Consumer Complaint: Nationstar/XXXX XXXX and their shyster lawyers are engaged in Mortgage Fraud, Accounting Embezzlement, Misappropriation of Funds, and Extortion : On or about XXXX XXXX, XXXX a letter was sent to my former XXXX XXXX Bankruptcy attorneys concerning a Nationstar Mortgage loan modification offer. The modification letter stated that if no response was received by XXXX XXXX, XXXX, Nationstar would then consider the offer rejected. No acceptance response to the said modification offer was ever provided. It is without any question and an undeniable fact that all Nationstar modification offers have been rejected. On XXXX XXXX, XXXX a letter expressing concerns about Nationstar 's fraudulent accounting practices and once again declining the modification offer ( s ) was sent to Nationstar Loan Specialist XXXX XXXX XXXX with supporting documentation. Nationstar continued to enforce their fraudulent loan modification attempts through the XXXX XXXX XXXX XXXX XXXX ( in partnership with XXXX ). I advised the XXXX Representative XXXX that all Nationstar modification offers have been rejected and that Nationstar had been provided with documentation establishing proof of their fraudulent mortgage, escrow practices, and misappropriation of funds. I also advised Representative XXXX that her services were never solicited, needed and/or required. Nationstar falsely claims that I made the following modification Trial Period Plan Payments. {$1200.00} received on XXXX XXXX, XXXX {$1200.00} received on XXXX XXXX, XXXX {$1200.00} received on XXXX XXXX, XXXX XXXX : No modification trial payments were ever made for any of their fraudulent modification offers. Nationstar falsely claims that my property taxes were paid to the XXXX County Tax Collector via an escrow account. This is a false claim, a tax payment attempted by Nationstar in the amount of {$5200.00} was returned back to Nationstar on or about XXXX XXXX, XXXX along with an explanation letter by the XXXX County Tax Collector. In addition, I have paid approximately {$23000.00} in property taxes excluding the homeowners insurance payments I have made and I have provided several copies of the tax payment receipt and homeowners insurance payments confirmations to Nationstar and XXXX. Moreover, on or about XXXX XXXX, XXXX the XXXX County Tax Collector confirmed that an impound account was never established by Nationstar and that the property taxes are being paid the home owners, us. I have repeatedly advised Nationstar Mortgage, their Escrow Department, Loan Specialist XXXX XXXX XXXX, Account Supervisor XXXX XXXX, and Customer Relation Specialist XXXX XXXX about my concerns with respect to their mortgage, accounting, and escrow fraud. I have provided them with supporting documentation several times. I have repeatedly advised them that the missing escrow funds must be found and immediately refunded to us and/or appropriately credited to our loan balance. On or about XXXX XXXX, XXXX I was told by Nationstar that my monthly mortgage payments were no longer going to be accepted and that a foreclosure on my property had been filed. Nationstar advised that a full payment of {$7500.00} had to be made immediate via wire transfer in order to take the property out of foreclosure. Unfortunately, under duress and the threat of a foreclosure, I had no choice by to pay the said amount. On XXXX XXXX, XXXX, Nationstar and XXXX managed to extort {$7500.00} from me and my family in order to keep our home. The overwhelming simple fact of it all is that Nationstar/XXXX XXXX and their shyster lawyers created loan arrears by misappropriated escrow and monthly mortgage payment funds are attempting to conceal their wrongful sinister deeds by means of intimidation, a forced modification, and foreclosure threats.

Consumer Complaint: Dear CFPB, In a previous complaint to you XXXX XXXX about Nationstar mortgage ( see attachment ) I respond to their requirements and submitted all the documents needed on XXXX XXXX. XXXX XXXX ( point of contact, See attachments ) acknowledge that the documents received and she sent it to the loan modification department. But today XXXX/XXXX/2016, I spoke to nation star employee XXXX - XXXX and he said NO DOCUMENTS WAS RECEIVED. A TRUSTEE SALE DATE POSTED ON MY FRONT DOOR FOR XXXX/XXXX/2016 WHILE I AM IN AN ACTIVE LOAN MODIFICATION. This is not right or fair, this is wrong, please kindly help me resolve this matter. My point of contact XXXX XXXX or the loan modification department has not me since I have submitted my loan documents XXXX/XXXX/2016. On XXXX/XXXX/2016 a trustee sale date was posted on my front door. Please Please help me.

Consumer Complaint: My Chapter XXXX Bankruptcy discharged XX/XX/XXXX. My Interest Only loan # XXXX adjusted while I was I was still in the bankruptcy. The lender did not notify me or the Bankruptcy trustee or my BK attorney. I continued to make payments the entire time and upon discharge was made aware of the payment change XX/XX/XXXX and immediately paid the arrearage. I was assured in XXXX different telephone calls that that loan would not be reported late. As of today, I am informed that the the loan is reported to my credit report with EIGHT late payments dropped my score and preventing me from pursuing a refinance now in process. Nationstar 's failure to notify me or the Bankruptcy trustee is not in compliance with Federal bankruptcy law pursuant to Bank Ruptcy Rule 3002.1

Consumer Complaint: I am a XXXX vet who is going back to XXXX so I am home part time and in Iowa partime. My friend XXXX XXXX lives with me and we make my house payment together but we fell behind a couple of months. We tried to start paying the loan XX/XX/XXXX. XX/XX/XXXX and have been running into a wall ever since. She called several times to put XXXX on the loan. She told them she was paying with with her tax card and the representative never told her that they would not except this type of payment until the she called the second or third time. At this time the bank was closed. They would not except just XXXX They wanted a full XXXX so I sent a XXXX check so they would take they XXXX. They held the XXXX check on the side and did not apply it. XXXX got a cashiers check and mailed it but mailed it to the wrong zip code this was XXXX XXXX. When I saw they had not received it we tracked it and it was on its way back to us, so I go a cashiers check on XXXX XXXX from my bank that I have in XXXX by school. Call and spoke to nation star and explain the situation. The representative said it was no problem as long as I had the payment in by XX/XX/XXXX there was no problem at all. I check to make sure they got my payment on XX/XX/XXXX and they had not received it. So I called Nation Star again to see if they have received my check. The representative said they did not but they would not except the XXXX because they foreclosed on me on XX/XX/XXXX. I never receive any for closer information on my property saying they were going to foreclose on my property. Or did anyone say anything to us in the 6 to 10 calls we may in XX/XX/XXXX -XX/XX/XXXX. I talked to XXXX manger on XX/XX/XXXX and XXXX before that. The representative advised me on XX/XX/XXXX to cancel my check and pay them XXXX and I would be ok, but the Manger told me to call back on XX/XX/XXXX. I called back on XX/XX/XXXX and the told me I had to pay them XXXX or something close to that to get out of for closer. Ever person I talk to gives me a different amount. They will not take my payments. They always tell me it has to be a specific dollar amount. How is anyone suppose to catch up when they continue to do this to you. They harassed with phone calls one or two a day for over six months till I threatened them with my lawyer. This is when I did not miss a payment at all and when I miss a payment I get nothing to say they are going to foreclose. Then Schedule an Appointment now. Consumer Complaint: I refinanced with another lender in XXXX 2016. I was owed a refund of the money still in escrow with Nationstar Mortgage. First they sent my check to an old address that I had attempted to correct no less than 5 times. For whatever reason, they could never seem to get that right. In XX/XX/XXXX. I called and they put a stop payment on check # 1. Sent Check # 2. The person who I spoke with offshore apparently did not know how to spell XXXX even though it was part of the property address on the asset and the check was sent to Mission XXXX. I waited and waited. No check. I called again and they said that the check was sent to the wrong city ( XXXX XXXX ). Top payment issued on check # 2. Check # 3 issued. Was told it was being sent by XXXX and it should arrive in 2 days. waited and waited. No check. Called again and asked for ONSHORE supervisor. Was given a tracking number. Went to XXXX website and tracking number did n't exist. Called again to ask why a customer service rep had given me a tracking number that did n't exist and assured me that my check was sent out via XXXX when it was n't. No explanation for that one. Said I should wait for the check. waited another week. No check. called again. Told check was sent on XXXX XXXX and I needed to wait for 10 full business days to pass and that the check should arrive by XXXX XXXX. Check never arrived. Called again, reached offshore, asked for onshore, asked for supervisor. dropped a few f-bombs, pointed out that they LIED to me and explained how many hours of my life I 've wasted on hold and being shuttled back and forth onshore, offshore, dialing my SSN and Zip code into an automated system TWICE each time I call, then being asked for my SSN because it does n't actually get passed on to the person who picks up the call when you enter it into the automated system - SO WHAT IS THE POINT of even having this feature?. Pointed out again that they LIED to me and that they seem to have a serious operational problem. Asked if I could have funds wired to my bank. She said yes, but it would prolong the process and I was better off waiting for the check. Waited and waited and waited and waited ... .NO CHECK! XXXX XXXX : email from a woman at Nationstar saying they have a check for me that was returned. Asked her to send it via XXXX. She refused, saying she had already taken it to the mail room??? Check arrived a few days later. Deposited check. Bank rejected it, as a stop payment was placed on check. {$12.00} bank fee for me - woo hoo! XXXX XXXX : Call again ... .enter SSN, zip, enter SSN and ZIP again ... .Offshore rep : What is your SSN and ZIP??? ME : Get me to onshore supervisor NOW! GRRR! '' Onshore supervisor : what is your address? What is your name? What is your XXXX??? GGGRRRRR!!!! Tell her the check was returned. She said it was a check cut on XXXX XXXX and yes indeed, there was a stop payment placed on that check. I should wait until Friday, XXXX XXXX for the XXXX check to arrive. Friday, XXXX XXXX : You guessed it! NO CHECK!!! Call again on XXXX XXXX - SSN, ZIP x XXXX - offshore, onshore, XXXX, XXXX XXXX. Supervisor says no, they ca n't do electronic transfer. Apologizes for my troubles and promises to send it XXXX on Monday. I have wasted hours of my time trying to get a simple check for money that is owed to me.

Consumer Complaint: XX/XX/XXXX, we submitted proof of insurance on a property on which Nationstar Mortgage holds a mortgage ; the policy covered from XX/XX/XXXX to XX/XX/XXXX. Despite this, the insurance department of Nationstar then purchased a policy on this property and billed us for the cost. When I received a call informing me that our account was in arrears, I then faxed another copy of the proof of insurance in XXXX XXXX. They sent me a letter claiming that the policy only covered until XX/XX/XXXX. I called and spoke to a customer service representative in the insurance department. I had the XXXX pull up the proof of insurance and read me the dates of coverage. This individual read that the dates of coverage were from XX/XX/XXXX to XX/XX/XXXX. He then assured me that he would correct their error and make certain that the account would show that we were not in arrears. This was not done. The next letter I received informed me that the proof of insurance I had provided was unsatisfactory because it stated that the policy covered XXXX structures. I called and spoke to a supervisor in the insurance department and explained that the policy covered XXXX structures because there were XXXX structures on the five-acre property, a fact which they could easily verify if the merely consulted the legal description of the property. The supervisor then told me that he would " research '' the issue and call me back. He never did so. I have received daily phone calls since that date, which was some two weeks ago. Each time I answer, the caller informs me that we are behind in our mortgage payments because we have n't paid for the insurance policy Nationstar purchased for us. I then tell ask to be connected to the insurance department. When I speak to the person in the insurance department, they tell me that they are still " researching '' our insurance policy and promise to call me back when they have resolved the issue. They never do. The kicker is that Nationstar did this same thing to us last year. They, of course, are reporting us to the credit reporting agencies, and our credit rating has been destroyed. I had to put in a great deal of effort last year to try to repair our credit rating. Now, I 'm going through the same experience again. I am at my wit 's end. We own XXXX real properties and have always paid all of our mortgages on time, and we have always submitted proof of insurance. No other mortgage holder has ever done anything like this. This company has made it nearly impossible for us to obtain credit now, and we have never done anything wrong. What recourse do I have?

Consumer Complaint: Nationstar has been charging me late fees and calling me saying my payments have been late for two years, from the very first payment!! My payments have always been on time, early or in the grace period and I have written proof from my bank. Nationstar owes me late fees with interest and credit for my on time payments. My credit has been adversely affected, and I had to put up with their multiple daily calls while dealing with my husband XXXX from XXXX in 2015. I did n't have time to deal with this then, but I do now. None of their representatives would help at all until I told them that I was filing a complaint with the CFPB. Side note : Their representatives are very difficult to understand and not accommodating, treating me as a deadbeat. Worst experience ever in the worst time of my life. Now I have XXXX and this is the last thing I need to deal with at this time of my life. Thank you for your help resolving this matter.

Consumer Complaint: XXXX XXXX XXXX, XXXX XXXX XXXX XXXX, XXXX XXXX XXXX, XXXX, AZ XXXX was substituted as a Trustee and has filed a Notice of Default in the XXXX County Records with fraudulent and altered paperwork in order to " steal ''. They violated Pen C 131 and 134 which is a " felony ''. They are as well violating the FDCPA 15 U.S.C 1692c as they are debt collectors and are liable for this. The Lenders have not noticed us that they are the party authorized to take this action. The attached memo trying to satisfy that they have satisfied the Declaration of Mortgage Servicer Pursuant to Civil Code 2923.55 ( c ) is fraudulent as they have not tried to contact us and have had access to our council. This was attached by Nationstar Mortgage LLC and signed. The substitution of Trustee is based upon XXXX " fraudulent '' recordings on behalf of the XXXX XXXX which closed as the XXXX indicates where attempted recordings to the Trust were made 8 and 10 years after the Trust closed. The Trust violated the the IRS tax exempted status. XXXX XXXX XXXX has not sent any mail notifications that they are involved. County recordings show that XXXX XXXX XXXX as a debt collector attempted to extort {$140000.00} due by XXXX/XXXX/XXXX while the recording was dated XXXX/XXXX/XXXX.

Consumer Complaint: My mortgage is with Nationstar Mortgage , LLC by assignment. On XXXX XXXX, XXXX Nationstar sent to me, addressed to me at the property concerning the loan XXXX its " RIGHT TO REQUEST A MODIFIED MORTGAGE LOAN. '' On XXXX XXXX, XXXX, my attorney received from Nationstar 's attorney a Reinstatement Quote providing figures good through XXXX XXXX, XXXX. The amount paid was exactly the total amount of the quote, sent directly to Nationstar on XXXX XXXX, XXXX. Nationstar 's letter stated " The total amount necessary for reinstatement must be received in full ... '' or threatening foreclosure proceedings will continue. I was not aware of any foreclosure proceedings until XXXX XXXX, upon receipt of a certified letter of Notice of Foreclosure from the same Nationstar law firm that provided the Reinstatement Quote! On XXXX XXXX, XXXX, after my own repeated but unsuccessful attempts to get Nationstar to communicate with me as the mortgagor and borrower listed on the mortgage, my attorney sent a letter directly to Nationstar, documenting all payments from the Reinstatement Quote payment and every month thereafter through XXXX XXXX. Each monthly payment from the Reinstatement Quote to date, including the XXXX monthly payment have been sent to Nationstar. I have learned that Nationstar documented receipt of each payment as I have the Payment History produced pursuant to a subpoena to Nationstar. The Payment History Statement from Nationstar shows each payment, including the Reinstatement Quote payment in a " suspend '' account. I did not know that Nationstar was not applying each and every payment to the mortgage but to this " suspend account ''. In addition, Nationstar has added on additional fees and charges as reflected on the Payment History Statement. Nationstar acted deceptively and unfairly. It clearly wrote that upon payment of the total amount of the Reinstatement Quote must be received and it was. Nationstar never stated that the Reinstatement would not be applied to the mortgage which was the sole financial issue associated with the Reinstatement. I paid it in full per the Nationstar attorney instruction, payment which included costs and fees for attorney fees. The lump sum payment of {$46000.00} which was received but now I learn not applied to the mortgage. Nationstar has continued to refuse to discuss this matter with me, even returning monthly payments that I have sent, not for any reason of the funds being good, which payment I had re-sent immediately to Nationstar by my attorney. Now Nationstar has sent me a Notice of Foreclosure. I have done everything I can to insure full payment on the Reinstatement Quote and monthly payment right up to date, this XXXX XXXX. Why on XXXX XXXX, XXXX, did Nationstar communicate directly to me, communicated through its attorney with my attorney when I was sending it {$46000.00}, but refuses to communicate now? And XXXX XXXX XXXX talked with me to set up elecronic payments. That is unfair and deceptive. When it was getting money it would communicate but thereafter it would not. It was receiving the payments but not applying them to the mortgage. I included a mortgage payment stub with every payment so as to identify the mortgage and for proper credit to the mortgage. Nationstar unilaterally chose to not apply the payments to the mortgage, which I believed were up to date. It is my understanding that the Homeowners Protection Act of XXXX was enacted specifically to protect consumers from banks doing exactly this, and acting unfairly and deceptively, failing to communicate, choosing to communicate when Nationstar was getting money but failing to communicate otherwise. Is n't the consumer supposed to be protected under the Dodd Frank Act? Now Nationstar is threatening to take my house. The Nationstar History of Payments shows Nationstar received the payments. Please advise ASAP.
