Consumer Complaint: CONSUMER FRAUD XXXX Nationstar is billing for a service it does n't provide and it is guilty of misleading government investigators while attempting to cover-up numerous XXXX by their counterparts in the racketeering scam. I was the victim of loan origination fraud and Nationstar knows the Truth in Lending Act was violated. They do not answer consumer questions so I will present them below, on public record. EMBEZZLEMENT XXXX Our Escrow funds were stolen and misused. A proven fact covered up by Nationstar. EXTORTION ~ While pretending to help, they rack up the payments and blindside the consumer, even when they XXXX a loan that contains crime like the XXXX on XXXX XXXX XXXX, XXXX, FL RACKETEERING ~ Without the teamwork between LoanCare, XXXX Mortgage and Nationstar, consumer rights and laws would be followed. Their entire business model starts and ends with crime. CRIMINAL INTENT TO DEFRAUD A XXXX GOVERNMENT FINANCIAL INSTITUTION, A CRIME PUNISHABLE BY PRISON AND FINES AND EASILY PROVEN HERE. ~ CRIMINAL INTENT TO DEFRUAD THE FHA AT THE HIGHEST LEVELS OF ALL XXXX CORPORATIONS ... UP TO AND INCLUSING THE CEO 'S XXXX XXXX INTENT ... OR NOT??? Your Honor, There are XXXX possible scenarios here and the BIG question is criminal intent to defraud the XXXX Government ... or no criminal intent? Scenario # 1 ... no criminal intent You have an isolated incident where XXXX elderly couple was accidently misled on loan disclosure and any errors were corrected immediately. An honest company would write off the loan since loan disclosure and escrow fraud are XXXX highly illegal and it would investigate itself internally to insure this dangerous legal scenario involving numerous acts of fraud at numerous levels never happens again. That would be no criminal intent whatsoever. Unfortunately, your honor, everyone chose scenario # 2 ... individual and systematic criminal intent to defraud the XXXX taxpayer and consumers. We have documented systematic corruption at all levels. We have customer service people that intentionally lie and mislead the customers. We have intentional stalling, games from their legal department, and months of unreturned phone calls on imaginary escalations of complaints In this particular case we have people issuing a 30 year FHA loan to my husband XXXX XXXX XXXX husband with a XXXX ... who died within XXXX months. Next they committed escrow fraud repeatedly on this grieving, XXXX XXXX XXXX widow in an attempt to steal my home at the absolute lowest point in her life. Broke and alone ... they attacked. They have shown ; NO REGARD for the Truth In Lending Act in any form, No regard for documentation regulations on what she needed to receive from a mortgage company, No regard for proper escrow management and no penalties on themselves when they made errors ... BUT .. thousands and thousands of dollars in penalties were billed to this elderly widow and mystery fees were added over and over again with no written or verbal explanation. I am NEVER told why my payment went up, ever. And when the initial payment spike of several hundred dollars a month did n't XXXX me out of the home they wanted so badly? This criminal racketeering group paid someone else 's property taxes with my money to create an artificial escrow shortage, and billed me for it. My HOUSE PAYMENT NEARLY DOUBLED TO $ XXXX/MONTH ... TWICE ... most recently on XXXX 2016! I had a complete and total nervous breakdown and was bedridden with tears over the stress intentionally created by this predatory lending group. It has taken a serious toll on my physical health as I approach XXXX XXXX XXXX. I have many questions about my account, the wrongdoing and cover up, and this is their only answer now. ~ & gt ; " No further responses will be provided. Consumer Complaint: Had my first mortgage with Nationstar XXXX. I refinanced my home second and first into XXXX new loan with a new company. Nationstar would not send me my refund of my escrow payments. I contacted them 9 times, each time I was told the " checks been sent '' and " we can reassure you the check has been mailed. '' They escalated my refund up to a supervisor three times and I still had to call regarding my refund check. Today was call # XXXX and again was " reassured the check has been sent via overnight by XXXX ''. Absolutely ridiculous company to work with and completely inefficient customer service and supervisors.

The agreement was to get the modification packet request to Nation Star.Modification request was sent by there due date. Left message with account manager on XXXX/XXXX/16 also spoke to XXXX who advised of other docs needed. These were faxed. Left another voicemail with acct manager on XXXX/XXXX/16. As of to date no return call from account manager. I spoke to a representative today, XXXX/XXXX/16 who advised me that the account is closed and house went up for sale on XXXX/XXXX/16

Consumer Complaint: My mother and I are currently in the middle of a bankruptcy. We are being contacted by representatives of our mortgage company saying that we are being foreclosed on. We had communicated with our mortgage company several times that we would prefer a deed in-lieu process. Our mortgage company claimed we were assigned to an expert that would help us in this process. The expert has never made contact with us and attempts from us to contact the expert resulted in automated emails or voice messages claiming the expert was on vacation or unavailable. I called our mortgage company by phone and I was told by a representative that the expert could not help us and we would have to apply for a modification before going through a deed in-lieu. We applied XXXX times for a modification process and our mortgage company continually denied our modification claiming that we did not provide paperwork despite proof presented that all paperwork was turned in with certified delivery. The mortgage company has made no effort to accept a deed in-lieu and is continuing with foreclosure proceedings. Our bankruptcy lawyer has also made no attempt to contact us or help us regarding this issue.

Consumer Complaint: I am livid with Nation Star for refusing to work with me on a fair resolution to satisfy my foreclosure. I had to re-apply numerous times because Nation Star purposely used wrong property value and/or labeled my home as a single family residence to avoid approving my loan for XXXX XXXX modification. I was approved for XXXX non-affordable modifications based on incorrect property value. Nation Star used an inflated property value to justify the outrageous trial payments and after submitting my own appraisal and proving them wrong they retracted the offer and allow me to re-apply. Again, they continue to use wrong property value and offered trial payments that were not affordable. This is when I began to get frustrated and decided to contact my investor directly. My investor advised that I was eligible for all government modifications and based on my property value my monthly mortgage payment should not exceed {$1800.00}. I provided all proof submitted to Nation Star and was told I would be approved within 30 to 60 days. Once again that never happened because according to Nation Star my property value had increased over XXXX within 30 days. I demanded proof and when I receive Nation Star 's BPO they used a commercial building to increase my property value for their benefit. Finally, my investor contacted me XXXX 2015 and advised to not file a complaint with my attorney general nor cfpb because they had approved a new modification that would help me called XXXX XXXX. Finally, I was relieved and static to find a solution to this problem that had begun to affect my well-being. Unfortunately, my positive outlook was cut short when Nation Star continue to deny me mortgage assistance. To my dismay it has taken over a year to get approved for XXXX XXXX despite my investor reaching out to me directly based on my eligibility. Nation Star has and continues to label my home as a single family residence when it clearly shows in all BPO 's, Appraisals and XXXX county records that it is a XXXX to XXXX unit property. Regardless of all proof Nation Star conveniently continues to make internal mistakes to deny XXXX XXXX Modification. Moreover, Nation Star was sued and I was part of the settlement therefore Nation Star 's underwriting department advised my loan would be considered for XXXX modification. After advising Nation Star this was my next step they finally decided to review my loan for XXXX XXXX. Nation Star claims they are reviewing me because they received enough proof to move forward. I am terrified to lose my home therefore I am submitting this complaint to ensure they do modify me under my city modification. I have tried to work with them for the past 2 years and they have done everything to deny me assistance and prolong my foreclosure. I trust that with this complaint my loan will be modify under XXXX XXXX modification so I can satisfy my foreclosure. I have done and continue to do everything in my power to save my home. Please help me in this stressful matter. Thank you for your assistance.

Consumer Complaint: We currently have an FHA loan & after 5 years, we are eligible by law to drop our Private Mortgage Insurance ( PMI ) if our debt to equity is below ~78-80 %. Nationstar Mortgage is denying us, because they are claiming it is based on the original loan value. However, in their letters they stated that it 's either the loan value OR current market value. I tried tirelessly to a contact a representative at Nationstar Mortgage to get an appraisal done ( at my expense ), but I am getting runarounds and other excuses as to why I am not able to get this process completed. They are insisting that I refinance my mortgage in order for this to occur. Over a year ago, I was able to contact a representative and he explained the process that was needed to be done. However, I was n't eligible by law because I did n't hit the 5 year time frame. Now that the value of my house is well above $ XXXX ( rough estimate to meet the % requirements ), it is now time for the PMI to be removed indefinitely, with a credit back to me from Nationstar Mortgage for not working quickly with me to resolve this.

Consumer Complaint: To whom it may concern, I 'm filing a complaint against Nationstar mortgage due to failure to record my permanent loan modification with XXXX County Recorder. On multiple occasions we have spoken with various agents of Nationstar in regards to requests for recording our fully executed agreement with XXXX County Recorder on the following dates, XXXX XXXX, 2016, XXXX XXXX, 2016, XXXX XXXX, 2016 and XXXX XXXX, 2016. Nationstar mortgage, has refused to oblige our demands and we are seeking assistance with this matter. Per Real Estate Settlement Procedures Act - RESPA. It is essential for Nationstar mortgage and the respective investor to complete this obligation following changes to my original loan. I have contacted XXXX County Recorder, located at XXXX XXXX XXXX XXXX XXXX XXXX, XXXX, MO XXXX, XXXX and they have informed me as of XXXX XXXX, 2016 that no such contact has been made to their office with respect to our constant requests. In fact the county recorded office advised me that the financial institution will need to provide an original wet ink signature of the executed modification in order for them to update their records with changes to my original loan.

Consumer Complaint: XXXX XXXX XXXX I, XXXX XXXX XXXX residing at property XXXX XXXX XXXX XXXX, XXXX, GA XXXX purchased the home in XXXX and refinanced it with XXXX XXXX Loan # XXXX on XXXX/XXXX/XXXX. That loan was sold to XXXX Loan # XXXX and was taken over by XXXX XXXX XXXX Loan # XXXX when they went under and held the loan for the years XXXX and XXXX then to XXXX Mortgage Loan # XXXX and to XXXX Loan # XXXX then eventually to Nationstar Mortgage - Loan # XXXX which is the current servicer. During the time the loan was being serviced by XXXX XXXX. I experienced some hardship and requested their assistance with a modification to avoid foreclosure when I was informed that they had not received any payments for at least 12 months with which I disagreed and thereafter received what seem to have amounted to a refinance for 30 years which included a second mortgage in the amount of XXXX. In XXXX I requested the assistance of the XXXX XXXX, a XXXX Certified non-profit counseling agency, to apply for a modification and was given a 3-month trial of which payments were made on-time and was offered a final modification with terms extending the balance to a 40-year loan maturing in XXXX which was to be signed and returned by a specific date. In reviewing these documents I noticed that an area was incomplete on the Agreement To Maintain Escrow Account ( page XXXX of XXXX ) and the balance in question seem incorrect from the years I owned the home. Consumer Complaint: On XXXX XXXX, XXXX we lost our home to our a fire. The home was a total loss and in accordance with Georgia law, our insurance company paid us the coverage maximum on our house. We endorsed our payment check and sent it to our mortgage company Nationstar Bank in XXXX XXXX. Since recieving that check, Nationstar has not been of any assistance to us at all. We originally told Nationstar that we were going to act as our own general contractors to which they said fine. we started taking the steps to rebuild our home and 6 weeks later Nationstar told us that we could n't build our own home. We called them and explained we were n't actually building the house but would be managing the sub-contractors who would be. They said fine. At this time I clarified payment procedures and was told what I needed to submit in order to get the sub-contractors paid. I followed up this conversation with a written letter confirming what I had been told. As of XXXX XXXX, XXXX, Nationstar has still not released funding to start the construction of our home. Because of some issues we ran into with our septic system, we decided on hiring a contractor. All applicable paperwork required by Nationstar has been sent in to them. We need them to release funds to our contractor and also to reimburse us for funds we expended that we were told we would be reimbursed for. We called and complained when they said they were n't going to pay us. Approval was granted to pay our reimbursement by corporate headquarters but when I called today to check on the status of any payment, I was told that we could n't be reimbursed until 90 % of the home was rebuilt, something that was never ever told to us. We just want to get this process done and our home rebuilt, something Nationstar in apparently not interested helping expedite
