Consumer Complaint: I have been trying to prevent a Foreclosure on my property since the end of last year and have been in constant contact with NationStar trying to prevent this. I have, literally, sent email after email and made phone call after phone call to get them documents in a reasonable amount of time. All of the documents that we submitted through XXXX were uploaded to NationStar on multiple occasions and with the exception of needing updated bank statements and pay stubs, they were all the same. My realtor used the software from XXXX right after we listed it to get it approved for a short sale. Well, the sheriff sale is tomorrow so obviously, the approval NEVER came. My realtor put the sign in the yard in XXXX to get the process started. When we contacted NationStar, they told us that we needed to start the process on the XXXX site to get the property approved for the Short Sale. During this time, we received an offer that we had to wait to submit because of this whole process. When my realtor listed my property and if there were any delays to submit these documents, we were waiting for a response from NationStar representative. When my realtor talked to someone else at the company, because after more than a week, she still had no response from him. She was told he had been away on vacation and no one had taken over his files when he was gone. Every other document that we were told we needed was submitted within about 2 days time. Also, when these were needed, my agent would notify me when she needed them. After I would send them to her, she would again notify me when she would upload them to XXXX. NationStar was telling me when I called that the realtor was causing the delay with failure to upload documents and I knew this to not be the case, as she and I were in constant contact. Multiple times, we would contact NationStar within minutes of each other and every time we talked to a representative, we were told different things EVERY time we called. When I received the final papers that the house was going up for sheriff sale on XXXX XXXX, to say the least, I was shocked. We have been working on this diligently to expedite the Short Sale review so we could get approved to submit the offer of over {$70000.00}. In multiple phone calls from either myself or my realtor, they would tell us there were documents that needed to be submitted that had already been submitted to XXXX ( weeks prior. ) When they asked for these, I told them what date they were sent and then they would find them in the system. The times my agent would inquire into what documents were needed, she would receive a generic message from the rep, stating that ALL the required documents needed to be submitted again. Typically, it was updating of a bank statement or pay stub. When we would call NationStar Short Sale department, they say it was the XXXX or new bank statements, which had already been submitted. After multiple go-rounds with NationStar for almost a year, again where they are telling my realtor one thing and myself a completely different thing, my house is now going up for sheriff sale. The XXXX week of XXXX, we were told to submit MORE documents, documents that had already been sent in. She told me that the submission of these would reinstate the review for the short sale and I immediately submitted XXXX more recent bank statements and the most recent pay stubs that I had. I called later on that night and spoke to XXXX of the men in the department and he told me that he received these documents and that the review was still on-going. When my realtor called a few days later, they told her that there was nothing we could do that it was going for sheriff sale. So after multiple reps and non contact, I am now going to have to fight this in any way possible because this companies failure to know the system they are lacking the knowledge to use.

Consumer Complaint: I have fallen behind on making post-petition mortgage payments since last XXXX and there is a hearing date coming up on XXXX, to dismiss my chapter XXXX bankruptcy which was filed back on XXXX. Apparently, there is a strange statue within the foreclosure procedures in Oklahoma, that requires the lender to not only conduct a public auction, but also complete was known as a " Confirmation of Sale '' ( COS ) .From what I 've been able to understand, the judge either grants or denies the COS. If the sale is confirmed then that action will complete the foreclosure process. The bank Nationstar XXXX NSM XXXX, will then transfer the loan to the Real-estate owned ( R.E.O. ) dept. and then on to eviction. The property was sold at auction on XXXX, and purchased back by NSM at auction for $ XXXX. I filed bankruptcy on XXXX, prior to NSM completing the COS process, which means the sale has never been fully executed.What has happened ; is because I filed the chapter XXXX bankruptcy on XXXX, it interrupted the foreclosure process and the completion of the COS. The reason the bankruptcy is still active is because the chapter XXXX bankruptcy, was converted to a Chapter XXXX on XXXX was to complete all of the steps to approval of a chapter XXXX bankruptcy plan. I completed the " meeting of the creditors '' which NSM did not contest even though database system it shows the house was purchased at auction for XXXX on XXXX. NSM DID NOT motion the court that the home was sold prior to the original BK filing on XXXX. The BK plan consists entirely of late mortgage payments. I spoke with NSM in the bankruptcy department in an attempt to again, re-establish post-petition payments and or arrange modification to include post-petition payments so that the loan can be brought current. First in XXXX of 2015 to no avail again in XXXX of 2015 with no luck, so that I could resume my post-petition payments and no one would give me an amount that was due.Again beginning XXXX, I discussed with a bankruptcy supervisor by the name of XXXX XXXX XXXX ID # XXXX. During this conversation XXXX XXXX attempted to remove what was referred to as a " CODE XXXX, '' according to XXXX the code stood for FORECLOSED. This code prevents any viewing of delinquency nor current or late payments due. XXXX opened a special request to have the code XXXX removed, the code should not be allowed to co-exist within a chapter XXXX XXXX reorganization ) bankruptcy, XXXX could not understand how the system could reflect home sold as well as active chapter XXXX. She stated that she had never seen anything like this and would need review from the legal team. Conclusion : XXXX was unable to open a review for any workout plans or payment options due nor due dates, because of an eternal, code XXXX. XXXX, I spoke with NSM agent XXXX ID # XXXX and advised that she can see the request from XXXX, however the code XXXX remanded. She advised the review is still pending for the matter, and to call back in a few days. I called back on XXXX and spoke with another agent named XXXX ID # XXXX, and was advised code XXXX not removed, review still pending. I called back on XXXX and spoke with another BK Supervisor XXXX XXXX ID # XXXX and was advised that XXXX had resigned from the company two weeks prior. However, that he could see her notes and the request for the legal team to review the concerns that had been raised by XXXX on XXXX. On XXXX, I spoke with XXXX final manager named XXXX XXXX ID # XXXX, that apologized for the lengthy review. XXXX advised the conclusion from the legal to shows NSM, is not going to remove the code XXXX filing bankruptcy XXXX ; after the execution of sale on XXXX, interrupted the COS process.He said that NSM is going to wait until the chapter XXXX bankruptcy is either dismissed or discharged. Then complete the COS and start eviction.

Consumer Complaint: After being exposed to the foreclosure process with Nationstar Mortgage and the XXXX XXXX XXXX XXXX Court, especially the Foreclosure Settlement XXXX Department, I am requesting that you conduct an investigation of all parties involved for potential violations such as the XXXX laws. I understand that these are serious allegations, however I have attached supporting documentations and I challenge you to take a look at all of the foreclosure cases filed in NYS XXXX XXXX XXXX Court by Nationstar Mortgage since year XXXX or even before the National Mortgage Settlement. Nationstar Mortgage has deceptively, wrongfully, unlawfully and illegally : Assessed, charged and collected fees, expenses and miscellaneous charges that I am not legally obligated to pay under this mortgage, note and/or deed of trust ; Made false, deceptive and misleading representations concerning their standing to sue me for foreclosure ; Nationstar Mortgage has committed FRAUD. Consumer Complaint: Nationstar acting as the Servicer of this mortgage has failed to meet all of its requirements under HBOR and is attempting to illegally foreclose on my personal home by selling it at auction on XXXX/XXXX/2015. The direct violation of HBOR law is based on Nationstar Mortgage improperly and unfairly reviewing my loan modification request for relief. i have submitted a complete loan modification direct via fax and have been forced to resubmit the same package several times and i never get a single person to answer my questions honestly or directly. They always have hundreds of people pass of the file amongst each other just to create motion and delays. i intend to keep my home and i meet all eligibility criteria. they have never offered any help or relief and continue to threaten to take my home. Nationstar Mortgage instructed and allowed the Foreclosure Trustee named XXXX\ XXXX XXXX to illegally start foreclosure on my property. The Nationstar Mortgage and know your options website gave the result that i am eligible for a loan modification with a lower payment to save my property. So there is no reason why Nationstar should have denied my request or started foreclosure on my home.

Consumer Complaint: I had refinanced my home XX/XX/XXXX from XXXX XXXX XXXX XXXX. XXXX sold the loan to Nation Star Mortgage. As per the original loan documents and private mortgage insurance disclosure, my PMI would automatically terminate XX/XX/XXXX. Nation star is refusing to honor the original document. Nationstar wants me to go for a new appraisal or wait till loan to value falls to 75 %. My decision to re-finance the home was based on number of factor and XXXX of the main factor was PMI. I refinanced from FHA loan to conventional loan to avoid paying higher PMI for a longer period of time. I have also attach the document that was given to me by XXXX, communication between Nation Star and me and the payment history. Request your intervention to get this issue resolved. I have always paid the monthly payments on / in time. I have never been late on the payments.

Consumer Complaint: Hello, I 'm writing a second letter regarding the unfair and poor business practices of Nationstar Mortgage. I sent my 1st complaint on XXXX/XXXX/15, and Nationstar responded with a XXXX page letter stating that everything I said was incorrect. I disputed their letter with more documents and called the XXXX phone # s they listed in the letter. XXXX were customer service lines, but in the letter it stated that " If you have any questions regarding this correspondence, please contact me directly. '' I called this person 's direct line and the customer service representative who answered did n't know who that person was, and could not find his extension. I emailed this Customer Relations Specialist on XXXX/XXXX/15 and XXXX/XXXX/15, but no response. I then emailed the gentleman listed in the letter as my " Dedicated Loan Specialist '', because his " Direct Number '' went to customer service line also. Within a few minutes I received an automated email response that said to call the same customer service # listed on the previous response letter. I replied 10 minutes later with my direct phone # and hours available to reach me. I said I expected his call today, because the letter stated that he was my " single point of contact ''. This is a ridiculous game that Nationstar plays with their borrowers, and is the lowest level of service. Borrowers expect and deserve to speak and email with real people from their lender, not just to call in to a call center with people only trained to take notes and put in the electronic file, and when the next level of " service providers '' open the file and send out a form letter by snail mail, which will arrive in 10 days or so. The letter will politely say " At Nationstar, customer concerns are important to us. " I just received the form letter dated XXXX/XXXX/15 on XXXX/XXXX/15, stating that they were reviewing my complaint from the XXXX/XXXX/15 letter. 3 Weeks to send me that letter when they emailed their response through CFPB on XXXX/XXXX/15, and I have emailed 3 reply letters since that time, with only an automated email response to call the toll-free # of customer service. I would like the CFPB to intercede and require Nationstar Mortgage to communicate with a reliable contact phone #, and one person assigned to service my account.
