 's name right. In the meantime, my credit score has been affected, dropping almost XXXX points. Therefore, something at Nationstar is not connecting with the payments that are evidently being made, as evidenced by both my bank account and the Nationstar website. Now I just received a call from Nationstar stating that the XX/XX/XXXX payment has not been made ... this is ridiculous. No one there is listening to me, my banker, or my lawyer. And yet the payments ARE being made. My credit score is being affected, which is very serious to me, and this company is not paying attention to my concern. Please help me.

XXXX 's EVIDENCE - XXXX has " yet to conduct an investigation on this account '' and requested CFPB on XXXX XXXX, 2015, to extend its resolution date of XXXX XXXX complaint to XXXX XXXX, 2015 ( CFPB case number XXXX ). Nationstar 's recorded Notice of Default on XX/XX/2015, therefore, LACKS LEGAL FOUNDATION ... as the ALLEGED DEBT, and ALLEGED CURRENT OWNER of DEBT XXXX XXXX yes " yet to investigate the account ''. Until proven otherwise, this Notice of Default, remains to be UNLAWFUL and thus the resulting TRUSTEE Sale of our home XXXX XXXX, 2015. Nationstar also defaulted on XXXX 's Debt Validation ( DV ) Request of XXXX XXXX, 2015 ( relative to Nationstar/XXXX Notice of Debt Validation dated XX/XX/2015- with 30 day to validate debt ; then Nationstar violates FDCPA by recording the Notice of Default two days later, XX/XX/2015, without satisfying DV requirements ). XXXX requested in DV, among other things, to personally view the " alleged NOTE '' - per requirement of UCC 3-501 on presentment. Nationstar defaulting on this DV request, in addition to alleged owner of debt XXXX that has yet to investigate the account, renders this NOTICE of DEFAULT of NO LEGAL BASIS, and therefore UNLAWFUL and needs to be rescinded. Consumer Complaint: I applied for a loan modification with Nationstar Mortgage Loan number XXXX. On XXXX XXXX we were approved for a 3 month trial modification, however the payments were only XXXX per month lower than the prior payments, but, I was informed that there was an escrow shortage and an additional payment of {$61.00} as a result my monthly payment was going to be {$6.00} less per month and would be extended by 1 year. XXXX XXXX my dedicated loan specialist told me I could request an appeal by mailing a letter and updated proof of income to Nation Star Customer Relations. It could take up to 30 days to receive an answer. I sent a letter with updated proof of income that was received by Nationstar on XXXX XXXX. Today XXXX/XXXX/2015 I called Nationstar and was told a letter was mailed yesterday. The customer service rep e-mailed me a copy of the letter that informed me that they made no errors and If there has been a change in circumstance due to reduced income, Nationstar may evaluate the account for assistance with an updated complete application ; however, another approval is not guaranteed. Should you wish to reapply for payment assistance using updated financial documents, you may provide the enclosed. Borrower Response Package within 15 days from the date of this letter using the information listed below. They are basically telling me the same thing I was told 2 months ago and are asking for the same documentation I sent to them back in XXXX. The letter also says I am 6 months behind on my payments which is not correct because I made XXXX payments of a 6 month repayment plan that were not properly applied to my mortgage balance which is causing more damage to my credit rating and I believe my mortgage principle is not being reduced by the correct amount.

Consumer Complaint: In the process of applying for a refinance of a current mortgage of my home, underwriters at Greenlight Loans determined I had XXXX outstanding liens against my home, XXXX of which was invalid and required release from the prior lien holder, XXXX XXXX XXXX. After nearly a year, Greenlight made little-to-no progress in getting the invalid lien released. So, I took matters in my own hands and contacted XXXX about the invalid lien and they said all they needed was the title search information from Greenlight and they could then expedite lien release, enabling me to refi my loan and move forward. I advised Greenlight all they needed to do was fax the title information to XXXX to move the process forward and the underwriter agent at Greenlight, XXXX XXXX XXXX whom had been " working '' my case for almost a year, said she would fax it over immediately. It has now been several weeks and Greenlight has yet to fax the title search information to XXXX, further extending my refinancing problem. I 've tried calling XXXX and multiple levels of her management, but not getting any reply. It is now obvious to me that Greenlight is only interested in processing " low hanging fruit '' loans and provides intentionally bad service to everyone else, effectively discriminating. I need CFPB intervention to help move this process forward.
