Consumer Complaint: On XX/XX/XXXX I submitted my application for Loan Modification assistance. My request for modification assistance has been under review. On XX/XX/XXXX I received a collection call from a representative at Nationstar Mortgage that said my request for modification assistants had been denied due to negative disposable income. She wanted to know what are my plans for the home since it is in foreclosure. I asked her why have n't I received a denial letter. She then stated it would be mailed. Today is XX/XX/XXXX and I still have not received a denial letter. Additionally I received a notice of a class action lawsuit XXXX Nationstar Mortgage LLC, Case No XXXX. This notice states that If I was charged for lender placed insurance by Nationstar ( which I was ) for your residential property this settlement will provide you with the opportunity to claim a credit towards what you currently owe the Nationstar Defendants if you did not pay but still owe the premiums for that LPI Policy to the Nationstar Defendants during the class period. XX/XX/XXXX - XX/XX/XXXX. Claims must be postmarked by XX/XX/XXXX. Here is the link for more information XXXXXXXXI told the representative that called on XX/XX/XXXX. How can Nationstar have accurate reinstatement figures if this settlement had not been taken into consideration? I still receive collection calls from Nationstar.

Consumer Complaint: I am launching a second complaint against Nationstar/champion mortgage of Texas. My initial complaint was placed XX/XX/XXXX and their response XX/XX/XXXX. This company has claimed all along that the discrepancies in the letter of intent - XXXX I, was what led them to filing the foreclosure proceedings against the property. I repeatedly faxed the information that was asked for beginning XX/XX/XXXX. If this matter could have been resolved with the letter of intent the pending Sheriff sale or possible discrepancies that have arise from this matter could have been avoided. I am requesting an as the mortgage company has claimed that I am entitled to the documents that they based their denial of the letter of intent upon. In the past 15 months illegal proceedings with the Court XXXX in XXXX XXXX Ohio have de-evolved from the actions of the plaintiffs law firm. There was not adequate notification and on further investigation a person name XXXX XXXX, was supposedly notified or was the person that stopped the short sale process from the mortgage company on the property that is in question. I am still trying to determine who is XXXX XXXX and how would he have the authority or the rights XX/XX/XXXX to disrupt the short sale? Champion mortgage claims that they notified XXXX XXXX XX/XX/XXXX that short sale proceedings could occur if myself as the defendant would comply. Through the law firm that was representing me and my person I never received any such notifications. This was also pointed out to and confirmed by XXXX XXXX XXXX, management analyst for the national servicing center of housing and urban development XX/XX/XXXX. This matter has now been from that timeframe referred to a Sheriff sale XXXX in question is scheduled XX/XX/XXXX This is wholly unfair and patently unethical as to the actions of Nationstar/champion mortgage. They also sent occupant conveyance HUD forms in XX/XX/XXXX which XXXX XXXX confirmed that these forms should not have been used or the scare tactics that the mortgage company was implying was false and incorrect. They also sent court documents to their residence and property in question to " occupant ''. How is it after 17 months the mortgage company could send an official document to an address the listed as occupant and expect a tangible reply? The law firm that was representing me has now withdrawn from the case either because of their knowledge of similar types of cases and that it is headed towards either the short sale or the unfortunate reality of a Sheriff sale with in 30 days time. The fact remains that I had the ability to discharge this debt over 14 months ago. The subsequent court dealings and extreme levels of subterfuge and misunderstanding has been from the plaintiff 's law firm and in response the law firm representing me attempted to offer the HUDXXXX forms and offers of short sale only to be rebuffed by the mortgage company and its law firm. As I am patently stating that the XXXX notifications for offers of a short sale process were never received. I am filing this complaint in hopes that your Bureau can resolve this as quickly as possible.

Consumer Complaint: On XXXX/XXXX/XXXX XXXX XXXX was hired and paid specifically to supply a " Retro-Active Appraisal '' and " Appraisal Review '' to support or deny XXXX guideline compliance in the XXXX residential appraisal from XXXX. All " Retro-Active '' and " Appraisal Review '' assignments given to XXXX and acknowledged in his " Scope of Work '' were specifically related to activity that occurred in the XXXX XXXX appraisal. Statements provided by XXXX in his " Scope of Work '' were known to be used for the purposes of possible litigation and these statements required supporting evidence to confirm or deny XXXX compliance in the XXXX XXXX appraisal. Further evidence of XXXX 's knowledge of the use for his " Scope of Work '' for civil litigation purposes can be found in a deposition conducted on XXXX/XXXX/XXXX where XXXX states the following : Q. Now, you state in the appraisal that this appraisal is also intended for litigation, correct? A. Correct. Q. What does that mean? A. That means in case we have to do a deposition or something, that 's what it 's going to be used for. It 's not for mortgage lending purposes, not for valorem tax purposes, it 's not for other purposes. It 's for litigation purposes. XXXX states he is fully aware of the magnitude and necessity for accuracy in his report to support a possible civil claim when he states " The purpose of this report is to present the data and reasoning the appraiser has used to form an opinion as the market value of the subject property as of the effective date. The use of the report is for litigation. " XXXX also states in his scope of work that " The size of the comparable sales data is generally taken from the Appraisal District 's data. " Before even considering the " For Sale by Owner '' home for purchase in XXXX, I conducted due diligence on the subject property by researching information in the XXXX Appraisal XXXX ). Attached is a copy of the XXXX Account Detail ( XXXX ) dated XXXX/XXXX/XXXX. When conducting due diligence on the subject property, the attached XXXX XXXX public record document was utilized to make a fair market offer to the sellers of {$250000.00} based on the XXXX XXXX market tax valuation of {$240000.00}. XXXX committed negligence that forever complicated the recovery of my civil petition when he failed to confirm the lack of discrepancies in the public record for the purposes of establishing " discovery '' for my civil claim against the appraisers that conducted the negligent appraisal in XXXX. XXXX negligently misrepresented and supplied evidence without supporting facts or documentation when he supplied XXXX documents to support a conclusion as to what was the subject property description in the XXXX XXXX public record. The XXXX Appraisal Review negligently errs by stating in the " IMPROVEMENTS '' section of his brief that the " Square footage of living area, as shown, includes XXXX square foot Bonus Room addition to the XXXX square foot house reported as XXXX bedroom. '' XXXX continues to err when he states that " It is also noted the Appraisal District shows the XXXX square footage as separate area, reporting the XXXX square feet in the house and XXXX square feet Room Addition. '' This information is from the XXXX XXXX XXXX, not the appropriate XXXX XXXX XXXX. This statement IMMEDIATELY puts credibility issues into the reports provided by XXXX. XXXX states that " The appraisal reports tax data was used to determine the subject site value in the Cost Approach, '' indicating that both XXXX XXXX XXXX and XXXX should have utilized this same attached XXXX XXXX report when issuing their appraisals and appraisal reviews.

XXXX XXXX demonstrates he does not understand the legal significance of his statements and opinions and should be advised that this behavior brings question to his integrity, ethics, and his lack of professional standards contribute to additional erosion in confidence that Texas residents rely upon from the industry he represents. The affidavit submitted by XXXX XXXX demonstrates his indifference to the potential for punishment and adds additional questions of moral value for all appraisal professionals in the state of Texas. The affidavit that was submitted by XXXX XXXX was utilized to protect the integrity of the truth seeking process and to support the integrity of my claims before the courts. Consumer Complaint: After repeated attempts to collaborate with both state and federal compliance agencies to address the predatory appraisal practices of the Texas XXXX XXXX XXXX XXXX, I am filing a formal letter of inquiry and complaint regarding the flagrant, open, unbridled, unsanctioned and negligent misrepresentation of the XXXX & XXXX agencies that are charged with safeguarding with following federal and state mandates to safeguard home owners. The XXXX XXXX, XXXX & XXXX are complicit in acts of moral turpitude by their lack of XXXX federal guideline enforcement that are within the scope of influence and this tax payer funded state agency. I have attempted to bring transparency to the injustices committed from the XXXX XXXX XXXX XXXX XXXX agency that fails to discipline violators of the XXXX federal and state guidelines and I have been met with nothing but open defiance and deniability. Either the state agency that I have reached out to for assistance has stated that their Non-Disciplinary measures are within state guidelines or the agency denies culpability and responsibility for the licensed associates in their organization. As I have received nothing but dismissive responses to my repeated inquiries it is my civic duty to bring the open and flagrant violations of the XXXX & XXXX agency as well as the performance of Executive Director XXXX XXXX to the attention of every state, federal, executive, legislative and judicial branches until someone takes immediate intervention to stop these predatory violations of constitutional and consumer rights here in Texas

Consumer Complaint: I called my mortgage company the other day to request a loan modification packet and they told me that my home was in active forclosure which is the first I have heard. I am behind on payments, but never revcieved anything from the mortgage company regarding foreclosure or a notice to cure debt before a certain date to avoid it happening. It is my understanding that this process is to occur prior to going into foreclosure. Once again this company has wronged me. This is not my first complaaint against them.

Consumer Complaint: I am responding to the response I just received from case # XXXX, Nationstar Mortgage. They indicate that my loan is in foreclosure and no portions of the amount due will suffice. only the full amount. This is truly a case of predetory lending since my loan became delinquent in XXXX XXXX and in XXXX I sent a payment, in XXXX/XXXX/15 I sent a payment and I sent XXXX more all totaling {$11000.00} and they were returned way before my loan supposedly went into foreclosure. One of the representatives that I spoke to whispered to me on the phone, '' if you want this to stop, call an attorney ''. The reason that I have not called in an attorney yet is that I thought I could handle something like this on my own. Obviously I was wrong. I need you to see this for what it is. ILLEGAL. Why woulda mortgage co. not accept payments on a loan that is three months behind? This is what I want you to find out for me..

Consumer Complaint: I am a XXXX and have a property listed for sale. NationStar did a Broker Price Opinion ( BPO ) of the property and it came in at {$810000.00}. During the BPO the properties basement was flooded and the BPo agent made no mention of it in the BPO report and subsequently brought the BPO price in an inflated value. The buyer had an appraisal done which reflected it 's as-is value with the needed repairs and the value showed {$670000.00}. The appraisal, photos and the repair bid were submitted for a value dispute. Four weeks later a decision was rendered and NationStar stood by the BPO value of {$810000.00} stating " Please advise how all parties want to proceed as our value did not change from $ XXXX. An appraisal report completed by XXXX ( XXXX ) was submitted for valuation dispute. The appraisal estimates the subjects ' as-is value at {$670000.00} as of XX/XX/XXXX. The appraisal is considered to provide a low value estimate utilizing dated sales ( all sales closed in XX/XX/XXXX ) and the - {$100000.00} across the board repairs adjustment is overstated. The repair estimate included in the appraisal is unsigned and no photos were provided that would confirm the noted repairs as described. The subject is located within a desirable pocket subdivision and a sale was noted on the subjects ' XXXX at XXXX XXXX XXXX XXXX, similar age and size, inferior in condition ( dated, inferior kitchen, requires repairs ) and closed XX/XX/XXXX at {$800000.00}. This sale is less recent than desired but is a good indicator of market support for a reasonably similar substitute property within this market. " How can an appraisal by a master appraiser of 25 years experience be considered inferior to Nationstar 's BPO when he took into account the needed repairs and all the comps that were used for the appraisal be considered outdated when I 'm assuming similar comps for the BPO were also used? The area of the home is a very specific location and there 's only so many comps they can use which is stated in the appraisal. The seller has not received a copy of the BPO because it is the property of NationStar. Nationstar should be required at minimum to do an appraisal of their own if they do not agree with the appraised value as the BPO is a much inferior estimate of the properties real value.

Consumer Complaint: Nationstar Mortgage purchased our mortgage from another lender ( XXXX ) after they bought out the mortgage they started to charge us " legal fees '' They never sent us any documentation as to what these legal fees were for but the fees started showing up on my monthly statement. I would call the company and ask what these legal fees were for and they could never tell me, they would have to 'file an inquiry '' to figure out what the fees were for. I would never receive any answers. I asked repeatedly to speak to a manager or supervisor and was denied. Then, a few months into the waiting process, I noticed that they started to add more fees ; now they were charging for 'home inspection ; fees- though there was no home inspection ever made to my knowledge and no reason to inspect my property. The property in question is our primary home, where we have been living for more than 13 years. The mortgage account has always been in good standing and I have never even missed or been late with payments. Finally, I had to get an attorney involved to find out why they were charging me since they never got back to me. My attorney had them investigate and reverse the charges. That was about 6 months ago. Then, in late XXXX early XXXX I received a check from them for " escrow surplus '' in the amount of {$96.00}. I was out of town and did n't have an opportunity to cash the check yet in XXXX, I received another letter from Nationstar stating that my account was currently being held in 'suspense ' The letter claimed that recently a transaction on behalf of my account has resulted in Nationstar placing unapplied funds in suspense. These funds are insufficient to be applied as a full payment and to expedite the processing of these funds, the total amount due is {$5200.00}. However, when I contacted Nationstar I was told that my account was current and no payment was due until XXXX XXXX. As it is only XXXX XXXX, and my payments are all made online and on-time, I questioned them further and told them about the letter. They refused to speak with me stating that all they could say was that the account was being held in suspense but that no payment was due at this time? I again contacted my attorney to try to find out what this 'account in suspense ' phrase indicated since I could get no clear explanation from Nationstar and he informed me that this is what Nationstar does before the put a property into foreclosure?!! I have been paying my mortgage on time and in full more than a decade, I have XXXX credit and if anything it appears that I may have accidentally overpaid maybe in part because of the property taxes or that they wrongfully returned money to me from the escrow 'surplus ' but all in all, the account is and has always been paid in full. I have found this company to be extremely deceitful, their customer service agents are not forthcoming, they refuse to provide clients with accurate information and insist on 'internal trouble tickets ' which are never responded to. They have repeatedly charged me for services I did not authorize and which were unnecessary. Now they have put my account " in suspense '' even though my account is and has always been in good standing. I would like to pay off this mortgage since I do not trust this company but they will not provide me with a payoff amount due.

Consumer Complaint: I have suffered severe hardships that have led to me falling behind on my mortgage. My hardship began when my ex-husband basically abandoned me and my son XX/XX/XXXX-this led to our divorce in XX/XX/XXXX. My ex-husband was the main income earner for my family and after he was fired from his job of almost 10 years we started to have problems with paying bills. When the divorce was finalized I was awarded this home and spousal and child support. Due to him losing his job that support stopped for me and my son, making the mortgage payment unaffordable for me. I receive XXXX for some debilitating conditions and in XX/XX/XXXX I was diagnosed with XXXX. The diagnosis as debilitating as it is, has not stopped me from doing what I needed to do to keep my home. I wanted to keep my son in his familiar neighborhood, that has proven to be a challenge for me. I have been appliying for mortgage relief with Nationstar for years now. I have income to prove, I can afford a mortgage payment but have experienced nothing but difficulty in the review of my options. I was even foreclosed on back in XXXX of this year, another error by Nationstar, that was corrected via them rescinding that sale. I was told they would work with me on a HAFA short sale, I desperately need relocation assistance to move my young son and my mother that is now in XXXX. I listed my home as instructed by Nationstar with an agent that presented an offer to them for consideration, this was all before any new sale date was set on my home. Nationstar working against me set a sale date on my home and are now using that sale date against me, refusing to proceed with reviewing everything I have given them. It is painful to come to terms with having to let go, now I must also face being forcefully removed from my home of almost 15years! I have worked tirelessly with this company, I am not trying to delay anything
